M . Corrections to February 22 , 1995 Minutes Draft : 1 ) Page 1 - under Privilege of the floor - [ delete - high density ] and replace with planned development 2 ) Page 2 - under Proposed Revision - Fill Extraction and Deposit of Fill - [ delete the word " Fill " ] 3 ) Page 4 - first paragraph delete [ and the ] 4 ) Page 4 - under Joel Gagnon [ delete the word " is " ] Approval of February 22 , 1995 Planning Board Minutes : A motion was made by Joel Gagnon and seconded by William Farrell to approve the February 22 , 1995 Planning Board Minutes as corrected . Carried Unanimously Corrections to March 15 , 1995 Planning Board Minutes : 1 ) Page 1 - under Approval of Minutes Postponed delete " were " replace with " was " . 2 ) Page 3 - first paragraph delete the word " precedence " replace with Precedent . 3 ) Page 3 - Joel suggested the following rewrite of the reference to Proposed Legislative Amendments - Extraction and Deposit of Fill - delete - [ Susan explained that in the ordinance under Extraction and Deposit of Fill requirements the volume of fifty ( 50 ) yards per year may be too restrictive and replace with - Susan suggested that the ordinance requirement under Extraction and Deposit of Fill fo#101ermit for volumes of fifty ( 50 ) yards or more per year, be too restrictive . Approval of March 15 , 1995 Planning Board Minutes : A motion was made by Joel Gagnon and seconded by Arch Dotson to approve the March 15 , 1995 Planning Board Minutes as corrected . Carried Unanimously Review of the Proposed Camelot Subdivision The Board received an updated engineered plan for the Proposed Camelot Subdivision to review . The plan contained revisions of water and sewer systems , provisions for erosion control including a silt fence located on the wetlands buffer as well as near Hillview Road area . Glen Harrington reported that he has submitted all the necessary information for his proposal to the Tompkins County Health Department . All the requirements of the Health Department have been addressed . Presently there are 98 units on the West Danby water system and it is designed for 128 units . . , 298 2 Planning Board Minutes April 19 , 1995 S usan Beeners reported that the preliminary response received from J ohn Anderson did not indicate there would be a problem with the water supply system . She is waiting for a final report from John Anderson . Mr . Harrington reported that there will be " Covenants and Restrictions " for the proposed subdivision . Part I - SEQR Review S usan reported that John Anderson of Tompkins County Health D epartment requested the following two ( 2 ) minor changes to the S EQR Part I as follows : 1 ) Page 4 - b 13 . - Change to yes - the type is domestic sewage 2 ) Page 5 - Approvals Required - add County Sub - Division and Water / Sewage Disposal , Sub - Division . Changes recommended by the Planning Board - SEQR Review - Part I A - Site Description 1 ) No . 8 - add Varies greater than four ( 4 ) feet in development area . 2 ) No . 13 - add Part of the West Danby Morainal Topography B - Project Description 1 ) No . 9 - No . of jobs generated after project is complete " 0 " 2 ) No . 13 - delete " no " add " yes " . 3 ) No . 18 - add yes - domestic only Review of SEQR - Part II The Planning Board reviewed and approved SEQR Part II for the P roposed Camelot Subdivision with the qualifying statements with explanations as prepared by the Code Enforcement Officer . Motion to Approve SEQR Part II , Section " Impact on Aesthetic Resources " - for the Proposed " Camelot " Subdivision A Motion was made by Arch Dotson and seconded by Nancy Weitzel that t he Planning Board check the box marked " YES " , on the SEQR Part II for the Proposed Camelot Subdivision . for Item No . 11 , Impact on Aesthetic Resources , small to moderate impact with the explanation prepared by the Code Enforcement Officer attached . A vote on the motion resulted as follows : Five ( 5 ) Ayes One ( 1 ) Nay Motion Carried Motion to Approve SEQR Part II " Impact on Growth and Character of Community or Neighborhood " A motion was made by Arch Dotson and seconded by Nancy Weitzel that t he Planning Board check the box marked " YES " for on the SEQR Part II for the Proposed Camelot Subdivision for Item No . 18 , Impact on G rowth and Character of Community or Neighborhood , small to moderate impact with the explanation prepared by the Code E nforcement Officer attached . A vote on the motion resulted as follows : Five ( 5 ) Ayes One ( 1 ) Nay Motion Carried RESOLUTION NO . 