October 10 , 1994 PRESENT : Supervisor Oltz Councilpersons : Roger Hile , Rosa Lee Johnson , Joseph Schwartz Howard Steiner Others Present : H ighway Superintendent - Wm . Hall Town Clerk - Carol Sczepanski S . P . C . A . Director - Pam Stonebraker Code Enforcement Officer - Susan Beeners Members of the Public : N ancy Weitzel , Elizabeth Owens - Roe , Edw . M . Roberts , Susan Hautala S upervisor Oltz called the meeting to order at 8 : 03 and led all present to the Pledge of Allegiance to the American flag . Approval of September 12 , 1994 Minutes A motion was made by Councilperson Hile and seconded by Councilperson Steiner to approve the September 12 , 1994 minutes as published . Carried Unanimously PRIVILEGE OF THE FLOOR : Supervisor Oltz reported the following : Tompkins County Youth Bureau Inter - municipal Recreation Pilot P rogram . Tompkins County Human Services Committee and the Budget & Fiscal Policy Committee have endorsed the pilot Inter - municipal Recreation Pilot Program . The Youth Bureau requested $ 46 , 000 from Tompkins County for the first year for a two ( 2 ) year program . Not all municipalities have agreed to participate in the program and only $ 40 , 000 has been included in the 1995 Proposed County Budget . Tentative 1995 Budget Town Clerk , Carol Sczepanski reported that she received the S upervisor ' s Tentative 1995 Budget and it is on file in her office . Members of the Public : Town Historian : S usan Hautala , our Town Historian , reported that the first settler in Danby arrived 200 years ago in 1795 and represents the founding o f the settling of Danby . She would like to see some special Town ✓ ecognition for the 200 year anniversary . Susan suggested an old h ome day or special activity linked to the Danby Fair . One of the suggestions she received from a resident is the rebuilding the band stand that was around the Town Hall . County Representative Report : County Representative Proto was unable to attend the meeting t onight and sent the following message : The proposed County budget for 1995 is on file at Tompkins County B udget and Finance . Members of the Board and residents may view the complete document by appointment at the Budget and Finance Office . A summary of the budget is on file in all municipalities and libraries throughout the County . COMMUNICATIONS : N otice of Meetings : 1 ) Senator John ( Randy ) Kuhl will be hosting an informal Town Meeting at the Town Hall on Tuesday , October 25 , 1994 from 1 : 00 - 1 : 30 P . M . 2 ) N . Y . S . Department of Law - Home Improvement Contractors . October 27 , 1994 from 7 : 00 - 8 : 30 P . M . , Common Council Chambers , City Hall , 108 E . Green St . , Ithaca , NY . 373 2 Town Board Minutes October 10 , 1994 3 ) Public Notice - Ithaca Tompkins County Transportation Council Meeting on October 24 , 1994 , Ithaca Holiday Inn , 7 : 30 P . M . , 4 ) Dewitt Historical Society is planning a fund raising auction for November 6 , 1994 and are soliciting donations of items that have a historical slant . Monthly Reports Received : 1 ) Highway Superintendent ' s Report - September 1994 2 ) Code Enforcement Officer ' s Report - September 1994 3 ) S . P . C . A . Report - August 1994 OTHER REPORTS : S . P . C . A . 1994 Report : P am Stonebraker , Director of Tompkins County S . P . C . A . reported that this is the first year of a three ( 3 ) year contract to provide dog control for the Town . A proposed increase of approximately $ 120 . 00 is projected for 1995 and is linked to the Consumer Price Index . H ighway Department September 1994 S upervisor Oltz read a portion of the September 1994 Highway Report . - In September the Highway Department placed rip rap on Old Town Road , double surfaced treated Old Town Village , installed d riveway pipes on Yaple Road and Comfort Road . They graded roads filled pot holes , cleaned ditches , repaired washouts from heavy ✓ ains , mowed along road sides and repaired equipment as needed . Trees were cut on Deputron Hollow Road for the turn - around for snow plows . The Town trucks and spreaders are being prepared for winter plowing and sanding . Environmental Management Council Report : E lizabeth Owens - Roe reported that she attended the August meeting o f the EMC . There was a presentation on the Ithaca - Tompkins Transportation Council Long Range Plan and the SEQR Committee ✓ eported that the County can now set their own thresholds for Type I declarations . A Committee is working on a proposal for a County law to ban burning barrels . Town Hall Building Report Susan Beeners reported that improvements and / or modifications must be made by January 26 , 1995 to the Town Hall Building to comply w ith the Americans Disability Act . The minimum areas that need to be addressed are as follows : 1 ) The handicapped ramp and railing 2 ) Switching of the interior doors 3 ) A door bell or inter - communication system between the front entrance and the