The Public Hearing was called to order at 7 : 27 P . M . by Chairperson
W eitzel and the following notice of publication was read :
" TOWN OF DANBY
NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a public hearing will be held by
the Planning Board of the Town of Danby on Wednesday , January
20 , 1993 at 7 : 15 P . M . , 1830 Danby Road , Ithaca , New York
14850 . Purpose of hearing is to consider approval of the
proposed subdivision of a 8 . 03 + / - acre lot from Town of Danby
ti Tax parcel No . 15 . - 1 - 11 . 1 , 12 . 9 + / - acres total , located on
the west side of Comfort Road Extension South of Lieb Road .

Code Enforcement Officer Susan Beeners submitted the Certification
o f Mailing / Notification that was mailed or personally delivered to
n eighboring property owners .
Jack Boyd explained to the Planning Board and members of the public
present his subdivision plan for the above referenced property . He
said the property would be limited ( have deed restrictions ) to one
dwelling , ccnd not more that four ( 4 ) out buildings such as a barn
o r garage but with no business of any kind .

Mr . Pampuch . asked why a public hearing was needed for a subdivision
o f more than five ( 5 ) acres .
Code Enforcement Officer , Susan Beeners explained that a public
hearing was necessary because the lot he wants to keep would be
less than five ( 5 ) acres , and one lot would have less than 150 '
road frontage , using the clustered subdivision technique proposed .
Mr . Boyd answered questions from the Planning Board regarding deed
restrictions on the remaining property . Concern for the
preservation of the maple trees that border the right - of - way near
the proposed drive was expressed by Planning Board members .
Members of the Public :
Fred Pampuch - 316 E . Falls Street ( a neighboring property owner )
said he had no objection to the subdivision proposal .
Ralph Wilbur - 1378 Danby Road ( a neighboring property owner ) said
he had no objection to the subdivision proposal .

S ubdivision Application - Jack Boyd
The Planning Board reviewed the Subdivision Application of Jack
B oyd for Town of Danby Tax Parcel # 15 . - 1 - 11 . 1 located on Comfort
Road Extension .
The Short Environmental Assessment Form ( SEAF ) was reviewed and C - 5
was amended to read - - " Not expected on this site , since further
development would be limited to one additional lot " .

S EQR DETERMINATION - PROPOSED SUBDIVISION

WHEREAS , this action is the consideration of Subdivision Approval
for the proposed subdivision of an 8 . 03 + / - acre lot from Town of
D anby Tax Parcel No . 15 . - 1 - 11 . 1 , 12 . 9 + / - acres total , located on
t he west side . of Comfort Road Extension , south of Lieb Road , Jack
B oyd , owner / applicant , and
WHEREAS , this is an Unlisted action for which the Planning Board is
acting as Lead Agency in environmental review and for which no
coordinated review is required , and
WHEREAS , the Planning Board at and following public hearing on
January 20 , 1993 , has reviewed the Environmental Assessment Form
and draft environmental review prepared by the Code Enforcement
O fficer , now be it
RESOLVED , that the Town of Danby Planning Board , acting as Lead
Agency in environmental review of this Unlisted action , makes a
negative determination of environmental significance for this
action .

RESOLUTION NO . 2 OF 1993
RESOLUTION TO APPROVE BOYD SUBDIVISION
B y Joel Gagnon : Seconded by Arch Dotson
WHEREAS , this action is the consideration of Subdivision Approval
for the proposed subdivision of an 8 . 03 + / - acre lot from Town of
D anby Tax Parcel No . 15 . - 1 - 11 . 1 , 12 . 9 + / - acres total , located on
t he west side of Comfort Road Extension , south of Lieb Road , Jack
boyd , owner / applicant , and
WHEREAS , this is an Unlisted action for which the Planning Board on
J anuary 20 , 1993 , acting as Lead Agency in environmental review ,
h as made a negative determination of environmental significance ,
and
WHEREAS , the Planning Board at and following public hearing on
J anuary 20 , 1993 , has reviewed a sketch plan showing the proposed
new lot , entitled " Proposed Subdivision of Property with 70 ' Road
Frontage to Avoid Root Compaction of Maple Trees " , now be it
RESOLVED , that the Town of Danby Planning Board grants Preliminary
and Final Subdivision approval to the proposed subdivision as
presented subject to the following conditions :
1 ) that a Final Survey Map be submitted for such lot ,
suitable for filing , for approval by the Planning Board
Chairperson ;
2 ) that deed restrictions provide that no further
subdivision shall occur of the 8 . 03 + / - acre lot and that
t he 4 . 87 + / - acre lot be restricted in resubdivision to
t he creation of only one ( 1 ) new lot ;
3 ) that any driveway to access the proposed new lot be
located so as to minimize compaction of the roots of the
large maple trees along the north property line of the
proposed new lot .

