The public hearing was opened at 7 : 25 P . M . by Chairperson Horst and
t he following Notice of Publication was read :
" NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the
Town of Danby Planning Board on September 21 , 1994 at 7 : 20 P . M . ,
1830 Danby Road , Ithaca , New York to consider approval of the
proposed transfer of 0 . 6 + / - acres from Town of Danby Tax Parcel
# 5 . - 1 - 1 . 2 ( 1120 Coddington Road ) to Parcel # 5 . - 1 - 9 ( 1122 Coddington
Road ) with no new development proposed . The involved lots are
located on Coddington Road near Banks Road . Robert J . & Alice R .
McCune owners / applicants :
At such time and place all persons interested in the subject matter
thereof will be heard concerning the same .

Applicant Robert McCune explained that he owns two lots that are
side by side and is selling . 06 acre to move the property line
around the pond .
No public appeared before the Planning Board concerning this
proposal .
Motion to Close Public Hearing :
A motion was made by Joel Gagnon and seconded by Nancy Weitzel to
close the Public Hearing at 7 : 28 P . M .

The meeting was called to order by Chairperson Horst at 7 : 30 P . M .
Chairperson Horst addressed the Planning Board with the following
comments :
1 ) Ken thanked Nancy Weitzel publicly for the job she has done as
Chairperson to the Planning Board over the past several years .
S he deserves a vote of thanks from all of us on the Planning
Board and he appreciates her willingness to act as Vice -
Chairperson in his absence .
2 ) He hopes the Board looks at all of our activities as a team
approach and asked them to stand behind the Board ' s decisions
that are made as a Planning Board body . He said this includes
not only our reactions before the public , but our reactions to
t he press .
3 ) Meeting starting time and completion of the meeting will be
punctual . Agendas will be set with an effort made to
accomplish all business and adjourn meetings by 10 : 00 P . M .
Approval of Minutes :
The August 10 , 1994 Planning Board Public Hearing Minutes and of
t he Regular Meeting were approved with minor corrections .
COMMUNICATIONS :
1 ) Letter from Phyllis Corey dated September 13 , 1994 - regarding
t he Boardman property and activities .
2 ) Copy of brochure - received September 16 , 1994 - advertising
N ature ' s Song Retreat Center .
3 ) A Community Meeting with Senator John ( Randy ) Kuhl at the Town
H all Tuesday , October 25 , 1994 at 1 : 00 P . M . All public is
invited .
RESOLUTION NO 37 OF 1994
S EQR DETERMINATION , PROPOSED MCCUNE BOUNDARY MODIFICATION

WHEREAS , this action is the consideration of approval of the
proposed transfer of 0 . 6 + / - acres from Town of Danby Tax Parcel
# 5 . - 1 - 1 . 2 ( 1120 Coddington Road ) to Parcel # 5 . - 1 - 9 ( 1122 Coddington
Road ) with no new development proposed . The involved lots are
located on Coddington Road near Banks Road . Robert J . and Alice R .

WHEREAS , this is an Unlisted action for which the Planning Board is
acting as Lead Agency in environmental review and for which no
coordinated review is required , and

and draft environmental review prepared by the Code Enforcement

RESOLVED , that the Town of Danby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .

RESOLUTION NO 38 OF 1994
MCCUNE BOUNDARY MODIFICATION - APPROVED

WHEREAS , this action is the consideration of approval of the
proposed transfer of 0 . 6 + / - acres from Town of Danby Tax Parcel
# 5 . - i - 1 . 2 ( 1120 Coddington Road ) to Parcel # 5 . - 1 - 1 - 9 ( 1122
Coddington Road ) with no new development proposed . The involved
lots are located on Coddington Road near Banks Road . Robert J . and
Alice R . McCune owners / applicants , and
WHEREAS , this is an Unlisted action for which the Planning Board
on September 21 , 1994 , acting as Lead Agency in environmental
review has made a negative determination of environmental
significance , and
WHEREAS , the Planning Board , at and following Public Hearing on
September 21 , 1994 , has reviewed a map entitled " SURVEY FOR ROBERT
AND ALICE R . MCCUNE , by MANZARI & REAGAN LAND SURVEYORS , DATED 7 -
1994 " , showing the proposed subdivision , now be it
RESOLVED , that the Town of Danby Planning Board grants Preliminary
and Final Subdivision approval to the proposed subdivision as
presented , subject to the submission of a final survey map for such
lot , suitable for filing , for approval by the Planning Board
Chairperson .

