Button , Ashley & Elaine Westmiller , Esther Button The Public Hearing was called to order at 8 : 30 P . M . by Chairperson W eitzel and the following public notice was read : " NOTICE IS HEREBY GIVEN , that a Public Hearing will be held by the Planning Board of the Town of Danby on Wednesday , July 21 , 1993 at 8 : 30 P . M . , 1830 Danby Road , Ithaca , New York . Purpose of hearing is to consider Subdivision Approval for the proposed subdivision of a 4 + / - acre lot from the Town of Danby Tax Parcel No . 9 . - 1 - 14 . 2 , 78 . 65 acres total , located on the east side of Bruce Hill Road north of Brown Road . . • , Esther and Percy Button owners ; Dean T . and Bonnie L . Albanese , applicants . At such time and place all persons interested in the subject matter thereof will be heard concerning the same . A regular meeting of the Planning Board will follow the public hearing . By order of the Planning Board Chair Carol W . Sczepanski , Town Clerk Dated : July 14 , 1993 Published : July 16 , 1993 Affidavit of neighbor notification was submitted . Code Enforcement Officer , Susan Beeners said the Albanese / Button subdivision proposal was for a building lot for a single family residence . Members of the Public : Mr . Percy Button presented the following letter to the Chairman of the Planning Board . " Chairman Danby Planning Board 1830 Danby Road Ithaca , New York 14850 Dear Chairman : We , Percy C . Button and Esther M . Button , owners of the Button Farm hereby give notice that we no longer wish to sell any parts or lots of said farm located at 285 Bruce Hill Road . Consequently , we do not wish to consider subdivision approval for the proposed subdivision of a 4 + / - acre lot from Town of Danby Parcel No . 9 . - 1 - 14 . 2 , 78 . 65 acres total . S incerely , P ercy C . Button E sther M . Button " T 32 2 Planning Board Minutes Public Hearing - Albanese D ean Albanese - applicant - asked " why " . Mr . Ashley Westmiller answered for Mr . Button and stated " he d oesn ' t want to subdivide his farm , period . " Mr . Albanese said that he had not been contacted previous to the hearing of the Button ' s decision not to sell the building lot to III them . Mr . Ashley Westmiller said that Mr . Button did not want to make his property a into a development and did not want the property assessment on his farm to go up . Motion to Close Public Hearing_ A motion was made by Joel Gagnon and seconded by Arch Dotson to close the public hearing at 8 : 40 P . M . Chairperson Weitzel called the meeting to order at 8 : 00 P . M . APPROVAL OF MINUTES Corrections to June 7 , 1993 Minutes J oel Gagnon request the following correction to the June 7 , 1993 Working Session of the Planning Board . 1 ) Add complete name of Chairperson Nancy Weitzel 2 ) Second Paragraph -- under Fieldstone Circle discussion - delete [ suggested changing ] - add - Joel Gagnon expressed concern that the review board of the project might terminate when the last house is sold . 3 ) Delete last paragraph - and insert - he wondered what would happen to the restrictions if the review board ceased to exist . 4 ) No . 10 - second page - delete [ perimeter ] add pier foundation system . Approval of June 7 , 1993 Planning Board Minutes A motion was made by Joel Gagnon and seconded by Paul Viscuso to approve the June 7 , 1993 Planning Board Minutes as corrected . Carried Unanimously Corrections to June 16 , 1993 Minutes 1 ) Page 1 & 2 - delete roll call vote 2 ) Page 2 - Under County Planning Report : delete - [ Gloria ] add Steven deGloria from delete [ John ] insert Joan. 3 ) Page 2 - Proposed Subdivision second paragraph - after frontage [ on ] and add as Approval of June 16 , 1993 Minutes A motion was made by Joel Gagnon and Seconded by Paul Viscuso to approve the June 16 , 1993 Minutes as corrected . Carried Unanimously Corrections to May 19 , 1993 Minutes 1 ) Page 1 - Approval of Public Hearing Minutes Fieldstone Circle - insert - Carried Unanimously 2 ) under corrections - 1 ) correct spelling Mr . Ken Thompson N 7 34. 2 Planning Board Minutes July 21 , 1993 2 ) delete quotation marks to before the word " Plans and insert quotes before the word reclamation ; 3 ) insert the word without after plans ; 4 ) insert quotation marks after the word layers " ; 5 ) add quotes after regulations " and delete [ delete the words ] 6 ) insert at and following Public Hearing ; 7 ) under No . 9 - add the word delete after Requested . 3 ) Page 2 - Under - Ray responded - insert quotes " Jones " 4 ) Page 2 - last line delete [ further ] 3 ) Page 3 - second paragraph - delete [ to ] insert from 4 ) Page 3 - insert after Arch Dotson stated that 5 ) Page 5 - Under Dobson - Special Permit - delete [ as stated in t he SEQR ] insert 6 ) Resolution No . 