M . by Chairperson W eitzel . Susan Beeners reported that there is a revision to the Agenda - - Rick Dobson has requested additional time to prepare an over - all landscape plan . The County Planning Board will not meet again until September 1993 . 1 n r 2 Planning Board Minutes June 16 , 1993 The meeting focus was on the GIS ( Geographical Information System ) . Gloria Cornell , John Jerkowitz and Jane VanderZee spoke about what GIS is and how it relates to Tompkins County and Cornell University . Most of the GIS data comes from the NYSEG ( New York State Gas and Electric ) mapping project . Tompkins County Health Department has received for review the New York State Health Department Draft Waste Treatment Specifications Handbook ( now in thirty [ 30 ] day comment period ) that addresses Part 75A of the N . Y . S . Septic and Sewage Laws . The County Health Committee is currently reviewing the handbook . Code Enforcement Officer ' s May 1993 Report : A copy of the Code Enforcement Officer ' s May 1993 Report was received . Proposed Subdivision - Camelot / Glen Harrington Owner / applicant Glen Harrington explained the his Proposal for Camelot Subdivision - a proposed subdivision of Tax Map Parcel No . 26 . - 1 - 9 . 3 , seventeen and one half ( 17 - 1 / 2 ) acre total into a nine ( 9 ) lot subdivision . The property is located on the northeast corner of Hillview Road and State Route 34 / 96 . Glen Harrington owner / applicant . Mr . Harrington described the proposed subdivision sketch plan . A portion of road frontage on shown on the sketch plan is located on State Route 34 / 96 and is an acceleration lane . A surveyor from the State ( DOT ) Department of Transportation said that a regular driveway permit for access onto the State road will be required . The small strip along the frontage ( the acceleration lane ) of the Property is owned by Tompkins County Parks and Recreation . The Planning Board reviewed. Map # 1 of the Preferred Clustered Plat dated 6 / 11 / 93 , the Hypothetical Plat - Map # 2 dated 6 / 11 / 93 , and the Topography Wetlands Boundary - Map # 3 . Approximately seventy - five ( 75 ) per cent of the area is usable . Mr . Harrington said that the boundaries of the wetlands shown on the topographical map are in error . He has sent a letter to the DEC asking them to delineate the wetlands . Susan said that the DEC , County Planning , the DoT and Health Department will need to be involved in this project . She suggested the Planning Board tour the proposed site . Tour ( field trip ) of Harrington Proposed Subdivision Site The Planning Board will meet at the Town Hall at 6 : 00 P . M . on Wednesday , July 21 , 1993 to tour the Harrington property . The neighboring property owners will be invited . A regular meeting of the Planning Board will follow the field trip . Fieldstone Circle Subdivision Reaffirmation Susan Beeners reported that Attorney Barney has reviewed the Fieldstone Circle documents . The Town has the option to enforce the deed. restrictions at any time . Before the last Certificate of Occupancy is issued the Town can inquire as to the status of the Review Board and a decision made at that time as to whether the Town will take a more active role in the enforcement of the restrictions . EAF Checklist : EAF Page 9 - Impact on Agricultural Land Resources Under Other Impacts - Add ( see attachments ) and add the following : " Impact on agricultural resources - - while site has not been in agricultural use during the time of this project proposal , there exists approximately twenty ( 20 ) acres with past and potential agricultural value . This is a small to moderate 126 3 Planning Board Minutes June 16 , 1993 impact which could only be mitigated at this time by major plan modifications . " The following Resolutions for the Fieldstone Circle Subdivision Reaffirmation were reviewed and approved by the Planning Board . RESOLUTION NO . 12 of 1993 APPROVAL OF SEQR - FIELDSTONE CIRCLE SUBDIVISION B y Joel Gagnon : Seconded by Paul Viscuso WHEREAS , 1 . This action is the consideration of a reaffirmation of Final S ite Plan and Final Subdivision Plan Approval for the proposed " Fieldstone Circle Subdivision " , proposed to be located in Planned D evelopment Zone No . 12 , on Danby Road south of Muzzy Road , Town of D anby Tax Parcel No . 2 - 1 - 49 . 3 , and 2 . This is a Type I action for which the Planning Board has been legislatively determined to act as Lead Agency in environmental ✓ eview , and 3 . The Town of Danby Town Board , the Tompkins County Department o f Health , and the Tompkins County Department of Planning are potentially involved agencies which have been duly notified of this action , and 4 . The Town Board on February 11 , 1991 , acting as Lead Agency in e nvironmental review of the preliminary plans for this project , made a negative declaration of environmental significance for this project , and 5 . The Town Board on February 11 , 1991 granted preliminary and conditional approval to the project , and 6 . The Town of Danby established the boundaries of Planned D evelopment Zone No . 