PUBLIC HEARING - PRELIMINARY BUDGET 1993
Special Meeting 7 : 00 P . M . November 9 , 1992
A Public Hearing was scheduled to present the Fiscal Year 1993
Budget for Thursday , November 5 , 1992 and adjourned until Monday ,
November 9 , 1992 , 7 : 00 P . M .

S upervisor Oltz called the Public Hearing to Order at 7 : 00 P . M . and
read the following publication :
NOTICE IS HEREBY GIVEN that the Preliminary Budget for the Fiscal
Year 1993 has been completed and filed in the Office of the Town
Clerk at 1830 Danby Road , Town of Danby , Ithaca , New York where it
is available for inspection during office hours .
FURTHER NOTICE IS HEREBY GIVEN that the Town Board of the Town of
Danby will meet and review the said Preliminary Budget and hold a
Public Hearing thereon at the Town Hall on the 5th day of November
1992 at 5 : 00 P . M . Citizens attending the hearing have the right
to provide written and / or oral comments concerning the entire
budget . Pursuant to Section 108 of the Town Law , the proposed
salaries of elected officials are as follows :
Supervisor $ 9 , 335
Town Clerk / Tax Collector $ 11 , 220
Town Councilpersons ( 4 ) $ 1 , 539 ( per councilperson )
Highway Superintendent $ 27 , 500
Town Justices ( 2 ) $ 4 , 100 ( per justice )

Published : October 30 , 1992
Councilperson Marisa addressed the public and explained the process
for preparing the Fiscal Year 1993 Preliminary Budget . There are
a few changes in the budget as presented tonight due to a request
from the Justice Department ( salary increase will be deferred ) and
an adjustment in FICA and retirement system estimates . He said
that the total increase in the budget is approximately eighteen per
cent ( 18 % ) as it is presented tonight after adjustments .
Comments from the Public :
Edw . M . Roberts -- Bald Hill Road - asked why the budget increase
was not in the four per cent ( 4 % ) . Mr . Roberts asked the Town
Board to place an article in the Ithaca Journal so residents know
of the proposed tax increase .

Councilperson Marisa explained that all of the expenditures are
less than last year . The main reason for a tax increase is due to
d ecreases in State Aid revenues , mortgage tax income , CHIPS
funding , etc .
Marge Dillon representing The Human Service Coalition - - addressed
the Town Board and asked the Town to continue some funding in
support for the Human Service Coalition . The Town has supported
the HSC Organization on an annual basis .
Gary Ozmunkowski of Comfort Road - - addressed the Board and
✓ eported that there are a number of youth in Danby and there are
n ot many services . He asked if the City of Ithaca programs would
be available for the Town of Danby youth in 1993 .
Supervisor Oltz reported that the City programs would be available
for Town of Danby Youth at triple fees ( as in previous years ) . The
Town is working with other neighboring townships to develop an
affordable program for ball teams for the 1993 season .
S usan Hautala - Hornbrook Road - - asked for explanation of Highway
Department budget , how much the County pays the Town for snow
✓ emoval on County roads , why we have not sold the old highway
barns , and why isn ' t it closed . She said as a taxpayer she feels
that an 18 % tax increase is not financially responsible behavior
and a decrease in services is fine .
Councilperson Marisa said that the proposed Fiscal Year 1993 budget
implies that the Town would use the proceeds from the sale of the
O ld Town Highway Barns ( if / when it is sold ) and use them to move
everything from the old site to the new building on Hornbrook Road
and to build salt sheds .
Gary Ozmunkowski - Comfort Road - He thinks 18 % is a lot of money
and it should be publicized in community papers so that people are
informed about the proposed increase .
Supervisor explained that there are a few items that will be
adjusted down such as the FICA and retirement that are not
reflected in the budget draft .
Mary Ann Kozak - Representing the Pond Committee said she is not
happy that there is not money in the budget for the pond .
Councilperson Marisa said that the Board received a reduced
proposal for the Pond Program and that it will be considered at the
next budget meeting .

A motion was made by Supervisor Oltz and seconded by Councilperson
Marisa to close the Public Hearing at 7 : 52 P . M .

all present in the Pledge of Allegiance to the American Flag .

Tompkins County Representative Report
Representative Frank Proto reported on the following :
1 ) Tompkins County Budget - - adjustments to the Proposed 1993
Tompkins County Budget are in progress .
2 ) County 1 % Sales Tax Increase - - Sales Tax increase of 1 % goes
into effect on December 1 , 1992 and is expected to generate
approximately six and one half million ( $ 6 , 500 , 000 ) dollars .

