Supv Varvayanis asked if there any comments from the board or the public mnd there were not. The hearings were left open. Roll call was taken and board meeting was opened_ Supv Vamayanis suggested that the cautract for ambulance service with Dryden Ambulance, Inc, presently states that the Town will employ 2 full time paramedics and three part time paramedics_ 'There is a need for more part rimedics and in fact the Tou*rt has been Paying wages for more. He has gone through the formal bidding process, opened sealed bids, and at the last meeting asked the board to pass a resolution allowing him to accept the lowest responsible bid- For whatever reasons, Mrs. McFall claimed that the board could not do that and so she has put it back on the agenda, The resolution said that if the lowest responsible Nd was not in ex " of $32,000 the Highway Supe=tcndezrit was authorized to accept it. Jack has spoken with the Assodation of Towns and received some information from them. Atty Perkins has reviewed it. Fags ] of 33 4F~ i TS 1 -3 -0 l It appears that the Highway Superintendent does not need the Board's approval for purchase of materials, but in the past he has tried to communicate with Board and make sure things are done the right way. He wonders what the neart step is; he needs the pipe. It has not been ordered although the purchase order has been submitted. This is not the first time he has had difficulty. The Highway Department is out of salt nova. A request was put iii at least a week ago and he has not yet received any paperwork. He's left wondering what's going on until he receives his copy back_ Supv Varvayanis will check on the matter toga c ro , Jack explained that the frustrations is that this is not the first occurrence of this type of situation. This makes it difficult for Cargill, as they like to fill the entire order when they receive a purchase order. Jack believes there are problems with the purchase order system and that it should be reviewed. The FO still has a line for a purchasing agent on it. He does not believe we have a purchasing agent. The Department heads are the ones that are doing all the work to get the hest prices and figure out where the product should came from. It should be the Department Head's signature on it_ G1 T Ha,6eld suggested that perhaps it is time to review the system. Supv Varvayatus stated the general purcha4ng policies are something that will be looked at by the Little Grace Commission, which should be starting soon. Approval of minutes, A representative from the Recreation Commission, PuTchaise of highway equipment per the budget, Supv Varvayanis has received informations from the Association of Towns regarding the conference to be held in New York City on February 21 and 22. Supv Varvayanis closed the public hearings at 7:90 p,m. RE LUTION #2 - INCREASE SENIOR EXEMPTION FOR REAL PROPERTY TAXES Supv Varvayamis offered the foLowing resolution and asked for its adoption: WHEREAS, Real Property Tax Law §467 perEmts the 'fawn Board to adopt a resolution partially exempting from taxation by the Town certain real property within the Town awned by persons sixty -five (65) years of uge or over, and WHFR)1A the Real Property Tax Law preyvirles an option for the Town to set 1he income eligibility levels, NOW, THEREia ORS, 8B IT RESOLVED. Any exemption provided in this resolution shall be computed after all other partial exemptions allowed by law have been subtracted from the total amount assessed. 3. The real property tax exemption on real property owned by a husband and wife, one of whom is 65 years of age or over, once granted, shall not be rescinded solely because of the death of the older spouse so long as the surviving spouse is at least 62 years of age. 4. No exemption shall be granted: (a) If the income of the owner or the combined income of the owners of the property for the income tax y ear immediately preceding the date of making application for exemption exceeds the amounts set forth in the formula in this resolution. Income tax year shall mean the twelve month period for which the owner or owners filed a federal personal income tax return, or if no such return is filed, the calendar year. Where title is vested in either the husband or the wife, their combined income may not exceed such sum. Such income shall include social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year, net rental income, salary or earnings, and net income from self - employment, but shall not include a return of capital, gifts or inheritances. In computing net rental income and net income from self - employment no depreciation shall be allowed for the exhaustion, wear and tear of real or personal property held for the production of income; (b) Unless the title of the property shall have been vested in the owner or one of the owners of the property for at least twelve (12) consecutive months prior to the date of making application for exemption, provided, however, that in the event of the death of either a husband or wife in whose name title of the property shall have been vested at the time of death and then becomes vested solely in the survivor by virtue of devise by or descent from the deceased husband or