Supervisor Oltz requested an addition to the Agenda under New Business - Extending the Recycling Center Closure Date. No Board Member objected to the additions to the Agenda. PRIVILEGE OF THE FLOOR : Recycling Center Closing Date: Supervisor Oltz reported that she received word from Don Richardson of Tompkins County Solid Waste that the Town may keep the Recycling Center open through August. She has contacted Michael Collins, Danby Recycling Coordinator, and he is willing to continue working at the center. i •k '., ba� t ,��G. ,.... 443 2 Town Board Minutes Jame 12, 1995 TOWN HALL MONUMENT Dan Wheeler ofthe Sons of Union Veterans of the Civil War introduced Duane Mills from Big Flats, New York to the Board. Mr. Wheeler reported that he has a proposal to repair the base of Civil War Monument If the Town wants the fence to remain around the monument, it will be necessary to purchase concrete to build up the base. Supervisor Oltz and Councilperson Hile responded that they would like to keep the fence around the monument and have the base repaired. • Representative Frank Proto volunteered to find someone to supply concrete to repair the monument. base. Maly Lou Hardesty - 50 South. Danby Road - reported she attended a meeting at Cooperative Extent regarding community networking that was very informative. Edward Inman, Chair - Zoning Board of Appeals - reported that the Board will have a one ( 1 ) vacancy as of June 30, 1995 . t Roy Casterline - reported that the West Danby Community Garage Sale, last weekend, was a great success. County Representative Report: County Representative Frank Prato reported on the following: 1 ) Tourism Grant Funding is available through the Tourism Advisory Board for community events that promote tourism. Mr. Proto suggested the Town contact Richard Driscoll at the Community Arts Partnership for information on how to apply for grant funding. 2) Sanitary Code - the final public hearing was held on May 23 , 1995 and no public comment was received. Public comment may be submitted until June 19, 1995 on: 1 ) Article I - Definitions 2) Article 4 - Refuse Disposal 3) Article 9 - Air Pollution Control (open burning) 4) Article 11 - Offensive Material , Animal Waste, and Hazardous Substances 3 ) CttyWastewater Treatment Plant - the pump used at the City Wastewater Treatment Plant for determining the charge to haulers is not a calibrated cost There is no way to verify that the bills for dumping waste at the plant are correct until the pump is calibrated. Councilperson Schwartz responded that septic tank haulers used to be able to dump waste in DEC approved lagoons. The County passed legislation that forced the individual haulers to dump only at the City Wastewater Treatment Plant Representative Preto reported that Article 4 of the Sanitary Code says that if an approved wastewater treatment plant is willing to accept the affluent, land spreading of affluent is not permitted. • 4) Recycling Centers - The roadside pickup contract will be delayed and the recycling cent y y tng ers may remain open until at least the end of July. 5 ) County Budget - There will never be a zero (0) per cent increase in the budget due to the increase in cost of supplies, utilities, and cost of living increases. Councilperson Steiner referred to a County proposal to add the solid waste fee to the Town and County Tax Bill and said he is concerned that this is going to be a means by which the County will be able to add assessment fees onto the property owners and shift the apparent responsibility for these onto the local towns. In shifting the solid waste fee payment to the Town Tax Collector' s the public will lose sight of where this fee is coming from. Councilperson Johnson responded that the solid waste fee is for a service like any other utility and askedwhyisn.'t the County paying it and then assessing the taxpayer as tax. The taxpayer would then . I __ 444 3 Town Board Minutes June 12, 1995 have the opportunity to use the fee as a tax for tax purposes rather than it being a separate fee. She said that as a Town, we should not be responsible for the collection of County money. Representative Preto reported that the County is working with various townships to develop software to allow the solid waste to be added to the tax bill. A