3 ) Budget & Administration Committee - - will meet on Thursday ,
N ovember 19 , 1992 at 5 : 00 P . M . and Friday , November 29 , 1992
at 2 : 00 P . M . The public is invited to sit in on the meetings .
4 ) Bus Service - - if $ 115 , 000 is not restored in the budget ,
D anby , Caroline , Newfield , and Lansing will lose their bus
service .
5 ) User Fees for Trash Disposal - - A public hearing is scheduled
for November 17 , 1992 - - A LOCAL LAW DEALING WITH USER FEES .
6 ) New York State Archives Money - - some funds are available for
Archives Grants .
7 ) Water Well Protection Plan - - there will be a moratorium
placed on residents around DR - 7 Landfill site . Testing of the
water wells near the Hillview Road Landfill will continue and
$ 49 , 000 is set aside for 1993 .
Members of the Public :
Julie Colombe of 72 Bald Hill road reported on the Community
Council Halloween Party and said that more activities are needed
for children in our community .
Theresa O ' Connor of 250 Bald Hill Road reported that the Halloween
party was a great success and asked the status of the Danby School
building .
Councilperson Schwartz said that Community Council was negotiating
with the Ithaca City School District for use of space in the old
Danby School building for their youth programs .
COMMUNICATIONS :
1 ) Environmental Management Council Reports for September and
October 1992 - submitted by Daniel Decker ;
2 ) Dog Control Officer Report - October 1992 ;
3 ) Code Enforcement Officer ' s Report - October 1992 ;
4 ) Community Council Minutes for October 1992 .
Highway Report :
H ighway Superintendent William Hall reported that the Recycling
Center at the Old Highway Barns will be moved to the New Highway
B arns location at 93 Hornbrook Road .
P lanning Board Report :
Chairperson Nancy Weitzel reported that the Planning Board
unanimously passed the following motion at the October 15 , 1992
meeting .
" Motion Regarding Tompkins County Reclamation Plans for
L andfill Site on Hillview Road
A motion was made by Joel Gagnon and seconded by Billy Kelley
t hat the Town of Danby Planning Board requests that the Town
B oard request that Tompkins County voluntarily submit for
review the Reclamation Plan which falls under the ' Covered
Material Mine Project ' . "
Joel Gagnon explained that Tompkins County is in the process of
capping the landfill with soil from an adjoining property . It was
h is understanding that compost from the landfill was the material
t o be used for the capping in the original plans .
S olid Waste Advisory Committee :
J oe Gagnon reported that the Solid Waste Advisory Committee ( SWAG )
passed a brief resolution in support of keeping the central

processing facility . Joel also reported on the details of why
square footage of homes and number of persons living in a household
was used to calculate the proposed household user fee for solid
waste .
Councilperson Miller said that she has not received a list of the
positions and each salary that is associated with the Solid Waste
B udget .
D iscussion followed regarding the proposed user fee .
OLD BUSINESS :
Building Repairs :
E d Roberts reported that a lock on the north side of the Town Hall
was replaced .
NEW BUSINESS :
RESOLUTION NO . 56 OF 1992
APPROVAL TO ADD UNPAID WATER BILLS FROM OCTOBER 31 , 1991 THROUGH
OCTOBER 31 , 1992 TO THE 1993 TAX BILLS FOR COLLECTION

WHEREAS , Mary Casterline , Collector for the West Danby Water

W ater District in the amount of $ 1 , 305 . 39 to be turned over to
Tompkins County to be added to the 1993 Tax Roll for collection .

APPROVAL OF TRANSFER OF $ 7 , 000

WHEREAS , the Town of Danby has received seven thousand dollars
( $ 7 , 000 ) from the Danby Fire District as payment for certain
property located in the West Danby Water District , now be it
RESOLVED , that the Town of Danby Town Board approve the transfer of
seven thousand ( $ 7 , 000 ) from the General Fund Account to the West
D anby Water District , and be it further

of the landfill site for use in capping of the landfill , and
WHEREAS , the Town of Danby Town Board has received a request from
t he Planning Board to review the Reclamation Plans for " The Cover

RESOLVED , that the Town of Danby Town Board requests Tompkins
County to voluntarily submit for review the Reclamation Plans for

A motion was made by Supervisor Oltz and seconded by Councilperson
S chwartz to hold a Special Board Meeting on Monday , November 16 ,
1992 at 7 : 30 P . M . to review the 1993 Preliminary Budget .
Approval of Warrants :
Councilperson Marisa reported that there a claims entered on
N ovember 1992 Warrants that include New York State Sales Tax .
Approval of General Fund Warrant No . 11 of 1992
A motion was made by Councilperson Marisa and seconded by
Councilperson Schwartz to approve the General Fund Warrant No 11 of
1992 for an amount not to exceed $ 6 , 328 . 05 and that the warrant be
checked for sales tax charges .
