Avery , Town Clerk Other Town Staff: Mahlon Perkins , Town Attorney Kevin Ezell , Code Enforcement Officer David Sprout, Code Enforcement Officer Supv Sumner opened the meeting at 7 : 35 p . m. and board members and guests participated in the pledge of allegiance . PUBLIC HEARING UNSAFE STRUCTURE 114 IRISH SETTLEMENT ROAD Supv Sumner explained this proceeding has to do with a barn at 114 Irish Settlement • Road owned by Paul Cook . A portion of the building is dangerous and unsafe . Code Enforcement Officers have asked the town board to order the removal of that section and make the remaining structure secure. Paul Cook said he has he has been getting estimates and is trying to get financing to repair the barn . There are no workers in that part of the barn , but there are a few heifers in the barn . He doesn 't believe it is in any danger of falling down . Supv Sumner said it appears he has plans to fix it, an estimate , and someone to do the work, but doesn 't have the funds to do it. P Cook said that is correct. Craig Anderson said he visited the site with Code Enforcement Officers Ezell and Sprout. He said they walked away with the understanding that it will not collapse in the near future , though the roof is caved in . In his opinion , what is standing is structurally sound . The owner has put up caution tape . K Ezell said he doesn 't sec that there is a change in the condition of the building. What is standing appears to be structurally sound and it doesn 't appear that it will fall over. If it was secured against entry (more than caution tape) , then that might be one thing. He recommends securing with plywood or barn board . If the doors work , they should be closed. Caution tape would give a visual warning, but not stop entry . Snow fence might keep out small children . Cl Stelick said the building has been in disrepair for quite some time . In July of 201, 1 the property owner was consulted and nothing has happened since . P Cook said he did come in and discuss the matter with Dan Kwasnowski . • L Lavine asked whether the building was stable . Page I of 11 TB 3- 15- 12 Supv Sumner said the code officer's report says the building is open at the end walls making it accessible to and an object of attraction to minors as well as vagrants and trespassers . It is unfit for the purpose for which it may be lawfully used Cl Lavine said she had been under the impression that this was a hazard and that d.oesn 't seem to be the case . CO Ezell said it is an attractive nuisance . It could fall in on someone or they could walk in to a spot that would give way. Someone could enter the building and start a fire or cause other problems, Bruno Schickel agrees that caution tape is not a good barrier. He recommended use of physical barrier like a snowfence . That would reduce the risk to the public . Ci Stelick said he believed the code enforcement officers should visit the site with the property owner and come up with a plan to at least minimize the risk short term, and then the propert}, owner should come up with a long term plan for this, The property owner has been given notice and this situation didn 't happen overnight. Supv Sumner said code enforcement has been working on this. The property must be made safe and has now become a team wide liability . She agrees with one more month to come up with a plan . Cl Leifer asked that they put up snowfeoce in the meantime, H Ezell said the west side of the structure needs to be secured . Sups Sumner said she would like a plan for repair or demolition by the end of the summer. R Szymanski asked Sups Sumner to explain the town 's liability. She said once a building is recognized by the town to be unsafe , she assumes them is some town liability . . • Atty Perkins said the town has a local law regarding collapsed buildings , and a report from code enforcement that it is unsafe . If someone were injured them, they could probably take action against town _ Whether they were successful is another matter. The town would be subject to ridicule because it does not enforce its local laws. Lloyd Ki.mmich said this is no different than someone getting in your house and getting hurt. If this barn was on another road out in the country , the town probably wouldn't pay any attention to it and it would he the same safety buildings . he said them is house on Route 13 that appears to be unoccupied and is falling down and the town hasn 't done anything about ttxat , he doesn 't understand why this has happened . Sups Sumner said the town evaluates things on a case by case basis , That house he referred to is boarded up and not open to the public. It's not the same situation _ Atty Perkins said the Order requites that work be commenced within 30 days and completed within 50 days of service of the notice . The Board could grant an extension of time for commencement and completion of work to whatever period of time the board believes is reasonable, Notice was served February 17 , 2011 . After discussion , the board decided to extend the Order 45 days . hi Lavine will make arrangements with the property on.ner to view the structure prior to that time , RESOLUTION #TO [ 012J - GRANT EXTENSION win' RESPECT TO UNSAFE STRUCTURE • 114 IRISH SETTLEMENT ROAD upv Sumner offered the following resolution and asked for its adoption : Page 2ofll imma TB 3- 15- 12 • RESOLVED, that this Town Board hereby extends Order for the unsafe structure at 114 Irish Settlement Road by 45 days, and the property owner will update the board with respect to his progress at the April 19 , 2012 , town board meeting. 