S upervisor Oltz called the meeting to order at 8 : 00 P . M . and led
all present to the Pledge of Allegiance to the American Flag .
PRIVILEGE OF THE FLOOR :
Town Clerk - Tompkins County Annual Solid Waste Fee Formal Appeal
Forms are available in the Clerk ' s Office .
County Representative Report :
County Representative Frank Proto reported on the following :
1 ) Solid Waste Fee - Churches may apply for exemption of the
Solid Waste Fee .
2 ) Election Expenses Charged Back to Towns - Budget and
Administration Committee passed a resolution requesting
payments made to Tompkins County for election expenses be
✓ eturned to towns .
3 ) First Quarter Sales Tax - Danby ' s share for the first quarter
o f 1993 is approximately $ 66 , 512 . 00 and includes the 1 % sales
tax increase .
4 ) Board of Representatives Salaries - proposed salaries for the
n ext four ( 4 ) years as $ 8 , 650 . 00 for 1994 ; $ 9 , 050 . 00 for 1995 ;
$ 9 , 500 . 00 for 1996 ; $ 10 , 000 . 00 for 1997 .
5 ) County Bridges on Town Roads - The County is drafting a
maintenance contract for County Bridges located on town roads .
6 ) Vaccination Programs - The County will continue the
vaccination program for school children .
7 ) Rabies - the number of rabies cases reported in the raccoon
population is decreasing in the County .
8 ) Comprehensive Plan - the County is embarking on a three ( 3 )
year study for a County wide comprehensive plan .
9 ) Water Quality Plan - urged residents ( particularity farmers )
to give input into the Water Quyality Plans .
10 ) Surplus Equipment - will send information to the Town for the
surplus equipment available due to the closing of military
bases .
11 ) Michigan Hollow Road - Representative Proto suggested two ( 2 )
proposals to Senator Kuhl regarding Michigan. Hollow Road that
NYS could fund to help the Town of Danby :

1 ) let the State pave the portion that runs through New York
State Forest lands and send the Town approximately $ 96 , 000 . 00
per year to maintain the road , or
2 ) let the State pave and maintain this portion .
Members of the Public :.
J ulie Coulombe - 72 Bald Hill Road - reported problems with several
d ogs running loose in her neighborhood . Neighbors have talked to
t he owners and have reported them to the Dog Control Officer with
no results .
E lizabeth Owens - Roe - 1820 Danby Road reported that the dogs from
B ald Hill also are roaming her area .

1 ) Page 3 under discussion delete the word " incur " and replace
with " infer "
Approval of April 12 , 1993 Town Board Minutes
A motion was made by Councilperson Marisa and seconded by
Councilperson Hile to approve the April 12 , 1993 Town Board Minutes
as corrected .

COMMUNICATIONS
1 . Supervisor ' s Annual Report for Fiscal Year 1992 is on file in
the Town Clerk ' s Office
OTHER REPORTS :
EMC - No Report
Community Council Programs - Monthly Report received .
J ulie Coulombe - read a response from Community Council regarding
payroll for the youth programs . She reported that Community
Council is willing to provide payroll services for their Pre - K ,
Afterschool and summer programs by July 1 , 1993 if the Town will
provide $ 815 . 00 . The extra funds are to provide are to provide
payroll expenses and a bookkeeper . Community Council is willing to
t ake over this task if they are assured support from the Town for
youth programs and liability insurance coverage . Julie suggested
an agreement between the Town and Community Council . The agreement
should state that the Town has designated Community Council to
provide their payroll in exchange for all the monies designated for
t he programs . Community Council will provide the Town with
q uarterly written reports .
S upervisor Oltz said that if Community Council has a bookkeeper for
t heir programs the swim program should be included . She asked if
Community Council was willing to take over the Jennings Pond
payroll as well .
Discussion followed :
Judy Tagliavento said that she will look at program expenses to see
if they can adjust their budgets to include the swimming program at
Jennings Pond .
Councilperson Marisa reported to clear the record that Community
Council will be the employer for the personnel of the youth
programs , not just a bookkeeper for the Town . If approved the Town
will be granting the money to Community Council to pay these
people .

