Shepardson , John Shepardson , Timothy Ciaschi , John Shepardson , S r . , John Benjamin Chairperson Ken Horst called the Planning Board Meeting to order at 7 : 42 P . M . Members of the Public : S ettling of Danby 200 Year Anniversary S usan Beeners reported that the Town Historian , Susan Hautala reported at the October Town Board Meeting that 1995 is the 200 year anniversary of the settling of Danby . She hopes to plan some sort of recognition , in connection with the Danby Field Day in July . Susan Hautala is looking for ideas and suggestions of how t he Town could celebrate the settling . Town Hall Facilities Committee Up - date The Town Hall Facilities Committee is trying to complete their information on what to do with the Town Hall building . The Committee meets again on October 20 . It appears that adding to the existing building and to renovate it or to go to a completely new site , the cost would be about the same . The Committee is looking at what space may be needed for a twenty ( 20 ) year period . E loise Greene reported that adding to the present building included making it more energy efficient and preserving the historic significance that already exists . There would be a larger square footage than in the comparison of a new building . S usan reported that the Facilities Committee will forward information and a recommendation to the Town Board soon . HOVANEC SPECIAL PERMIT PROJECT RESOLUTION NO . 39 OF 1994 - Approved S EQR DETERMINATION - PROPOSED HOVANEC / SHEPARDSON SPECIAL PERMIT B y Joel Gagnon : Seconded by Eloise Greene WHEREAS , this action is the consideration of the granting of a S pecial Permit for a proposed Motorcycle Parts and Accessories S tore , proposed to be located in an existing building next to S toney Acres Western Shop , at the corner of Muzzy Road and Danby Road ( NYS Rte . 96B ) , Town of Danby Tax Parcel No . 2 . - 1 - 37 , James H ovanec , Applicant , and WHEREAS , this is an Unlisted action for which the Planning Board is acting as Lead Agency in environmental review and for which no coordinated review is required , and WHEREAS , the Planning Board , at and following Public Hearing on O ctober 19 , 1994 , has reviewed the Environmental Assessment Form J Li 4 2 Planning Board Minutes October 19 , 1994 and draft environmental review prepared by the Code Enforcement Officer , now be it RESOLVED , that the Town of Danby Planning Board , acting as Lead Agency in environmental review of this Unlisted action , makes a negative determination of environmental significance for this action . A roll call vote on the resolution resulted as follows : Farrell Aye G agnon Aye G reene Aye W eitzel Aye H orst Aye Carried Unanimously RESOLU_TION NO . 40 OF 1994 HOVANECJSHEPARDSON SPECIAL PERMIT - Approved B y Joel Gagnon : Seconded by Eloise Greene WHEREAS , this action is the consideration of granting of a Special P ermit for a proposed Motorcycle Parts and Accessories Store , proposed to be located in an existing building next to Stoney Acres W estern Shop , at the corner of Muzzy Road and Danby Road ( NYS Rte . 96B ) , Town of Danby Tax Parcel No . 2 . - 1 - 37 , James Hovanec , Applicant , and WHEREAS , this is an Unlisted action for which the Planning Board on O ctober 19 , 1994 , acting as Lead Agency in environmental review , has made a negative determination of environmental significance , and WHEREAS , the Planning Board , at and following Public Hearing on October 19 , 1994 , has reviewed a site plan and building plan submitted on September 9 , 1994 , and a written proposal dated September 6 , 1994 describing the proposed Special Permit operation , now be it RESOLVED , that the Town of Danby Planning Board grants a Special Permit for the use as proposed . A roll call vote on the resolution resulted as follows : Farrell Aye Gagnon Aye Greene Aye W eitzel Aye H orst Aye Carried Unanimously COMMUNICATIONS : Chairperson Horst reported that he has received a Newspaper Clipping from P . Corey regarding Nature ' s Song Retreat Center . ZONING ORDINANCE REVISIONS : Special_Permits - Proposed Revisions for Doublewides The Planning Board reviewed the Proposed Revisions for Doublewides . Susan said that we have no architectural design controls on stick built homes and you can build any type of structure that meets building codes . Her recommendation is that doublewides should . have_ .. a building permit process with certain standards that must be met . E loise Greene said she sees doublewides as a different kind of h ousing than a modular home . They could be moved from their location . She thinks that doublewides should be placed under the Mobile Homes section of the ordinance with areas for placement d esignated . 