2 "d Cl Leifer Roll Call Vote Cl Stelick Yes Cl Solomon Yes Supv Sumner Yes CI Leifer Yes Cl Lavine Yes PUBLIC HEARING UNSAFE STRUCTURE BONE PLAIN ROAD Supv Sumner explained this matter involves a residence at 473 Bone Data Road that has been posted against occupation since November of 20 .10 , Property owner, Ellen Ross said she and a friend have started working on the property_ She plans to sed the two ears and move things from the house to the shed, She said the house is good inside and the furnace is now , but she didn 't have money for propane so they took the tank . She will do things as she has money . Supv Sumner said the problem is that is not safe to Live there , and she knows that it is not getting better , E Ross said the building is safe , and she will work on it as she has money . • She has been paying on the mortgage and doesn 't want to lose the house . It is perfectly good inside and she needs to rearrange things inside . dupe Sumner said it is not safe to live in , and you are not allowed to have a storage building without a house there, It has been posted as unsafe to live in, The problems include an excessive accumulation of items inside the home . The code enforcement officials climbed over stuff to gain access to the home , There is o narrow path through the accumulated items that allow limited access, A side covered entrance appears to be falling away from the main house and is so full of items that you can 't reach the door_ The addition is so full that looking in you cannot see any of the windows or doors of the original part of the home and cannot travel beyond the entry way . Because of a leak the home has been without water since 2010 _ The status of the septic system is unknown , The furnace has been out of service for many years_ The wood stow has been removed or disconnected. The home was posted against occupancy because it is unfit for human occupancy . It is unsafe because of the degree to which it is in disrepair, is unsanitary , vermin or rat infested, contains filth and lacks maintenance , lacks ventilation , illumination , and sanitary heating facilities or other essential equipment as required by the code . E Ross said she has put stuff in there and did not want: people in . She said the house is structurally sound . The furnace is only four years old _ The roof isn 't falling in and the hack is certainly okay. Cl Stelick noted the report of code enforcement states the roof is sang and there is clear evidence along the caves of extensive deterioration . The front exterior wall is rotted at grade and it appears the framing members are rotted as well . The large front window pane has popped out of the frame and the sills are rotted . Other windows are broken and inoperable _ E • Ross disagrees and said there is no reason to tear the house down , rage iFt 'I•B 3 - 15- 12 Cl Lavine said there are two issues here and one is a hoarding issue. E Ross said she can take stuff out . She is a fabric artist and needs her materials , her clothes and her books . Cl Lavine said if the stuff could be removed the house , there could be a cost analysis to see whether the house is worth fixing, Supv Sumner said nothing has gotten better since code enforcement started working on this. E Ross said her belongings will not be hauled away _ Once you can get in , you can see the place is structurally sound . There are no leaks in the house except where the furnace pipe goes out and in the entry nay . The town is trying to deprive her of her home_ Supv Sumner said she will consider an extension . She will come and visit . if a subtantial amount of stuff is moved in a week, she could visit and report on that. She would like to see ten square feet of stuff removed by next Friday . There was a question about whether someone could have a storage building on their property if there is no residence , and whether the building can be considered a residence because it had been pasted against occupancy . B Schickel asked if this is the only option or can the Town remove everything from it and then investigate whether there is an in between _ Houses with rotted sills and eves can be fixed _ A lot of homes are packed to the rafters and create dangerous situations , Cl Leifer said he would be agreeable to giving her an extension. Code Enforcement Officer p Sprout said the only reason it is posted against occupancy is because she let him in . In his hind it is still a residence, but has been posted against occupancy . The electrical mast has tone away from the roof. The roof is failing and the exterior is deteriorating . It isn't accessible because there is so much stuff in it, There are a lot of issues . If it were cleaned out , they might be able to assess whether it can be fixed . 