J ennings Pond Swim Program :
Mary Ann Kozak asked the Town Board for additional funding of Two -
t housand One Hundred and Forty - five ( $ 2 , 145 . 00 ) Dollars for the
J ennings Pond Swim Program . With additional funding the pond could
be open everyday from 1 : 00 - 6 : 00 P . M . during July and August ,
1993 . This amount does not include weed control for the swimming
area .
Highway Department :
H ighway Superintendent reported on following :
1 ) The Town Highway Department will receive Six - thousand nine
h undred ( $ 6 , 900 . 00 ) in New York State Disaster Reimbursement
Funds for Blizzard 1993 .
2 ) The increase in CHIPS monies for 1993 is $ 28 , 920 . 00 .
3 ) Residents may take small limbs and brush that at the Town.
H ighway Barns during regular hours and possibly recycling
center hours . Wood chips ( when available ) may be picked up at
t he Town Highway Barns . All material left at the site must
h ave all nails , staples , and twine removed . No vines will be
accepted . Special arrangements can be made with the Highway
D epartment for large quantities .
S enior Citizens :
E dw . M . Roberts reported that the Senior Citizens went on a trip to
P ennsylvania in May . A trip to a theater in Auburn is planned for
J une 1993 .
Code Enforcement Report :
Supervisor Oltz read the following report :
Code Enforcement Department Officer ' s April 1993 Report has been
✓ eceived . There is new construction on LaRue Road , one ( 1 )
✓ enovation / alteration permit on Troy Road , value of construction
$ 144 , 000 . 00 , fees received $ 237 . 40 . Several Certificates of
Occupancy were issued and there were many field visits . Year to
date - - value of construction $ 608 , 185 . 00 and fees $ 1 , 091 . 40 .
Dog Control Officer Report :
There were ten ( 10 ) complaints and no summons were issued .
Planning Board Report :
Nancy Weitzel reported that the Planning Board will hold two ( 2 )
public hearings on May 19 , 1993 ; Bristol / Mayo - ` Cluster
Subdivision ' and Dobson - request for Special Permit . A special
working session will be held on June 7 , 1993 for review of the
Fieldstone Circle Reaffirmation and possible amendments to the
Zoning Ordinance .
Fire District Report :
William Genter reported that the Fire District held a public
hearing and an informational meeting on the proposed West Danby
Fire Station . About sixty ( 60 ) residents attended the meetings .
Many residents expressed concern regarding the $ 485 , 000 . 00 cost for
the construction of the building . Voting on the bonding for a new
fire station will be Wednesday , May 12 , 1993 from 6 : 00 - 9 : 00 P . M .
at the West Danby Fire Station for Voting District No . 2 and at the
Danby Fire Station on Route 96B for Voting Districts No . 1 and 3 .
There is no provision for absentee ballots .
B ill Genter submitted the 1992 Annual Reports for West Danby Fire
and Rescue and for the Danby Volunteer Fire Department . The
reports are on file in the Clerk ' s Office .
S olid Waste Advisory Committee Report :
J oel Gagnon reported that many new committees and Solid Waste
Action groups have been formed . There is a special meeting
scheduled with the County Board of Representatives on June 29 ,

1993 . The final Solid Waste Plan for Tompkins County will not be
submitted until October 1993 .
O LD BUSINESS :
RESOLUTION NO . 25 OF 1993
REJECTION OF SEALED BIDS " OLD TOWN BARNS "
B y Councilperson Miller : Seconded by Councilperson Schwartz
WHEREAS , the Town of Danby Town Board advertized for Sealed Bids
for the " Old Town Barns " on March 20 , 1993 , and
WHEREAS , Sealed Bids were accepted until 5 : 00 P . M . on April 7 , 1993
and opened publicly on April 7 , 1993 at 7 : 30 P . M . , and
WHEREAS , bids submitted are much below the appraised value of the
property , now be it
RESOLVED , That the Town of Danby Town Board in the best interest of
the Town rejects all bids submitted for the " Old Town. Barns " .

Councilperson Marisa stated that the only reason he voted against
t his resolution is to underscore that the Town should not sit on
t his property , that we should either sell it or use it .
Councilperson Hile said the Highway Department is using the
building and site for cold storage at this time . The Town has much
equipment that should be stored inside when not in use ,
H ighway Superintendent William Hall said the Highway Department
contunues to use the building and site for storage .
N EW BUSINESS :
RESOLUTION NO 26 OF 1993
AMENDMENT TO 1993 BUDGET - CHIPS REVENUE
B y councilperson Marisa : Seconded by Councilperson Hile
WHEREAS , Anticipated revenue for " CHIPS " was estimated as
$ 46 , 000 . 00 by the Town of Danby Town Board and included in the
Fiscal Year 1993 Budget Account DA3501 , and
WHEREAS , subsequent information from New York State indicates that
the revenue for " CHIPS " will actually be $ 74 , 920 . 00 , now therefore
be it
RESOLVED , that the Town of Danby 1993 Budget be amended as follows :

