Chairman Plew called the meeting to order and asked the members present If they were ready to come to a decision in regard to the application of Robert J. Daniels for a variance in the terms and conditions of Article XV, Section 15.2, Subdivision D. (1) of such Zoning Law to allow a sign at the Intersection of Routes 11,- 13 and 41, Cortland, New York, 13045, Tax Map Parcel 97.02-01-09.000. , If so, he would like a motion. Therefore since everyone was in agreement, Mr. Finn made a motion seconded by Oscar T_YC- ±4that this application for a variance be granted, Chairman Flew made this unanimous and this becomes RESOLUTION #1-1986 ZBA. Following a public hearing held at 8 p.m. on the above date the Cortlandville Zoning Board of Appeals met in executive session. Present were: Chairman"David Plew, David Finn and Oscar Taylor. Jacquelin Rosen and Jon Haight were not present. Chairman called the meeting to order and asked the members present if they were ready to act on the application of Susan M. Stevens for a Variance, in the terms and conditions of Article V, Section 5, Subdivision A of such Zoning Law to allow a trailer on Lot in R -2 Zoning District on 236 McLean Road, Cortland, N.Y. This is Tax Map Parcel # 96.09-02-36.000/ It is her intention to remove present mobile home and its addition and replace with a mobile home (14•x 50•) There is room to move the new home closer to the garage if necessary. No one appeared objecting to this application. Therefore Motion was made by Finn, seconded by Plew that this application be approved, This was unanimous and becomes Resolution # 3-86 ZBJ& i M. Pg. y Regarding, Horthup, Application June,3,1986, Town Hall, Town of Cortlandville I Following a Public Hearing held -at 7:30 p.m. on the above date, the Cortlandville Zoning Board of Appeals met in executive session: Present were the following members, Chairman David Plew, Jacqueline Rosen Oscar Taylor David.Finn and Jon Haight were not present at this time. Chairman P1ew called the meeting to order and asked the members present if they were ready to make a decision in regard to the application of Hugh Northup, requesting a Variance and issuance of a building permit,see Article XV, Section 3 of the Zoning Law Motion was made by Mr. Taylor that this application be granted, adding that this variance would terminate at such time as Mr. Northup ceases to operate or sells his roofing business. This motion was seconded by Rosen and was unanimous. This becomes RESOLUTION # 4.86. This executive session, now closed. M. Brookins, Secretary Regarding, PTM, Application Pg. 5 June 3, 1986, Town Hall, Town of Cortlandville Following a Public Hearing held at 7:40 p.m. on the above date, the Cortlandville Zoning Board of Appeals met in executive session. Present were the following members: Chairman, David Plew Jacqueline Rosen Oscar Taylor David Finn and Jon Haight were not present at this time. Chairman Plew-called meeting to order and asked the members present if they were ready to make a decision in regard to the application of Pall Trinity Corporation for a variance in the terms and conditions of Article V111, Section 6, of such Zoning Law to allow an addition, at 3643 West Road, Cortland, N.Y. 13045, Tax Map parcel 95.1201-07.000. and for consideration of Town Planning Board for Site Plan approval. Following a brief discussion, Chairman Plew made a motion that this application be approved subject to approval also by the Town Plan- ning Board. This motion was seconded by Rosen and was unanimous. This becomes RESOLUTION # 5••86. Bringing this executive session to a close.the Board will proceed with the next scheduled public hearing. M. Brookins, Secretary Pg. 6 Regarding,Hall/Potter Aplication June 3, 1986, Town Hall, Town of Cortlandville Following a Public Hearing held at7:50 p.m. on the above date, the Cortlandville Zoning Board of Appeals met in executive session. Present were the following members: Chairman David Plew, " Jacqueline Rosen Oscar Taylor David Finn and Jon Haight were not present at this time. Chairman Plew called the meeting to order. It is noted that this application for Use Variance & Subdivision was referred to the County Planning Board on GML Form # 77.00-03-03 Their RESOLUTION # 86-18 follows: THEREFORE BE IT RESOLVED, that this application be approved subject to the following conditions: 1. That a work permit be obtained from the State Department of Transportation for location of this road in relation to Lighthouse Hill Road. - 2. The proposal undergoes Cortlandville's and Town of Homer's Subdivision procedures. 3. That the Zoning Board of Appeals meets the conditional permit requirements under Article X11, Sections 12.3 and 12.4. Mr. Plew felt there had been adequate discussion and asked the Board If they would like to make a motion. THEREFORE, motion was made by Taylor that this application be denied, this was seconded by Rosen and becomes -RESOLUTION # 6-86. This was unanimous. Bringing this executive session to a close, the Board will proceed with the next public hearing at 8 P.M. M. Brookins, Secretary r• J� Regarding aplication/ Rose & William Hough June 3, 1986, Town Hall, Town of Cortlandville Following a Public Hearing held at 8 P.M. on the above date, the Cortlandville Zon nt;'4oard of Appeals met in In executive session. Present were the following members: Chairman David Plew Jacqueline Rosen Oscar Taylor David Finn and Jon Haight were not present at this time. All members of this Board have a copy of the Resolution of the Cortland County Planning Board as of their meeting May 21, 1986, as follows : - THEREFORE BE IT RESOLVED, THAT THIS USE VARIANCE be approved subject to site plan approval as such a proposed business will be located where it does not seem likely to create any nuisance to surrounding properties -and it will make good use of