N ature ' s Song Retreat Center
Chairperson Horst read a letter addressed to the Planning Board
from Phyllis Corey and dated September 13 , 1994 regarding " Nature ' s
S ong Retreat Center " . Ms . Corey expressed concern about the
advertising in local papers for the use of the conference center
and that the seminars are open to the public as well as
professional persons .
Susan Beeners reported that she has looked carefully at the
proposal submitted by Barbara Blanchard for the " Nature ' s Song
Retreat Center " and the minutes of meeting . The Planning Board
approved of a conference building described as a facility to be
u sed by mental health professionals . There was no approval for
o vernight lodging or camping .

The Code Enforcement Officer has responded to Ms . Boardman
regarding use of the building , maximum occupancy , and group
lodgings .
IIIThe Planning Board • suggested a copy of the response be sent to Ms .
Corey .
Hovanec Sketch Plan Review
J im Hovanec submitted a Proposal dated 9 / 6 / 94 for a motorcycle
parts and accessory store to be located at 1429 Danby Road , Ithaca ,
N ew York .
J im Hovanec addressed the Planning Board and explained the
proposal is to convert the existing warehouse at 1429 Danby Road
into a showroom and retail space for the sale of used motorcycles ,
motorcycle parts and accessories . Motorcycle inspections , oil
changes and small tuneups would be part of the service and the
business will require a New York State Motor Vehicle Sales Permit .
There is no proposed change to the exterior of the building and
only minor remodeling of the interior .
S usan Beeners said that the property is located in a " Commercial
Zone B " and this type of use requires a public hearing and the
issuance of a Special Permit .
The Planning Board reviewed the plan for the motorcycle parts and
accessory store and found the information complete enough to
schedule a public hearing .
Motion to Schedule Public Hearing - Hovanec Proposal
A motion was made by Joel Gagnon and seconded by Arch Dotson that
P lanning Board schedule a public hearing for the Hovanec Proposal
for October 19 , 1994 at 7 : 20 P . M .
Carried Unanimously
Review - Possible Amendments to the Zoning Ordinance
J oel Gagnon asked the Planning Board to consider an additional
amendment to allow for the construction of an agricultural building
on a residential lot to house animals .
S usan presented the Board with possible legislative amendments to
t he Zoning Ordinance .
The Board reviewed proposed additions / revisions to the Danby Zoning
O rdinance for the following items :
1 ) Notification Procedures for Site Plans , Special Permits ,
Appeals
2 ) Posting of Public Notice Signs
3 ) Special Conditions for Doublewide Mobile Homes
4 ) Appeal of Planning Board Decision
Other Items :
Public Hearing Requirement for Doublewides
Public Hearing Requirement for Doublewides discussion raised the
following question and comments :
Is Planning Board approval and public hearing really necessary for
double wide mobile homes ?
Comments :
1 ) It is not necessary for a public hearing but it lets the
Planning Board know where they are located .
2 ) It gives residents a chance to express their views .
3 ) The outcome is always the same as building specifications are

4 ) All requests and approvals have been in character with the
neighborhoods .
5 ) Should the Board make a recommendation to the Town Board that
doublewides do or do not require a public hearing ?
Motion to table discussion on Public Hearing Requirement for
Doublewides
A motion was made by Arch Dotson and seconded by Nancy Weitzel to
table discussion relative to the public hearing requirement for
special permit approval for doublewides until the October meeting .
Carried Unanimously
Motion to Send Proposed Zoning Ordinance Revisions to Town Board
A motion was made by Joel Gagnon and seconded by Arch Dotson to
send the proposed zoning ordinance revisions as reviewed by the
Planning Board with a few minor changes to the Town Board for their
consideration : 1 ) Notification Procedures ; 2 ) Special Permits ;
3 ) Appeal of Planning Board Decision ; 4 ) Posting of Public Notice .
Carried Unanimously
