November 16 , 1994 PRESENT : Chairperson Kenneth Horst P lanning Board Members : Arch Dotson , William Farrell , Joel Gagnon , Eloise Greene , Nancy Weitzel ABSENT : D on Schaaf O thers Present : S ecretary Carol Sczepanski Councilperson Howard Steiner Chairperson Horst called the meeting to order at 7 : 36 P . M . Miscellaneous Reports : N ancy Weitzel reported she received the following : 1 ) Tompkins County Outlook Mapping Report 2 ) Survey questionnaire from the Faculty of Environmental Studies S usan Beeners reported that thanks to the approval of the Planning B oard Chair , she has purchased a set of maps from the County that were produced by New York State Gas & Electric in 1991 . They are of the same scale as the tax maps and can be overlaid to determine where buildings are located on individual parcels . She also purchased mylar film so that the tax maps can be copied . Yaple Road Subdivision Susan reported that the Planning Board Chair approved of minor modifications to the Neal Robison Yaple Road Subdivision Plat . A map of the minor modifications was reviewed by the Planning Board . COMMUNICATIONS : 1 ) Fingerlakes Land Trust - Two Conservation Easements donated to t he Fingerlakes Land Trust in the Town of Danby . 1 ) Perry and Claire Gilbert - 113 acres on Gilbert Road near DePutron Road ; 2 ) Clifford and Jane DeMayo - 66 acres located on East Miller Road . 2 ) Second Annual Tompkins County Greenway Coalition Workshop - H ow to Build Local Greenways , the Next Steps - Saturday D ecember 3 , 1994 at 8 : 45 a . m . to 1 : 00 p . m . at the AT & T Cafeteria ( formerly NCR ) . P lanning Board Public Hearing Minutes - October 19 , 1994 P age 1 - under Mike Hovanec explained to the public that his proposal is for a Motorcycle Accessories Shop and it will also . . . . P age 2 - under Albert Shepardson delete the word " compliment " replace with complement . Approval of - Public Hearing Minutes of October 19 , 1994 A motion was made by Joel Gagnon and seconded by Arch Dotson to approve the Planning Board Public Hearing Minutes of October 19 , 1994 as corrected . Carried Unanimously Camelot Subdivision Proposal Update G len Harrington addressed the Planning Board with a status report for the Camelot Subdivision Proposal . He reported that at the last meeting the Board requested information related to the following : 1 ) Would the County accept the roads - - a completed survey map was submitted for review . 2 ) An unsafe school bus stop if the bus come from 34 / 96 and stopped on Hil .lview - - the Spencer district confirmed that the 280 2 Planning Board Minutes November 16 , 1994 school bus comes from the Michigan Hollow Road . 3 ) Health Department acceptance of the revised plan - - John Anderson has notified the Code Enforcement Officer by letter that everything in the revised plan appears to be in accordance except the rear lot No . 3 . A test hole must be dug for that lot . The septic systems outlined on the plans are in line . Mr . Anderson will review the the plan and the SEQR Review before any approval is given . G len reported that the County accepted and approved the location of t he road and Jerry Sterns requested a perpendicular alignment to H illv :iew Road to make the road a 90 degree angle . The County asked t hat trees within the fifty ( 50 ) foot right - of - way be moved so that t hey can mow the area . He explained the lot layout for the proposed subdivision , lot sizes , wetland boundaries , buffer area and the septic layouts for the lots . S usan reported that the County Highway Department wrote a leter and t hat the entrance as proposed was 557 feet east of the center line of 34 / 96 . G len reported that the 557 feet is a typo and the actual distance is 575 feet . G len referred to the Town of Danby regulations and asked for a waiver because there is no provision in the regulations concerning a major and a minor intersection distance . The plan is proposed for 525 ft . and he has a permit from the County to work within the right - of - way . The County is accepting the road and he can proceed after approval to subdivide is is received from the Town . S usan said that since there is typo in Jerry Sterns letter , she t hinks it is appropriate that the Town request verification that t heir recommendation of May 23 , 1994 still stands and the exact d istance verification . If our regulations cause practical d ifficulty for unnecessary or significant hardship , the Planning B oard can waive the requirement if they do not significantly alter t he purpose of subdivision control and the policies of the Town B oard . If a waiver is granted it must be reported at the next meeting of the Town Board . G len reported that he has secured funding for the road and would like to make an initial cut this year . The road is surveyed and marked and he has a permit application . Motion to Approve Waiver for the Center Line Distance Requirement for Intersections A motion was made by Arch Dotson and Seconded by Eloise Greene to approve a waiver of the Town. regulation that requires 600 feet center line distance between major streets and 300 feet between minor streets and that this waiver is contingent upon confirmation in writing from Tompkins County that their recommendation for approval May 23 , 1994 still stands and that the actual distance is 575 feet . Carried Unanimously E nvironmental Assessment Form ( SEQR ) Grade of Road discussed . The proposed road will have a 10 % grade and requires cutting approximately three ( 3 ) feet from the top of the hill . The road is planned according to the Subdivision Regulations of the Town of D anby . S usan reported that the Town Subdivision Regulations read a 10 % maximum grade is permissible and the Town Highway Specifications read 7 % maximum grade . She said the Planning Board could not waive t he Town Highway Specifications . J L 3 Planning Board Minutes November 16 , 1994 S EQR Review Susan reported that there are some minor numbers in the EAF to be changed on SEQR Part I . She has requested preliminary review of this plan by the Tompkins County Health Department and the West Danby Water Commissioners will be requested to review the specifications for the water mains , crossing , and the service d etails related to the water district . The Board reviewed the plans for drainage , slope and grade of d itches , provisions for erosion control , size of culverts . Mr . H arrington said that the culverts will be sixty - five feet in length and thirty ( 30 ) inch pipe for ditch drainage . Mr . Harrington explained that the wetlands are flagged and there will be restrictions placed on the appropriate lots within the 100 foot wetlands area and the 75 foot buffer zone . A Motion was made by Joel Gagnon and seconded by Eloise Greene to waive 3B , 4B and 6B of the SEQR Part II as reviewed by the Planning B oard . Carried Unanimously Mr . Harrington said that the information presented tonight is for a Preliminary Plat and is asking the Board to vote on the Public H earing held in April 1994 . He has gone to a lot of expense for surveys and engineering work , and before he goes to additional expense he must know if he will be allowed to subdivide . Chairperson Horst said that his interpretation is that approval for subdivision will depend on what can be done about the road related t o the 10 % grade problem . That is not something that the Planning B oard can waive . The status of this proposal is that we have approved some waivers ' relative to this project , but the Town must d o some background research to see whose responsibility it is to address the issue of a possible waiver of the Town Highway S pecifications . D iscussion followed regarding whether there is a need to revise • or modify the road specifications so that the subdivision and the h ighway specifications are the same .
