NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the Town of Danby Planning Board on August 10 , 1994 at 7 : 15 P . M . , 1830 D anby Road , Ithaca , New York to consider approval of the proposed subdivision of a 0 . 5 + / - acre tract from Town of Danby Tax Parcel N o . 7 . - 1 - 92 . 21 , 7 . 71 acres total , with such tract to be consolidated with Tax Parcel No . 7 . - 1 - 88 , 1 + / - acre total . The properties are located at 1767 Danby Road , north of Hornbrook Road . The purpose of the subdivision is to separate an existing dwelling from an existing workshop / office building . M . „ . ; a . . . . : � D iscussion - Final Site Plan - Hardesty P aul Norton - 2381 Danby Road arrived after the public hearing was closed and said that he was interested in the type of lighting proposed in the Hillview Terrace Mobile Home Park Expansion . J oel Gagnon responded that the plan shows lighting at each intersection and at the end of each cul - de - sac at approximately every 200 feet . D iane Sherwood - 2352 Danby Road - is concerned that the run off along a hedge row along her property will increase . Mary Lou Hardesty reported that the hedge row is not a natural drainage point . J oel Gagnon asked where the fill was going to come from for the leach fields . P aul Seeley responded that the fill required for the leach fields is a special material that must be approved by the Tompkins County H ealth Department . S usan reported that the Department of Transportation ( DoT ) has made minor modifications for the driveway , a Sewage Pollution Discharge E limination System Permit ( SPDES ) has been issued , and the Health D epartment has essentially approved the engineering site plans for t he project . The Health Department before final approval will need t o know what the Town of Danby has approved . Two ( 2 ) water quality t ests are being done today . J oel Gagnon asked if anything is proposed for the landscaping surrounding the Sherwood ' s property and what would be done to reduce the noise created by residents using their mailboxes . f 26 5 3 P) .mnnipg Board Y Minutes ' � r T ^ - August 16 , 1994 Mary Lou Hardesty said that she suggested at a previous meeting that Mrs . Sherwood obtain a list of the shrubbery that is planned for the project and that she help design her own buffer area . Arch Dotson suggested that the Planning Board request the developer to take into account these concerns and if objections or problems are raised at a future time the Town could take some action . Ric Dietrich asked when the neighbors would have input into the landscaping , berms , drainage , etc . Arch Dotson stated " it is not the role of the Planning Board to landscape and design . This Board does not know enough about the site and situation to suggest particular solutions . The Site Plan Review is for reasonableness and design . It is not for detail involving landscape particulars . " Susan Beeners reported that the purpose of Site Plan Review is to look at the engineering and the landscaping to see that the t echnical approvals are being taken care of as much as possible . RESOLUTION NO . 33 1994 S EQR , PROPOSED HILLVIEW TERRACE MOBILE HOME PARK EXPANSION - FINAL S ITE PLAN B y Joel Gagnon : Seconded by Don Schaaf WHEREAS , this action is the Consideration of Final Site Plan Approval for the proposed Hillview Terrace Mobile Home Park E xpansion , proposed to include 31 new lots for single and doublewide mobile homes , with access from Danby Road ( NYS Route 96B ) , northwest of South Danby Road , located in Planned Development Zone 2 , on Town of Danby Tax Parcel No . 20 . - 1 - 4 . 2 , and WHEREAS , this is a Type I action for which the Town of Danby P lanning Board is acting as Lead Agency in environmental review , and for which the Tompkins County Division of Environmental Health , The . The final locations of mobile homes , parking spaces , and lot boundaries shown on the final site plans may be subject to field adjustment provided that there is no deviation from the minimum criteria described in " Typical Lot , Hillview Terrace Mobile Home Park Expansion " , dated July 19 , 1994 . 2 . The Final Site Plan is the same as the General Site Plan as approved by the Town Board on July 13 , 1994 . RESOLUTION NO . 35 OF 1994 S EQR DETERMINATION , LAURENSON PLANNED DEVELOPMENT ZONE FINAL SITE PLAN B y Joel Gagnon : Seconded by Arch Dotson WHEREAS , this action is the Consideration of Final Site Plan Approval for the proposed construction of a 4 - unit dwelling in P lanned Development Zone 16 , which Zone was established by the Town B oard on July 13 , 1994 , on a portion of former Town of Danby Tax P arcel No . 