5 Ross is resistant to help. Supv Sumner said the condition of property is affecting neighbors. CI Leifer asked if rho could board up windows , etc so no one could get inside if that would address the public safety question_ babe Sumner said E Rose has told the Judge several times she will clean it up and then nothing happens , The board agreed to allow an extension , RESOLUTION #71 (2012) — GRANT EXTENSION mum RESPECT TO UNSAFE STRUCTURE 473 BONE PLAIN ROAD Supv Sumner offered the following resolution and asked for its adoption : RESOLVED, that this Town Board hereby extends Order for the unsafe structure at 075 Bone Plain Road by 45 days , to allow the property owner to make progress on removing material from the property , and the property comer will update the board with respect to his progress at the April 19 , 2015 , town board meeting. • 2nd 51 Leifer Roll Call Vote CI Stelick has Inn4otIi TB 3- 15- 12 • Cl Solomon Yes Supv Sumner Yes Cl Leifer Yes Cl Lavine Yes Supv Sumner said people wishing to speak during the citizens privilege portion of the agenda should sign in and limit their comments to three minutes . She added that the board is trying to keep public comment to this portion of the meeting, rather than have interjections during the meeting_ CITIZENS PRIVILEGE Tim Woods, 118 Johnson Road , said he is speaking as the coordinator for the Dryden farmers committee that has been formed , and presented a petition to establish a Dryden Agricultural Advisory Committee, a formal committee that the mown board would establish and recognize and use in an advisory method . He read the petition that was presented containing approximately 30 signatures gathered in the last few days . He also presented the resumes of 6 farmers that are interested in serving on an Agricultural Advisory Committee . Evan Carpenter, 2263 Dryden Road , read a statement from the Farmers Committee requesting that the town board delay voting on the proposed CLAs until the Conservation Board has been given a minimum of 60 days to re-write the proposal _ They would like the process to include procedures similar to those used when designating the unique natural areas in the town , consultation with landowners in each proposed CEA _ They would like a complete list of the criteria, lists, etc used in designating the CEAs . The vote should also be delayed until • the Agricultural Advisory Committee has been established and had time to review and comment on the Cdhe , and until after public hearings have been held to discuss the re-write . Supv Sumner said she has a message from the Chair of Conservation death that they are requesting additional time to deliberate on the critical environmental areas proposal . Ron Szymanski, Johnson Road , said if you look at the DEC website , it shows one CEA in Tompkins County. That is a disconnect from the 30 plus proposed in the Town. There needs to be more study on this issue . The one that is there is designated for an area that is exceptional or unique . This is a tool that can be used in a municipality, but it is em extreme tool . We need to keep that in perspective _ Dan Schmohe , 2035 Dryden Road , said the Dryden Lake Festival (to be held July 28) would like to provide camping for event participants_ They have applied for a permit through. DEC and was told Town must also approve carnbing. The reason for this is that some of the participants in the triathlon would like to camp because of the distance they come from _ They also want to provide early access for people setting up concessions. The Revolutionary War people would also like to camp overnight_ A copy of the application was left for the board to review . Supv Sumner said she will. check with departments and the board will vote on this next month , Bruno Schickel , dfd Schutt Road , urged the board to take the farmers proposal seriously_ Their prosperity is vital to keeping and preserving the very things we love about the area . de hopes the board would give greater consideration to the needs of the farmers and • what they need to prosper so that can help present the landscape_ Pagetofll TB 3- 15- 12 • Don Scutt , said he just came from Kiwanis youth ball _ He thanked the town for continuing to support that program . They are looking at more than 330 participants this year The program is growing by leaps and bounds . He apologized for his last visit to a town board meeting He may have been harsh in the way he ended his speech and apologized for that. He still believes that property taxes am out of control . When it comes to budget season , look at • three different types of budgets and start a citizen advisory board for finance , Hugo Sumner moved the Bolton Point UAW contract up on the agenda. The contract has been approved by the personnel Committee . hobo Sumner thinks it is a well -negotiated contract, with a 2% increase each year . it provides for fully paid health insurance until 2014 when employees will contribute 15 per month . This contract was written to expire in the some year as the engineers' contract. The contract is the S same as was used for the previous enumeration . COUNTY BRIEFING Page 7ofiI eft 3- 15- 12 