M . Roberts , Howard Steiner , Joel Gagnon , Diane Sherwood S upervisor Oltz called the meeting to order at 8 : 02 P . M . and led all present in the Pledge of Allegiance to the American Flag . APPROVAL OF JANUARY 10 , 1994 TOWN BOARD MINUTES : A motion was made by Councilperson Hi_ le and seconded by Councilperson Johnson to approve the January 10 , 1994 Town Board Minutes as published . Carried Unanimously COMMUNICATIONS : 1 ) S . P . C . A . Contract 2 ) Facility Committee Meeting Minutes - February 27 , 1994 3 ) D . S . S . Adoption / Homefinding Unit - request to use building 3 / 10 / 94 . 4 ) Code Enforcement Officer Report for January 1994 and Annual report for 1993 . 5 ) Highway Department Report 6 ) Community Council Report of activities for November 1993 to February 14 , 1994 . County Representative Report : Representative Frank Proto reported on the following : 1 ) Libraries - Assemblyman Luster is the new Chairman of the Assembly Subcommittee on Libraries . 2 ) Agricultural Districts - The Farm Land Protection Committee has embarked on a plan that includes water and air quality , pesticides , what agriculture means to the community and what the economic impact is . 3 ) County Health Committee - has completed the revision of • Article VI of the Sanitary Code ( NYS Part 75A ) and are now revising the definitions of Article 1X and 1V ( refuse removal and open burning ) . 4 ) Sales Tax - there was an increase in Sales Tax Revenue of 10 - 1 / 2 % last quarter and Towns will receive an adjustment . 5 ) State Archives and Records Administration ( SARA ) - asked the Town to adopt a resolution in support of repealing the sunset provision of Article 78 , Laws of 1989 Establishing the Local Government Records Management Improvement Fund . 6 ) Airport Committee - Airport terminal project is on target , under budget and will be open mid April 1994 . 7 ) HUD Grant - Tompkins County has received $ 600 , 000 . 00 from HUD to help first time home buyers in purchasing homes . - 2 - Town Board Minutes 3 Q February 14 , 1994 • H oward Steiner asked Representative Proto if the County had been aware during budget preparation that there would be additional funds from sales tax revenue . Representative Proto responded that they were not aware of additional sales tax revenues when preparing the 1994 budget . H oward Steiner - 1050 Coddington Road - would like to see more participation , communication , aggressiveness toward our County B oard to get some of the extra money they seem to give to the City for their youth programs , etc . He does not feel that the Town of D anby is getting a fair share . • S enior Citizens Report E dw . M . Roberts reported that Dorothy Roberts will be in charge of the arrangements for Senior Citizens trips year . P lanning Board Report P lanning Board Chairperson Nancy Weitzel reported that the Planning B oard has referred the Hardesty Proposal to the Town Board for ✓ eview . Included in the information is a Proposed Local Law - " A L ocal Law to Amend the Zoning Ordinance to Establish a Mobile Home P ark Planned Development and a Residential Planned Development Within Planned Development Zone 2 and to Modify the Boundaries of Such Zone . " S WAC Committee Report Joel Gagnon reported that SWAC met last month with the Tom Todd the Chairman of the Solid Waste Committee . Recommendations for ✓ evisions to the bi - laws and new appointments to the committee are o n the County February Agenda . Frank Proto reported that the Hillview Road Advisory Committee is still in existence . The Citizens Water Well Protection Committee w ill be reorganized for the Caswell Road and the Hillview Road L andfill sites . D anby School Use Committee Councilperson Johnson reported that the Danby School Use Committee is meeting bi - weekly and progress is very slow . A study of the building is in progress . N EW BUSINESS : RESOLUTION NO . 19 OF 1994 APPROVAL for TOWN SUPERVISOR TO ENCUMBER 1993 FUNDS B y Councilperson Johnson : Seconded by Councilperson Hile WHEREAS , Several General Fund bills totalling $ 15 , 029 . 34 and H ighway Fund bills totalling $ 16 , 859 . 39 were approved to be paid from 1993 funds and / or funds were allocated to pay these expenses in 1993 , and WHEREAS , invoices covering these obligations were not received until 1994 or , they were received too late to be included in the 1993 Warrants for payment , now be it RESOLVED , That the Town of Danby Town Board authorize the Town Supervisor to encumber 1993 funds in the amount of $ 31 , 888 . 