Chairperson Weitzel called the Public Hearing to order at 7 : 35 P . M .
and read the following notice of publication .
" NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the
Planning Board of the Town of Danby on Thursday , August 5 , 1993 ,
7 : 30 P . M . , 1830 Danby Road , Ithaca , New York , 14850 . Purpose of
hearing is to consider granting a Special Permit for the proposed
construction of a 2160 + 1 - sq . ft . grading shed at Wilbur Lumber
Company , Bald Hill Road south of Lieb Road , Town of Danby Tax
Parcel # 15 . - 1 - 15 . 22 . Commercial Zone Cl , Ralph Wilbur , applicant .
At such time and place all persons interested in the subject matter
thereof will be heard concerning the same .
A special meeting of the Planning Board will follow the public
hearing .

S cott Daigler - 282 Bald Hill Road - Asked the Planning Board why
it is necessary to file for a special permit .
S usan Beeners responded that it is necessary to hold a public
hearing for a special permit because it is requirement in our
Zoning Ordinance .
Mr . Daigler said he lived down the road from the lumber mill and
wondered what kind of an impact it might have on the residential
area noise wise , etc . and asked if there were regulations
regarding noise limits .
Joel Gagnon and Arch Dotson responded that moving the grading shed
away from the road ( as shown on the sketch plan ) should reduce the
noise level from the neighborhood .
Ronald Rorick ( an employee and neighbor to the lumber mill ) said
that there should be less noise because it is set further back on
the property .
Mr . Daigler said that his neighborhood is becoming increasingly
more residential and asked if there were restrictions on how late
at night work could go on when the operation creates noise .
Sometimes trucks come into the mill late at night . ( Has not
noticed any this summer . ) He said the beeper on the loader
disturbs him when trucks are unloaded .

Mr . Rorick said that three ( 3 ) or four ( 4 ) times a year trucks come
in at night . He lives next door and sometimes doesn ' t hear trucks
when they come in at night .
Susan said that there is nothing in our ordinance that covers

noise .
Rod Randall - 2016 Danby Road - said maybe this is a time for the
Town of Danby to consider a noise ordinance .

Members of the Public :
E linor Randall - 2016 Danby Road - said she lives diagonally across
from where this proposed doublewide will be placed . There is
already one that was placed one ( 1 ) year ago and is nicely
kept up . At that time she had strong feelings about this and wrote
t o the Planning Board and sent copies of letters to their
n eighbors . Rod and Elinor Randall have concerns about the fact
t hat the Town does not require a foundation to be put under
d oublewides , the resale value of their own land with the placement
of doublewides in the neighborhood . She said that she is also
concerned , after reading in the Danby Area News , that the Town is
considering easing the restrictions on doublewides .
Rod Randall - 2016 Danby Road - said that he felt that doublewides
should be treated as modulars and placed on permanent foundations .
J oel Gagnon responded that doublewides must be mounted on permanent
foundations .
Mary Moon - 132 South Danby Road - said she is concerned with the
mobile home park the effect it may have on water in the area . She
o perates a perennial nursery . She would feel badly about a mobile
h ome placed in her neighborhood .
P rudence Bentley - 296 Bald Hill Road asked if we want to structure

D anby with structures that are not going to generate as much tax
dollars as homes placed on foundations . She is concerned that they
are not going to pay as much in taxes . Is this something we want
t o think about ? Maybe they ( doublewides ) should be taxed higher .
J im Metz - 1979 Danby Road - said that he thinks it would add to
t he tax base and contribute to the tax roll more than an empty lot .
H e said he approves of it and has no objections to a doublewide
placed in his neighborhood . Mr . Metz said that he was authorized
t o speak for someone else ( name unknown ) who also approves of it .
Michael Hovanec - applicant - reported that he received a letter
from Mr . Louis Nezvesky who has no objection to the placement of a
doublewide .
Mr . Hovanec described the home as an $ 80 , 000 . 00 home to be placed
on a permanent foundation . It is an affordable type of housing ,
financing is available , they are resalably priced , and they are
permanent . He said that he has a buyer for the home .
Mike said that he plans to build his own home on his remaining lot .

proposed renovation of the existing Angelheart Design barn . Such
renovation is to include various repairs , conversion of 2600 + / -
sq . ft . for office , production , and processing space , and a new
drive and loading dock . The site is located at 303 Gunderman Rd .
west of Comfort Rd . , Town of Danby Tax Parcel # 9 . - 1 - 9 . 12 , Zone P . D .

S cott Englehart is representing his brother tonight . He said that
t he only outside physical evidence of the proposed renovations will
be a loading dock on the north side of the building .
Robert Strichart - 708 Comfort Road - asked if there would be
increased truck traffic .
Mr . Englehart said that he does not think there will be an increase
in truck traffic . The loading dock is more for the convenience of
being able to unload the goods into the area where they are going
t o be manufactured .
Arch Dotson asked what goods were manufactured at Angelheart
D esigns and how many persons they employ .
Mr . Englehart said Angelheart Designs manufacture mostly women ' s
clothing and employ twenty ( 20 ) persons including the office staff .
Pat Woodworth - 205 Gunderman Road - asked how the waste water from
dyes used in silk screening was disposed of .

Mr . Englehart said he did not know what the disposal system for the
facility was . He assumes it is hooked into it ' s own septic system .
Joel Gagnon said he thinks that in the original plans the disposal
system was placed behind the barn structure .
Mr . Strichart said that certain aspects of the operation have been
disturbing . Lights are left on all night and shine in his windows ,
but the overall proposal does not seem like a major change .
Susan reported that there may be two ( 2 ) or three ( 3 ) parking
spaces added next to the loading dock . There must be a twenty - five
( 25 ) foot set back from the road right - of - way and some modest
landscape to screen the parking lot from the road . The silo on the
property may need to be removed .
Chairperson Weitzel closed the public hearing at 8 : 18 P . M .

H OVANEC REQUEST FOR SPECIAL PERMIT - PLACEMENT OF DOUBLEWIDE
J oel Gagnon said that we keep getting requests for special permits
for doublewides and asked what was the point . If we are going to
have a special permit procedure there ought to be some sort of
conditions that have to be fulfilled that we could review that
would make it worth while . Otherwise it ' s just giving another hoop
t o jump through and putting them to additional expense with nothing
t o show for it .

ANGELHEART BARN RENOVATION
The Planning Board reviewed the Site Plan for Angelheart Design and
discussed the issue of light from the building disturbing the
neighbors at night .
J oel Gagnon offered a suggestion to consider putting curtains on
the windows and closing them at night .
S usan Beeners said that she would convey to the applicant the
concerns raised at the public hearing regarding the lighting and
screening near the parking area .
