The public hearing was called to order at 7 : 30 P . M . by Supervisor
O ltz .
The following Notice of Public Hearing was read by the Town Clerk .
NOTICE IS HEREBY GIVEN that the Preliminary Budget for the Fiscal
Year 1994 has been completed and filed in the office of the Town
Clerk at 1830 Danby Road , Town of Danby , Ithaca , New York , where it
is available for inspection during office hours .
FURTHER NOTICE IS HEREBY GIVEN , that the Town Board of the Town of
Danby will meet and review the said Preliminary Budget and hold a
Public Hearing thereon at the Town Hall on the 4th day of November ,
1993 at 7 : 30 P . M . Citizens attending the hearing have the right to
provide written and / or oral comments and ask questions concerning
the entire budget . Pursuant to Section 108 of the Town Law , the
proposed salaries of the following Town Officials are hereby
specified as follows :

The public hearing was called to order on November 4 at said date
and time , adjourned to 3 : 00 p . m . November 5 , 1993 and adjourned
until 7 : 30 P . M . November 8 , 1993 .
S upervisor Oltz asked for comments on the Town of Danby Preliminary
B udget for Fiscal Year 1994 .
S upervisor Oltz reported that there is an error on page 8 , Account
N o . DA9710 . 606 ( $ 6 , 527 ) should be increased $ 100 to a total of
$ 6 , 627 - Total Debt Service Principal Serial Bonds $ 33 , 997 .
Raymond Mayo - 335 Ridgecrest Road - asked if funds were increased
for Jennings Pond .
Councilperson Marisa reported that there is not an increase in the

budget for 1994 for Jennings Pond .
Raymond Mayo - Danby Area News - Many areas of the Town do not
receive the Danby Area News . If we are going to use taxpayers money
t o support the Danby Area News then effort should be made to see
t hat every resident in the Town receives it .
Councilperson Marisa responded that has been an ongoing problem and
that trying to get mailing routes that correspond with the Town
boundaries is next to impossible . The post office and carriers
h ave done a good job in trying to accommodate us . It is nearly
impossible to keep the mailing lists up - to - date and postage for
mailing has increased due to individual requests .
Councilperson Marisa gave the following overview of the Fiscal Year
1994 Preliminary Budget : The tax rate increase is under three per
cent ( 3 % ) . The increase to Town employees this year was three per
cent ( 3 % ) . The General Fund is down approximately 12 . 8 % . Highway
Fund is increased approximately 18 % and the overall total of a
three per cent ( 3 % ) increase over the 1993 budget .
Motion to Close Public Hearing :
A motion was made by Supervisor Oltz to close the public hearing
and seconded by Councilperson Miller at 7 : 45 P . M .

The public hearing was called to order at 7 : 45 P . M . by Supervisor
O ltz and the following Notice of Public Hearing was read by the
Town Clerk .
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Danby ,
County of Tompkins , and State of New York , will hold a public
hearing at 1830 Danby Road , Ithaca , New York in said Town on the
8th day of November , 1993 at 7 : 45 P . M . o ' clock , on the proposition
that said Town grant to Contel of New York , Inc . , d / b / a GTE New
York , its successors and assigns , the right to use the streets ,
highways and public places of said town for the erection and
maintenance of poles , cables and other fixtures and appurtenances
for the transmission and distribution of telecommunication services
upon such terms and conditions as may be deemed proper and may be
permitted by law .
At such time and place all persons interested in the subject matter
thereof will be heard concerning the same .
A regular meeting of the Town Board will follow the public hearing .

Raymond Mayo - 335 Ridgecrest Road asked what the is purpose of -
this franchise agreement .
Chris Blaine of G . T . E . - explained to the Public and the Town
Board that when GTE purchased Contel that no original franchise
agreement between Contel of New York and the Town of Danby could be
located . A franchise agreement will grant GTE permission to lay ,
place and maintain cable on poles or below ground through and on
the Town of Danby public highways , lanes , streets and other public
places for the purpose of transmitting and distributing
telecommunication services over said cable .
Motion to Close Public Hearing :
A motion was made by Supervisor Oltz and seconded by Councilperson
Marisa to close the public hearing at 8 : 00 P . M .