wife, the time of ownership of the property by the deceased husband or wife shall be deemed also a time of ownership by the survivor and such ownership shall be deemed continuous for the purposes of computing such period of twelve (12) consecutive months. In the event of a. transfer by either a husband or wife to the other spouse of all or part of the title to the property, the time of ownership of the property by the transferor spouse shall be deemed also a time of ownership by the transferee spouse and such ownership shall be deemed continuous for the purposes of computing such period of twelve (12) consecutive months. Where property of the owner or owners has been acquired to replace property formerly owned by such owner or owners and taken by eminent domain or other involuntary proceedings, except a tax sale, the period of ownership of the former property shall be combined with the period of ownership of the property for which application is made for Pagc 3 of 33 TB 1 -3-1)1 exemption and such periods of ownership shall be deemed to be consecutive for purpose of this section. Where a residence is sold and replaced with another within one (1) year and both residences are within the state, the period of ownership of both properties shall be deemed consecutive for purposes of this resolution. Where the owner or owners transfer title to property which as of the date of transfer was exempt from taxation under the provision of this resolution, the reacquisition of title by such owner or owners within nine (9) months of the date of transfer shall be deemed to satisfy the requirement of this paragraph that the title of the property shall have been vested in the owner or one of the owners for such period of twelve (12) consecutive months. Where, upon or subsequent to the death of an owner or owners, title to property which as of the date of such death was exempt from taxation under such provisions, becomes vested, by virtue of devise or descent from the deceased owner or owners, or by transfer by any other means within nine (9) months after such death, solely in a person or persons who, at the time of such death, maintained such property as a primary residence, the requirement of this paragraph that the title of the property shall have been vested in the owner or one of the oxvncrs for such period of twelve (12) consecutive months shall be deemed satisfied; (c) Unless the property is used exclusively for residential purposes, provided, however, that in the event any portion of such property is not so used exclusively for residential purposes but is used for other purposes, such portion shall be subject to taxation and the remaining portion only shall be entitled to the exemption provided by this section; (d) Unless the real property is the legal residence of and is occupied in whole or in part by the owner or by all of the owners of the property, provided that an owner who is absent while receiving health-related care as an inpatient of a residential health care facility, as defined in Section 2801 of the Public Health Law, shall be deemed to remain a legal resident and an occupant of the property while so confined and income accruing to that person shall be income only to the extent that it exceeds the amount paid by such owner, spouse, or co- owner for care in the facility; and provided further, that during such confinement such property is not occupied by other than the spouse or co -owner of such owner. 5. The Town shall notify or cause to be notified, each person owning residential real property in the Town of the provisions of this resolution. This may be met by a notice or legend set on or with each tax bill to such persons reading "You may be eligible for senior citizen tax exemptions. Senior citizens have until (month) (day) (year) to apply for such exemptions. For information please call or write followed by the name, telephone number and /or address of a person or department selected to explain the provisions of this resolution. Failure to notify, or cause to be notified any person who is, in fact, eligible to receive the exemption provided by this resolution or the failure of such person to receive the same shall not prevent the levy, collection and enforcement of the payment of the taxes on property owned by such person. 6. Application for such exemption must be made by the owner, or all of the owners of the property, on forms prescribed by the Office of Real Property Services and shall furnish the information and be executed in the manner required or prescribed in such forms, and shall be filed in such assessor's office on or before the taxable status date. 7. At least sixty (60) days prior to the taxable status date, there shall be mailed to each person who was granted an aged exemption on the latest completed assessment roll an application form and a notice that such application must: be filed on or before the taxable status date and be approved in order for the exemption to be granted. Within three (3) days of the completion and filing of the tentative assessment roll, notice by mail shall be given to any applicant who has included with his application at least one self - addressed, pre -paid envelope, of the approval