Cole, Donald Barnes Supervisor Oltz called the meeting to order at 8 : 00 P.M. and led all present to the Pledge of Allegiance to the American flag. APPROVAL OF TOWN BOARD MINUTES Approval of September 11 , 1995 Town Board Minutes A motion was made by Councilperson Steiner and seconded by Councilperson Hile to approve the September 11 , 1995 Town Board Minutes as published. A roll call vote on the motion resulted as follows : • Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Approval of September 11 . Special Meeting Town Board Minutes A motion was made by Councilperson Steiner and seconded by Councilperson Johnson to approve the September 11 , 1995 Special Meeting Minutes as published. A roll call vote on the motion resulted as follows : Hile Aye i I Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Approval of September 11 . 1995 Public Hearing Minutes - Local Law No. 1, of 1995 A motion was made by Councilperson Schwartz and seconded by Councilperson Steiner to approve the September 11 , 1995 Public Hearing Minutes - Local Law No. 1 of 1995 as published. 485 2 Town Board Minutes October 9, 1995 A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously • Approval of August 14. 1995 Town Board Minutes A motion was made by Councilperson Steiner and seconded by Councilperson Schwartz to approve the August 14, 1995 Town Board Minutes as published. A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously PRIVILEGE OF THE FLOOR Supervisor Oltz reported that the Board must set up Budget Meeting Workshops for the 1996 Budget. Councilperson Schwartz reported he will have recommendations for appointment to the Danby Youth Commission in November. Town Clerk, Carol Sczepanski reported that the Supervisor' s Tentative 1996 Budget was filed in her office and presented to the Town Board on Wednesday, October 4, 1995 County Representative Report Representative Frank Proto reported on the following : 1 ) Department of Social Services Proposal for Relocation to the City of Ithaca - The County Board will be review proposals for the relocation of DSS to a site in the City of Ithaca. The preferred proposed site is unidentified at this time and the second choice is next to the Biggs Complex. 2) Cofinty 1996 Tentative Budget - Budget hearings will begin in November. The public may review the packages of the 1996 Budget Requests on file with the Municipal Clerk' s in Tompkins County. • 3 ) Comfort Road Bridge - is on the County Agenda to be rebuilt next year ( 1996). The bridge will be a two (2) lane bridge. 4) West Danby Playground. - Representative Proto has contacted Senator Kuhl in regard to funding for a playground in West Danby. Joel Gagnon is working on a schematic proposal for a playground in West Danby. 5 ) Dedication of Civil War Monument and Parade - A Parade and the Dedication of the Town of Danby Civil War Monument will take place on Saturday, October 14, 1995 . 6) County Charge back for Election Expenses - The County Board passed a resolution regarding charging back election expenses to the towns. 48G 3 Town Board Minutes October 9, 1995 NYS Local Government Telecommunications Initiative Robert Spaulding, Caroline Town Supervisor, reported to the Board that he has created a Webb page on a local government programed computer through Cornell University. The program lists government activities, history, churches, fire districts and organizations located within towns. He has permission for the Town of Danby to be a part of the network. Donald Barnes - 57 Michigan Hollow Road - addressed the Board and described his proposal for a rezoning of his property to place a multi-dwelling complex on a property on Michigan • Hollow Road . He asked the Town Board to review his proposal and to consider granting the rezoning. He presented reference copies of the proposed structure, location of the site for the Board to review. Mr. Barnes invited the Board to visit the site. COMMUNICATIONS: 1 ) Reduced Speed Limit Request on German Crossroad - A memo from the Department of Transportation was received regarding the approval of a reduced speed limit on German Cross Road from the unposted speed limit of fifty-five (55 ) miles per hour to thirty-five (35 ) miles per hour. 2) Ribbon Cutting Ceremony - Shady Corners - Supervisor Oltz received notice that there will be a Ribbon Cutting Ceremony for the completion of the Shady Corners Project which upgrades the intersection of N. Y. S . Rte ' s . 13 , 13A and 96 in the Town of Ithaca on October 10, 1995 at 10 : 00 a.m. 3 ) Department Reports - Highway Department and Code Enforcement Office reports for September 1995 . 4) Recommendations from Planning Board regarding the Barnes Proposal 5 ) Supervisor' s Fiscal Year 1996 Tentative Budget REPORT S Danby Youth Commission - Report received . Highway Department Report - September 1995 received Code Enforcement Officer - September 1995 received Senior Citizens Danby Senior Citizens Chairperson Charles Cole thanked the Town Board for their generosity in the past and extended his appreciation on behalf of the Danby Senior Citizens. Mr. Cole distributed copies of the Senior Citizen Winter Meeting Schedule and said that they are actively seeking new members. OLD BUSINESS: Tompkins County Motor Vehicle Fee of $2. 50 per registration. Representative Proto reported that the Tompkins County Motor Vehicle Department Fee of $2. 