For the record, it is noted, applicants were

close the public.hearing and proceed with an
executive session.
Executive -Session, -
Chairman Plew, -this property.is located on the west side of Rt. 11 in-
between the'Skyliner Restaurant and Econ.o Lodge and directly across from
the I-81 exit ramp.
At this time the -Manderano-Brothers, appeared for the hearing, therefore,
Chairman Plew, closed the executive meeting and reopened the public hearing
in.order for the Board Members to question the applicants.,
John Manderano informed the Board Members that affordable -and suitable
industrial property was not .:.available ,.they fel-t that this property would
be suitable for the machine"'shop they would like to operate .
The Manderano Brothers have purchased this property, it would create a
hardship for them if they were unable to have a permit to conduct their
business.
Chairman Plew, I will close this public hearing and proceed with an execu-
tive session.
After some discussion, motion -was made by Oscar Taylor, seconded by Thomas
Bilodeau that the/ManderanoBrothers be granted a.variance for a machine shop
plus a conditional Permit to operate in a business-Zone'.This was unanimous
and becomes RESOLUTION NO. 1-91.

The applicant Mr. John Casey was -not
present, and I would like to state that
it has been the policy of -the Zoning Bd.
to table an application.until the appli-
cant or a representative may be .present.
Therefore this will be scheduled at another
date, when the applicant may be present.

This application was reviewed in great lengt'
all possibilities were considered. It is
noted that the County Planning Board recomme:
-ed denial of this application because of en-
vironmental- concerns related to the potentia.
hazardous substance leakage from stored ve-
hicles in close proximity to the west branch
of the'Tioughnioga River and,the poor aesthe
tic appearance of the storage of such vehicl
Chairman Plew stated if there were no more
questions, he would close this hearing and
proceed with an executive session.
The Town is doing every thing possible to clean up all the dumps that
are here and -there in the Town, we do not want to -produce any more. I
feel this could happen at this site.,
Board members were in agreement,
THEREFORE, Motion was made by Oscar Taylor, seconded,by Thomas Bilodea
that this application for a Use Variance be denied.
This was unanimous and becomes RESOLUTION NO -2-91.

Agenda:
Ralph A Hewes; Application for a variance for a 7' X
16' building in the Cortland Mobile Home Park, was
approved. Motioned by Chairman, David Plew, seconded by
Joann O'Rourke. RESOLUTION NO. 19-91.
Keith Plumadore; Application for a variance for a deck
in the Cortland Mobile Home Park, was approved.
Motioned by Tom Bilodeau, seconded by Joann O'Rourke.
RESOLUTION NO. 20-91.
Robert Hickox; Application for a variance for a double
wide to have less than 60' front yard, was approved.
The subject property is located on Sweeney Rd. Motioned
by Chairman, David Plew, seconded by John Finn.
RESOLUTION NO. 21-91.
A discussion occurred between Mr. Douglas Stanton
of the North Rd. in McGraw and the Board. Resolution
No. 18-91 stated that Mr. Stanton was granted a variance
to place a second dwelling on his property with the
condition that the dwelling was on a temporary basis to
be used for the grandmother due to her ill health.
Mr. Stanton has requested that the condition be
lifted. Mr. Finn stated what we try to achieve by
conditioning the variance, is so the property does not
become income or rental property. The condition was
placed due to the hardship for the grandmother.
Chairman, David Plew stated, conditions that are
placed on the trailers will be there as long as the
reason the applicant has applied for has not changed.
Mr. Stanton stated he will reapply for a variance
with no conditions attached. Bruce Weber, CEO stated to
Mr. Stanton the variance process will have to be
completely done over. Mr. Stanton agreed.
Chairman, David Plew stated to Mr. Stanton without
the condition he would be into a whole new process.

July 31, 1991 will be set up for the next meeting
for variances.
Chairman, David Plew stated to the Board that Oscar
Taylor has. resigned from the Zoning Board of Appeals. He
asked any of the Board members to keep in mind someone
to fulfill the vacancy. A letter of recognition will be
sent to Mr. Taylor.
John Finn made a motion, seconded_ by Tom-Bilodeau,
to adjourn the meeting. All voting aye, the motion was
carried.
The meeting was adjourned at 7:50 p.m.

of the Town of Cortlandville was held on July 31, 1991
at 7:30 p.m., at the Town Hall, 15 Terrace Road,
Cortland, New York.

