March 14 , 1994 PRESENT : S upervisor Oltz Councilpersons : Hite , Johnson , Schwartz ABSENT : Councilperson Miller ( excused ) . Others Present : Code Enforcement Officer - Susan Beeners H ighway Superintendent - Wm . Hall County Representative - Frank Proto Members of the Public : E dw . M . Roberts , Mary Lou Hardesty , Roy Casterline , Charles & Betty W hite , Sr . , Nancy Blacken , David Pochily , Joel Gagnon , Diane Sherwood , Mary Ann Kozak , Audrey Chaffee , Beverly Klinko and o thers . Supervisor Oltz called the meeting to order at 8 : 00 P . M . and led all present to the Pledge of Allegiance to the American flag . S upervisor Oltz requested the Town Board to retire to Executive S ession at 8 : 02 P . M . The Regular Meeting of the Town Board reconvened at 8 : 30 P . M . Approval of February 14 , 1994 Town Board Minutes : A motion was made by Councilperson Schwartz and seconded by Councilperson Johnson to approve the February 14 , 1994 Town Board Minutes as published . Carried Unanimously Additions to the Agenda : S upervisor Oltz requested the addition of Resolution No . 23 ✓ egarding office supplies . P rivilege of the Floor : Councilperson Schwartz reported that many residents in his n eighborhood are concerned about the conditions of Durfee Hill Road and are here tonight to address the issue . Supervisor Oltz reported that there has been unauthorized entrance t o the Town Hall . Because of this it has been necessary to change all locks and are considering a motion detector for the building . The cost for replacing the locks was $ 739 . 80 . S upervisor Oltz reported that the Town has been involved with the County Cable TV Commission and they have asked the Town to appoint IIIa representative to serve on the commission . County Representative Report : Representative Frank Proto reported on the following : 1 ) State Forest Lands - New York State pays Town and County property tax on State Lands and it is applied to our tax warrant . 2 ) The Board was served with a law suit from the Biggs Building A Employees . 3 ) County Budget -- A very preliminary budget fiscal planning meeting indicated that County Taxes could increase 18 % . 4 ) Recycling - Solid Waste Fee will be approximately $ 45 . 00 per household in 1994 . There is discussion on possibly closing the drop off centers in favor of 100 % curbside pick up . F . .i . _ . . 3 s G 2 Town Board Minutes March 14 , 1994 5 ) N . Y . S . Sanitary Code - Part VI review was completed and revisions for Part I , Article 9 are currently being reviewed . 6 ) Medicaid - It is proposed that New York State will take over the Medicaid program for 1 % of sales tax revenue . Members of the Public : Mary Lou Hardesty - South Danby Road - reported that two ( 2 ) new wells were drilled on the Hillview Terrace property . She submitted an updated report and drilling logs as of 3 / 10 / 94 . Mr . Brayton Foster will submit a report on the draw down testing of the wells and information regarding impact ( if any ) on the neighboring wells . Dave Ponchily - 236 Durfee Hill Road - addressed the Board and asked for a schedule , plans and dates for the repair of his road . H is concern is that construction will not be completed this season . H ighway Superintendent William Hall said that materials for road construction and drainage will be ordered when the Tompkins County contracts are in place . The Town bids some road construction materials with County services . Durfee Hill Residents - Nancy Blacken , Charles F . White , Sr . , Audrey Chaffee , and Beverly Klinko - addressed the Board with concerns about the condition of Durfee Hill Road . They are concerned that their road will not be surfaced this year . Charles White , Sr . - 325 Durfee Hill Road asked that the record show that the neighborhood is unhappy and the road condition is unacceptable . The section of Durfee Hill Road that he lives on has never been paved and wants assurance that the road will be paved this year . • Highway Superintendent Hall said that he is aware that Durfee Hill Road is soft and the road will be repaired this year . Stone will be placed on the road this week to help stabilize the soft condition . Drainage work on the road cannot be done until the frost is out of the ground . S upervisor Oltz reported that she received a letter from A Durfee H ill Road resident who wants to join with the neighbors in making t he Highway Superintendent aware that the condition of Durfee Hill Road is unacceptable . COMMUNICATIONS : 1 ) Snow and Ice Removal Contract - Tompkins County / Town of Danby received . 2 ) Code Enforcement Officer - February 1994 Report 3 ) Highway Department - February 1994 Report 4 ) Community Council Monthly Report and 4th Quarter 1993 Report . 5 ) Facilities Committee Minutes - March 10 , 1994 . • 6 ) SPCA - January 1994 Report . S upervisor Oltz reported that the Facilities Committee would like Town Board approval for basic initial consulting services from a d esign professional and / or a contractor for the Town Hall facility . Code Enforcement Officer Susan Beeners explained that the Committee would continue to explore various space options for additions to t he existing Town Hall or for a new building . The Committee has asked the Town Board Approve a request for Proposal to seek basic consulting services for an improved facility . Roberts reported that the Senior Citizens cancelled the monthly dinner meeting due to bad weather and is re - scheduled for April . Forty - three seniors went on a St . Patricks D ay Celebration trip to Geneva today . ( 3 / 14 / 94 ) . S olid Waste Advisory Committee ( SWAC ) J oel Gagnon said that the SWAC is still being reorganized . There is a meeting this Thursday ( 3 / 17 / 94 ) on the business of illegal d umping . NEW BUSINESS : RESOLUTION NO . 