The Board Members, having reviewed the site, as well as the pictures of the proposed sign as presented by the applicant and having read the Permit issued Under Section 136 of the Highway Law, County Roads and signed by Walter Tennant`. Co. Hgwt. Superintendent as of Januarai 4, 1990, also it is noted no one appeared to object to this application, THEREFORE, Motion was made by Chairman Plew that this application for a variance be approved, this was seconded by Bilodeau, and was unanimous. 5 Ayes, becoming ZBA RESOLUTION NO. 1-1990. Mr. & Mrs. Joseph Neville of East River Road were present, late, but their concern -was whether, Suite-Kote were going'to expand. They did not question, as to the sign. Next on the agenda was to have been , the Pizza Hut,, application for a variance, but no one appeared-, therefore, there will be further delay. There being no further business, meeting was adjourned. Weber Public Hearing No. 1, Kenneth Demeree, Application for a variance No. 2 Pizza Hut, 3923 West Rd., Application, 2 signs. P.H. No. i, Mr. Demeree asks for a variance due to'the fact that when this land was surveyed, apparently the pins were placed wrong so the house is 3 ft. too close to lot 21. Having reviewed the sketch and after discussion, Chairman Plew made the motion that this application be approved,,th.is was.seconded.by Taylor and was unanimous and becomes RESOLUTION NO. 2-90. P.H.No.2 Dee Capella., representing Pizza Hut at 3923 West Road, this has been delayed since November 21, 89.. All members have reviewed the site and the proposed sketch, 2 signs, illuminated, one on the front entrance and one at the back. Chairman Plew asked if they were ready with.a.motion, THEREFORE, Motion was made by O'Rourke, seconded by Bilodeau that this application for the two illuminated signs, be approved. Weber Following their discussion at a closed executive session;, and no one having appeared to object to this variance as requested by the applicant, Irvin;- Fisher and represented by Mr. Edson, Chairman Plew made a motion to approve of this application as presented, this was seconded by Finn, and was unanimous. RESOLUTION NO. 4-90. Public Hearing No.2, Mr. Gaynor, represented by Mr. Forrester, Following their discussion at a closed executive session, see Co. Planning Board Resolution 90-22, March 21,90. which will be filed with this report., subject also to CEO. Bruce A. Weber's satisfaction and verification. THEREFORE, Motion was made by Taylor, seconded by Bilodeau that this application as presented, be approved, this was unanimous and becomes RESOLUTION NO. 5-90. Cortland_ N.Y. 13045 Dear Sirs: Zoning Hoard of Appeals/_ Board 3728 Lyncort Dr. Cortland, N.Y. April 8, 1990 I received a notice of a Public Hearing for a variance on Parcel No. 95.00-03-10.000, 3710 Lyncort Dr. I am unable to attend the Public Hearing set for April 12, 1990, at 7:30 PM dueto an out -of town committment. Therefore, I am -setting forth below requested condi- tions prior to approval of this variance. Provisions need to be made for proper drainage of the road and surface water between my property line and the aforementioned property. Prior to the Murdock Estates Development being approved, I attended the Public Hearing and voiced concerns as to improperdrainage possibly occuring. This could cause the contamination of my water supply which is situated at the base of this area. The problem now arises by the fact that the above parcel has been filled in and raised substantially. This has created a blockage of surface (road) water which comes down Lyncort Dr. north to south from continuing to a stream due to the change of land topography. This now creates two problems: #1 Water now gathers at the southern end of my property with nowhere to go except into the ground. #2 The salt and road film water permeates into the ground over and near my well. This could create a contamination of my well. (It's not a problem for the above parcel as they will have public water.) On the day I received this notice, I went to see Bruce A. Weber, Code Enforcement Officer. I spoke to him about the problem. He duggested I contact Mr. Bush, Road Superintendent. I went to the Supt's. office and left a messsage with Jim Cogswell to have Mr. Bush contact me. In the meantime I contacted Councilman Ted Testa and reviewed the problem with him. He assured me that Mr. Bush would be in contact with me and that the possibility of extending the waterline from the next door property could solve the problem. Later that day Mr. Bush and Mel Pierce, Town Supervisor, Stopped to see me and we discussed the situation and problems. Mr. Bush assured me that he would monitor the surface water flow and look for a remedy to this. Mr. Pierce suggested that extending the water line might be a solution to avoiding contaminated water useage from the well should this occur. I do not wish to hold up the development of Parcel No. 95.00-03- 10.000. However, I feel that since the Town has created these two problems by the approval of the Development, they should be responsi- ble for their solution. -2 - The solutions of the two problems are: #1 Eliminate the drainage problem created by the re -configuration of the newly developed land. #2 Solve the possible contamination problem by the means suggested by Mr. Testa and Mr. Pierce. Hopefully the Zoning Board and Town Board will understand this problem and document remedies as conditions for granting a variance for building on the above mentioned parcel. On motion of Thomas Bilodeau , seconded by John Finn, the following resolution is unanimously adopted: WHEREAS, this