RESOLUTION NO. 23-91.
Donald & Judith Johnson; Application for a variance to
allow for a rear yard less than allowed, accessory
building larger than 'allowed, for more students than
allowed and to allow parking on adjacent property.
Variances were approved with the conditions of a maximum
of eight (8) students and to adhere to the building
codes. Mrs. Johnson withdrew the variance application
of parking. Motioned by Chairman, David Plew, seconded

The following is a decision regarding the Public
Hearing of Robert Zirbel which ocurred'earlier.
Robert Zirbel submitted an application for a
variance for the storage of more than two unlicensed
motor vehicles. The variance was approved with
conditions. Mr. Zirbel will have until October 31, 1991
to remove all vehicles and all other items he brought to
the site from his previous site in Homer, except for the
yellow caterpillar, which does not belong to Mr. Zirbel
and was not brought to the site by him. Mr. Zirbel will
have until January 1, 1992 to remove the two trailer
frames, which are owned by him. This became
RESOLUTION #28 OF 1991.
Due to the death of Mildred Brookins, Secretary to
the Zoning Board of Appeals, the position is vacant.
Karen Betters, Deputy Town Clerk of the Town of
Cortlandville has been filing in as Acting Secretary to
this Board. Ms. Betters has shown an interest in the
position and would like to carry on as their Secretary.

A Special Meeting was held by the Zoning Board of

New York, for an interpretation of the Town of
Cortlandvilles Zoning Law regarding antenna/towers for
accessory use.

Chairman, David Plew called the Special Meeting to
order at 4:00 p.m.
Chairman, David Plew stated the purpose of the
Special Meeting. He stated Mr. & Mrs. Fred.Skinner'have
purchased a new home on Quail Ridge from Carl & Linda
Goodrich. Mr. Skinners long time. hobby has been
operating a ham radio which he wishes to continue.
Chairman, David Plew added.the conditions that were
made part of the purchase agreement. He stated the
seller shall furnish the buyer a letter from the present
owners of lots on Quail Ridge that they do not object to
the buyers installing a ham .radio tower to the rear of
the lot. This has been completed. A written
notification from the Town of Cortlandville for
permission to -erect a ham radio tower, not to exceed 70'
in height 'upon said premises, is the main reason why
this Special Meeting is being held.
Chairman, David Plew stated there seems to be no
regulation pertaining to ham radio towers within the
Town -of Cortlandvilles Zoning -Law.. CEO, Bruce Weber has
made a decision that the ham radio tower falls within
the category within the Zoning Law which does require a
Conditional Permit.
Chairman, David Plew explained to the Board members
a decision needs to be accomplished either to agree with
CEO,. Bruce Weber or to allow the Skinners to.erect a ham
radio tower without a Conditional Permit. Mr. Plew
stated our Town Attorney, Phillip Rumsey, stated the
decision could go'either way.

CEO, Bruce Weber was given privilege of the floor.
Mr. Weber explained to the Board and those present
his interpretation of the Zoning Law regarding
antenna/towers for a ham radio purpose. He stated
within an agricultural district where communication
towers are to be installed the Zoning Law indicates the
use,would.be subject to a Conditional Permit. He added
a ham radio antenna with a height of 70' would be
included within this portion of the Zoning Law. There
are no height restrictions within an agricultural
district. He added A. footnote within the Zoning Law
states height limitations of the Cortland County Airport
supersede listed maximums and no maximums are listed.
The preceding 'regulations has stated a maximum height
limitation of 30'. In other districts the height
limitations are listed. Under the Conditional Permit
regulation there is a height limitation of. 30' for
antenna/towers. This includes towers and antennas
within residential areas..
CEO, Bruce Weber stated there is a precedence in
regards to this interpretation. A resident on Pendleton
St. Ext., who was in an agricultural district, applied
to erect an antenna for radio communications to be used
on his farm. This permit was denied by the
�i Cortlandville Planning Board. CEO, Bruce Weber believes
the Cortlandville Planning Board would be the
appropriate Board to make a decision as to whether
towers should be permitted and what the height
limitations should be. CEO, Bruce Weber stated he has
not received any applications regarding antenna's of
height's of 70' for residential purposes. He added the
request of the Skinners is abnormal -for accessory use
and would require a Conditional Permit.
Member, Thomas Bilodeau asked CEO, Bruce Weber the
difference between a communication tower and a radio
antenna. CEO, Bruce Weber stated he believes there is
no difference.
Member, John Finn asked how the Pendleton St. Ext.
applicant was different. CEO, Bruce Weber stated the
difference -is the height of .the tower. His
determination of the appli.cant of Pendleton St. Ext. was
for a private accessory use to the farm for a
communication tower and would require a Conditional
Permit.
Chairman, David Plew asked why the applicant of
Pendleton St. -Ext. was denied the erection of a tower.
CEO, Bruce Weber stated the denial was based upon the
opposition within the surrounding area.
Chairman, David Plew stated. he inspected six
towers, only four were in the Town. None of the six
towers had permits. All were over 70' in height.