1 ) New Business - Addition of delinquent water bills to the tax
rolls for collection - Resolution
County Representative Report
Representative Proto reported on the following :
1 ) . Landfill Neighborhood Protection Committee - He is concerned
about the monitoring program at Hillview Road Landfill .
2 ) Unpaid Annual Solid Waste Fees - will be added to tax bills
for 1994 .
3 ) County Budget Meetings - are in progress and the public is
invited .
4 ) Open Land Project - study of creeks in Tompkins County is
still open for discussion .
5 ) Cable Franchise - County is entitled to issue a cable
franchise .
6 ) Solid Waste - Public Hearing for Annual Solid Waste Fees for
1994 - November 16 , 1993 at County Board Meeting .
7 ) Airport Terminal - Project on track , under budget and will
open March 1994 .
8 ) Environmental Management Council - Herb Engman was appointed
to the Tompkins County Planning Board as the EMC
representative .
9 ) Sales Tax - County Sales Tax receipts for the third quarter of
1993 are up approximately $ 600 , 000 . The share for Danby will
be $ 89 , 800 . 00 .
S PCA - CONTRACT PROPOSAL FOR DOG CONTROL
Supervisor Oltz reported that the SPCA has submitted a Contract
P roposal for Dog Control in the Town of Danby for 1994 in the
amount of $ 5 , 000 . 00 .
P am Stonebraker , Director of the SPCA introduced SPCA Officer Glen
Grossmann and SPCA Board President Karen Smith . She reported that
the SPCA is interested in providing dog control services for the
Town of Danby in 1994 and have submitted a proposal for

consideration .
G len Grossmann gave a brief overview of the service provided by the
d og control officers of the SPCA and Pam explained how the SPCA
could help the Town raise funds through dog revenue fees . They
also can help with enumeration follow up .
P am reported that the contract proposal for the Town of Danby in
1994 is $ 5 , 000 and is based on a comparison of the demographics of
anby and other towns that they are serving at this time . They
believe it is a fair bid based on their cost analysis .
K aren Smith reported that this proposal is for a one ( 1 ) year
contract . They need to assess the real cost for providing service
t o the Town before they could consider a three ( 3 ) year contract .

Planning Board Report :
Chairperson Nancy Weitzel reported that the Planning Board
recommends Don Schaaf for appointment to the Tompkins County
P lanning Board as the Town of Danby Representative . The Planning
B oard held two ( 2 ) public hearings in October 1993 :

( approved )
2 ) Dennis and June Pollack - ( approved ) .

Supervisor Oltz reported that Deborah Fitzpatrick has resigned from

J oel Gagnon reported that the Solid Waste Advisory Committee will
reorganize soon and new members appointed . There will be a public

P lan ( the environmental impact statement ) .

COUNTY , NEW YORK , TO FINANCE THE COST OF THE
ACQUISITION OF A JOHN DEERE LOADER FOR THE TOWN
OF DANBY .

BE IT RESOLVED by the Town Board ( the " Town Board " ) of

t he Town of Danby , Tompkins County , New York ( the " Issuer " ) as
follows :
S ECTION 1 . Based upon the review of this action by the
I/ Issuer , the Town Board hereby determines that
it is a Type II action under the State
E nvironmental Quality Review Act ( Article 8 of
t he Environmental Conservation Law ) and
t herefore no further environmental review is
✓ equired .
S ECTION 2 . For the object or purpose of paying the cost
o f the acquisition of a loader for the Issuer ,
t here are hereby authorized to be issued
$ 66 , 267 in serial bonds ( the " Bonds " ) of the
Issuer pursuant to the provisions of the Local
Finance Law .
SECTION 3 . It is hereby determined that the maximum
e stimated cost of the aforesaid object or
purpose is $ 66 , 267 , and the plan for the
financing thereof is by the issuance of the
B onds pursuant to this resolution .
SECTION 4 . It is hereby determined and declared ( a ) that
t he period of probable usefulness of the
object or purpose for which the Bonds hereby
authorized are to be issued is fifteen ( 15 )
years and ( b ) that the subdivision 28 of
paragraph a of Section 11 . 00 of the Local
Finance Law of the State of New York is
applicable thereto .
S ECTION 5 . The proposed maturity of the Bonds will be in
excess of 5 years .
S ECTION 6 . An annual appropriation shall be made in each
year sufficient to pay the principal of and
interest on the Bonds as the same shall become
due and payable each year . In addition , the
faith and credit of the Issuer
shall be and are hereby pledged for the
punctual payment of the principal of and
interest on the Bonds as the same shall become
due and payable .
SECTION 7 . Subject to the provisions of the Local Finance
Law , the power to authorize the issuance of
and to sell bond anticipation notes in
anticipation of the issuance and sale of the
Bonds herein authorized , including renewals of
such notes , is hereby delegated to the
Supervisor as chief fiscal officer . The Bonds
and any bond anticipation notes shall be of
such terms , form and content , and shall be
sold in such a manner as may be prescribed by
the Supervisor , consistent with the provisions
of the Local Finance Law .
SECTION 8 . The validity of the Bonds and any bond
anticipation notes may be contested only if :
a . such obligations are authorized for
an object or purpose for which the
Issuer is not authorized to expend
money , or
b . the -inromisio the whit should
e co pre with a date o e publication
of the resolution or summary thereof , are not

