Supervisor Oltz opened the public hearing at 7 : 30 P . M . and stated t hat this public hearing is to hear all persons in favor of or opposing the adoption of a Local Law relating to the proposed H illview Terrace Subdivision and Mobile Home Park Expansion as proposed by Paul and Mary Lou Hardesty . Notice of this Public H earing was duly advertised in the Ithaca Journal on March 18 , 1994 . The Town Clerk was asked to read the Notice of Publication . " NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Town of Danby Town Board on Wednesday , March 30 , 1994 at 7 : 30 P . M . , Town Hall , 1830 Danby Road , Ithaca , New York to consider Adoption of a Local Law to Amend the Zoning Ordinance to Establish a Mobile Home Park Planned Development and a Residential Planned Development within Planned Development Zone 2 , to Modify the Boundaries of such Zone , and further , to approve a General Site Plan for such zone . The property is located southwest of the intersection of Danby Road ( Rte . 96B ) and South Danby Road , on Town of Danby Tax Parcels # 20 . - 1 - 4 . 2 and 20 . - 1 - 4 . 5 . Paul and Mary Lou Hardesty , Owners . At such time and place all persons interested in the subject matter thereof will be heard concerning the same . . RE : opposition to the proposed Hillview Terrace Mobile Home Park Zone Application : This petition has been prepared for the Danby Town Board as a • declaration of disapproval of the proposed local law to amend t he zoning ordinance to establish the Hardesty Mobile Home Park and residential development plan . We , the undersigned oppose the proposed zoning change and mobile park d evelopment . " COPY OF PETITION IS ATTACHED TO PUBLIC HEARING MINUTES as Attachment 3 - 30 - 94 page 2A . P lanner Tom Niederkorn addressed the Town Board and public with a presentation of the General Site Plan for the Hillview Terrace Mobile Home Park Expansion and Subdivision Proposal . He explained the background , history and the layout of the proposal . Consulting Geologist Brayton Foster explained the Hillview Mobile H ome Park water system , gave a review of the results of the long t erm pump testing on the new wells No . 5 and 6 and the effect on adjoining neighborhood wells . He said that the two ( 2 ) new wells are producing above average yields . Tom Niederkorn said that if this plan for a rezoning is approved by t his Board a final plan must be drawn up to be presented to the P lanning Board for approval . Roads must be laid out and a drainage and erosion control plan must be in place . The plan for a road cut must be approved by the Department of Transportation , Speedie P ermits must be obtained , approval of the Department of Conservation for the drainage system , and the Health Department must give final approval for the water and septic systems . Public Comments : Edw . M . Roberts - 47 Bald Hill Road - approves of this proposal as t his type of housing is badly needed . J ohn C . Shepardson , Sr . - 318 Ridgecrest Road - thinks the Town needs a place like this especially for our senior citizens . Ray Mayo - 335 Ridgecrest Road - said he thinks this is a good opportunity for Danby to increase the tax base , it will approve the appearance of the area , and open the door for some income housing . Ed . Inman - 52 Bald Hill Road - is a member of Zoning Board of • Appeals and in the zoning regulations there are no provisions to place mobile homes other than mobile home parks . He feels there is a need for these regulations to be expanded as there is a need for starter homes , retirement homes and for people who are not interested in expensive homes . He thinks this proposal should be approved . Donna Inman - 52 Bald Hill Road - approves of this proposal . A more moderate level of housing is needed in Danby . Virginia Dean - 30 South Danby Road - has lived in the mobile home park for twelve ( 12 ) years and approves of this proposal . She personally likes the security of living at the park , knowing there is a security light there and someone living next door . It is a d evelopment that is desperately needed in the community . E lizabeth Roe - 1320 Danby Road - as a Board of Zoning Appeals member has heard many applications for sighting of mobile homes , It is a choice that we should have in Danby . The proposal for the expansion the Hardesty ' s have presented is much more subtle with • much less impact than the original park plan . She urged the Board not to hold up this proposal any longer . Fred Wright - representing his mother Onalee Wright of 2350 Danby Road - reported that his mother is opposed to this proposal . She is concerned that it will reduce the value of her property and have an effect on her water supply . Mary Hovanec - 77 South Danby Road - feels the Hardesty ' s have increased the value of their property and have done a wonderful job in upgrading and maintaining the mobile home park . She is very much in favor of this proposal . Phil Simon - represents MVE Homes in Cortland , NY - is here to support the Hardesty ' s in their