21 OF 1994 SUPPORT OF REPEALING THE SUNSET PROVISION OF CHAPTER 78 , LAWS OF 1989 ESTABLISHING THE LOCAL GOVERNMENT RECORDS MANAGEMENT IMPROVEMENT FUND- Approved B y Councilperson Schwartz : Seconded by Councilperson Johnson WHEREAS , the appropriate management of local government records through their creation , use , maintenance , and disposition is e ssential to efficient and effective government , and I WHEREAS , The Local Government Records Management Improvement Fund w as established in Chapter 78 , Laws of 1989 , to benefit the local governments of New York State through grants for records management and through establishment of a program of regionally - based t echnical assistance administered by the New York State Archives and Records Administration of the New York State Education D epartment , and WHEREAS , The Local Government Records Management Improvement Fund h as enormously benefitted Tompkins County through three ( 3 ) grants t otalling $ 110 , 000 to the Tompkins County Clerk ' s Office , and grants exceeding $ 200 , 000 to Tompkins County municipalities through frequent and readily accessible consultation by the Improvement Fund - supported State Archives and Records Administration Regional Advisory Officer and through Improvement Fund - sustained training available through regularly scheduled workshops on records and information management - related subjects attended by the Tompkins County Clerk and the Records Officer , and WHEREAS , the grants have supported successful projects to inventory the records of Tompkins County , to store inactive records , and for III microfilming , and WHEREAS , the grants , consultation , workshops , and other services to I. Tompkins County supported by the Fund have contributed significantly to the improved management of its records , to the availability and accessibility of those records to its officials and citizens , and to economical and responsive administration saving taxpayers ' dollars , and WHEREAS , there is much more to be accomplished here in Tompkins County and in the other local governments of New York State , where n eeds will continue in the future with the growth in the volume of ✓ ecords , as needs change and information technologies present new challenges , and WHEREAS , grants and technical advice are essential in assisting all the local governments of New York State in developing records management programs adequate to the demands of governments and 308 4 Town Board Minutes March 14 , 1994 citizens , and demand for those grants and services remains critical , and WHEREAS , these needs are served and programs sustained through modest surcharges on fees for records filed and recorded by county clerks of the State of New York and the Register of the city of New York which sustain the Improvement Fund , without the use of state tax revenues , and WHEREAS , The Local Government Records Management Improvement Fund was created with a sunset date of December 31 , 1995 , now therefore be it RESOLVED , That the Town of Danby Town Board fully supports the perpetuation of the Local government Records Management Improvement Fund through the elimination of its sunset provision and supports its continued administration by the New York State Archives and Records Administration of the New York State Education Department with oversight by the Local Government Records Advisory Council , and be it further RESOLVED , That The Town of Danby Town Clerk forward copies of this resolution to its state legislators , the leadership of the state legislature , and to the Governor of the State of New York . A roll call vote on the resolution resulted as follows : H ile Aye S chwartz Aye J ohnson Aye O ltz Aye Carried Unanimously RESOLUTION NO . 22 OF 1994 DATE FOR PUBLIC HEARING - HILLVIEW TERRACE SUBDIVISION AND MOBILE HOME PARK EXPANSION - Approved B y Councilperson Hile : Seconded by Councilperson Johnson WHEREAS , The Town of Danby Town Board has received the January 19 , 1994 recommendation made by the Planning Board with respect to the proposed Hillview Terrace Subdivision and Mobile Home Park E xpansion , and WHEREAS , The Town of Danby Town Board is legislatively determined t o act as Lead Agency in environmental review of the project , which is a Type I Action , now be it RESOLVED , That the Town Board hereby shall hold a Public Hearing at Danby Town Hall , 1830 Danby Road , Ithaca , New York at 7 : 30 P . M . on Wednesday , March 30 , 1994 , to consider Adoption of a Local Law to Amend the Zoning Ordinance to Establish a Mobile Home Park P lanned Development and a Residential Planned Development within P lanned Development Zone 2 , to Modify the Boundaries of such Zone , • and , further , to Approve a General Site Plan for such zone , and be it further RESOLVED , That a Special Meeting of the Town Board will follow the public hearing . A roll call vote on the resolution resulted as follows : H ile Aye J ohnson Aye S chwartz Aye O ltz Aye Carried Unanimously RESOLUTION NO . 23 OF 1994 OFFICE SUPPLIES - LISTING B y Councilperson Schwartz : Seconded by Councilperson Hile WHEREAS , The Town Clerk acts as acquisition clerk for the Town by 309 5 Town Board Minutes March 14 , 1994 purchasing and making available some of the office supplies used by all Town office departments , and WHEREAS , it has been noted that some departments are making purchases of supplies that duplicate inventory on hand , now therefore be it RESOLVED , That the Town Clerk keep a written inventory list of all supplies available for general use and give each department a copy • of this list in order to prevent duplicate purchases . A roll call vote on the resolution resulted as follows : H ile Aye Johnson Aye Schwartz Aye O ltz Aye Carried Unanimously Other Reports : Danby School Building Committee Councilperson Johnson reported that the Danby School Use Committee h as been meeting regularly and have narrowed its use to two ( 2 ) proposals for consideration will be passed to the Superintendent of S chools . The proposals are : 1 ) an additional middle school and , 2 ) an extension of the Alternative Community School . The Committee is planning to meet with the architectural firm to study the demographics with High School Facilities Committee . APPROVAL OF WARRANTS : General Fund Warrant No . 3 of 1994 - Approved A motion was made by Councilperson Hile to approve the General Fund W arrant No . 3 of 1994 - voucher No . ' s 83 - 122 in the amount of $ 7 , 638 . 62 .