from the independent redistricting committee . There are not a lot of changes in the Town of Dryden . Most of the changes are in the City of Ithaca . Town Districts 13 and I4 will have some changes in the Caswell Road area,_ District 14 will lose some population and District 13 will gain some . The Town will have an opportunity to weigh in on this in the future. The City is looking at a proposal of having 5 city wards or 4 city wards that are coterminous with the four districts . The county is proceeding to fund a contract with IaBella Engineers for administration of a road protection law , They need a way to determine the status of roads before and after Projects within the confines of the new law. They looked at Delta and other firms , and LaBelle stood out for them . They have a higher level of road management than some of the towns do, and hope some of the information they produce will be useful to the towns as well. M Lane said he understands the town now has a map of the aquifer, and hopes that it will move an aquifer protection law forward _ Supv dumper said she is hoping to it have on the agenda for discussion next month . M Lane and Cl Leifer discussed a resolution that the cable cornmissian would like passed by municipalities with respect to negotiating renewal of franchises. There is no obligation of funds for commitment for franchise approval , M Lane said he recently spent time with a consultant from Earlvale . They could do an audit to see if municipalities are receiving the full amount of the franchise fees due them . M Lane will take the resolution to the county for their support , hope Sumner thanked Mike L.a.ne for making it possible for Jack Bush to participate in the search for a new County Highway Director, M Lane said hopefully they will ferret out a • geed candidate. In the meantime , Cheryl Nelson has stepped in and is doing a great job . PLANNING DEPT No report_ • ENGINEERING No report. dupe Sumner said she would like to review the SEQR for the Yellow Bern Road Water District at the April meeting. ATTORNEY do report, UNFINISHED BUSINESS None . NEW BUSINESS Cl Leifer explained that TCCOG has formed a subcommittee to discuss whether to form a cable commission to negotiate with Time Warner. Most municipalities have franchise agreements expiring in 2013 . Some (like Dryden ) are operating under expired agreements , he has distributed a proposed resolution to form that committee, and some historical information, he believes it would be in the town 's interest to continue these discussions and them is some • sense and strength in numbers. Cl Ptclick said it is a move in the right direction , rage t of 1 ' 1133- ] 5- 12 • The board and M Lane discussed the proposed resolution and removal of the sixth 'Whereas' with respect to future costs for the municipalities and the board agreed to remove that paragraph. RESOLUTION 475 (2012) - AMEND PROPOSED RESOLUTION IN SUPPORT OF FORMATION OF A CABLE COMMISSION Supv Sumner offered the following resolution and asked For its adoption : RESOLVED, that this Town Board hereby amends the proposed resolution to form a consortium for the purpose of negotiating a renewed franchise agreement with Time Warner Cable by removing the sixth 'whereas' from said proposed resolution. 2nd Cl Ste lick Roll Call hate Cl &click Tee Tl Solomon Tee Tape Sumner Tee TI Leifer Tee Cl Lavine Tea RESOLUTION 476 (20121 - ADOPT RESOLUTION IN SUPPORT OF FORMATION OF A CABLE COMMISSION • Pope Sumner offered the following resolution and asked for its adoptiom WHEREAS , the Town of Dryden is provided cable service by Time Warner Cable ; and WHEREAS , the Town of Dryden recognizes the advantage of cooperation with other municipalities 'with mgard to cable franchise issues ; and WHEREAS , the Town of Dryden is interested in exploring , through the Tompkins County Council of Governments, the possibility of entering into an agreement with other municipalities to farm a Consortium to negotiate , on behalf of the Town of Dryden , a renewal franchise agreement with Time Warner Cable ; and WHEREAS , the intent would be to form a Consortium with the authority to conduct public hearings, conduct surveys , and engage in ah activity , within the limits of applicable State and Federal Law , that is necessary and appropriate to negotiating a renewal franchise agreement for its member municipalities ; and WHEREAS , the Consortium may be charged with analyzing the financial , technical , and legal issues related to cable television regulation to enable the member municipalities to mach sound judgments in exercising their regulatory authority with regard to such matters as cable television rates , franchise fees, and nature and quality of service ; and WHEREAS, all members of the Consortium would individually reserve the right to approve , disapprove, or amend the franchise agreement so negotiated on their behalf; and NOW THEREFORE , it is • Pjinb t rt TD 3- 15- 12 RESOLVED , that Town of Drvden does hereby express interest in exploring the Possibility of forming a consortium of municipalities to negotiate on its behalf for the renewal of its franchise agreement with Time Warner Cable; and it is further RESOLV € 17 , that Town of Dryden does hereby reserve the right to refrain from joining the consortium should the terms and conditions of joining the consortium prove to be unacceptable to the Board. 