Dexter Paddock, Donald Fowler Ronald Gauthier David Plew February 9, 1981 Chairman ZONING BOARD OF APPEALS MINUTES - Meeting After a public hearing in regard to the matter of the Application of Philip A. Davis, a meeting was held by the Zoning Board of Appeals to consider said application. Meeting was called to order at 7:4.0 p. m. by Chairman Paddock. A discussion was held on permanent structures. Mr. Gauthier stated that there must be some definition on what is a permanent structure. Mr. Plew agreed with Mr. Gauthier and suggested that the matter be looked into to see if there is such a definition on what is a permanent structure. A motion was made by Mr. Gauthier and seconded by Mr. Plew that the variance be granted. Mr. Paddock instructed the Zoning Officer, Donald Fowler, to grant the variance. A vote was held. Mc§eal, a meeting was held by the Zoning Board of.Appeals to consider said application. Meeting was called to_order at 8:16 p. m. by Chairman Paddock. Mr. Plew made the motion that the variance be granted with the stipulation on this permit that it is only to pertain to Frank L. McNeal. 1f he ceases this operation, the permit will be revoked. The motion was seconded by Mr. Gauthier. All voted in favor and no one opposed said vote. Meeting was closed at 8:19 p. m. �).&M 1J Mary D. Discussion by members. No opposition from the floor. A vote was asked for by chairman Paddock, motion made to grant the variance by Aon Gauthier, seconded by Jon Haight, unanimous. Dexter Paddock, Chairman; Ronald 'Gauthier, Board Member; Charlie Finn, Board Member; Don Fowler, Zoning Enforcement Officer; and, John Folmer, 9 Town Attorney. 10 Mr. Paddock asked if there was any discussion in regard to the Special _Permit request by Pall Trinity. 11 There was no discussion, 12 A_� motion. was made by Ron Gauthier and seconded by Charlie- Finn that the Special -Permit be granted. 13 A vote was taken and all were in favor. Dexter Paddock, Chairman; Ronald Gauthier, Board Member; Charlie Finn, Board Member; Don 9 Fowler, Zoning Enforcement Officer; and, John Folmer, Town Attorney. 10 Mr. Paddock stated he had no questions because he went and looked at the motel. Mr. Sykes advised 11 that basically they wanted to make the rooms the same size. 12 Mr. Sykes questioned a reference to size made by the County Planning Department in which they listed 13 29, 700 square feet. 14 Mr. Paddock asked if there was a favorable comment on this. Mr. Gauthier stated that if they wanted to 15 enlarge and improve the existing business structure, he would recommend approval. 'Mr. Finn stated that he 16`7 also recommended -approval. A vote was taken and all were .'yin favor'. -`,,'Mr. Paddock stated he would make a ;recommendatio.n.,to the Town Board that they approve it. . 17 Whereupon the following RESOLUTION was made. 18. WHE EA;Sf, a ;meeting of the Zoning Board of Appeals was;held on the 19th day of November, 1981, quorum being _ 19, present, on motion of Mr. Gauthier, seconded by Mr. Finn, - '.carried unanimously, it.was 20 RESOLVED, that the Zoning Board of Appeals of the Town of Cortlandville hereby recommends that the Town 21 Board of the Town of Cortlandville approve a request for a bulk variance submitted on behalf of Mr. and Mrs. 22 Malcolm V. Sykes concerning premises known as the Riverside Motel located at 4408 North Homer Avenue, 23 Cortland, New York, and be it further 24 RESOLVED, that the Zoning Board of Appeals recommends the approval of the expansion of nonconforming use by 25 such premises as described in the application.
