Moon , David Pochily , Neil S herwood , Ed & Pat VanDusen , Charles R . White , Sr . , Betty White The meeting was called to order by Supervisor Oltz at 8 : 00 P . M . and all were led in the Pledge of Allegiance to the American Flag . Approval of March 14 , 1994 Town Board Meeting Minutes A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to approve the March 14 , 1994 Town Board Meeting Minutes as published . A roll call vote on the motion resulted as follows : J ohnson Aye Schwartz Aye O ltz Aye Carried Unanimously P rivilege of the Floor : Danby School Use Committee Councilperson Johnson reported that at the Board of Education Committee will acknowledge receipt of the official proposal from t he Danby School Use Committee for an Alternative Community School from the Superintendent of Schools . At the last meeting of the committee the Superintendent acknowledged the fact that other proposals would be considered dealing with more traditional forms of secondary schools . County Representative Report : S upervisor Oltz reported on the following items for Representative Frank Proto who is unable to attend tonight . 1 ) Tuesday , April 12 , 1994 there will be a special meeting concerning the 911 Emergency System . 2 ) Tompkins County Budget Committee will review a revised draft o f the very preliminary budget that indicated a possible 18 % increase in County Taxes for 1995 . The revised budget will ✓ eflect budget cuts . 3 ) Thank you to the Town for their resolution in support of SARA and to the Town Clerk for her participation . 4 ) Reminded the Town Board to make appointments to the Tompkins County Youth Board , Economic Opportunity Corporation , County P lanning , and the Environmental Management Council 0 Members of the Public : Durfee Hill Road Residents Charles and Betty White , Nancy Blacken , Dave Pochily , Audrey Chaffee , and Ed and Pat VanDusen addressed the Town Board and reported that they are not happy with the decision 319 2 Town Board Minutes April 11 , 1994 t o surface only one ( 1 ) mile of Durfee Hill Road and are concerned t hat the ditching and drainage work has not been started at this t ime . Supervisor Oltz and the Town Board responded that the Highway S uperintendent has contracted with Baker Drainage for the drainage work to be done on Durfee Hill Road . Work is expected to begin by t he end of April . ® COMMUNICATIONS : 1 ) Code Enforcement Monthly Report - March 1994 2 ) Community Council Monthly Report and Minutes - - are requesting t he Town Board to attend the April 18 , 1994 Meeting to discuss t he Youth Commission progress . D iscussion followed regarding residency requirement for Community Council Members . 3 ) SPCA - February 1994 Report Other Reports : H ighway Report Councilperson Schwartz read the Highway Superintendent ' s Report for March 1994 . The report includes estimated expense for road surfacing and repairs on Durfee Hill , VanBuskirk Gulf , Tupper and W est King Roads . Zoning Report : Susan Beeners reported that she is checking the damage to buildings from the heavy snow . There are several collapsed and damaged roofs to be repaired and one ( 1 ) partially collapsed building will be demolished next week . P lanning Board Report : Chairperson Weitzel reported that the Planning Board held four ( 4 ) public hearings on March 16 , 1994 . Two ( 2 ) requests for subdivision were approved , Hoffay Farms Proposal was postponed and a Proposed Local Law to Amend the Zoning Ordinance was referred to t he Town Board . SWAC Committee Report : J oel Gagnon reported that the Committee is still waiting for the County Board to appoint new members . There was discussion at the last meeting as to whether there was any prospect in reviewing approval of the Central Processing Facility . OLD BUSINESS : CSEA and Town of Danby Highway Department Contract S upervisor Oltz reported that the Town and CSEA Representative ® Robert Morris are negotiating with the highway department for a new revised contract . County Ad Hoc Cable Committee Supervisor Oltz reported that Mayor Wixom from the Village of L ansing has asked the Town Board to pass a resolution in support of t he development of a committee to start planning for a County Cable Commission . An ad hoc committee will be formed to start discussion t o deal with issues of municipal cable television franchising in Tompkins County . RESOLUTION NO . 24 OF 1994 - Approved RESOLUTION TO AUTHORIZE PLANNING FOR A TOMPKINS COUNTY CABLE TV COMMISSION B y Councilperson Johnson : Seconded by Councilperson Schwartz WHEREAS , the municipalities of Tompkins County have formed a committee to explore cooperation in administering cable TV franchises in the County , and that committee proposes to start discussion based on a possible revival of the structure of a County 3 '- 0 3 Town Board Minutes April 11 , 1994 Cable Commission formed in 1977 , and WHEREAS , the Town of Danby agrees to take part in the formation of an intermunicipal commission to deal with issues of municipal cable t elevision franchising in Tompkins County , now be it RESOLVED , to that end the Town of Danby Town Board appoints Mary O ltz to represent it in drawing up an agreement to form such a commission , and be it further • RESOLVED , that the Town Board directs that a copy of this resolution be sent to Mayor Ted Wixom of the Village of Lansing , convener of the commission study group . A roll call vote on the resolution resulted as follows : J ohnson Aye S chwartz Aye Oltz Aye Carried Unanimously NEW BUSINESS : RESOLUTION NO . 