properties otherwise inacess- ible for the business activities for which it is zoned. Chairman Plew asked the members if they were prepared to offer a motion , since everything seemes to have been covered in their dis- cussion with Mr. & Mrs. Hough9 if so, he would make a motion subject to conditions as discussed, the 3 strand barbed wire and approval from the Cortlandville Planning Board for Site Plan,together with inspection of the conditions by Code Enforcement Officer, Bruce Weber that this Use Variance be approved, this motion was seconded by Rosen and was unanimous and becomes RESOLUTION # 7. The next regular meeting of the Cortlandville Planning Board will be June 24, 1986. There being no further business at this time, meeting was adjourned. M. Brookins, Secretary Pg. 7 Pg. 12 Page 5, Minutes of the Appeals Board, July 22, 1986 Following a Public Hearing held at the Town Hall, July 22, 1986 at 7:30 o'clock, p.m., the Cortlandville Zoning Board met in executive session. Members present at this meeting, Chairman David Plew Jacqueline Rosen Oscar Taylor David Finn and Jon Haight were not present at this time. Following more discussion , regarding the application of Chris Bushnell, For a variance in order to operate a used car center at 3655 Page Green Road, and consideration from the Town Planning Board for a Conditional Permit, Mr. P2ew(Chairman) asked the Board members if they had any further questions or comments, if not, he would like to make a motion, That Chris Bushnell be granted a Use Variance for a period of one (1) year, and further, that at no time should there be more than six (6) unlicensed cars parked outside of the building, also that the Zoning Officer may issue complaint if it appears the property is becomimg a type of Auto junkyard. This Use Variance would be subject to renewal at the end of the year, subject also, to the above conditions. Further, the Zoning Board of Appeals recommends this application for a Conditional Permit be referred to the Town Planning Board at their regular meeting on July 29, 1986. P9. 13 ? • • Page 6 Be it further resolved that the variance will terminate if :Mr. Bushnell ceases to operate the business. This motion by Chairman Plew was seconded by Oscar Taylor and was unanimous, thus becomes RESOLUTION # 8-86. There being no further business at this time, this meeting was adjourned, M. Brookins, Secretary Minutes of the Appeals Board, October 21, 1986, Town Hall, 15 Terrace Road, Cortlandville Members present were Jacqueline Rosen and Oscar Taylor David Plew, Chairman was not present due to sudden and critical illness of a member of his family. Other members not present, Jon Haight David Finn There were many other residents of the Town present due to the expected Public Hearings scheduled , beginning at 7:30 p.m. This was in regard to applications for a variance for Warren and Suzanne Greenwood and Randolph and Vicky Peebles. Due to the fact there were not enough members of the Appeals Board present for a quorum, the public hearings would have to be re -scheduled, therefore, Zoning Officer Bruce Weber checked with Supervisor Pierce and the date for these hearings will be changed to October 29, 1986 at the Town Hall' %: 3 0 �•h+ Everyone present was informed of this date and it will appear in the Cortland -- Standard regarding this change. Since no further business could be conducted at this time, meeting was adjourned. M. Brookins, Secretary APPEALS BOARD MINUTES, October 29, 1986, Town Hall, Town of Cortlandville Following a Public Hearing held at 7:30 P.M. regarding the application of Warren and Suzanne Greenwood for a variance, the Zoning Board of Appeals met in executive session . Present were, Chairman David Plew , David Finn , Jacqueline Rosen and Oscar Taylor. After a discussion, Chairman Plew offered the suggestion that this variance be approved for the chickens but there should be a six month trial basis as for the pigeons, depending on further problems and complaints from neighbors which should be reported to the Enforcement Officer, Bruce Weber. Therefore, motion was made by David Finn, seconded by Mr. Taylor, that this variance be granted for the chickens, and a 6 month period for the pigeons. This was unanimous and becomes RESOLUTION # 9-86. M. Brookins, Secretary (23) MINUTES, APPEALS BOARD, OCTOBER 29, 1986 Pge 4, October 29, 1986, 7:45 P.M. Town Hall, Town of Cortlandville. Following.a public hearing regarding the application of Randolph and Vicky Peebles for a variance, the Zoning Board of Appeals met in executive session. Present were the following members, Chairman David Plew David Finn Jacqueline Rosen Oscar Taylor Jon Haight was not present After discussion motion was made by Mr. Taylor, seconded by Mrs. Rosen that subject to these conditions, that this variance be approved stipulating, that this be entirely for personal use, no car repairs, no use of the saw mill for public or commercial use on said property. This motion was passed unanimously and becomes RESOLUTION # 10-86. Meeting now adjourned. M. Brookins, Secretary Minutes of the Zoning Board of Appeals, December 9, 1986 Public Hearing was held at the Town Hall, 15 Terrace Road in regard to the application of Diane Sorrells for a variance for her property at 15 Lime Hollow Road, Town of Cortlandville, Cortland ,New York Members present were Chairman David Plew ,Jacqueline Rosen Oscar Taylor David Finn and Jon Haight were absent. Also present, CEO.Bruce Weber, and many residents :-bf the Lime Hollow E area, Pheasant Run, Stupke Road and McLean Road. Several spoke before the Zoning Board(as noted in the public hearing transcript), against having this application for a variance, granted. After Miss Sorrells withdrew her application there was no further use for an executive session and the public hearing was closed by the Chairman.