expansion program . Marilyn Seeley - 1767 Danby Road - approves of the proposal and supports the Hardesty ' s . She thinks they have done all they could d o to satisfy the Towns requirements . . Paul Seeley - 1767 Danby Road - thinks there is a real need for a mobile home park in Danby as we are zoned so that mobile homes must be in a park . He is entirely in favor of this proposal . Clifford Hill - 215 South Danby Road - spoke for himself and his wife . He gave background of the Trailer Park ( he and his brother were he original developers of the existing park ) . The same concerns were expressed at that time and none of these things n eighbors were concerned about have happened and his taxes continue t o rise . He respects what the neighbors concerns but we have to look at what is good for the whole community not what is good for a few . He approves of the project proposal . Ric Dietrich - 100 South Danby Road - he agrees with Mr . Hill in ✓ espect to the need to take a look how it is going to affect the people as a whole and considers that the people who live in the immediate vicinity of where the park is proposed . He thinks what t he Hardesty ' s have done to their land and house is exemplary and h as no trouble at all with the present park as it is and the proposed development of single housing . He does oppose the mobile home park expansion and feels it is out of character with the n eighborhood . • Neal Sherwood - 2352 Danby Road - has no objection to the d evelopment of single family housing but objects to the mobile home park that is proposed there . He thinks it will lower the value of h is property . Ken Newton - 2 South Danby Road - said his property values will go d own if this expansion is put in and is concerned about the liability for the pond that he shares as a landowner with the Hardesty ' s . He opposes the project . L ily Newton - 2 South Danby Road - said she did not object when the o riginal park was developed but is opposed to this proposal . She is concerned with the liability of the pond and of the runoff of g roundwater from the park . S haron Tierney - 24 South Danby Road - has concern that the e xpansion will increase noise and traffic and is opposed to the 315 4 Public Hearing Hardesty Proposal March 30 , 1994 park expansion . Paul Norton - 2381 Danby Road - very opposed to the development as he feels it is a change in the area . Doug Makie - 13 South Danby Road - doesn ' t have problems with the concepts of a trailer park but is concerned about how the park is going to effect the water in his well with increased usage . Howard Steiner - 1050 Coddington Road - supports the park expansion and feels this is something that Danby needs and urged the Board to approve of the proposal . We need an area of affordable housing . MOTION TO CLOSE PUBLIC HEARING : A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to close the public hearing at 8 : 30 P . Supervisor Oltz called the special meeting of the Town Board to order at 8 : 30 P . M . to review information on the Hardesty Proposal for a Proposed Local Law to Amend The Zoning Ordinance to Establish a Mobile Home Park Planned Development within Planned Development Zone 2 , to Modify the Boundaries of Such Zone , and further , to approve a General Site Plan for such zone . Attorney Barney presented a Proposed Resolution for SEQR and the L ocal Law for the Hardesty proposal to the Town Board . D iscussion followed concerning a Board member who has not attended meetings for the past two ( 2 ) months . D iscussion on the proposal and public comments : 1 ) Draw Down Testing : B rayton Foster explained the water system at the Mobile Home Park , t he depth and yield of the new wells and the process used in the d raw down testing . Neighboring wells were tested for impact during • t he draw down testing . 2 ) Drainage : Brayton Foster explained that the drainage problem is because water runs down hill and there are not roadside ditches to carry of the water . The road has been built up and is higher than some of the properties along the roadway . S upervisor Oltz asked Mary Lou Hardesty if she would consider fewer units in the proposed park expansion . Mary Lou Hardesty reported that the density in the proposal has been decreased from the original proposal as much as possible . The Town Board will review the information submitted for the proposal and the public comments expressed at tonights public h earing . The petition submitted in opposition of the proposal at t he public hearing will be reviewed by the Code Enforcement Officer 317 2 Special Meetin ; g Hardesty Proposal March 30 , 1994 to determine whether it contains signatures of twenty ( 20 ) per cent of adjacent landowners and / or landowners across the road . The Board will continue SEQR review on this proposal at their Agenda Meeting on April 6 , 1994 and the Regular Meeting of the Board on April 11 , 1994 . ADJOURNMENT : 411 A motion was made by Councilperson Hile and seconded by Councilperson Schwartz to adjourn the meeting at 9 : 00 P . M .