Appointments for Local Assessment Board of Review :
Supervisor Oltz reported that the Town needs to appoint two ( 2 )
representatives to serve on the Local Assessment Board of Review on
May 11 , 1993 from 3 : 00 - 6 : 00 P . M .
A motion was made by Supervisor Oltz and seconded by Councilperson
Hile to appoint Linda Howe and Arch Dotson to serve on the Local
Assessment Board of Review on May 11 , 1993 from 3 : 00 - 6 : 00 P . M .
A vote on the motion resulted as follows :

RESOLUTION NO . 27 OF 1993
TRANSFER OF FUNDS TO COMMUNITY COUNCIL
By Councilperson Marisa : Seconded by Councilperson Miller
RESOLVED , that the Town of Danby Town Board transfer to the Danby
Community Council all responsibility for personnel and payroll for
all youth programs including Motor Development , Afterschool , Summer
Recreation and the Danby Pond , and be it further
RESOLVED , that the Town will provide to Community Council at least
Eight Hundred and fifty dollars ( $ 850 . 00 ) but not to exceed One
Thousand dollars ( $ 1 , 000 . 00 ) in compensation for their personnel
services for youth programs , and be it further
RESOLVED , that the transfer of funds will be effective July 1 , 1993
and the Town acknowledges that Community Council is administering
youth programs for the Town and that the programs remain covered by
the Town of Danby liability insurance , and be it further
RESOLVED , that Community Council will provide to the Town quarterly
written reports and copies of paperwork pertaining to the youth
programs and / or monies , matching funds , grants , roll - over monies
that pertains to these youth programs .
Discussion followed :
Councilperson Marisa said that he assumes that the amount of
$ 850 . 00 to $ 1 , 000 . 00 is an annual figure . The Danby Pond personnel
payroll is included and is the reason for the range of $ 815 . 00 and
not to exceed $ 1 , 000 . 00 .

Danby Pond Swimming Program :
Mary Ann Kozak asked the Town Board for $ 2 , 145 . 00 for the Danby
Pond Swim Program . The $ 2 , 145 . 00 would allow the pond to be open
seven ( 7 ) days per week for July and August 1993 form 1 : 00 to 6 : 00
P . M .
Discussion followed :
The Town Board strongly suggested weed control for this season .
Motion to Fund Community Council for Pond Swim Program :
A motion was made by Councilperson Schwartz and seconded by
Councilperson Hile to grant Community Council Two Thousand One
Hundred Forty - five ( $ 2 , 145 . 00 ) Dollars earmarked for the operation
of the Jennings Pond Swimming Program for summer 1993 only .

Agreement Between Tompkins County and Town of Danby to Spend Town
Highway Funds Signed :
Councilperson Oltz read the following Agreement Between Tompkins
County and the Town of Danby to Spend Town Highway Funds for the
year 1993 and asked the Town Board to sign the agreement .
P ursuant to the provisions of Section 284 of the Highway Law ,
we agree that moneys levied and collected for the repair and
improvement of highways , and received from the state for the
repair and improvement of highways , shall be expended as
follows :
General Repairs $ 157 , 891 . 00
Improvements : ( a ) Station Rd . East to Bald Hill
Intersection - $ 23 , 000 . 00 ,
( b ) LaRue Rd . - $ 29 , 619 . 00 ,
( c ) Buttermilk Lane to end and Meadowwood
Terrace to Old Town Rd . - $ 35 , 000 . 00
N o moneys set aside for such Improvements shall be expended ,
nor shall any work be undertaken on such improvements , until
t he County Superintendent approves the plans , specifications
and estimates for such construction .
This agreement shall take effect when approved by the County
S uperintendent of Highways .
The Agreement Between Tompkins County and the Town of Danby to
Spend Town Highway Funds for the year 1993 was discussed and
signed .
APPROVAL OF WARRANTS :
Approval of West Danby Water District Fund Warrant No . 5 of 1993
A motion was made by Councilperson Schwartz and seconded by
Councilperson Hile to approve West Danby Water District Fund
Warrant No . 5 of 1993 in the amount of $ 262 . 10 .

A motion was made by Councilperson Marisa and seconded by
Councilperson Miller to approve an increase of $ 464 . 49 ( Voucher No .
49 payable to Seneca Supply ) on Highway Fund Warrant No . 4 of 1993
for a total of $ 8 , 302 . 40 .