Board made a determination to grant the variance application of Cortlandville Lodge No. 470- of the Freemasons, and WHEREAS, the July 17, 1989 Order of Hon. Irad S. Ingraham remanded said determination to this Board for the purpose of -setting forth the Board's findings of fact, NOW, THEREFORE, BE IT RESOLVED, that the findings of fact which are the bases for this Zoning Board of Appeals granting an area variance on May 23, 1989 for property to be acquired by the applicant Cortlandville Lodge No. 470 of the Freemasons are as follows: 1. Applicant proposes a permitted use (subject to conditional permit from the Town Planning Board).on a parcel of land to be 3.31 acres in an area zoned R-1 on the west side of N.Y.S. Route 13 north of the boundary line of the City of Cortland. The proposed use is that of a private not-for-profit social organization of the Freemasons. 2. The subject- property is currently vacant. It is bordered on the north by 7.44± acres currently vacant and believed to be used for agricultural purposes, as well as a 1.5± acre parcel used for residential purposes. 3. Across from the subject property on the east side of N.Y.S. Route 13 is substantial acreage used for educational purposes and includes a� large building and parking lot for the Onondaga, Cortland, Madison Board of Cooperative Educational t Services. ( BOCES) . 4.- North of the subject property is a 5.74.1 parcel used- as sedas a church by the Faith Baptist Church of Cortland.. 5. The subject lot has five sides with 125± feet frontage on N.Y.S. Route 13; 200± feet in width for most of its proposed depth. 6. The proposed lot exceeds the necessary minimum lot size and. over 80% of the lot meets the required lot width. Section 47..5 (3)(c) of the Town of Cortlandville Zoning Law sets forth the. "guideline" of 200 .feet for lot width, defined as average. width measured at right angles to its depth. The proposed lot- has an average lot width of 196.3 feet, being within 2% of the stated "guideline" of 200 feet. 7. Applicant's proposed lot meets all bulk requirements and is within 2% of the numerical "guideline" for average lot width. 8. The Cortland. County Planning Board unanimously recommended approval of this area variance request by its resolution No. 89-39. dated May 17, 1989. 9. The proposed use of the parcel is a not-for-profit social organization of the .Freemasons for approximately 150 members, most over the age of 60 years and would have no alcoholic beverages available. 10. Based on the findings of fact herein, the Board concludes: A. An area variance fora difference of 2% from the stated average lot width "guideline" is not necessary since such a difference is insubstantial and is well within the discretion of the Town Planning Board- to allow if -the, Planning Board otherwise determines -to -grant. the necessary -Conditional Permit. B. Since a variance nevertheless has been sought from this Zoning Board of Appeals,. this Board further concludes that such variation of 2% from the "guideline" of average lot width is minimal. C. The lot's use and the variance would have virtually no impact on population density and governmental facilities. D.. The lot's use and variance would provide virtually no change in the character of the neighborhood, nor be a detriment to adjoining properties. E.._ Due to the unique shape of the applicant's lot, - applicant haspractical difficulties for its proposed, otherwise permitted,: use of the lot. F., It is in the interests of justice to grant the area variance request. ADOPTED:. Board members present have reviewed the application and the site at 4338 Hicks Hill Road,and after some discussion, Motion was made by Chairman Pletir, seconded by J. O'Rourke that this application be approved. ZBA member, J. Finn, was not present at this time for these hearings. P.H.No. 2, Application for a variance to have a body shop at 3575 Kellogg Road. Board members have reviewed the application and the site, and after further discussion, Motion was -made by Bilodeau, seconded by O'Rourke" that this appl.ication for a variance be granted, subject to certain conditions, that there have been no complaints from area residents, regarding this type of activity, also, should there be a change in ownership, any permit would be null and void. CEo. Bruce A. Weber will check this operation and will issue a regular permit after a 9 month.p.eriod, this would bring it to Feb. 1991,subject to CEO inspection and determination. In the matter of the application of Smith Corona for a variance, and the application of:James Stevens Jr. for a variance, No representatives were present, therefore, public hearings number 3 and 4, will be tabled until such time as they can be present. Mr. James Day, Pastor I would like to state that the Church has a conditional contract to purchase the So. Cortland Grange property on Route 13, in South Cortland, We feel this is an ideal site for their Church. We would be meeting at 10 A.M. and 6 P.M. on Sundays, We would like to use the -- existing rear entrance as our main entrance and use the front for an emergency exit. At this time we will have adequate parking for 8 cars, I am aware that there are plans for a truck terminal, next door and I am going to contact them for permission to use their park- ing area on a Sunday, if needed Chairman Plew. After discussion and review of the sketch plan for parking etc. the Zoning Board feels there must be "no parking" in the front of the build- ing. No one appeared to object to this application. Therefore, I will close the public hearing and proceed with an executive session.