13 . - 1 - 8 , and 2, 67 5 Planning Board Minutes August 10 , 1994 WHEREAS , the Town of Danby Planning Board is acting as Lead Agency in the Type I review of the final site plan , and had on March 16 , 1994 upon review of the Long Environmental Assessment Form for the proposed Planned Development Zone , recommended to the Town Board t hat a negative determination of environmental significance be made for the proposed Zone , and WHEREAS , the revision in acreage from 11 + / - to 6 . 9 + / - acres for t he project site does not represent a significant environmental impact given the lack of developability of the majority of the parent parcel , WHEREAS , the final site plans , entitled " General Site Plan ' B ' , and " General Site Plan ' C ' dated March 16 , 1994 , revised June 29 , 1994 , are essentially the same as those reviewed and recommended for approval by the Planning Board on March 16 , 1994 , NOW , THEREFORE , IT IS RESOLVED , that the Town of Danby Planning Board , acting as lead agency in environmental review of this Type I action , make and hereby does make a negative declaration of environmental significance with respect to the approval of the aforementioned final site plans . A roll call vote on the resolution resulted as follows : D otson Aye Farrell Aye G agnon • Aye Greene Aye S chaaf Aye W eitzel Aye Carried Unanimously RESOLUTION NO . 36 OF 1994 LAURENSON PLANNED DEVELOPMENT ZONE FINAL SITE PLAN B y Joel Gagnon : Seconded by Arch Dotson WHEREAS , this action is the Consideration of Final Site Plan Approval for the proposed construction of a 4 - unit dwelling in P lanned Development Zone 16 , which Zone was established by the Town B oard on July 13 , 1994 , on a portion of former Town of Danby Tax P arcel No . 13 . - 1 - 8 , and WHEREAS , the Town of Danby Planning Board is acting as Lead Agency in the Type I review of the final site plan , and has , on August 10 , 1994 made a negative determination of environmental significance for the proposed final site plans , NOW , THEREFORE , IT IS RESOLVED , that the Town of Danby Planning Board grants Final Site Plan approval to two alternative plans entitled General Site Plan ' B ' , and " General Site Plan ' C ' dated March 16 , 1994 , revised June 29 , 1994 , with the following conditions : a . That no building permit may be issued until necessary permits are granted by the Tompkins County Health Department and , as appropriate , by the New York State Dept . of Environmental Conservation . b . That a shrub or tree buffer be established through the use of either existing or new vegetation to screen the proposed parking areas from Danby Road . 2 ;_. 6 Planning Board Minutes August 10 , 1994 A roll call vote on the resolution resulted as follows : D otson Aye Farrell Aye G agnon Aye G reene Aye Schaaf Aye Weitzel Aye Carried Unanimously Other Business : Up - date on the " Camelot Subdivision " Proposal Susan Beeners reported that Mr . Harrington requested a waiver from Tompkins County of the distance requirement between intersections and it has been approved . He cannot confirm the distance of the ✓ oad from the intersection until there is a completed topo and there is a survey of the wetlands . She said that she must check w ith the West Danby Water District as to the availability of adequate water . Memo to Planning Board - From Town Board A memo dated August 6 , 1994 was submitted to the Planning Board ✓ egarding Public Hearings on Final Site Plans . " When Final Site Plans are submitted to the Planning Board for approval and there are no substantial changes between the General Site Plan and the Final Site Plan , no public hearing shall be called . If the Planning Board feels there are substantial changes and call a public hearing , only changes in the plan shall be addressed . This will help insure a timely processing of proposed projects . " Councilperson Steiner explained the memo from the Board was in response to many concerns related to public hearings . Many issues that come up at additional hearings only serve to antagonize , put people on the defensive and bring up issues that have been reviewed repeatedly . He said his interpretation of the zoning law is that if the final site plan differs significantly from a general plan and / or local law that was approved by the Town Board , then it needs a public hearing .