50 for vehicle registration has not gone into effect. New York State has placed a moratorium on any new regulations imposing fees. NEW BUSINESS: Schedules of Budget Work Sessions The Board scheduled budget work sessions for review of the Town of Danby 1996 Budget for Tuesday, October 10 , 1995 at 5 : 00 P . M. and Tuesday, October 17, 1995 at 5 : 00 P.M. An additional work session may be scheduled for Tuesday, October 24, 1995 at 5 : 00 P.M. if necessary . A public hearing date will be set for the Preliminary Budget after revisions and 487 4 Town Board Minutes October 9, 1995 preparations of the budget are complete . Public Hearing Scheduled - Barnes Proposal The Board set a Public Hearing for Monday, November 13 , 1995 at 7 : 30 P.M. to consider a Local Law to amend the Zoning Ordinance to establish. a Planned Development Zone on a 8+1- acre portion of Town of Danby Tax Parcel No. 14. - 1 -4. 2, ten ( 10) acres total, located in a Low Density Residential Zone on Michigan Hollow Road, with a Planned Development Zone proposed to include a four (4) unit dwelling. RESOLUTION NO. 49 OF 1995 ZONING ORDINANCE FEE By Councilperson Schwartz : Seconded by Councilperson Steiner RESOLVED, that the Town of Danby Town Board increases the fee for copies of the Town of Danby Zoning Ordinance to (seven) $7. 00 per copy to cover the cost of reproduction. A vote on the resolution resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Town Hall Building Project Supervisor Oltz reported that the Town Hall Building Committee has come up with a proposal for a new office building and introduced a resolution with attached "Addendum to Agreement" She reported that the new proposal incorporates the use of the present building meeting room with renovations that were previously proposed. The building committee has recommended to the Town Board that a design professional be retained to review and revise as necessary the plan that the committee has presented for the Town Hall Renovation and Addition Project. Discussion followed : Councilperson Johnson reported that she is concerned that this large meeting room is not going to be used . Everyone does not need a conference room and additional meeting space in their own working area . There could be some shared space. Supervisor Oltz said that the original design has been downsized considerably. RESOLUTION ON 50 OF 1995 PROFESSIONAL CONSULTING SERVICES FOR TOWN HALL PROJECT alBy Councilperson Schwartz : Seconded by Councilperson Hile WHEREAS, the Town. of Danby is in need of improved facilities for Town Hall functions, and WHEREAS, the Town Hall Building Committee has recommended to the Town Board that a design professional be retained to view, and to revise as necessary, the current schematic design and cost estimate for a Town Hall renovation/addition project, and WHEREAS, the firm of Demjanec and Associates, Architects has submitted a proposal for such services, therefore, it is RESOLVED, that the Town Board approves the retention of Demjanec & associates, Architects for professional consulting services generally as described in "ADDENDUM TO AGREEMENT" as reviewed by the Town board on October 9, 1995 , and be it further 453 5 Town Board. Minutes October 9, 1995 RESOLVED, that the Town Board authorizes the expenditure for such services not to exceed $ 1 ,760 . 00 plus reimbursable expenses without further Town Board approval. A vote on the resolution resulted as follows: Hile Aye Johnson Aye Schwartz Aye • Steiner Aye Oltz Aye Carried Unanimously Southern Tier Building Officials Association Seminar Supervisor Oltz reported that the Code Enforcement Officer would like to attend the Southern Tier Building Officials Association Seminar. She asked the Board to approve the $40 . 00 Fee for registration. A motion was made by Councilperson Hile and seconded by Councilperson Johnson that the Town Board approve the $40 . 00 registration fee for the Code Enforcement Officer to attend the Southern Tier Building Officials Association Seminar. A vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Resignation of Town Hall Caretaker Supervisor Oltz reported that the Town received a Letter of Resignation from Edward M. Roberts the Town Hall Caretaker, effective December 31 , 1995 . Mr. Roberts would like to continue as Voting Machine Custodian. Appreciation to Edw. M. Roberts A motion was made by Councilperson Johnson and seconded by Councilperson Steiner that the Town Board express our gratitude and appreciation to Edw. M. . General Fund Warrant No. 10 of 1995 - Approved Councilperson Steiner requested that voucher No. 278 be removed from the Abstract and that the Highway Superintendent be consulted regarding this item. No Councilperson objected . 480 6 Town Board Minutes October 9, 1995 A motion was made by Councilperson Steiner and seconded by Councilperson Schwartz to approve the General Fund Warrant No. 10 of 1995 in the amount of $ 11 ,256 . 46, vouchers numbered 270 - 301 excluding voucher No. 278 . A vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Carried Unanimously Oltz Aye Highway Fund Warrant No. 10 of 1995 - Approved. The Highway vouchers were audited by the Board and No. 122 in the amount of $2, 593 . 21 was pulled from the Warrant until the Highway Superintendent could be consulted regarding the repair bill. A motion was made by Councilperson Schwartz and seconded by Councilperson Hile to approve the Highway Fund Warrant No. 10 of 1995 in the amount of $ 19,799. 28, vouchers numbered 109 - 124 excluding Voucher No. 122. A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously West Danby Water District Fund Warrant No. 9 of 1995 A motion was made by Councilperson Hile and seconded by Councilperson Schwartz to approve the West Danby Water District Fund Warrant No 9 of 1995 in the amount of $ 1 ,957. 91 vouchers numbered 34-39. A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye • Oltz Aye Carried Unanimously Supervisor' s September 1995 Report - Approved A motion was made by Councilperson Schwartz and seconded by Councilperson Hile to approve the Supervisor' s September 1995 Report.