or denial of the application; provided, however, that upon the receipt and filing Page 4 of 33 TI3 1 -3 d)1 of the application there shall be sent by mail notification of receipt of the same to any applicant Is who has included two (2) of such envelopes with the application. Where an applicant is entitled to a notice of denial such notice shall be on a form prescribed by the State Board of Equalization and Assessment: and shall state the reasons for such denial and shall further state that the applicant may have such determination reviewed in the manner provided by law. Failure to mail any such application form or notices or the failure of such person to receive any of the same shall not prevent the levy, collection and enforcement of the parvment: of the taxes on property owned by such person. 8. Any conviction of having made any willful false statement in the application for such exemption, shall be punishable as set forth in Real Property Tax Law Section 467(7). 9. This resolution shall be applicable to the Town tax for assessment rolls based on taxable status dates occurring on and after January 1, 2001 and the provisions of said resolution shall govern the granting of an exemption under Section 467 notwithstanding any contrary provisions of that section. 2nd Cl Grantham Roll Call Vote Cl Beck Yes Cl T Hatfield Yes Supv Varvayanis Yes Cl C Hatfield Yes Cl Grantham Yes RESOLUTION #3 - ADOPT LOCAL LAW 112001) GRANTING A REAL PROPERTY TAX EXEMPTION TO PERSONS WITH DISABILITIES Cl T Hatfield offered the following resolution and asked for its adoption: RESOLVED, that this Town Board hereby adopts the following local law grant a real property tar exemption to persons with disabilities, and directs the Town Clerk to file the- same with the New York State Department of State: 1. This local law is enacted pursuant to Section 459 -c of the Real Property Tax Law of the State of New York as most recently amended by Chapter 222 of the laws of 2000. 2. Real property located in the Town of Dryden, owned by one or more persons each of whom is disabled and whose income is limited by reason of such disability or real property owned by husband and wife, or siblings one of whom is disabled and whose income is limited by reason of such disability shall be partially exempt from taxation by said Town for the applicable taxes specified in Section 459 -c based upon the income of the owner or combined income of the owners. Such partial exemption shall be to the extent set forth in the schedule following. The partial exemption provided by this law shall, however, be limited to such property and persons as meet the conditions, qualifications, exclusions, and limitations set forth in Section 459 -c of the Real Property Tax Law. This local law shall be administered in accordance with said sections of the Real Property Tax Law, as now adopted, and as they may be amended from time to time, and the provisions of said section as provided in Section 459 -c, shall be applicable to the effectuation of the exemption provided for in this local law. 4. Application for such exemption must be made by the owner or all of the owners of the property on forms prescribed by the State Board to be furnished by the Tompkins County Assessment Department and shall include the information and be executed in the manner required or prescribed in such forms, and shall be filed in the said Assessment Department office on or before the appropriate taxable status date. 5. Any conviction of having made any willful false statement of the application for such exemption shall be punishable by a fine or not more than $100 and shall disqualify the applicant or applicants from further exemption under this local law for a period of five (5) years. 6. This local law shall be applicable to the Town tax for assessment rolls based on taxable status dates occurring on and after January 1, 2001 and the provisions of said local law shall govern the granting of an exemption under Section 459 -c, notwithstanding any contrary provisions of that section. 7. This local law shall take effect immediately. Roll Call Vote Cl Beck Yes Cl T Hatfield Yes Supv Varvayanis Yes Cl C Hatfield Yes C1 Grantham Yes Atty Perkins has provided Supv Varvayanis with a draft of the Flood Hazard Mitigation agreement to review and send on to the board. It is a generic form, and can be tailored to fit specific circumstances. Joseph Valentinelli, Town Justice, explained to the board some of the difficulties his court encounters because of lack of space. The court room continually needs to be rearranged because it is used for other meetings, such as board meetings. It makes for a. hectic time prior to trial. Sometimes 30 and more prospective jurors are in the building. There is no place for attorneys to conference with their clients or conduct meetings privately and often other offices in the building are used by them. The Judges frequently are unable to access their own office. Witnesses need to be kept separate at times of trials, and have had to use other offices in the building and even in the Highway building. Pre- trials days are also difficult. for the same reasons. Dryden has one of the busiest courts that there