TOWN BOARD MINUTES

Supervisor Oltz called the meeting to order at 8 : 00 P . M . and led
all present to the Pledge of Allegiance to the American flag .
Correction to April 11 , 1994 Minutes :
Resolution # 27 - delete ( Jr . )
Approval of Minutes - March 30 , 1994 and April 11 , 1994
A motion was made by Councilperson Schwartz and seconded by
Councilperson Johnson to approve the March 30 , 1994 Town Board
Minutes as published and the April 11 , 1994 Minutes as corrected .
Carried Unanimously
Privilege of the Floor :
Councilperson Schwartz reported that he has heard from many
residents on Durfee Hill Road regarding the condition of the road .
They have conveyed to him that they do not think their road is more
important than others but would like to see one project completed
before another has been started .
Councilperson Johnson responded that in relation to the road
situation , it is her understanding that as elected officials the
Town Board appropriates money for the Highway Department . They do
not have any control over the department . She suggested that the
Board meet with Mr . Hall to find out what his priorities are and
what resources he has to work with .
Supervisor Oltz reported Highway Superintendent Hall could not
attend tonight ' s meeting due to a death in the family .
Supervisor Oltz reported that due to the lateness of the State
Budget the Town has not received the first quarter CHIPS payment .
County Representative Report :
Representative Frank Proto reported on the following :
1 ) County Budget - working to reduce the proposed tax increase
for 1995 .
2 ) Better Housing for Tompkins County - Federal funds secured for
first time home buyers . ( Assistance based on income . )
3 ) Youth Services - Meeting scheduled for Tuesday , May 17 , 1994
at noon .
4 ) Observation Platform - Plans to build the observation platform
may be dropped .
5 ) Fall Clean - up Day for 1994 may be scheduled .
6 ) Local Board of Assessment Board of Review for Danby is May 17 ,

1994. - - will review the requests at the County Assessor ' s
office .
7 ) Comfort Road Bridge - - may be scheduled for design review and
replacement in 1995 .
8 ) E - 911 - proposal for E - 911 expected to be voted on soon .
9 ) Sanitary Code - County will hold a public hearing regarding
the County Sanitary Code in June 1994 .
10 ) Bus Shelters - one or more bus shelters will be built on 96B .
11 ) Solid Waste Advisory Committee Meeting - discussion regarding
continuing landfill investigations at the Hillview Landfill
site .
Board of Education Meeting Announcement
Councilperson Johnson reported that the Board of Education will
meet Tuesday , May 19 , 1994 at the Ithaca High School Cafeteria . The
Agenda includes a vote on the use of the Danby School and a first
hearing on the Superintendent ' s proposed budget .
Privilege of the Floor
Edw . Inman - Board of Zoning Appeals Chair - thanked the Board for
the privilege of attending training meeting this past weekend and
reported that it was informative .
Mary Lou Hardesty - 50 South Danby Road - asked for Supervisor Oltz
it she had received her letter to the Board dated May 9 , 1994 .
Supervisor Oltz responded that the letter was et< received .
Elizabeth. Owens - Roe - referred to the proposed expansion of the
trailer park on South Danby Road . She reported that at the last
meeting she attended , the perception seemed that the Town is voting
on the expansion . She believes that it already was approved , and
that the concerns and questions were answered by fairly thorough
analysis by the engineers , etc .
Residents of Durfee Hill Road - Dave Pochily , Nancy Blacken ,
Charles and Betty White , Jim and John Turk , Robert Blackeny , Edw ,
VanDusen , and Jon Mosher addressed the Town Board with comments and
concerns regarding the condition of Durfee Hill Road . They
reported that the dust created by the dirt road is unbearable , the
surface was removed last year and drainage work is not started at
this time . They asked what section will be surfaced , when will
work start , and if there is a plan for repair and maintenance .
Supervisor Oltz reported that she received a letter from Fred Moore
of Durfee Hill road and he shares the same concerns .
Supervisor Oltz responded that due to a death in his family Mr .
j Hall is unable to be here and read the following statement from
Supervisor Hall dated May 9 , 1994 : " When the County put services
out for bid , the bid for drainage was omitted . Drainage was the
main reason that I wanted to bid services with the County . We hope
to have this straightened out shortly . Meanwhile I have been
contact with Bill Baker and he will start Durfee Hill Road as soon
as he finishes the drainage in the area he is working , hopefully
within the next couple of weeks . "

3 ) Request from Tompkins County - someone is needed to serve on
the Tompkins County Environmental Management Committee .
4 ) Letter from Fire Commissioners - May 28 , 1994 - re condition
of road at Fire Department site .

Code Enforcement Office April 1994 report . •
Supervisor Oltz reported that she attended the April 1994 Community
Council Meeting .
L icensing Cats :
Supervisor Oltz received a call from Jack Little , Treasurer of the
S . P . C . A regarding the licensing of cats . She asked the Board ' s
✓ eaction .
Councilperson Schwartz said he thinks cats should be required to
h ave rabies shots .
Councilperson Johnson responded that cats can be a problem to
n eighbors . Licensing cats may have some merit and may control the
n umber of cats within a household .
Representative Proto reported that Jack. Little approached the
H ealth Committee with a request from the S . P . C . A . for funding to do
a study . They are asking for input from municipalities .
P lanning Board Report :
Chairperson Nancy Weitzel reported that the Planning Board will
hold two ( 2 ) public hearings at their next meeting : I ) A
subdivision proposal for four ( 4 ) lots on the northeast corner of
W est King and Yaple Road ; 2 ) a special permit application for a
proposed Conference Center at 217 Peter Road . The Planning Board
h eld three ( 3 ) public hearings on April 20 , 1994 . The Board
approved the Ferris one lot subdivision located on Danby Road and
granted a Special Permit to place a doublewide on the lot and
approved the Sackett two ( 2 ) lot subdivision on Hornbrook Road . The
P lanning Board will continue their review of the " Camelot
S ubdivision " proposal .
S olid Waste Advisory Committee ( SWAC )
Joel Gagnon reported that there is concern that if the County has
a fall clean - up day that it should be done in a way that maximizes
t he opportunity for reuse and recycling . Joel was elected chair of
t he Solid Waste Advisory Committee . A committee was appointed to
review the proposals for the Central Processing Facility .