11 of 1993 - Motion made by Joel Gagnon and seconded by Paul Viscuso to amend the last Resolved in Resolution No . 11 as follows : RESOLVED , that the Planning Board requires submission of a landscaping plan and installation schedule for the involved parcel for review [ of ] and approval by the Planning Board at their next regular meeting on June 16 , 1993 . Approval of May 19 , 1993 Minutes A motion was made by Joel Gagnon and seconded by approvethe May 19 , 1993 minutes as corrected . A roll call vote on the motion resulted as follows : D otson Aye Farrell Aye G agnon Aye S chaaf Aye Viscuso Aye W eitzel Aye Carried Unanimously Review of Landscape Plan - Rick Dobson Rick Dobson described his overall landscape plan for Danby Tax P arcel No . 7 . - 1 - 48 . 12 . Motion to Adjourn to Public Hearing A motion was made by Joel Gagnon and seconded by Paul Viscuso to adjourn to Public Hearing . A roll call vote on the motion resulted as follows : D otson Aye Farrell Aye G agnon Aye Schaaf Aye ✓ iscuso Aye W eitzel Aye Carried Unanimously The Planning Board adjourned to Public Hearing at 8 : 30 P . M . and reconvened at 7 : 40 P . M . Overall Landscape Plan - Rick Dobson Property Rick Dobson explained the landscape plan for his property located on Danby Road Danby Tax Parcel # 7 . - 1 - 48 . 12 . The building with t he question mark ( ? ) on Map B is future plans for that area . The area just above that area is for twenty - two units for elderly h ousing . He said he wants to put in something to generate income 1 7 r i ' 3 3 Planning Board Minutes July 21 , 1993 to pay his taxes . Mr . Dobson said that there is a question as to what kind of siding can be used to enclose his building in with . S usan said that the problem is that it was stated at the meeting III the understanding was that the building was going to be a pavilion . It might be sided at some future date but was not part of the proposal . Mr . Dobson asked if it will be necessary to apply again to add sides to the pavilion . D iscussion followed on the proposed uses of the building . Mr . Dobson said that the building was proposed as a multi purpose building and will be used for various activities such as flea markets , car shows , auctions and things . Susan suggested that Mr . Dobson make a list of possible uses for t he building for the Planning Bord to review . Tour of the Dobson Property A tour of the Dobson Property was scheduled for August 18 , 1993 . The Planning Board is to meet at the Town Hall at 6 : 45 p . m . Chairperson Weitzel said that she thinks we need to look at the property to clear up the questions of the buffers and landscaping . Review of the Wilbur Special Permit - Grading Shed The Planning board reviewed the site plan submitted by Ralph Wilbur for building a grading shed at Wilbur Lumber Co . Mr . Wilbur III explained the plans , location , materials , size , use , etc . for the building . Susan said that Mr . Wilbur is requesting site plan approval for a special permit to build a grading shed . Mr . Wilbur is asking permission tosite a metal grading shed to replace a building could put a business in jeopardy . Public Hearings Scheduled A motion was made by Joel Gagnon and seconded by Arch Dotson to schedule the following Public Hearings to be held on August 5 , 1993 : 1 ) 7 : 30 P . M . - Wilbur - Special Permit - Grading Shed 2 ) 7 : 45 P . M . - Bailey Homes - Special Permit for Doublewide 3 ) 8 : 00 P . M . - Angelheart Design - Final Site Plan - Renovations A roll call vote on the motion resulted as follows : D otson Aye Farrell Aye Gagnon Aye S chaaf Aye I Viscuso Aye W eitzel Aye Carried Unanimously A regular meeting of the Planning Board will follow the public h earings to consider the proposals . Tompkins County Solid Waste - Reclamation Plans J oel reported that the Town has not heard from Tompkins County S olid Waste regarding the reclamation of soil and capping of the landfill . The Town has not received the contour maps and grading specificaitons for the reclamation at the landfill that the Planning Board requested . 136 4 Planning Board Minutes July 21 , 1993 Susan will contact the County and request a copy of the Reclamation P lans showing contours , specifications for reclamation , erosion control updated and most curent plans . Chairperson Weitzel read communications from the Code Enforcement O fficer to : 1 ) Pamela Sackett - re : subdivision requirement for future building ; 2 ) Marcia and David Radin regarding additional activities on their property .