25 OF 1994 TOMPKINS COUNTY HILLVIEW ROAD LANDFILL PROTECTION COMMITTEE APPOINTMENTS - Approved B y Councilperson Johnson : Seconded by Councilperson Schwartz RESOLVED , that the Town of Danby Town Board recommends the following appointments to the Tompkins County Hillview Road L andfill Protection Committee : • Ric Dietrich of 100 South Danby Road , Willseyville , New York as the Town representative , and B rian Caldwell of Walding Lane , West Danby , New York as the N eighborhood representative , and be it further RESOLVED , that the term of appointment is for two ( 2 ) years , begins immediately and expires on December 31 , 1995 . ' war; Mdnuments throughout New York State , and WHEREAS , Mr . Wheeler has approached the Town for permission to clean and restore the Town of Danby Civil War Monument located in front of the Town Hall at no cost to the Town , now be it RESOLVED , that the Town of Danby Town Board gives approval to Dan Wheeler Departtment Commander of the Sons of Union Veterans and Sidney Camp No . 41 to clean and restore the Town of Danby Civil War Monument . 32 / 4 Town Board Minutes April 11 , 1994 A roll call vote on the resolution resulted as follows : Johnson Aye Schwartz Aye Oltz Aye • Carried Unanimously RESOLUTION NO . 27 OF 1994 APPOINTMENTS TO THE DANBY YOUTH COMMISSION -- Approved By Councilperson Schwartz : Seconded by Councilperson Johnson WHEREAS , the Town of Danby Town Board created the Danby Youth Commission by Resolution No . 38 of 1993 , and WHEREAS , the Town Board created a Danby Youth Commission by Resolution No . 16 of 1994 , now be it RESOLVED , that the Town of Danby Town Board appoints the following residents to serve on the Danby Youth Commission : J im Holley P atti Meyers Charles White , Jr . A roll call vote on the resolution resulted as follows : J ohnson Aye S chwartz Aye O ltz Aye Carried Unanimously RESOLUTION NO . 29 OF 1994 TOWN CLERK ASSOCIATION MEETING APPROVAL B y Supervisor Oltz : Seconded by Councilperson Johnson RESOLVED , that the Town Board approve the request from the Town Clerk to attend the New York State Town Clerks Association Conference in Albany on April 24 - 27 , 1994 . A roll call vote on the resolution resulted as follows : J ohnson Aye S chwartz Aye Oltz Aye Carried Unanimously Audit of Town Justice Records : Supervisor Oltz reported that the Town Justice Records were audited at the Agenda Meeting of the Town Board on April 6 , 1994 . All records were in order . OTHER BUSINESS : The Town Board reviewed Part II of the SEQR Review and attachments for the Hardesty Proposal . 52Z 5 Town Board Minutes April 11 , 1994 Ric Dietrich and Neil Sherwood arrived at 9 : 00 P . M . and requested permission to ask questions regarding the SEQR Part II forms . Mr . Dietrich addressed the Town Board with comments and concerns regarding Part II of the SEQR submitted for the Proposed Local Law t o Amend the Zoning Ordinance to Establish a Mobile Home Park Planned Development and a Residential Planned Development Within a P lanned Development Zone 2 and to Modify the Boundaries of Such Zone . He said he thinks this type of development is out of character with the neighborhood . He submitted a memo dated April 11 , 1994 from the Members of the South Danby Neighborhood regarding : Section 906 / Appeal of Planning Board. Decision on Zoning Change . Code Enforcement Officer Susan Beeners responded and said that S ection 906 ( Appeal of Planning Board Decision ) says that there may be an appeal of a Planning Board ' s decision to grant a special permit . She explained that this proposal is not special permit it is a re - zoning . She referred Mr . Dietrich to the section for " Authority to Amend " in the ordinance . Mr . Dietrich said for the record that it is unclear how one goes about appealing the decision . It seemed to indicate that residents h ad an opportunity to appeal a decision made by a board to the Town Clerk under the specified time . If it is true , we don ' t know how t he process is going to proceed but that is partly our concern . Mary Lou requested permission to comment and read a section of S ection 604 - Planned Development Zones of the ordinance . She said that she does not see anything under Planned Development Zones that h as anything to do with density . S upervisor Oltz said that the Board would not act on the proposed local law at this meeting . APPROVAL OF WARRANTS : General Fund Warrant No . 4 of 1994 A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to approve the General Fund Warrant No . 4 of 1994 , voucher No . ' s 123 - 164 in the amount of $ 7 , 796 . 18 . A roll call vote on the motion resulted as follows : J ohnson Aye S chwartz Aye O ltz Aye Carried Unanimously Highway fund Warrant No . 4 of 1994 A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to approve the Highway Fund Warrant No . 4 of 1994 , voucher No . ' s 47 - 60 in ; the amount of $ 11 , 664 . 30 . A roll call vote on the motion resulted as follows : J ohnson Aye S chwartz Aye O ltz Aye Carried Unanimously West Danby Water District Fund Warrant No . 3 of 1994 A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to approve the West Danby Water District Fund Warrant No . 3 of 1994 , voucher No . A roll call vote on the motion resulted as follows : J ohnson Aye S chwartz Aye Oltz Aye Carried Unanimously S upervisor ' s March 1994 Report Postponed : Approval of the Supervisor ' s March 1994 Report was postponed until t he April 1994 meeting due to lack of quorum .