substantially complied with , and
an action , suit or proceeding contesting such
✓ alidity , is commenced within twenty days
after the date of such publication ; or
c . such obligations are authorized in
violation of the provisions of the
constitution of the State of New
York .
S ECTION 9 . This resolution shall be published in full in
t he Ithaca Journal , the official newspaper of
t he Issuer , together with a notice of the
Clerk of the Issuer in substantially the form
provided in Section 81 . 00 of the Local Finance
L aw .
SECTION 10 . This resolution is adopted subject to
permissive referendum in accordance with
S ection 35 . 00 of the Local Finance Law . This
✓ esolution shall take effect thirty ( 30 ) days
after its adoption or , if a petition is filed
pursuant to Article 7 of the Town Law , upon
t he affirmative vote of a majority of the
qualified electors of the Issuer voting on the

CONDUCT OF TOWN OF DANBY GOVERNMENT AND ESTABLISHING THE RATES OF
COMPENSATION FOR OFFICERS AND EMPLOYEES FOR SUCH PERIOD .
WHEREAS , the Town of Danby Town Board has met at the time and place
specified in the notice of public hearing on the Preliminary Budget
for Fiscal Year 1994 and heard all persons desiring to be heard
thereon ; now , therefore be it
RESOLVED , that the Preliminary Budget for Fiscal Year 1994 as
amended and revised and as hereinafter set forth is hereby adopted
as stated in the column titled " Adopted " and they hereby are
appropriated for the objects and purposes specified and the
salaries and wages stated in Schedule 5 of such budget shall be and
are hereby fixed at the amounts shown therein effective January 1 ,
1994 .
Discussion :
Councilperson Marisa said that the 1994 General Fund Tax Rate in
the budget is approximately $ 2 . 0889 per $ 1 , 000 . 00 .

FRANCHISE AGREEMENT - TOWN OF DANBY AND CONTEL OF NEW YORK , INC .
d / b/ a GTE NEW YORK
B y Councilperson Marisa : Seconded by Councilperson Schwartz
WHEREAS , an application has been duly made to the Town Board of the
Town of Danby , County of Tompkins , State of New York by Contel of
N ew York , Inc . d / b / a GTE New York , for permission to lay , place and
maintain cable on poles or below ground with splice boxes or
closures through and on the public highways , lanes , streets and
o ther public places in said Town for the purpose of transmitting
and distributing telecommunication services over said cable ; and
WHEREAS , said Board having called a public hearing , notice of which
was given by publication thereof in the official newspaper of said
Town at least ten days before the meeting , and the Board having
d uly convened and held. said hearing , a quorum being present , and
h eard said application and concluded that the grant thereof would
be in the public interest ; now therefore , on a motion duly made
and carried ; be it
RESOLVED , that said Contel of New York , Inc . , d / b / a GTE , New York ,
( hereinafter called the Company ) , its successors and assigns is
hereby granted the right and privilege to lay , place and maintain
cables on poles or below ground for transmitting and distributing
t elecommunications and to erect and maintain poles , cables , splice
boxes , closures , cable stems , arms , braces , switching equipment and
all other necessary and usual attachments and devices , and to
suspend cables over , through and on the public highways , lanes ,
streets and other public places in said Town , and to transmit over
said cable at all times telecommunication service .
That at all times after the placing of said poles and the
installation of said cable , said Company shall be permitted to
e xamine and keep the same in proper condition and repair , and do
all necessary work properly to maintain the construction thereof .
This . grant and privilege is made upon the following terms :
1 . That the poles and underground cables shall be located
u nder the direction of said Town Board or its duly authorized
agent .
2 . That all of said poles , cables and fixtures shall be
placed , erected and maintained in a proper workmanlike manner so

t hat the same shall in no way endanger the public , and the said
Company shall at all times indemnify and save harmless the said
Town and the members of said Town Board , from and against any and
all actions , suits , damages , costs , charges and expenses by reason
o f the location and maintenance of said poles , cables and fixtures ,
in any streets , avenues , lanes and other public places , or by
✓ eason of any act done or omitted to be done in the premises by
said Company .
3 . This grant and permit is made upon condition that
permission be secured from such public officers and commissions as
is required by law , and the consideration hereof is the expenditure
by said Company of the funds necessary for the construction of said
t ransmission lines and the proper maintenance thereof .
IN WITNESS WHEREOF , said Town Board of said Town has caused these
presents to be subscribed by its members this 8th day of November ,
1993 .

t ransfer funds before warrants are prepared in lieu of the transfer
