S upervisor Oltz opened the public hearing at 8 : 20 P . M . and the Town
Clerk read the following Notice of Publication :
" NOTICE IS HEREBY GIVEN , that the Preliminary Budget for the Fiscal
Year 1995 has been completed and filed in the office of the Town
Clerk at 1830 Danby Road , Town of Danby , Ithaca , New York , where it
is available for inspection during office hours .
FURTHER NOTICE IS HEREBY GIVEN , that the Town Board of the Town of
D anby will meet and review the said Preliminary Budget and hold a
P ublic Hearing thereon at the Town Hall on the 9th day of November
1994 at 8 : 00 P . M . Citizens attending the hearing have the right to
provide written and / or oral comments and ask questions concerning
t he entire budget Pursuant to Section 108 of the Town Law . The
proposed salaries of the following Town Officials are hereby
specified as follows :
S upervisor $ 10 , 000
Town Clerk / Tax Collector $ 12 , 020
H ighway Superintendent $ 29 , 458
Town Justice ( s ) ( 2 ) $ 4 , 017 each
Town Councilpersons ( 4 ) $ 1 , 638 each
A special meeting of the Town Board will follow the public hearing .

Comments on the Preliminary Budget 1995
S uperintendent Hall reported that Highway Account DA5130 . 2
( equipment purchase account ) was reduced from $ 12 , 000 to $ 2 , 000 and 1
asked the Board to adjust the highway accounts to raise this
account by $ 10 , 000 . He suggested the following adjustments within
t he highway budget to increase Account DA5130 . 2 by $ 10 , 000 .
DA5110 . 400 transfer $ 5 , 000 to DA5130 . 2
DA5140 . 400 transfer $ 1 , 500 to DA5130 . 2
DA5130 . 400 transfer $ 2 , 000 to DA5130 . 2
DA5142 . 400 transfer $ 1 , 500 to DA5130 . 2
H ighway Superintendent Hall reported that he is one of the lowest
paid Highway Superintendents in the County and would like his
salary increased to $ 30 , 000 .

Members of the Public :
K aren Jamarusty - 293 Curtis Road - She would like to express the
need for the Town to allocate enough funds to properly repair and
maintain Town roads .
Ira and Ann Brous - 293 Curtis Road - feel the same way as Karen
J amarusty and would appreciate having their road repaired . Mr .
B rous supports increasing the pay for our Highway Superintendent .
• Edw . M . Roberts - Bald Hill Road - said he requested $ 2 , 700 for
building maintenance in his budget request for 1995 . The
P reliminary Budget for 1995 is $ 2 , 200 for this item . He asked if
t his adjustment included an increase of in his pay of 4 % .
S usan Beeners - Code Enforcement Officer - asked the Highway
S uperintendent if the proposed work schedule summary for 1995
included both drainage on Curtis Road and repairs to Michigan
H ollow Road .
Supervisor Oltz reported that the Town has proposed an increase in
the Highway Budget by 5 . 67 % for 1995 .
H ighway Superintendent gave a brief overview of proposed road
repair , drainage and surfacing for 1995 .

Following the Public Hearing for the Town of Danby Preliminary
B udget for 1995 , Supervisor Oltz called the Special Meeting of the
Town Board to order at 8 : 50 P . M .
Health Insurance Coverage for Town Office Employees :
Supervisor Oltz asked the Board to reconsider providing 30 % of the
cost to obtain health insurance coverage for Town of Danby office
employees who work part - time . The Town does not provide any
incentives or any benefits for its part - time employees to encourage
them to continue long term employment . If all three office ( 3 )
employees participated in the plan the cost to the Town would be
$ 3 , 669 . 00 for 1995 or approximately $ 1 , 000 . 00 per person .
Discussion :
Councilperson Steiner said that the cost of insurance is almost as
much as the payroll and asked if the we had looked at other
providers for estimates . He said he does not think that health
insurance benefits should be provided to employees who work so few
h ours .
Councilperson Schwartz said that he needs more time to think about
t he insurance and thinks the premiums are to expensive for a small
t own like Danby .
Supervisor Oltz said that the providers for small group insurance
plans is very limited .
TOWN OF DANBY BUDGET - FISCAL YEAR 1995
S upervisor Oltz reported that the Town of Danby Preliminary Budget
for Fiscal Year 1995 shows a tax increase for General , Highway ,
W ater and Fire of 3 . 41 % .
AMENDMENTS TO THE TOWN OF DANBY FISCAL YEAR 1995 PRELIMINARY BUDGET •
The Preliminary Budget was amended as follows :
General Fund Account A5010 . 100
Account No . A5010 . 100 increased $ 542 for a total of $ 30 , 000
bringing the Transportation Total to $ 55 , 400 . 00

There is no change in the total highway appropriations .