211d it Stelick Roll Call Vote Ci Stelick Yes Cl Solomon Yes Supv Sumner Yes CI Leifer Yes 1 Lavine Yes COMMITTEE REPORTS Emergency Services Committee - Supv Sumner said she met with the chiefs and others who are working on remappinb coverage areas and establishing guidelines by which coverage areas and response tunes are determined and approved _ She thanked Mark Bell for his assistance with this , as well as Brian Wilber. They are also discussing improvements to the training facility in Etna and whether the town might assist with funding improvements to that facility which all departments and the county are finding to be useful. • Finance Committee - Cl Stelick said they root with the bookkeeper and had preliminary talks about the budget_ They had a good meeting and will continue to meet each month . Supv Sumner mild she applied for an extension for filing the Annual Update Document • today , The examiner from the Local Government and School Accountability Office was here today and Supv Sumner said she thinks she will be a big help in the weeks to come . Personnel Committee -- Cl Stelick said he has an update on the maternity leave policy . The proposal is to pay full salary during the one week gap before short term disability kicks in . Something just came no about the Family and Medical Leave Act. They are working on a policy and have a little tweaking yet to do . They have a basic understanding of what they want _ Employees will continue to accumulate benefit time while on maternity leave _ They hope to have a final proposal for next month. Cl Stelick said he had an email about a new highway hire asking for a cash payout for opting out of our medical insurance _ CI Stelick said this is a slippery slope and will cloud the salary. structure . He said this is something the Personnel Committee should look at_ Supv Sumner said she would like a formal opt out policy . The Personnel Committee will discuss this in April, lo the meantime, Cl Stelick will let the Highway Superintendent Than that they are looking at this . Supv Sumner said the 'Teamsters will be renegotiating and this is something they asked for this last time , Loans & Grants - No report_ Technology Committee - C1 Leifer said Concept Computing is resigning, It is the attorney 's opinion that we could take next person on the list from last RPP because it was such Page 10 ofll TN 3 - 15- 12 • a short time ago . CI Leifer is comfortable with recommending 1V4 . Supv Sumner will write to them and see if their offer still stands. There is a recommendation for a new server and they are getting estimates . The Rec Department is looking at new software and has had six demos . All have add- on modules . M Bianconi expects to have a recommendation to the tech committee before she goes on leave. Infrastructure Committee - No report. Recreation/Youth/ Community Centers Committee - The Recreation Commission is reviewing grant applications . They currently have 12 - 15 applications from agencies beyond community centers . This expands programs without increasing town staff. Expect recommendations for approval at the April board meeting. Supv Sumner recognized CI Stelick for getting this grant program up and running as well as Don Scutt , Dan Schmohe , and David Makar. Cl Lavine said she had a discussion with Deborah Goldberg and explained that the role of lead counsel versus non -lead is that they are the one that does the oral arguments and if there were differences of opinion , they would have the greater say, however the ultimate say goes to the client. So it is somewhat of a moot point who has the greater decision making power . The bottom line is that in either of the relationships that we have been discussing, Deborah Gold berg or Whiteman Osterman , the relationship would be the same . The other party would be the lead counsel and our town attorney would be co-counsel , but not lead counsel . • CI Stelick said with respect to the Ag Committee , he would like to work on this and come up with recommendations . He feels it is something the board needs to move on . He would like to come up with some recommendations on how many people , how long a term , etc . He asked that any board members with suggestions get them to him . In the meantime the CEAs are delayed until we're comfortable with what we are doing. He will be meeting with CI Leifer on April 12 prior to the board meeting and they can discuss it then . Cl Lavine asked if we needed to define members of farming committee. Cl Stelick said that it is important because we need to hear the voice of those who are truly involved in farming and what that is . They need to be defined . Supv Sumner said there is language in the Planning Board legislation with respect to allowing them to designate an agricultural member and it refers to income . Evan Carpenter said the farms who had attended their meetings included vegetable farmers, horse people , etc , as well as dairy farmers .