1 OF 1995 Negative Determination of Significance - Camelot Proposal - Approved B y Arch Dotson : Seconded by Nancy Weitzel WHEREAS , the Planning Board as Lead Agency has reviewed the P roposed Camelot Subdivision materials as submitted through April 19 , 1995 , and ? 99 3 Planning Board Minutes April 19 , 1995 WHEREAS , the Planning Board is Lead Agency for this Type I Action and involved agencies have been notified , and WHEREAS , the Planning Board has reviewed and amended the Draft Environmental Review provided by the Code Enforcement Officer , now be it RESOLVED , that the Planning Board acting as Lead Agency in the Type I Environmental Review make and hereby does make a Negative Determination of Environmental Significance . A roll call vote on the resolution resulted as follows : Dotson Aye Farrell Aye G reene Aye Weitzel Aye H ortz Aye Gagnon Nay Carried D iscussion followed regarding whether a second public hearing was n ecessary . Chairperson Horst will contact the Town Attorney for h is recommendation . J oel said that he feels it is necessary as a matter of fairness to the community to allow people to express their feelings on the matter . Chairperson Horst said that subject to the direction of the P lanning Board , he will be in touch with the Town Attorney to determine whether a public hearing is necessary . Public Hearing Date Set for the Proposed Camelot Subdivision A motion was made by Joel Gagnon and seconded by Arch Dotson that the Planning Board authorize Chairperson Horst to schedule a Public H earing for 7 : 00 P . M . , Wednesday , May 17 , 1995 , preceding the ✓ egular Planning Board Meeting if he is advised by the Town Attorney if it should be held . A vote on the motion resulted as follows : Carried Unanimously S usan reported that before Final Subdivision Approval can be granted , the Town must have acceptance from the Water Commissioners o f the location of the water main . The Town Board must approve t he location of the water main and location of the road . Action Plan : Chairperson Horst asked the Planning Board to review their packet and materials for a future action plan for the Town . ADJOURNMENT : On a motion the meeting adjourned at 10 : 25 P . M . N otice of Publication was read as follows : " NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by t he Town of Danby Planning Board on Wednesday , May 17 , 1995 at 7 : 00 P . M . , 1830 Danby Road , Ithaca , New York , to consider P reliminary Subdivision Approval for the proposed seven ( 7 ) lot " Camelot Subdivision " , proposed to be located northeast of t he intersection of New York State Rte 34 / 96 ( Spencer Road ) and Hillview Road on Town of Danby Tax Parcel No . 26 . - 1 - 9 . 3 . J ames & Catherine Benjamin , owners ; Glen Harrington , applicant . All interested parties will be given the opportunity to be h eard either in writing or in person . By Order of the Planning Board Carol W . Sczepanski , Town Clerk Published : May 11 , 1995 " G len Harrington gave a brief summary of the proposed the " Camelot " S ubdivision Proposal . Mr . Harrington presented final drawings for t he public to view and described the proposed deed restrictions for the lots that border the wetlands area . S usan Beeners reported that the County Health Department has approved the plans for the water main extension and septic systems . The County Highway Department , Department of Transportation and the Town Highway Superintendent have approved the location and design of the proposed road . She reported that the Department of Conservation has flagged the wetland boundary , and that she sees no danger to threatened or endangered species in the project area . The SEQR review reflects the concerns of the neighbors related to d ensity , traffic , and wetlands impact . This project meets the basic necessary requirements and the environmental impacts are being lessened as much as possible . Comments From Members of the Public : Al Becker - Hillview Road - is opposed to this entire project and previously submitted a petition to the Board indicating that one ( 1 ) or two ( 2 ) homes in the area would be acceptable . He is concerned with the density of the project . S teve Cortright - Hillview Road - questioned the location of pond on the proposed project property . He does not like the proposed d ensity of the project .
