March 8 , 1993 PRESENT : Supervisor Mary Oltz Councilpersons : Marisa , Schwartz ABSENT : Councilperson , Bile , Miller Others Present : Town Clerk - Carol Sczepanski County Representative - Frank Proto Planning Board Chair - Nancy Weitzel Code Enforcement Officer - Susan Beeners Town Justice - James Herson Members of the Public : Ray Axtell , Brian McLean , Jason Nash , Roy Casterline , Mary Ann Kozak , Joel Gagnon , Julia Hughes Supervisor Oltz called the meeting to order at 8 : 00 P . M . and led all present in the Pledge of Allegiance to the American flag . Privilege of the Floor : Councilperson Schwartz reported that he has requested information regarding the creation of a youth board from Tompkins County Youth Bureau . Supervisor Oltz reported that New York State Comptroller has granted an extension of ninety ( 90 ) days for the filing of the Supervisor ' s Annual Report . County Representatives Report : Representative Frank Proto submitted a list of Tompkins County Committee Assignments to Supervisor Oltz and reported on the following : 1 ) Tompkins County Sanitary Code - The Health Committee is in the process of reviewing the Tompkins County Sanitary Code sections that deal with sewer , septic , water , and subdivisions ( Article 7 and Article 8 ) . 2 ) Open Burning - There can be no burning within a village or city limit and no burning of paper , plastics , garbage or tires in Tompkins County . You are permitted to burn almost anything else in a covered container . A controlled burn of brush or leaves is allowed as well as recreational fires . 4 ) City Sales Tax - ( Additional 1 % sales tax ) . The City of Ithaca is asking for 50 % of the County share of the increased sales tax and if granted could result in an approximate increase of 44 % in County property taxes . 5 ) Medicaid - NYS has proposed to take over Medicaid for one percent ( 1 % ) of Tompkins County Sales Tax . ( Representative Proto does not support this takeover . ) 6 ) Airport Terminal - Ground was broken for the new airport terminal on Friday , March 5 , 1993 . The Airport Development Committee has been officially dissolved . 7 ) Water Quality Strategy Committee - The committee is in the process of developing a water quality plan for Tompkins 190 2 Town Board Minutes March 8 , 1993 County . The committee will examine the water sheds throughout Tompkins County . 8 ) Health Issues - The County has received an additional $ 15 , 000 . 00 from New York State for testing of lead levels in children . 9 ) Rabies - Rabies information programs and advertising will start April 1 , 1993 . 10 ) Dental Clinics - the County is looking into possibly opening a dental clinic within the City of Ithaca . 11 ) Mental Health - Mental Health Department - Tompkins County must pay for County jail inmates who go to a state facilities for Mental Health Screening . 12 ) Assessment Board of Review - Tompkins County Assessors Office is proposing not to have a Local Assessment Board of Review . 13 ) Bus Service - Ridership throughout Tompkins County on all bus services is up 25 % since 1982 . In Danby and Lansing there were 9 , 507 riders and in 1991 and 20 , 320 in 1992 . Solid Waste Advisory Committee - Report Joel Gagnon reported on following activities of the Solid Waste Advisory Committee . A meeting of the County Board is scheduled for March 30 , 1993 and will focus on solid waste , election of Committee officers was held , and reorganization of the committee and the participation of the process was discussed at considerable length . Sub - committees of SWAC are drafting resolutions to present to the Board for the March 30th meeting . A cost accounting is recommended for solid waste programs so that projections can be made . Members of the Public : Mary Ann Kozak - addressed the Board and asked the Town Board to use $ 10 , 000 of reserve funds to restore the cuts made to the Town Youth and Recreation Programs and the Danby Area News . She said youth programs are popular and cost the Town little due to matching funds , Jennings Pond was patronized by 921 persons in July 1991 and 593 in August . ( Numbers were down in 1992 due to the unusually rainy weather . ) The Danby Area News is the only communications link in Town . Danby Community Council is trying to keep its programs running and do not want to raise user fees . She appealed t o the Town Board to restore funding to these programs . J ulia Hughes - said she is the Chairperson to the Hillview Road L andfill Advisory Committee and there is a lot going on that will be presented before the SWARM Committee concerning the landfill monitoring . Representative Proto said that the Town Board should be aware that t he Hillview Road Landfill Advisory Committee has spent hours and h ours looking out for the Towns best interest and have done an exceptional job over the last three years . Approval of January 11 , 1993 and February 8 , 1993 Town Board Meeting Minutes : A motion was made by Councilperson Schwartz and seconded by Councilperson Marisa to approve the January 11 , 1993 and February 8 , 1993 Town Board Meeting Minutes as published . A roll call vote on the motion resulted as follows : Marisa Aye S chwartz Aye O ltz Aye Carried Unanimously 191 3 Town Board Minutes March 8 , 1993 COMMUNICATIONS : 1 ) Letter from EMC Representative Daniel Decker regarding February 1993 Meeting . 2 ) Letter from Judy Tagliavento inviting the Town Board to the March 10 , 1993 Community Council Meeting . Other Reports : Dog Control Officer - February 1993 Report Highway Department - February 1993 Report Code Enforcement Office - February 1993 Report Susan Beeners reported that she has completed proposed changes to the Zoning Ordinance related to Permit to Build , Doublewides , Fill and Public Hearing Notification . The materials have been submitted to the Planning Board for their review . Board of Zoning Appeals - Goodwin Appeal - Notice of Decision - approved temporary variance to maintain a mobile home for eighteen ( 18 ) months following Public Hearing on February 25 , 1993 . Planning Board : Chairperson Weitzel reported that Ken Tompson from Tompkins County Solid Waste Division will speak at the March 17 , 1993 Planning Board Meeting . The Planning Board approved a small subdivision on the corner of Buttermilk Lane and 96B where the Old Town Village Sign is located . Representative Proto said that he has been approached by several ✓ esidents in Old Town Village regarding the road conditions in their development . They would like some reassurance that e ventually their road will be paved or maintained so that they can e xit on to 96B in the winter time . NEW BUSINESS : RESOLUTION NO . 21 OF 1993 APPROVAL FOR SUPERVISOR TO CARRY OVER 1992 FUNDS By Councilperson Marisa : Seconded by Councilperson Schwartz WHEREAS , Resolution No . 62 of 1992 authorized the Supervisor to e ncumber 1992 funds to pay for expenses encumbered in 1992 and paid in 1993 , and WHEREAS , it has been determined that the town accounting software can more easily accommodate the setting up of payables in December 1992 to be paid in 1993 , and WHEREAS , the setting up of payables would accomplish the same purpose as encumbering funds , now therefore be it RESOLVED , that resolution No . 62 of 1992 be rescinded and replaced by this resolution No . 21 of 1993 authorizing the use of a system of payables rather than encumbering funds , and be it further RESOLVED , that it is the intent of the Town Board to recognize some surplus funds from 1992 which may be needed in 1993 and to modify the 1992 budget as needed in order to make these funds available . Bowles has submitted his resignation effective February 28 , 1993 , and 4 Town Board Minutes March 8 , 1993 WHEREAS , the Town of Danby Town Board accepts his resignation effective February 28 , 1993 , now be it RESOLVED , that the Town of Danby Town Board appoint Julia P . Hughes as Town of Danby Town Justice to fill the remaining term of Ralph F . Bowles which expires on December 31 , 1993 . Proto to the Hillview Road Landfill Citizens Advisory Committee as the Town of Danby At - large Member for a three ( 3 ) year term to expire on December 31 , 1995 . A roll call vote on the resolution resulted as follows : Marisa Aye Schwartz Aye Oltz Aye Carried Unanimously Miscellaneous : New York State Town Clerks Association Annual Conference Town Clerk Carol Sczepanski asked the Town Board to approve funds so that she can attend the New York State Town Clerks Association Conference in April 25 thru April 27 , 1993 . Approval of Funding for New York State Clerks Association Conference A motion was made by Supervisor Oltz and seconded by Councilperson Schwartz to approve funding for the Town Clerk to attend the New York State Town Clerk ' s Association Conference in Amherst , New York , April 25 thru 27 , 1993 .