73 to pay for these 1993 expenses . A roll call vote on the resolution resulted as follows : H ile Aye J ohnson Aye O ltz Aye Carried Unanimously ( Councilpersons Miller and Schwartz absent ) RESOLUTION 20 OF 1994 AUTHORIZATION TO PARTICIPATE IN COOPERATIVE PURCHASING OF HIGHWAY SERVICE WITH TOMPKINS COUNTY By Councilperson Hue : Seconded by Councilperson Johnson 303 3 Town Board Minutes February 14 , 1994 WHEREAS , the Office of the State Comptroller has ruled that counties may no longer extend their bids for public work ( service ) t o political subdivisions , and WHEREAS , General Municipal Law Section 119 - 0 provides for municipalities entering into cooperative purchasing agreements to • jointly bid needed services , and WHEREAS , General Municipal Law , Article 5 - G , Section 119 - 0 states that any agreement entered into hereunder shall be approved by e ach participating municipal corporation or district by a majority ✓ ote of its governing body , " now therefore be it RESOLVED , That the Town of Danby be hereby authorized to participate with Tompkins County in the cooperative purchasing of t he following highway services : 1 . Liquid Bituminous Materials 2 . Installation of Corrugated Polyethylene Tubing for Substance Drainage 3 . Calcium Chloride Solution 4 . Recycling of Existing Bituminous Pavement 5 . Vegetation Control and , be it further RESOLVED , that the Town of Danby reserves the right to reject any and all bids . A roll call vote on the resolution resulted as follows : Hile Aye J ohnson Aye O ltz Aye Carried Unanimously ( Councilpersons Miller and Schwartz Absent ) • Proposed Local Law - Hardesty Proposal S upervisor Oltz reported that the Town Board has received the H ardesty Proposal from the Planning Board , which includes a proposed local law entitled " A Local Law to Amend the Zoning O rdinance to Establish a Mobile Home Park Planned Development Within Planned Development Zone 2 and to Modify the Boundaries of S uch Zone . " A public hearing date will be considered after the geologist has completed the water well draw down testing . ® Audit of Town Clerk ' s Records Supervisor Oltz reported that the Town Board received the Town Clerk ' s Annual Report for 1993 . The Board audited the Town Clerk ' s Records on February 9 , 1994 and found all records in order . Records Officer Management Report Town Clerk Carol Sczepanski reported that the Town of Danby and the D anby Fire District are preparing a Cooperative Records Management Grant Application to the State Records Administration ( SARA ) . The plan for records management for 1994 is as follows : 1 , ) Inventory of the Town , Fire District , West Danby Water District , Highway Department , and the Town Historian ; 2 ) Committee to be appointed to review inventory results ; 3 ) Development of Assessment Plan 4 ) Application to SARA for a Records Management Grant Carol will meet with the Danby Fire Commissioners at their meeting o n February 15 , 1994 . 30- � 4 Town Board Minutes February 14 , 1994 APPROVAL OF WARRANTS : General Fund Warrant No . 2 of 1994 - Approved A motion was made by Councilperson Hile and seconded by Councilperson Johnson to approve the General Fund Warrant No . 2 of 1994 , voucher numbers 31 - 82 in the amount of $ 46 , 151 . 53 . A roll call vote on the motion resulted as follows : H ile Aye • J ohnson Aye Oltz Aye Carried Unanimously Highway Fund Warrant No . 2 of 1994 - Approved A motion was made by Councilperson Johnson and seconded by Councilperson Hile to approve the Highway Fund Warrant No . 2 of 1994 , voucher numbers 14 - 30 in the amount of $ 36 , 151 . 73 . A roll call vote on the motion resulted as follows : H ile Aye J ohnson Aye O ltz Aye Carried Unanimously West Danby Water District Fund Warrant No . 1 of 1994 - Approved A notion was made by Councilperson Hile and seconded by Councilperson Johnson to approve the West Danby Water District Fund Warrant No . 1 of 1994 , voucher numbers 1 - 5 in the amount of $ 1 , 417 . 79 . A roll call vote on the motion resulted as follows : H ile Aye J ohnson Aye O ltz Aye Carried Unanimously Approval of Town Clerk ' s January 1994 Report A motion was made by Councilperson Hile and seconded by Councilperson Johnson to approve the Town Clerk ' s January 1994 Report as submitted . A roll call vote on the motion resulted as follows : H ile Aye J ohnson Aye O ltz Aye Carried Unanimously Town Supervisor ' s January 1994 Report Postponed The Town Supervisor ' s January 1994 Report is postponed until the March 1994 meeting due to a lack of quorum .
