Supervisor Oltz called the meeting to order at 7 : 05 P . M .
Public Hearing Date for Preliminary Budget for Fiscal Year 1994
S upervisor Oltz reported that the Town Board must set a date for a
public hearing on the Preliminary Budget for Fiscal Year 1994 .
RESOLUTION NO . 44
DATE SET FOR PUBLIC HEARING - PRELIMINARY BUDGET - APPROVAL
B y Councilperson Marisa : Seconded by Councilperson Hile
WHEREAS , the Town of Danby Preliminary Budget for Fiscal Year 1994
h as been completed and filed in the Office of the Town Clerk , 1830
D anby Road , Ithaca , New York where it is available for inspection
by the public during regular office hours , now be it
RESOLVED , that the Town of Danby Town Board hold a public hearing
on , Thursday , November 4 , 1993 , 7 : 30 P . M . , 1830 Danby Road , Ithaca ,
N ew York to hear comments from the public for the Fiscal Year 1994
P reliminary Budget .

E asement for NYSEG :
Supervisor Oltz reported that NYSEG has requested an Easement
Agreement to set a pole for electric service to the new West Danby
Fire Station and moved the following resolution :
RESOLUTION NO 45
EASEMENT FOR NEW YORK STATE ELECTRIC AND GAS - APPROVED
B y Supervisor Oltz : Seconded by Councilperson Hile
WHEREAS , New York Electric and Gas has requested an easement to
place a stub pole with anchor for a new line to the New West Danby
Fire Station , and
WHEREAS , the pole is to be staked in a field located on the West
D anby Water District property and requires that the Town of Danby
grant an easement to set a pole , now be it
RESOLVED , that the Town of Danby Town Board authorize the Town
S upervisor to sign an easement granting New York State Electric and
G as ( NYSEG ) permission to set a stub pole on the West Danby Water
D istrict property to provide electric service to the New West Danby
Fire Station .

Bonding for John Deere Loader
Supervisor Oltz reported that she is in the process of obtaining
bonding for the John Deere Loader . A Bond Resolution will be
submitted for consideration at the November 1993 Meeting .

B udget and accepted as submitted .

Affidavit of Neighborhood Notification was submitted for the
✓ ecord .
Clifford Hill addressed the Planning Board and reported that this
w as a request for approval by the Planning Board to subdivide two
( 2 ) building lots from his property . His plan is to place
manufactured homes that are similar to the ones Mr . Hovanec placed
n ear Steam Mill Road on the subdivided lots .
J oel Gagnon asked Mr . Hill if he had obtained Health Department
approval for septic and sewage .
Mr . Hill said that this was a preliminary request for subdivision
and he has not asked the Health Department for approval at this
t ime . The proposed lots are large enough to allow for problems
should they occur . The soils in this area are gravel , ' on a natural
g rade , and there has never been a problem with water or sewage .
D iscussion followed regarding access to the back property .
Clifford Hill said that he plans no further development of his
property .

Pat Darsie - 9 Hornbrook Road - asked what was the property to be
used for and how it would affect drainage . She reported that there
is a problem with drainage from other properties near her home .
Elizabeth Lindsay - 71 Middaugh Road - responded that a single
family residence is proposed to be built there and that the
drainage will flow away from her property .

H ILLVIEW TERRACE SUBDIVISION & MOBILE HOME PARK EXPANSION -
PROPOSAL Review of the Part 2 - Project Impacts and Their Magnitude
K en Horst asked Susan Beeners to give a brief review of the project
for the new members of the Planning Board .
A copy of the petition addressed to the Danby Planning Board and
the Danby Town Board - dated April 2 , 1992 - submitted to the Town
Board on April 13 , 1992 and to the Planning Board on April 15 , 1992
was presented to the Planning Board by Susan Beeners .
E loise Green asked if the names on the petition were materially
different than the persons who attended the Public Information
Hearing .
D on Schaaf said that in regard to her comment as to whether or not
the persons were the same doesn ' t elude to the fact that there were
as many or more people who were speaking in support of the proposal
at the public information meeting .
Joel asked if he could see a copy of the geologists report .

J oel said he is concerned that further development may affect the
neighbors water supply .
E loise asked Joel if he knew the condition of the neighboring wells
and do they need new ones anyway .