is in the County. When the Board has had emergency meetings at 8:00 a.m. on a 9:00 am. court day, it has caused difficulties for the Court. Judge Valentinelli offered to serve on a committee to see what can be done t., Pale 6 of 33 TO 1 -3-()1 about additional space. People working in this building are all impacted by the lack of space. It is very frustrating for the Judges, their secretaries, and everyone in the building. Cl Beck stated that he had brought this up a few months ago and we now have a building committee. Judge Valentinelli has visited other Courts in Lansing, Candor, Virgil, Ithaca and they have nice complexes not only to accommodate the Court, but other Town offices. It is important to have more space, not just for storage, but so that people can have a little privacy while doing their work. People in this building are disturbed all the time. Cl Grantham pointed out that Jean Ryan is on the building committee. Judge Christopher Clauson explained that Jean Ryan will be retiring in May and he needs to hire her replacement. It will take three or four months for a new person to get their feet on the ground. He would like the board's permission to start interviewing for a replacement for her and invited the board to attend the interviews. He has been looking and believes there is a lot of experience out there and he feels that if he could have some sort of competitive wage that he could get a good court clerk. Though Jean's salary is already in the budget, a new person would not be started at that wage. Judge Clauson would like to put an ad in the paper this week and set up interviews within the next week or two and make a decision by February 1. He believes the minimum wage he would have to offer would be $10.00 per hour plus health benefits. Cl T Hatfield suggested that the ad state that the salary would be commensurate with experience and the Judge Clauson establish a salary range and come back to the board to talk about it. Ci T Hatfield acknowledged that it will be difficult to replace Mrs Ryan considering her years of service, experience and knowledge. Cl Grantham asked Judge Clauson to get information regarding what people are paid in this position in other Courts in the area to justify a salary request. He will do that. He has a few people who are interested and he is looking for experience. Judge Clauson informed that Board that Bill George has taken a job at the airport, so he is also looking to employ a new court officer. Mike O'Connell, who recently retired from the State Police, has expressed an interest in the position. Cl Grantham explained that the building committee met in December and has been looking at building plans and is trying to obtain copies of space studies from Towns that have recently built buildings. The next step will be to write an RFP to get a space study done. Collateral shall not be required with respect to the direct purchase of obligations of New York State, obligations of the United States, and obligations of federal agencies the principal and interest of which are guaranteed by the United States Governments. 2, DELIVERY OF SECURITIES a. Payment shall be made by or on behalf of the Town of Dryden for obligations of New York State, obligations the principal and interest of which are guaranteed by the United States. At the time independent auditors conduct the annual audit of the accounts and financial affairs of the Town of Dryden, the independent auditors shall audit the investments of the Town of Dryden for compliance with the provisions of this investment policy. c. Within sixty (60) days of the end of each of the first three quarters of the fiscal year, the Supervisor shall prepare and submit to the Town Board a quarterly investment report, which indicates the new investments, the inventory of existing investments and such other matters as the Supervisor deems appropriate. d. Within 120 days of the end of the fiscal year, the Supervisor shall prepare and submit to the Town Board an annual investment report; recommendations for change in these investment guidelines; the results of the annual independent audit, the investment income record; and such other matters as the Supervisor deems appropriate. At least annually, at the Organizational meeting of the Dryden Town Board, the board shall review and amend, if necessary these investment policies. FAIR HOUSING PLAN TOWN O.F DRYDFN JANUARY 2001 Introduction The Town of Dryden received a 1995 and 1998 Small Cities CDBG grant to undertake a housing rehabilitation project in the Town. The Town anticipates further participation in the Small Cities program. As part of U.S. Department of Housing and Urban Development regulations for grantees, the Town must "take actions to affirmatively further fair housing." This Fair Housing Plan describes actions the Town will undertake to meet this requirement. Town Profile 1. Location The Town of Dryden is located in the Finger Lakes region of New York State, and is part of the Southern Tier East Regional Planning and Development Board service area. The Town includes two villages, Dryden and Freeville. The center of the Town is approx. 40 miles southwest of Syracuse and 45 miles northwest of Binghamton. 