subcommittee is looking at a software and hardware package for the County tax program. Carol Sczepanski , Town Clerk reported that the Tompkins County Town. Clerks have not had the opponunityto view the proposed tax program. A draft of a proposed tax bill includes the solid waste fee even though adding the fee to the bill. 6) Rural Affairs Committee - held two (2) sessions ' 1 ) adult education; 2) home based businesses and where they exist Highwav Report: Superintendent William Hall submitted his written report for May 1995 to Supervisor Oltz and reported that the Highway Department is busy with the seasonal maintenance on gravel roads, trimming and cutting trees and patching pot holes. West King Road is being prepared for repaving. Code Enforcement Officer Report - Zoning Code Enforcement Officer Sue Beeners reported that her office has been working high and low range house numbers in preperation of the County 911 System. In May building permits were issued for two (2) garages, a chapel at the speech camp, two (2) houses and one ( 1 ) housing addition. BZA Report - May 1995 The Board of Zoning Appeals granted an appeal to James and Lucille Avery for a garage setback on their property located on Heisey Road. Planning Board Report- May 1995 The Planning Board held a public hearing on the proposed "Camelot" Preliminary Site Plan and hard Preliminary Subdivision approval. The Board granted conditional approval for Benjamin' s Used Cars Sales to build a small office/garage for their car lot located on NYS Rte. 96B. NEW BUSINESS : Truck Mounted Telescopic Boom Hydraulic Excavator. Bid Opening The Town Board held a bid opening on June 7, 1995 for a Truck Mounted Telescopic Boom Hydraulic Excavator on June 7, 1995 . Two (2) sealed bids were received and opened at the bid opening. Board discussed and reviewed the bid proposals. The Highway Superintendent reported to the Board that he has inspected both of the machines cited in the bids and would like the Town to accept the bid from L.B. Smith, Inc. as it has fewer metered hours and appears to be in good condition. • RESOLUTION No. 30 of 1995 AWARD OF BID FOR ONE (1) TRUCK MOUNTED TELESCOPIC BOOM HYDRAULIC EXCAVATOR - Approved By Councilperson Schwartz: Seconded by Councilperson Hile WHEREAS, the Highway Superintendent on May 20, 1995 advertised in the Ithaca Journal that the Town of Danbywas seeldng bids for one ( 1 ) 1988 or newer truck mounted telescopic boom hydraulic excavator, and WHEREAS, the Town of Danby Town Board received and opened .bids at their Regular Agenda Meeting on June 7, 1995 at 7: 30 P.M. , and WHEREAS, the Town Board and the Highway Superintendent have reviewed the bids, now be it 445 4 Town Board. Minutes June 12, 1995 RESOLVED, that the Town of Danby Town Board awards the bid from L.B. Smith, Inc. , 5985 Court Street, P. O. Box 65 , Eastwood Station, Syracuse, New York for the purchase of a truck mounted telescopic boom hydraulic excavator, for their bid price in the amount of $60,266. 00 less trade allowance of $5 ,000. 00 for a total purchase price of $55 ,266. 00, and be it further RESOLVED, that this bid best meets the needs of the Town Highway Department A roll call vote on the resolution resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye • ' Carried Unanimously 4-H PROCLAMATION Supervisor Oltz reported that the Town has received a request from Tompkins County Cooperative Extensionto adopt the following Proclamation to declare July as Tompkins County Youth Month and July 23 -29, 1995 be declared as 4-H Acres Youth Fair Week. RESOLUTION NO,31 OF 1993 PROCLAMATION - TOMPKINS COUNTY YOUTH MONTH By Councilperson Schwartz: Seconded by Councilperson Johnson WHEREAS, The 4-H Program of Tompkins Cooperative Extension serves the youth of Tompkins County without regard to race, color, or religion by encouraging participation in leadership development and educational programs, and WHEREAS, The Tompkins County 4-H Youth Fair held at 4-H Acres is the culmination of the year's activity program, or programs that are held throughout the community, and is organized and conducted by and for the members of 4-H and youth who participate in youth organizations throughout the county, and. WHEREAS, The Tompkins County 4-H Acres Youth Fair provides an opportunity for 4-H