Mr . Boyd was instructed to submit a new survey map to the Code
Enforcement Officer that is suitable for filing with the County
Clerk . The next step is final approval by the Planning Board
Chairperson .
Discussion followed regarding recent subdivision of properties and
building in the Comfort Road Extension area .
Code Enforcement Officer ' s December Report :
Susan Beeners submitted her December 1992 Report of activities and
said the Annual Report will be completed soon . She hopes that her
report will show a true picture of the fees and values related to
building permits issued .

Susan reported that there have been a few chimney fires that ha.ti�
prompted her to place an article in the Danby Area News . She calls

in a chimney sweep or other professional to check chimneys after a
fire has occurred .
Fieldstone Circle - Update
Susan reported that she has written to Scott Hoffay informing him
that the approval for Fieldstone Circle has expired . Mr . Hoffay
✓ esponded to her letter and said he has obtained financing and
w ould like to have the subdivision approval reaffirmed .
S usan reported that the process may be a reaffirmation of both the
Final and Preliminary Plats for the subdivision . A Public Hearing
must be held by the Planning Board , and fully signed agreements
must be approved and signed by the Town Supervisor . After approval
t he developer has six ( 6 ) months to have the subdivision filed at
t he County Clerk ' s Office .
D iscussion followed :
B ill Farrell said he feels that a time limit for the start of a new
project of 180 days is too restrictive . The planning and approval
of this project has taken over two ( 2 ) years .
Susan said that the filing requirement of six ( 6 ) months for a
subdivision is a New York State requirement .
Arch Dotson asked if the term " reaffirmation meant that we could
reaffirm some of the process had been completed for the
subdivision process or do we start from the beginning to satisfy
the SEQR .
Susan will look into the SEQR requirements to find out if there is
a statute of limitations .
Susan reported that Mr . Hoffay is sending a request for
reaffirmation for the " Fieldstone Circle " Subdivision Project in
writing .
Motion to Authorize Chairperson Weitzel to Schedule a Public
Hearing for Fieldstone Circle Subdivision Reaffirmation
A motion was made by Joel Gagnon and seconded by Arch Dotson to
authorize Chairperson Weitzel to schedule a public hearing for
" Fieldstone Circle " reaffirmation when the appropriate materials
are received by the Town .
A vote on the motion resulted as follows :

Susan reported on the following
1 ) West Jersey Hill Acres :
Harriet Moore needs to bring in a possible way to segregate
out the lots so that she can build one lot at a time , if that
is what she desires to do .
2 ) Shepardson Doublewide :
P roject was approved with R - Kotek skirting - - there was a
change of material and a drivit type skirting will be used .
S usan said she has asked to see definite plans and
specifications for the revised skirting so that she can see if
t he masonry parging will hold up .
Miscellaneous :
1 ) Joel asked Susan 4 there had been anything done on
d rafting of language for doublewides and reasonable definition
for skirting materials .

Susan said that she is working on possible revisions to our Zoning
Ordinance .
2 ) Request to Tompkins County Landfill Reclamation Plans
S usan reported that the Town has not received a response for
t he request to Tompkins County for the " Reclamation Plans " for
t he Hillview Road Landfill site . III
3 ) West Danby Fire Department Site
S usan reported that the West Danby Fire Department
Construction site is exempt from zoning requirements but not
from New York State Building Code .
J oel Gagnon reported that at the January Town Board Meeting that to
t here was concerns were expressed in regard to the West Danby Fire

approved ; 2 ) the sight lines when entering the main highway from
t hat road are terrible ( blind ) .
1992 - Planning Board Activities Report
Secretary Carol Sczepanski presented the Official Planning Board
Minute Book for review . Also the Planning Board received a record
of the following : 1 ) Complete list of 1992 Resolutions passed by
t he Planning Board ; 2 ) record in 1992 Public Hearings held by the
P lanning Board ; 3 ) a list of items proposals and applications
received and reviewed for 1992 .