2. Population The 1990 population of the Town of Dryden was 13,251, with 1,908 persons located in the Village of Dryden and 437 persons located in the Village of Freeville, for a total of 10,906 located outside the incorporated areas. The Town's population increased by 1,095, or nine (9) percent between 1980 and 1990, a slightly larger increase than the County's increase of eight (8) percent during the same period. A small portion of the Town with 979 persons is located in the Ithaca Urban Area, the remainder of the Town is rural (12,272 persons). The Village of Dryden, the Town's largest incorporated place, has 1,908 residents, or 14.4% of the Town population. Dryden's population is largely white, with 12,783 (96.5 %) of the population being white. Asian and Pacific Islanders are the Largest ethnic minority in the Town, with 194 persons (1.5 %). There are also 187 Blacks, 55 American Indians, Eskimos, Aleuts, and 131 persons of Wispanic origin in the Town. Tompkins County is 90% White, 5.5% Asian and Pacific Islander, 3.3% Black, 0.3% American Indian and 1.5% H-ispanic, according to the 1990 U.S. Census. 3. Income Characteristics The Town had a per capita income of $12,850 based on 1990 U.S. Census data, and a median family household income of $39,578. Ten (10) percent of the persons in the Town of Dryden were Page 29 of 33 TB 1 -3-01 below the poverty line in 1990. Six (6) percent of the households in the Town were on public assistance. Tompkins County had a per capita income of $12,709 in 1990, and a median family household income of $37,874, according to the U.S. Census. Seventeen (17) percent of the persons in the County were below the poverty line in 1990, and four and a half (4.5) percent of the persons were receiving public assistance. 4. Land Use The Town of Dryden covers 94 square miles, which is 14 percent farmland and 10 percent forest lands. Commercial and industrial uses in the Town are largely concentrated along State Routes 13 and 366, which go through the Town. The population density of Dryden is 141 per square mile. 5. Housing Characteristics The 1990 Census indicates there were 5,362 housing units in the Town of Dryden, of which 5,037 were occupied and 325 (6.10/6) were vacant. Thirty (30) percent of the housing of the housing in the Town was renter - occupied, and seventy (70) percent was owner - occupied. Units included 2,901. single-family homes (54.1%), 951 units in structures with two to nine units, and 236 units in structures with more than 10 units. There were 1,190 mobile homes in the Town in 1990 (22.2 %). 6. Substandard Housing Conditions There is no current, definitive data on housing conditions in the Town as a whole. 1990 U.S. Census data indicates that approximately half of the housing in the Town is 30 years older or greater, and the Tompkins County Planning Department and Better Housing for Tompkins County, .Inc., a not - for -profit housing agency in the County, indicate that there are substantial numbers of deteriorated units in the rural portions of the County, including the Town of Dryden_ Most recent estimates indicate that about 20 percent of the Town's housing stock can be classified as substandard. 0 7. Vacancy Rates The 1990 U.S. Census indicated a vacancy rate of 6.1 percent. 8. Economic .Base The Town's economic base includes many persons who work at Cornell University, Tompkins County's leading employer. Portions of the University property are located in the Town, and employ many persons. In addition, several medium -sized companies and organizations, including H_i -Speed Checkweigher, Wilcox Press, Tompkins- Cortland Community College, New York State Electric and Gas, George Junior Republic and XCP Inc. are located in the Town. Fair blousing Problems The Town has not undertaken a formal study of fair housing problems in Dryden to date. Discussions with the Tompkins County Affordable Housing Advisory Board, Cornell University, the Tompkins County .Human Rights Commission and other interested agencies, have identified the following possible but not substantiated areas of concern; -- Possible discrimination against families with children. -- Possible discrimination against the mentally handicapped. -- Economic constraints which restrict housing for low and moderate - income persons. -- Possible problems associated with renting to students. Cl Granthamm spoke about the Fall Creek Watershed Committee. It is a grass roots committee and she has been attending the meetings when she can. A lot of the people involved in it are Dryden people. The Town did a letter of support earlier in the year for an application through the Tompkins County Water Resources Council to get funding for a cleanup along the creek. That was funded and the Committee will be doing a Fall Creek cleanup in the Spring. They are now working on a proposal to get some funding to do some stream bank stabilization demonstration projects for homeowners along Fall Creek. Matt Shulman has volunteered to help with this proposal which is due January 17. If funded, the committee will do one or two projects in Fall Creek, and workshops will be open to anyone who is interested in learning how to do it on their property.