youth and those involved in county youth groups, to share with their parents, family, friends, and the public the results of the year-long learning and growing process, NOW THEREFORE BE IT RESOLVED, that the month of July be declared Tompkins County Youth Month and that the week of July 23 through July 29, 1995 be declared Tompkins County 4-H Acres Youth Fair Week in recognition of the significant role that 4-11 plays in the lives of its members and the role in which county youth organizations positively encourage community youth, which are addressed on the • occasion of the 1995 4-H Acres Youth Fair. FIELDSTONE CIRCLE SUBDIVISION: A draltresoiution was presented to the Board for the Consideration of Acceptance of roads and other 446 5 Town Board Minutes June 12, 1995 Public Impwvements for Fieldstone Circle Subdivision to enable the developer to be issued a second building permit in the development Discussion followed regarding the acceptance of a road before a second building permit can be issued. Councilperson Schwartz said we did not want to see expensive repairs to the road from construction in the development. • Councilperson Johnson said that we should not accept the road until it is completed. . She said that she did not think the Town should accept the road without some sort of contingency. Councilperson Steiner said that once the road was accepted the Town was responsible for the maintenance of the road. Councilperson Hile said that he disapproves of the Town accepting a road with only one building permit iced He said he is not saying accept the road after the proposed development is completed, but after it is partially completed and the road has weathered. The draft resolution was amended by the Board and the following resolution (No. 32 of 1995 ) was approved. RESOLUTION NO. 32 OF 1995 GRANTING ADDITIONAL BUILDING PERMITS IN FIELDSTONE CIRCLE SUBDIVISION, - Approved By Councilperson Hile : Seconded by Councilperson Johnson WHEREAS , the developers of "Fieldstone Circle Subdivision" have requested that the Town of Danby Town Board make a modification to paragraph 2 of the Town Board Resolution No. 43 of 1994, so that the developers might apply for a building permit for Lot #5 prior to completion of the roadways and other improvements in the subdivision, and WHEREAS, the Town Attorney is in the process of review of the title and deed documents for the proposed roadways, and WHEREAS, the construction of the roadways and other public improvements is progressing to the satisfaction of the Town Highway Superintendent, and . WHEREAS, theTownHighway Superintendent has recommended that the deadline for completion of the roadway construction be extended beyond the August 1 , 1995 date established in the July 18, 1994 Agreement between the developer and the Town of Danby and in the July 11 , 1994 Letter of Credit established with the Town by Snyder County Trust Company, with the proposed extended deadline being August 1996, now therefore, it. is RESOLVED ,SOLVED that the Town of Danby Town Board hereby modifies the terms of Paragraph 2 of •To nBoard Resolution No. 43 of 1994 to permit additional building permits for construction in the Subdivision conditional upon the continuation of a Letter of Credit in an amount satisfactory to the Town Board and the Town Highway Superintendent to assure completion of the roadways and other public improvements including the construction; and the documentation of same, and it is further RESOLVED, that the Town Board approves the extension of the deadline for ;completion of the roadway ,construction beyond the August 1 , 1995 date established in the July 18, 1994 Agreement between the developer and the Town of Danby and in the July 11 , 1994 Letter of Credit established withth a Town by Snyder County Trust Company, with the approved extended deadline being August 1 , 1996. 