ADOPTION OF TOWN OF DANBY 1995 BUDGET
A RESOLUTION ADOPTING A BUDGET FOR THE FISCAL YEAR COMMENCING
JANUARY 1 , 1995 AND ENDING DECEMBER 31 , 1995 , MAKING APPROPRIATIONS
FOR THE CONDUCT OF TOWN GOVERNMENT AND ESTABLISHING THE RATES OF
COMPENSATION FOR OFFICERS AND EMPLOYEES FOR SUCH PERIOD

WHEREAS , The Town of Danby Town Board has met on Wednesday ,
N ovember 9 , 1994 , Town Hall , 1830 Danby Road , Ithaca , New York at
8 : 00 P . M . on the preliminary budget and heard all persons desiring
t o be heard thereon ; now , therefore be it
RESOLVED , that the preliminary budget as amended and revised and as
h ereinafter set forth is hereby adopted and that the several
amounts stated in the column titled " Adopted " in Schedule Al ,
S chedule Dl , and Schedule SW1 be and they hereby are appropriated
for the objects and purposes specified and the salaries and wages
stated in Schedule 5 of such budget shall be and are hereby fixed
at the amounts shown therein effective January 1 , 1995 .

CONSTRUCTION , REPAIR OF FACILITIES AND COMPLIANCE WITH AMERICANS
WITH DISABILITIES ACT RESERVE FUND OF THE TOWN OF DANBY " -

Supervisor Oltz presented the Town Board with a resolution to
establish a Capitol Reserve Fund for consideration .
RESOLUTION NO . 57 OF 1994
E STABLISHING THE " TOWN BUILDING CONSTRUCTION , REPAIR OF FACILITIES
AND COMPLIANCE WITH AMERICANS WITH DISABILITIES ACT RESERVE FUND OF
THE TOWN OF DANBY " UNDER SECTION 6 - C OF THE GENERAL MUNICIPAL LAW .
B y Supervisor Oltz : Seconded by Councilperson Schwartz
WHEREAS , The Town Board of the Town of Danby duly convened in
S pecial Session , Wednesday , November 9 , 1994 at the Danby Town
H all , does hereby resolve as follows :
S ECTION 1 . That there be and hereby is established a capital
reserve fund in the amount of one hundred thousand dollars
( $ 100 , 000 . 00 ) for Town Building Construction , repair of facilities
and compliance with Americans With Disabilities Act .
� I SECTION 2 . Such fund to be known as the " Town Building
Construction , repair of facilities and compliance with the
Americans With Disabilities Act Reserve fund of the Town of Danby " .
S ECTION 3 . That the estimated cost of said construction , repairs
and compliance with Americans With Disabilities Act has not been
established .
S ECTION 4 . That out of the surplus monies of said Town now on hand
for the year 1994 and not otherwise appropriated , the sum of one
h undred thousand dollars ( $ 100 , 000 . 00 ) be and the same hereby is
appropriated for the " Town Building Construction , repair of
facilities and compliance with the Americans With Disabilities Act
Reserve Fund of the Town of Danby " and the supervisor of the town

is hereby authorized , empowered and directed to transfer from
surplus funds of said Town of Danby the sum of one hundred thousand
d ollars ( $ 100 , 000 . 00 ) to the fund .
S ECTION 5 . such additional sums as may hereafter be appropriated
shall become part of the fund .
S ECTION 6 . The monies in the fund shall be deposited in a separate
bank account in the Tompkins County Trust Company . •
S ECTION 7 . The supervisor in his / her discretion , may invest the
monies in the fund in the manner provided in Section 6 - F of the
G eneral Municipal Law of the State of New York . Any interest
earned on capital gains realized on the monies so deposited or
invested shall accrue to and become part of the fund .
S ECTION 8 . No expenditures shall be made from the fund except by
authorization of the Danby Town Board pursuant to the provisions of
S ection 6 - C of the General Municipal Law of the State of New York .
S ECTION 9 . This resolution shall take effect immediately .