12 on the revised Zoning Map of December 11 , 1991 as part of its 1991 legislative program , and also enacted on D ecember 11 , 1991 a revised Zoning Ordinance and new Subdivision Regulations , and 7 . The Town Board on February 10 , 1992 referred the project application to the Planning Board for consideration of Final Site P lan and Final Subdivision Plat Approval , and 8 . The Planning Board on March 18 , 1992 granted Final Site Plan and Final Subdivision Approval to the project with the following provisions : a . ) Approval by the Town Attorney and the Town of Danby Town Board of the form and content of the proposed Declaration of Restrictive Covenants and the proposed Agreement between the Project Sponsor / Owner and the Town of Danby , with changes as requested by the Planning Board on March 18 , 1992 ; b . ) The developer shall be entitled to obtain building permits for the model homes and sales office on Lot A prior to the approval stated in ( a ) above , and 9 . The Planning Board has on June 16 , 1993 completed its review o f the application materials submitted for the requested ✓ eaffirmation of Final Site Plan and Final Subdivision Approval , including the following : a . ) " Fieldstone Circle Subdivision - Subdivision Plat , - E ngineering Plan , " and typical details and cross sections , dated March 18 , 1992 , prepared by George S chlecht , P . E . , L . S . ; 127 4 Planning Board Minutes June 16 , 1993 b . ) Plans dated March 10 , 1992 by Scott Hoffay being " Proposed Sign and Sign Planting and " Proposed Lot A Model Site " ; c . ) Several proposed documents as follows : " Declaration of Restrictive Covenants for Fieldstone Circle Subdivision " , " Suggested Language for Fieldstone Circle Subdivision P lat for ' natural / rural space ' area east of lots 7 , 9 , 10 , 12 , 13 , and 14 " , and " Agreement between Elizabeth G risanzio , Sponsor and Owner of Fieldstone Circle and Town of Danby " , as approved by the Town Board on May 11 , 1992 and by the Town Attorney on June 24 , 1992 ; d . ) The SEQR Environmental Assessment Form Part 1 dated March 12 , 1993 submitted by the applicant , and the draft P art 2 review dated March 12 , 1993 prepared by the Town Code Enforcement Officer , and amended by the Planning B oard on June 16 , 1993 , now be it RESOLVED , That the Town of Danby Planning Board , acting as Lead Agency in the environmental review of this Type I action , make and hereby does make a negative declaration of environmental significance for the proposed " Fieldstone Circle Subdivision " . The Planning Board , acting as Lead Agency in environmental review of this Type I action , has on June 16 , 1993 made a negative d eclaration of environmental significance for this action , now be it RESOLVED , That the Planning Board reaffirm and grant Final Site P lan and Final Subdivision Approval to the proposed Fieldstone Circle Subdivision with the following conditions and provisions : Execution and filing of " Declaration of Restrictive Covenants for Fieldstone Circle Subdivision " , " Suggested Language for 1 n 0 Z ., 6 Planning Board Minutes June 16 , 1993 Fieldstone Circle Subdivision Plat for ' natural / rural space ' area east of lots 7 , 9 , 10 , 12 , 13 , and 14 " , and " Agreement between Elizabeth Grisanzio , Sponsor and Owner of Fieldstone Circle and Town of Danby " , as approved by the Town Board on May 11 , 1992 and by the Town Attorney on June 24 , 1992 , prior t o any building permit issuance for construction on lots within the subdivision with the exception that the developer shall be entitled to obtain building permits for the model h omes and sales office on Lot A prior to such approval and execution . A roll call vote on the resolution resulted as follows : D otson Aye Farrell Aye G agnon Aye Viscuso Aye W eitzel Aye Carried Unanimously O ther Items : Request for an Additional Four ( 4 ) Unit Building on 96B 1 ) Susan reported on an inquiry for permission to build an additional four ( 4 ) unit building complex on 96B north of Fieldstone Circle . D iscussion followed regarding the request . The existing four ( 4 ) u nit complex was a permitted use under the old ordinance . There is n o mechanism readily apparent and further inquiries will be ✓ eferred to the Town Board . 2 ) Wilbur request for Grading Shed Ralph Wilbur has submitted plans for a grading shed which is a partial replacement shed for one destroyed by fire . A t echnical amendment ( modification to Zone C1 ) to the Zoning Map may be required to adjust the boundaries of his property . ADJOURNMENT : O n a motion the meeting adjourned at 9 : 45 P . M .