Attorney, Emerson Avery, Jr. was given privilege of
the floor.
Mr. Avery stated his interpretation of the Towns
Zoning Law. Mr. Avery believes there are provisions
within the Zoning Law that do address the situati-on of
antenna/towers. He stated within a residential non-farm
district there are no height limitations. Also adding
the property. involved is not within the airway of.the
Cortland County Airport. In his opinion the property
involved is considered a residential lot. Mr. Avery
stated it is cleara building permit is required but
does not necessarily mean an applicant needs approval
from a board to erect an antenna/tower. Commercial
towers or communication towers are radio towers used for
commercial use. Radio and t.v. antennas are excepted
out of the this provision. They are not a use subject
to a Conditional Permit. This tower to be erected is
not of commercial use. It is strictly for private use.
This tower is for residential home occupation. Mr.
Avery stated an affidavit- would be submitted cif
necessary. Mr. Avery 'believes CEO, Bruce Weber is
.incorrect with his- interpretation of the Towns Zoning
Law regarding antenna/towers being labeled as
transportation and utility uses.
Mr. Avery quoted a provision of the Zoning Law. He
stated nothing in this local law will limit the height
of television antennas and similar structures, except
for the Cortland County Airport provisions and the
interference of solar access of adjacent properties. He
believes this provision takes into consideration a radio
tower or a television tower for personal use.
Mr. Avery believes there are no height'restrictions
-regarding a radio tower for non-commercial use in a
residential district and a Conditional Permit is not
required for this type of use.
With no further comments or questions heard the
Special Meeting was adjourned.

interpretation of CEO, Bruce Weber. The interpretation
is stated as -follows:
The erection of an antenna/tower. for. accessory -use
will not require a Conditional Permit, the
antenna/tower for accessory use will have no height
limitation and a building permit will be required
for the erection of an antenna/tower for accessory
use. The Zoning Board of Appeal members are also
recommending to the Cortlandville Town Board that
they clarify and adopt regulations regarding ham
radio'antennas and their heights.

An Executive Meeting was held by the Zoning Board
'of Appeals, of the Town of Cortlandville, on -November
21, 1991 at 7:30 p.m. at the Town Hall-, 15 Terrace Rd.,
Cortland, New.York, for a variance to allow for a side
yard less than allowed.
Members present: Chairman, David Plew
John Finn
Thomas Bilodeau

Others present were: CEO, Bruce Weber; Brent
Ril-ey; Thomas Gallagher; Bonnie Southworth; Michael
Barbato; Robin Wheeler and Brent Cross.
Chairman, David Plew called the Executive Meeting
to order.
Chairman, David Plew asked of the Board members if
they had any questions or comments.
No comments or questions were heard from the Board
members.
THEREFORE, a motion was made by Member, Thomas
Bilodeau seconded by Chairman, David Plew to approve the
variance for a side yard less than allowed for Bonnie
Southworth. All voting aye, the motion was carried.
This becomes RESOLUTION #35 OF 1991.

By adding the addition it would leave a side yard
of 6'. The required side yard is 10' of the Trailer
Park Ordinance of the Town's Zoning Law.
The addition will have it's own entrance. The
existing entrances accessing the trailer will not be
changed. The addition will not be used for -a living
area.
With no further comments or questions the Public
Hearing was closed.,.

Cortland, New York, for a variance to allow for an
industrial use in a business district.

Chairman, David Plew asked of the Board members if
they had any questions or comments.
The Board members were in agreement with the
Cortland County Planning Board recommendations.
No further comments or questions were heard by the
Board.
THEREFORE, a motion "was made by Chairman, David
Plew, seconded by Member, John Finn to approve the
variance for an industrial use in a business district
and to approve the recommendations from the Cortland
County Planning Board. The Cortland County Planning
Board approved the use variance contingent upon Graph -
Tex having a waste disposal system approved by the Town,
County, State and Federal Agencies and, if hazardous
chemicals are used, applying for a,Special Permit under
the Aquifer Protection District of the Town of
Cortlandvilles Zoning Law. All voting aye, the motion
was carried.
This becomes RESOLUTION #36 OF 1991.
