N ancy Weitzel declared the public hearing open a 7 : 28 P. M . and the following Notice of
Publication was read.
"NOTICE IS HEREBY GIVEN, that a Public Hearing will be held by the Planning Board of
the Town of Danby on Wednesday, October 18, 1995 at 7 : 15 P . M . , Danby Town Hall , 1830
Danby Road, Ithaca, New York 14850 . Purpose of hearing is to consider the transfer of 2 . 05
+1- acres from Town of Danby Tax Parcel No. 10 . - 1 - 21 . 15 , owned by Brian and Susan Beeners ,
to No . 10 . 1 -21 . 14 owned by Richard Bogusch and Susan Beeners . Parcels are located at 20
B ald Hill Road. Brian and Susan Beeners, applicants .
All interested parties will be given the opportunity to be heard either in writing or in person.

The meeting was called to order at 7 : 34 P .M. by Vice Chair Nancy Weitzel
Beeners to Beeners Transfer of Property Subdivision
Following Public Hearing, October 18 , 1995 the Board passed the following resolutions :
RESOLUTION NO. 11 of 1995 - Approved
SEQR DETERMINATION BEENERS TO BEENERS SUBDIVISION

WHEREAS, this action is the consideration of approval of the proposed transfer of 2. 05 +/-
acres from Town of Danby Tax Parcel No. 10 . - 1 -21 . 15 , owned by Brian and Susan BEENERS ,
to 10 . - 1 -21 . 14 owned by Richard Bogusch and Susan Beeners, located at 20 Bald Hill Road,
and Susan Beeners, Applicants, and
WHEREAS, this is an Unlisted action for which the Planning Board is acting as Lead Agency
in environmental review and for which no coordinated review is required, and
WHEREAS, the Planning Board, at and following Public Hearing on October 18, 1995 has
reviewed the Environmental assessment Form and draft environmental review prepared by the
applicants, now be it
RESOLVED, that the Town of Danby Planning Board, acting as Lead Agency in environmental
review of this Unlisted action, makes a negative determination of environmental significance for
this action.

WHEREAS, this action is the consideration of approval of the proposed transfer of 2. 05 +/-
acres from Town of Danby Tax parcel No. 10 . - 1 -21 . 15 , owned by Brian and Susan Beeners, to
10 . - 1 -21 . 14, owned by Richard Bogusch and Susan Beeners, located at 20 Bald Hill Road,
Brian and Susan Beeners, Applicants, and
WHEREAS, this is an Unlisted Action for which the Planning Board on October 18, 1995 ,
acting as Lead Agency in environmental review, has made a negative determination of
environmental significance, and

WHEREAS, the Planning Board, at and following Public Hearing on October 18, 1995 has

reviewed two maps dated Sept. 11 , 1995 , showing an overall plan and a detail of the proposed
transfer, now be it
RESOLVED, that the Town of Danby Planning Board grants Preliminary and Final Subdivision
approval to the Proposed Subdivision as presented, subject to the submission of a final survey
map for such lot, suitable for filing, for approval by the Planning Board Chairperson.

Approval of September 20, 1995 Planning Board Minutes
A motion was made by William Farrell and seconded by Joel Gagnon to approve the September
20, 1995 Planning Board Minutes as published .
A vote on the motion resulted as follows : Carried Unanimously
Water and Sewer Information Report
Joel Gagnon reported he has researched what is available for water and sewer district assistance
for planning and funding in Tompkins County. His contact with the Tompkins County Planning
Department said that there is no money available at the County level but they are willing to lend
assistance if we want to apply to the State for funding. He received information from Lansing
and learned that they worked with a the State Water Resource Group that works with groups
in the area of small sewage plants. Small plants are created and then linked together.

He received a draft report of the study by Tom of the requirements for business
for water and sewer. The most yignificant findings were that municipal water and sewer systems
are considered essential by theilexisTig manufacturing businesses in the County and by those who
Oare engaged in the selection'(rrlarketing and potential development sites. The general feeling
is that the potential for the development in the County would be enhanced if a strategic plan for
extension of existing water and sewer systems could be developed to implement it.
Joel suggested that what the Planning Board could do now, is to give some thought to how to
deal with the question of where businesses locate, how they grow and how to deal with them.
He suggested that TomiCialerleorn or Barbara Blanchard be invited to a meeting.

Discussion :
Susan reported that the Town has submitted a grant proposal and that part of that request is to
do an inventory of businesses in Danby and to look at soils to determine suitable areas for
commercial development. If a grant is awarded, it will give us the basis for making commercial
sites. She is working on developing an inventory of home occupations.

The Board discussed the existing commercial zones and looked at other possible areas that could
be suitable to zone as commercial areas or be considered for commercial use.
, Mary Lou suggested that a minimum charge for a business license per year be collected and
applied to the cost of a brochure or directory. It would be a way of keeping track of the
businesses in Danby.
Nancy suggested that obtaining information of businesses located in Danby for a brochure could
be a Community Council project.

Recycling of Construction and Household Materials
Ralph ragthat the recycling and grinding of construction materials cannot be considered
as a home occupation. To start a recycling business a permit must be obtained from the State
of New York. Many operations are having difficulty locating a market or site to take the
recycled construction materials.
Mary Boardman - Retreat Center
Susan reported that she received a letter from a South Danby Road resident indicating that the
terms of the special permit for Nature ' s Song Retreat Center are being violated because there
are so many seminars . She will contact Ms . Boardman and inform her that her operation is
exceeding the terns , at least at face value, of the permit.
Possible Revisions to Subdivision Regulations
Susan reported to the Board that they should consider possible revisions to the Town of Danby
Subdivision Regulations to minimize the administrative burden that many small subdivision
applications require. .
Joel said that the purpose of subdivision review by the Planning Board is to be made aware of
potential problems through SEQR review. He thinks requirements for one lot subdivisions
should require a site plan review by the Code Enforcement Officer to see if there was any
problem. He would like to see subdivision and construction sites of new building reported to
thePlanningBoard so they know where building is going on. Small lot line adjustments that are
not creating a new lot should not need to be reported.
Discussion :
Joel said that in the past the Town has allowed building along roads so that new roads are not
created. The problem is that if you are trying to maintain the rural character you loose it when
you line the roads with houses .
Bill said that a landowner cannot use his back lands at this time without subdivision approval
bythePlanningBoard. The Town does not want to maintain more roads , but there is a 150 ' road
frontage requirement for access to a back lot. He thinks we should allow a right of way for a
driveway to back lands for individual lots. We are not taking advantage of the road frontage
by requiring 150' for right of way.
Susan will draft possible changes to our subdivision regulations for the Board to review.