Clerk ' s office 4 ) Modifications in bathrooms and locks on bathroom doors 5 ) Relocation of the water cooler . The Town must establish a procedure to provide seating for the h earing impaired and develop written policies for how we provide public services to the handicapped . There is not an accessible privacy space available for court when a small conference room is ✓ equired for confidentiality . Accessibility to the second floor o ffices will remain a problem . Facility Committee Report S usan reported that the Facility Committee evaluation of the Town H all needs is nearing completion and a recommendation will be made t o the Board soon . Planning Board Report : N ancy Weitzel reported that the Planning Board held a public h earing on September 21 , 1994 and approved of a boundary modification on a property located on Coddington Road and owned by Robert and Alice McCune . The Planing Board is reviewing proposed amendments to the Zoning Ordinance . 577' 3 Town Board Minutes October 10 , 1994 S enior Citizens Report : E dw . M . Roberts reported that the seniors may take a trip to B uffalo in December to see the " Festival of Lights " . S olid Waste Advisory Committee ( SWAC ) Report : J oel Gagnon reported that there was a joint meeting of the Solid Waste Advisory Committee and the Environmental Advisory Commission . The issue of burn barrels was addressed . It was the consensus of t he committee ( with the exception of the Chair ) that the probability of getting any kind of legislative action on regulating burn barrels is pretty slim without some convincing evidence that it is a significant problem . N EW BUSINESS : RESOLUTION NO . 53 OF 1994 MODIFICATIONS OF BUDGET TO PROVIDE FUNDS TO PAY ARCHITECTURAL FEES AND EXPENSES B y Councilperson Johnson : Seconded by Councilperson Steiner WHEREAS , an agreement was executed between the Architect , Demjamec & Associates and the Town of Danby for the schematic design of the D anby Town Hall , and WHEREAS , a voucher has been received for compensation and expenses for September in the amount of $ 154 . 35 and it is estimated that an additional amount up to $ 1190 . 11 will be vouchered in the near future , now therefore be it RESOLVED , that $ 1344 . 46 transferred from Contingency Fund Account A1990 . 4 increasing Appropriation Account A8010 . 4 by a like amount t o pay the above costs . A roll call vote on the resolution resulted as follows : H ile Aye J ohnson Aye S chwartz Aye S teiner Aye Oltz Aye Carried Unanimously RESOLUTION NO . 54 OF 1994 MODIFICATION OF CERTAIN HIGHWAY ACCOUNTS B y Councilperson Schwartz : Seconded by Councilperson Steiner WHEREAS , William Hall , Highway Superintendent , needs to modify certain highway fund accounts in order to pay expenses , and now t herefore be it RESOLVED , that $ 3712 . 00 be transferred from DA5120 . 4 to DA5110 . 4 $ 3160 . 00 be transferred from DA5120 . 1 to DA5110 . 1 $ 1000 . 00 be transferred from DA5140 . 4 to DA5110 . 4 $ 1500 . 00 be transferred from DA5140 . 1 to DA5110 . 1 A roll call vote on the resolution resulted as follows : H ile Aye J ohnson Aye S chwartz Aye Steiner Aye O ltz Aye Carried Unanimously RESOLUTION NO . 55 OF 1994 S UPPORT FOR SPEED ZONE TEST ON SOUTH DANBY ROAD B y Councilperson Steiner : Seconded by Councilperson Schwartz WHEREAS , Ward Hungerford , Tompkins County Highway Manager , has received a request from a South Danby Road resident about having V 7r 4 Town Board Minutes October 10 , 1994 t he State conduct a speed zone test for all of South Danby Road , and WHEREAS , Mr . Hungerford believes this to be a reasonable request considering the condition of the road , now be it RESOLVED , that the Town of Danby supports this request for a speed zone test on all of South Danby Road by the State , and be it further RESOLVED , that the required forms will be completed and forwarded t o Mr . Hungerford along with a certified copy of this resolution to be submitted to New York State Department of Transportation for t heir review and determination . A roll call vote on the resolution resulted as follows : H ile Aye J ohnson Aye S chwartz Aye Steiner Aye O ltz Aye Carried Unanimously Town of Danby 1995 Budget A Budget Work Session of the Town Board was scheduled for Monday , O ctober 17 , 1994 at 6 : 00 - 8 : 00 P . M . and was approved by the Board . The 1995 Tax Rate Summary will be available at the October 17 , 1994 budget meeting . S upervisor Oltz reported that the office staff has asked the Town t o consider some type of health insurance . She presented the Board with rates to supply health insurance for part - time employees working at least fifteen ( 15 ) hrs . per week . APPROVAL OF WARRANTS General Fund Warrant No . 10 of 1994 - Approved A motion was made by Councilperson Schwartz and seconded by Councilperson Hile to approve the General Fund Warrant No . 10 of 1994 , voucher numbers 343 - 377 , in the amount of $ 4 , 120 . 92 .