Appointment to County Youth Board
RESOLUTION NO . 30 OF 1994
TOMPKINS COUNTY YOUTH BOARD APPOINTMENT
By Supervisor Oltz : Seconded by Councilperson Schwartz
RESOLVED , that the Town of Danby Town Board recommends the
appointment of Patricia B _lakesley of 83 Gunderman Road , Ithaca , New
York to the Tompkins County Youth Board .
A roll call vote on the resolution resulted as follows :

RESOLUTION NO . 33 OF 1994
APPOINTMENT TO TOWN BOARD
By Supervisor Oltz : Seconded by Councilperson Hile
WHEREAS , a resignation letter was submitted to the Town Clerk on
April 25 , 1994 from Councilperson Gail Miller effective the end of
April 1994 , and
• WHEREAS , a vacancy exists on the Town Board , and
WHEREAS , the Town Board on May 9 , 1994 interviewed residents who
are interested in filling the vacancy , now be it
RESOLVED , that the Town of Danby Town Board appoint Howard Steiner
of 1050 Coddington Road , Ithaca , New York to the Town Board to fill
a vacancy created by the resignation of Councilperson Gail Miller ,
and be it further
RESOLVED , that the appointment takes effect immediately and expires
on December 31 , 1994 .

N ewly appointed Councilperson Steiner was administered the " Oath of
O ffice " by the Town Clerk .

H ardesty Proposal - Local Law
S upervisor Oltz requested that the Town Board set a public hearing
date to hear the Hardesty Proposal and to consider the Adoption of
a Local Law to Amend the Zoning Ordinance . She reported that a
Special Meeting of the Town Board will follow the public hearing
and a decision on the proposal would be made .
RESOLUTION NO . 31 OF 1994
PUBLIC HEARING DATE - HARDESTY PROPOSAL
B y Supervisor Oltz : Seconded by Councilperson Hile
RESOLVED , that the Town of Danby Town Board schedule a public
hearing for Wednesday , June 1 , 1994 at 6 : 30 p . m . to consider
Adoption of a Local Law to Amend the Zoning Ordinance to Establish
a Mobile Home Park Planned Development and a Residential Planned
Development within Planned Development Zone 2 , to Modify the
B oundaries of such Zone , and further , to approve a General Site
P lan for such zone located southwest of the intersection of Danby
Road ( Rte . 96B ) and South Danby Road , on Town of Danby Tax Parcels
# 20 . - 1 - 4 . 2 and 20 . - 1 - 4 . 5 . Paul and Mary Lou Hardesty , Owners .

approval of a General Site Plan and establishment of a Planned
D evelopment zone and a Proposed Local Law to Amend the Zoning
O rdinance to Establish a Planned Development Zone comprised of a
portion of Town of Danby Tax Parcel No . 13 . - 1 - 8 , located on the
n orth side of Danby Road ( Rte . 96B ) east of South Danby Road .

RESOLUTION NO . 34 OF 1994
APPOINTMENTS TO THE LOCAL ADVISORY BOARD OF ASSESSMENT REVIEW

WHEREAS , the Local Advisory Board of Assessment Review for the Town
o f Danby is scheduled to meet from 3 p . m . to 7 p . m . on Tuesday ,
May , 17 , 1994 at the Danby Town Hall , and
WHEREAS , the Town of Danby has been requested to appoint two ( 2 )
people to serve on the Local Board of Review , now be it
RESOLVED , that the Town of Danby Town Board appoint Elizabeth
Owens - Roe of 1820 Danby Road , and Howard Steiner of 1050 Coddington
Road to serve on the Local Board of Review at the time and place
indicated .

RESOLUTION NO . 35
ZONING FOR SENIOR HOUSING
B y Councilperson Johnson : Seconded by Councilperson Steiner
WHEREAS , there is a need for affordable housing for senior citizens
in Danby , and
WHEREAS , the Code Enforcement Officer has reported that temporary
h ousing such as an " Elder Cottage " or " ECHO unit " would most likely
✓ equire a Special Permit from the Planning Board , and
WHEREAS , standards and procedures are needed to expedite the
provision of such housing , now , therefore , it is •
RESOLVED , that the Town Board requests that the Planning Board
draft appropriate modifications to the Zoning Ordinance to
streamline procedures related to senior citizen housing such as
" Elder Cottages " and " ECHO units " .

Request to Purchase Law Books :
S upervisor Oltz reported that a Town Justice has offered to buy law
books he frequently needs for research with his salary and asked
t he Board their opinion . Supervisor Oltz said that she personally

t hinks the Town should purchase the books .
D iscussion followed .
Councilpersons suggested that Supervisor Oltz discuss the issue
with both Town Justices .
Mowing of Town Cemeteries :
Supervisor Oltz reported that she has advertised for someone to mow
• the cemeteries and received two ( 2 ) replies . She will appoint
someone soon if there are no objections .
There were no objections from the Board .
APPROVAL OF WARRANTS :
General Fund Warrant No . 5 of 1994 - Approved
A motion was made by Councilperson Hile and seconded by
Councilperson Steiner to approve the General Fund Warrant No . 5 of
1994 , voucher numbers 165 - 196 in the amount of $ 5 , 869 . 10 .
A roll call vote on the motion resulted as follows :
