The public hearing was opened at 7 : 30 P . M . by Supervisor Oltz and
t he following Notice of Publication was read by the Town Clerk .
" NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the
Town of Danby Town Board on June 13 , 1994 at 7 : 30 P . M . , 1830 Danby
Road , Ithaca , New York to consider the Adoption of a Local Law to
Amend the Zoning Ordinance to Establish a Planned Development Zone
proposed to contain a proposed new four ( 4 ) unit dwelling and
further , to approve a General Site Plan for such zone . The
proposed zone would consist of a 11 + / - acre portion of Town of
D anby Tax Parcel No . 13 . - 1 - 8 , located on Danby Road northeast of
S outh Danby Road . Rudy Laurenson , Applicant
At such time and place all persons interested in the subject matter
t hereof will be heard concerning the same .
A regular meeting of the Town Board will follow the Public Hearing .

Affidavit of Neighborhood Notification was received .
Code Enforcement Officer reported that it is necessary to schedule
a new public hearing for this proposal due to an acreage
• discrepancy in the local law and the public hearing notice . The
description is in error and the acreage description is 6 + / - acres
not 11 + / - acres .
Mr . Laurenson addressed the Board with his concern that the
proposal has taken several months and he will not be able to
complete the project this season . He was not notified until 7 : 00
P . M . tonight that this hearing would be canceled or rescheduled .
Susan Beeners said that the public hearing must be rescheduled due
to a technical issue and the local law must reference accurate
acreage .
Members of the Public :
Richard Moore - Muzzy Road - boarders Mr . Laurenson ' s property and
asked if there was a property restriction to prohibit building on
the proposed site .
Susan Beeners explained that to build a four ( 4 ) unit dwelling the

property must be rezoned .
E dw . M . Roberts - Bald Hill Road - feels it is a shame that this
proposal has been delayed .
Rudy Laurenson requested that the Town present him with a written
notice of exactly what he needs to present for the public hearing .
H e requested that the public hearing be held on July 13 , 1994 at
7 : 30 P . M .
S upervisor Oltz asked the Code Enforcement Officer to confirm that
t he information would be received by July 13 , 1994 .
Motion to Adjourn Public Hearing :
A motion was made by Supervisor Oltz and seconded by Councilperson
Schwartz to adjourn the public hearing to Wednesday , July 13 , 1994
at 7 : 30 P . M .

S upervisor Oltz called the meeting to order at 8 : 00 P . M . and led
all present to the Pledge of Allegiance to the American flag .
Approval of May 9 , 1994 Town Board Minutes
A motion was made by Councilperson Mile and seconded by
Councilperson Steiner to approve the May 9 , 1994 Board Meeting
Minutes as published .
Carried Unanimously
ADDITIONS TO THE AGENDA :
S upervisor Oltz requested the addition an item to consider
retaining professional consulting services fora Town Hall Facility
S tudy . No Board member objected ,
PRIVILEGE OF THE FLOOR :
Councilperson Schwartz reported that the Youth Commission has
elected the following officers :
Charles White - Chairman
J ames Holley - Deputy Chairman
P atricia Myers - Secretary
P atricia Blakeslee - County Representative
Town Clerk Carol Sczepanski urged the Town Board not to endorse a
proposal from the S . P . C . A, for the licensing of cats in Tompkins
County .
County Representative Report :
Representative Proto reported on the following :
1 ) Tompkins County has applied for a grant to aid first time
homebuyers ;
2 ) County Budget --- A Special Committee has been appointed to
review the County Budget . The committee ( BRAC ) will schedule
meetings in individual townships to explain the County budget
process .
3 ) Hillview Road Landfill - Authorization to proceed with the
contract for the evaluation of the Hillview Road Landfill
site .
4 ) Flow Control - resolution passed by County to ask Congress to
change the flow control legislation at the Federal level .
5 ) Cats - is interested in hearing from the Town of Danby
regarding the licensing of cats .
6 ) Comfort Road Bridge - scheduled for repair in 1995 .

7 ) Committee Appointments - Town of Danby recommendations to
Tompkins County Planning Board and Hillview Road Advisory
Committee approved .
8 ) Solid. Waste - Mr . Proto reported that he is preparing a report
and recommendations regarding the handling of recyclables and
the projected revenue for the Tompkins County Processing
Facility .
MEMBERS OF THE PUBLIC :
Charles White - Durfee Hill Road - would like to know when Durfee
Hill Road would be completed . He is aware that the Town is
working on the road at this time . He is concerned with loose stone
o n the roadway .
H ighway Superintendent Hall reported that the Town is preparing the
base on Durfee Hill at this time and he expects to start the oil
and stone surface the week of July 11 , 1994 .
D ave Pochily - Durfee Hill Road - concerned that his road is not
✓ epaired at this time .
Audrey Chaffee - Durfee Hill Road - reported that she thinks the
✓ oad conditions on Durfee Hill damaged a tire on her car .
Emery Guest - German Cross Road - reported to the Board that
speeding traffic on German Cross Road is a dangerous situation . He
✓ eferred to the petition submitted by his neighborhood residents
containing 113 signatures asking the Towns of Danby and Dryden to
start proceedings to reduce the speed limit on German Cross Road to
t hirty - five ( 35 ) miles per hour .
E d Roberts - Bald Hill - walks on Bald Hill Road mornings and
traffic there exceeds the thirty - five mile per hr . speed limit . He
would like to see more enforcement of posted speed limits .
ADDITION TO THE AGENDA :
S upervisor Oltz requested that the German Cross Road speed limit
issue be added to the Agenda under New Business . No Board member
o bjected .