D on referred to the public meeting when people reported problems
w ith their wells over a long period of time but they have not done
anything to correct the problem .
Susan referred the Planning Board to the back portion of the EAF
P art I and the letter dated April 1 , 1992 from John Anderson of
Tompkins County Health Department to Supervisor Oltz regarding the
w ater supply for the park and the proposed expansion . She said
t hat draw down tests , if appropriate , would be conducted prior to
any building permit issuance .
Ken said that we have to base any judgement that we make on what
the experts say . The geologists and the health department , in his
o pinion have to be the experts .
Chairperson Weitzel requested that further discussion of 5 - E be
d eferred .
S ection - 18 - Impact on Growth and Character of Community or
N eighborhoods .
Joel said that he questions as to why there is a lot of opposition
by the neighbors . He understands that water is a part of it but
there is concern of the effect on property . Joel referred to
problems in other mobile home parks in the county with poor
maintenance , crime , services , etc . and said that the tenants cause
problems to surrounding neighborhoods . What happens to the
maintenance and conditions in the park if the owners should sell
it . He thinks that there should be rules and regulations to be
e nforced for public safety .
Arch asked if it was reasonable under public health safety to
✓ equest a tenants agreement for the mobile home park that address
maintenance and other reasonable issues .
Mary Lou said that all mobile home parks must file rules and
✓ egulations for certification with Community Housing and Renewal to
be certified . She suggested that Joel obtain a copy of the Mobile
H ome Tenants Handbook before making suggestions for additional
✓ ules .
K en Horst said that this design for the park is a great improvement
o ver the last plan the Planning Board reviewed for this proposal .
D on Schaaf said that we seem to be locked in to the focus of
n egative aspects of what could happen without giving any
consideration to the positive aspects .
J oel proposed that in 18 - C there is a definite impact as it is in
a low density zone .
D iscussion - Section 5 - E
Ken Horst said that he still feels very strongly that Section 5 - E
is one that we have experts opinions on .
Ric Dietrich - said that the neighbors may want to get their own
e xpert opinion .
J oel said that getting another opinion might make the neighbors
more comfortable but there are people surrounding this development
who have marginal water .
Chairperson Weitzel asked Joel who were the neighbors who had
marginal water supply that he is concerned about .
Joel did not respond but Ric Dietrich said that he did not know of
anyone who doesn ' t .

Mary Lou Hardesty asked that the neighbors get statistics on all of
t hese wells .
P roposal to Change Section 5 - E
J oel Gagnon proposed that Section 5 - E be amended from No . 1 - No
impact on water to No . 2 Potential Large Impact .
A vote on the proposal resulted as follows :

Arch asked the Planning Board to request information from the
n eighbors regarding the history of their water problems and supply .
The Planning Board Chair requested that documentation and history
o f the neighborhood wells be submitted to the Planning Board by the
n eighbors who have reported problems . That information should
include when the well was drilled , how deep is it , what the yield
was when it was drilled and what is the yield not . The information
must be received within the next four ( 4 ) to six ( 6 ) weeks and
preferably by the November 17 , 1993 Planning Board Meeting .
K en Horst stated that this is a major development the Planning
B oard has been working on for over two ( 2 ) years .
Ric Dietrich said that the people have not had access to this
information before . He would be upset if the Town went speedily
t hrough it .
D on Schaaf responded to Mr . Dietrich that people who currently live
in this mobile home park , are residents of this community and have
h ad an option to come to all of these public hearings and express
an opinion . He would certainly think , that if there were some who
h ad adverse comments that they would have taken that same
o pportunity to come to the public hearings and express an opinion .
O ut of order discussion followed with a member of the public
e xpressing how he thinks the mobile home park should be operated
w ith specific rules for tenants .
Mary Lou asked what information is needed before a formal public
hearing can be scheduled . She said she is not willing for this to
continue for two ( 2 ) more years . She said there was a lot of
support for this project at the public information meeting .
Motion to Hold Special Meeting :
A motion was made by Ken Horst seconded by Arch Dotson to hold a
brief meeting on Thursday , October 28 , 1993 from 7 : 00 - 7 : 30 P . M .
to decide what the next step is with the Hardesty Proposal .