447 6 Town Board Minutes June 12, 1995 A roll call vote on the resolution resulted as follows : • Hile Aye Johnson Aye I Schwartz Aye Steiner Aye . Oltz Aye Carried Unanimously ID " CAMELOT" SUBDIVISION Four (4) resolutions were presented to the Board for consideration for the Proposed "Camelot ' Subdivision. Discussion followed regarding the legal title to the property. Susan Beeners said that once the developer receives final approval for more than one house on that landhewill obtain title to the property. The "Camelot" proposal has received preliminary approval from the Planning Board but must obtain final approval. The four (4) resolutions before the Board tonight are preliminary. RESOLUTION NO. 33 OF 1995 - Approved DETERMINATION OF ENVIRONMENTAL SIGNIFICANCE FOR THE ACCEPTANCE OF THE PROPOSED CONSTRUCTION AND DEDICATION OF A NEW PUBLIC ROAD, "KING ARTHUR' S COURT" . IN THE PROPOSED CAMELOT SUBDIVISION By Councilperson Steiner: Seconded by Councilperson Johnson WHEREAS , Glen Harrington has applied for Subdivision Approval for the proposed Camelot Subdivision, proposed to be located on Town of Danby Tax Parcel No. 26-. 1 -9. 3 , located on the northeast corner ofHillview Road and Route 34/96, and to consist of seven lots and a new public road named "King Arthur's Court", and WHEREAS, the Town of Danby Planning Board on May 17, 1995 , acting as Lead Agency in environmental review of the proposed subdivision, made a negative determination of environmental significance and granted Preliminary Subdivision Approval to the project, and by a subdivider fan easement or fee title to a highway or other public facility shall be shown on a Final Nat unless the Town Board determines to accept such dedication, and Glen Harrington has requested that the Town Board accept the proposed dedication of King Arthur's Court, subject to the subsequent requirements offinal subdivision approval and final road acceptance, and WHEREAS, the proposed construction and dedication of "King Arthur's Court" is a Type I action. for which the Town Board is legislatively determined to act as Lead Agency in enviromnental review, and 0 WHEREAS , the Town Board has reviewed the SEQR Enviromnental Assessment Forms for the proposed action, I NOW, THEREFORE, IT IS RESOLVED, that the Town of Danby Town Board, acting as Lead Agency in Type I environmental review of the proposed construction and dedication of "King Arthur's Court" in the proposed "Camelot Subdivision", make and hereby does make a negative determination of environmental significance. Final Subdivision Approval by the Town of Danby Planning Board. 2. AND TT IS FURTHER RESOLVED, That the Town Board authorizes the Town Supervisor to file an Application for Approval of Plans for Public Water Supply Improvement with the New York State Department of Health, AND IT IS FURTHER RESOLVED, That the Town Board authorizes the Town Supervisor to submit allotice of Intent to permit the construction of said water main extension with the New York • State Commissioner of Agriculture and Markets and with the Tompkins County Farmland Protection Board. A roll call vote on the resolution resulted as follows : Hile Aye Johnson Aye Steiner Aye Oltz Aye Schwartz Nay Carried RESOLUTION NO. 37 OF 1995 APPROVAL OF FUNDS FOR ROAD NUMBERING FOR COUNTY 911 SYSTEM By Councilperson Steiner: Seconded by Councilperson Hile 451 10 Town Board Minutes June 12, 1995 WHREAS, the Town of Danby Zoning Officer and her assistant have been working on the numbering of homes and lots on Danby Town Roads in conjunction with the County 911 system being set up by Jack Miller, County Coordinator, and WHEREAS, the project is very time consuming and an undue burden on the Zoning Officer and her assistant, and WHEREAS, Donna Inman, Assistant to the Zoning Officer, has stated that she would be willing to work on this numbering process outside of her normal working hours for a fee of $8. 00 per hour, and WHEREAS, there are presently 100 to 150 house numbers that must be changed for the 911 project, now be it RESOLVED, that Donna Inman be appointed for a fee of $8. 00 per hour to work out the necessary changes and report her findings to the Town Supervisor. Discussion: Councilperson Schwartz said he thinks the rate of $8. 00 per hour high for clerical work. A roll call vote on the resolution resulted as follows : Hile Aye Johnson Aye Steiner Aye Oltz Aye Schwartz Nay Canted Motion to Increase Town Mileage - Approved A motionwas made by Councilperson Schwartz and seconded by Councilperson Hile to increase the Town ofDanby Town mileage reimbursement for Town business by one ( 1 ) cent per mile to comply with the current federal standard of twenty-nine (29) cents per mile.