75 3 Planning Board Minutes October 19 , 1994 Joel said that the only benefit to having a public hearing for a special permit for a doublewide is that it gives the public an opportunity to state their views . Chairperson Horst agreed with Joel that a public hearing gives the public an opportunity to state their views but a special permit for a doublewide has never been denied under the process . Motion to Amend the Special Permit Requirement for Doublewides A motion was made by Joel Gagnon and a second was assumed by the Chair for the Planning Board to endorse a recommendation to have t he Code Enforcement Officer work out alternative language that d eletes the special permit and public hearing requirements for the citing of doublewides , and in ke , those requirements that must be bu , Wce m /-�tt e+ ' flnguage for the proposed complied with part of t� e p cols . revisions and changes is subject to approval of the Planning Board . D iscussion : B ill Farrell said that there is nothing wrong with doublewides , and there are many houses that look like doublewides . You are making affordable housing for people . Chairperson Horst and Nancy said they would like to see the language for the proposed revision as it will appear in the ordinance before Planning Board and Town Board approval . Susan reviewed the proposed new language in the proposed revisions of Section 903 - Special Conditions for Doublewide Mobile Homes with the Board . A vote on the motion resulted as follows : Carried Unanimously The Board completed their review Section A and Section B of the P roposed Zoning Ordinance Revisions . Agricultural Lot Definition S usan reported that our ordinance presently defines an agricultural lot as five ( 5 ) acres or more and there are no provisions for a barn or shed to be placed on a smaller lot . She will be preparing d raft language to make this provision parallel the State by taking out the lot size restriction . Motion to Approve - Sections A & B _of the Proposed Revisions A motion was made by Nancy Weitzel and Seconded by William Farrell that the Planning Board approve the Proposed Zoning Ordinance Revisions of Section A ( Special Permits ) and Section B ( Permit to Build ) and to send the revisions as amended on to the Town Board . A vote on the motion resulted as follows : Carried Unanimously Corrections to September 21 , 1994 Minutes Under Public Hearing Requirement for Doublewides : 1 ) Delete titles and reference to " Public Hearing Requirement " and replace with " Public Hearing Requirement for Special Permit for Doublewides . M . and read t he following Notice of Publication : " NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the Town of Danby Planning Board on October 19 1994 at 7 : 20 P . M . , 1830 ill Danby Road , Ithaca , New York to consider granting a Special Permit for a proposed Motorcycle Parts and Accessories Store , proposed to be located in an existing building next to Stoney Acres Western S hop , at the corner of Muzzy Road and Danby Road ( NYS Rte . 96B ) , Town of Danby Tax Parcel No . 2 . - 1 - 37 , James Hovanec Applicant . At such time and place all persons interested in the subject matter t hereof will be heard concerning the same . J ames Hovanec explained to the public that his proposal is for a motorcycle assessories shop and that will also sell used motorcycles . P ublic Comment : Tim Ciaschi - 1428 Danby Road - approves of the proposal and t hinks the proposed business will improve the property and be an asset to the community . J ohn Shepardson , Sr . - Ridgecrest Road - approves of the proposal but is concerned that there will be a problem with parking during III the winter months . J im Hovanec responded that there is adequate parking space along t he side of the building . Albert Shepardson - 40 Muzzy Road - approves of the proposal and said he thinks it will compliment Stoney Acres . Mr . Hovanec has assured them that the operation will not create unreasonable noise or traffic . J on Jolles - 405 Nelson Road - approves of the proposal and said t hat any business Mr . Hovanec would be involved in will be good for our community . ? 78 2 Public Hearing Hovanec October 19 , 1994 Mary Lou Hardesty - approves of the proposal and said we need new business in Danby to increase our tax base .
