PLANNING BOARD MEETING
Regular Meeting 7 : 30 P . M . December 21 , 1995

The meeting was called to order at 7 : 37 by Chairperson Ken Horst .
Communications :
Anonymous clipping from the Ithaca Times received on December 10 ,
1995 relative to " Nature ' s Song Retreat Center . ( Date of
publication unknown . )
Chairperson Horst asked the Code Enforcement Officer to send a
letter to Ms . Boardman and request a response in writing
acknowledging that she is in compliance with the provisions of the
Special Permit .
County Planning_ Board Report
Chairperson Horst reported he has not received a County Planning
Board Report from Don Schaaf in some time . He will contact
Mr . Schaaf to see _i. f he is still interested in serving as our
representative on that committee .
P roposed Legislative Revisions to the Zoning Ordinance :
The Planning Board reviewed and approved of minor revisions to the
N ovember 11 , 1994 Proposed Legislative Revisions .
P age A3 - Item 31 removed from special permit section .
S ection 707 - New Item 1 - is proposed to make clearer .
P age Cl - shows context of the language of " Permit to Build . "
P age C3 - Old section 11. 02 - moved to 1101 paragraph 7 to make
room for doublewide special conditions .
P age C2 - Item b ( ii ) - change 15 feet to one story in height .
Item d - signs when approval of the Planning Board or
Board of Appeals is not required for same .
P age A2 - Item 2h - Any such sign shall be non - flashing and , if
illuminated , shall have the light shielded as much as
practicable to direct the lights only at the signs .
P age Dl. Item 2b - new item - " Permitted Uses in a Commercial Zone

Motion to send Proposed Legislative Revisions of November 11 , 1994
t o the Town Board
A motion was made by Joel Gagnon and seconded by Nancy Weitzel to
send the Proposed Legislative Revisions dated November 11 , 1994 as
revised by the Planning Board on December 21 , 1994 to the Town
B oard .

P roposed Used Car Lot Application - John Rounds
J ohn Rounds submitted an application for a Used Car lot . Attached
t o the proposal is a sketch plan , a location plan and a survey map
o f the property . The proposed site is on the Rick VanOstrand
property on Danby Road south of Brown Lane and is zoned Commercial
Zone C . The sketch plan shows the DoT right - of - way along Rte .
968 . A trailer located on the property is proposed to be the
o ffice for the Used Car Sales and the plan is for a total of six
( 6 ) cars on the lot . The property along the roadside has a gravel
bed as it was used for ceramic sales .
The Planning Board discussed the legal status of the rental trailer
located on the property .
Chairperson Horst asked the Code Enforcement Officer to review the
status of the trailer . Susan said that this is clearly an
e nforcement issue and she will consult with the Town Supervisor and
Town Board as it may not be a high priority issue at this time .
J ohn reported that if the trailer cannot be used for an office that
he cannot proceed with his proposal .
S usan reported that she is concerned that the proposed site does
not allow for the front and side yard parking requirement of a.
t wenty - five feet set back . John has proposed the parking of the
cars to he in line with the telephone pole and guide wires located
within the twenty - five foot set back . She said if the twenty - five
foot set back cannot be obtained then it is necessary to obtain a
✓ ariance .
it was suggested by the Chair that Susan research the status of the
t railer . She will consult with the Supervisor , Town Board , and
Town Attorney as necessary and then report back to the Planning
B oard .
N ancy said that the Board needs to wait to see how the Town Board
proposes to handle that situation before additional plans are
requested for this proposal .
P roposed Camelot Subdivision - Update
S usan reported that the Highway Superintendent and Jerry Stearns
h ave looked at the road for the Proposed Camelot Subdivision . Bill
H all reported to her that the 10 % maximum road grade on the
proposed road would be acceptable subject to certain specific
d esign cri. teria. . She has not received a revised SEQR form . Mr .
Harrington has asked for the acceptance of the 10 % road grade from
t he Planning Board before he proceeds with an engineered
preliminary plat .
Motion to Accept Report for 10% Road Grade - Proposed Camelot
S ubdivision
A motion was made by Arch Dotson and seconded by Eloise Green that
t he Planning Board accept the report from the Tompkins County
H ighway Department and the report of the Code Enforcement Officer
t hat the Highway Superintendent find the road grade of 10 %
acceptable .

Approval of October 19 , 1994 Minutes
The minutes of the October 19 , 1994 Planning Board Minutes were
approved with the following corrections :

1 ) Page 3 - under Zoning Ordinance Revisions - Paragraph 1 delete
the word " be " insert the word " have " .
2 ) Page 3 - under the Motion to Amend the Special Permit - -
language should read - - these requirements that must be
complied with as part of the building permit application
process .