S enior Citizens Report - Edw . M . Roberts reported that the Senior
Citizens have planned trips for the summer .
P lanning Board Report :
Chairperson Weitzel reported that the Planning Board will hold two
( 2 ) public hearings in June and will act on the Nature ' s Song
Retreat Center proposal at the June 15 , 1994 meeting .
Fire District Report :
W illiam Genter reported the West Danby Fire Department Building
project is nearing completion .
S olid Waste Advisory Committee ( SWAC )
J oel Gagnon reported that SWAC passed a motion in support of a
t hirty ( 30 ) day Stay of the Action until an independent analysis is
completed in the financial assessment of the Solid Waste Recycling
Center .

OLD BUSINESS :
Supervisor Oltz reported the Town has received the following :
1 ) A letter from Senator Kuhl concerning the 1994 - 95 CHIPS Funds .
The Town will receive $ 74 , 000 for CHIPS .
2 ) ACC Franchise Fees for 1993 have been received and were $ 100
over budget .
3 ) A three ( 3 ) year Revocable License for Jennings Pond for 1994
• - 1996 .
Mowing of Cemeteries :
D avid Krebs has signed a contract to mow the Town cemeteries for
t his summer ( 1994 ) .
N EW BUSINESS :
RESOLUTION NO . 38 OF 1994
REQUEST TO TOMPKINS COUNTY TO DELAY DECISION ON THE CONSTRUCTION OF
THE TOMPKINS COUNTY TRASH TRANSFER STATION
WHEREAS , the United States Supreme Court has recently rendered a
d ecision concerning the constitutionality of flow control laws for
t he regulation of trash hauling , and
WHEREAS , the impact of the Court ' s decision may well seriously
effect the trash hauling system within Tompkins County , and
WHEREAS , the Tompkins County Board of Representatives is
considering the construction of a county trash transfer station in
t he City of Ithaca , it is
RESOLVED , that the Town Board of the Town of Danby request the
Tompkins County Board of Representatives delay a decision on the
construction of the County trash transfer station until such time
as the County may assess the effect of the recent United States
Supreme Court decision on trash hauling within the County .

Appointment to the Planning Board - Approved
A motion was made by Councilperson Schwartz and seconded by
Councilperson Hile to re - appoint Nancy Weitzel of 20 West Miller
Road , Ithaca , New York to serve on Town of Danby Planning Board .
The seven ( 7 ) year term begins on July 1 , 1994 and expires on June
30 , 2001 .

The five ( 5 ) year term begins on July 1 , 1994 and expires on June
30 , 1999 .

E NVIRONMENTAL MANAGEMENT COUNCIL REPRESENTATIVE RECOMMENDATION FOR
THE TOWN OF DANBY - Approved
A motion was made by Councilperson Hile and seconded by
Councilperson Steiner to recommend Elizabeth Owens - Roe , 1820 Danby
Road , Ithaca , New York 14850 as the Town of Danby Representative
o n the Tompkins County environmental Management Council for a term
beginning immediately and ending December 31 , 1995 .

RESOLUTION NO . 39 OF 1994
RETAINING PROFESSIONAL CONSULTING SERVICES FOR TOWN HALL FACILITY
S TUDY_
B y Councilperson Rile : Seconded by Councilperson Schwartz
WHEREAS , the Town of Danby is in need of improved facilities for
Town Hall functions , and
WHEREAS , the Town Hall Facility Committee has , upon approval of the
Town Board , issued a Request for Proposals for consulting services
✓ elated to a Town Hall Facility Study , and
WHEREAS , following review of several proposals and the interview of
several consultants , the Facility Committee has recommended the
✓ etention of the firm of Demjanec & Associates , Architects for such
a study , and
WHEREAS , the Town Board has interviewed Peter Demjanec , firm
principal , on June 8 , 1994 and has reviewed materials relevant to
t he Study , therefore , it is
RESOLVED , that the Town Board approves the retention of Demjanec &
Associates , Architects for professional consulting services
generally as described in " Services as Identified in May 11 , 1994
Refined Work Scope " , as submitted by said firm , conditional upon
final approval by the Town Attorney of an Agreement between
D emjanec & Associates , Architects , and the Town of Danby , and be it
further
RESOLVED , that the Town Board authorizes the Town Supervisor to
e xecute said Agreement .
D iscussion :
Supervisor Oltz asked the Code Enforcement Officer to explain the
cost of the proposed consulting service .
S usan Beeners reported that the cost for the consulting service
would be $ 4 , 850 . 00 .
S ection 3 . 3 of the proposed agreement were discussed .

RESOLUTION NO . 40 OF 1994
REQUEST FOR REDUCED SPEED LIMIT ON GERMAN CROSS ROAD
B y Councilperson Schwartz : Seconded by Councilperson Hile
WHEREAS , German Cross Road is a populated road with an unposted
speed limit , and
WHEREAS , fifty - five ( 55 ) miles per hour presents an unsafe
environment for German Cross Road residents and motorists using
said road , and
® WHEREAS , the Town of Danby Town Board has received a petition
signed by 113 residents requesting a posted speed limit on German
Cross Road , be it
RESOLVED , that the Town of Danby requests Tompkins County Highway
D epartment and the New York State Department of Transportation to
reduce the speed limit on German Cross Road in the Town of Danby to
t hirty - five ( 35 ) miles per hour .

and a Used Tractor
A motion was made by Councilperson Schwartz and seconded by
Councilperson Hile that the Town of Danby Town Board authorizes
Highway Superintendent William Hall to advertise for bids for the
purchase of one ( 1 ) used detachable gooseneck trailer , one ( 1 ) plow
wing , and one ( 1 ) used tractor .
