I know Lansing and other towns in the county have been moved by what has happened in Groton and it makes sense to take a look at this issue and not have something sneak up. Supv Schug - the moratorium will be in place and then go the Planning Board and Zoning Board of Appeals for their review and input to the town board as to what they feel is appropriate. Slater - since it is mounted on the building it would be allowed to occupy not more than 20 percent of the building facie and would not be permitted to rise above the roof line, which it does not. For my own purposes for the application I drew the line through the connection and treated the house as the house and the business as the business. I was asked to look at the Christmas tree situation and looking around the town there are people that sell Christmas trees, and do every year. I thought we need to treat them all of the same. If we tell Bob he can't sell Christmas trees then we would have to tell everybody else that is selling trees. It has never been the towns position to do that and we have never considered doing that. I didn't feel we should 40 change that for this particular situation just because the house and the business are right next door to each other. There is a separate address and that is the judgement I used. ` %% TP12 -9--97 Page 4 •Clp Grantham - my question is not so much what the practice has been, but what are the requirements. Is that differentiated in our local law. Z.O. Slater - I would think that selling Christmas trees, being a limited time frame is not a typical business application. I have never had the question before so it has never been considered. Atty Perkins - Henry's approach is no harm, no foul until someone complains with respect to the Christmas trees. It could be argued that since it is not a specific enumerated use it is not an allowed use. That is one position that could be taken. I don't think the sale of Christmas trees fall into allowed uses described as a greenhouse or a nursery unless he grows them there and harvests them and offers them for sale at the same location. Ken Finkelstein - I think the point the other neighbors have expressed is if you are going to have a business then, I have no problem with the business and we are going to have a display on the inside that is great. You can't also have your home a future yard sale. I don't mind the Christmas trees, but I don't want to have that to be your display area. Carried CITIZEN PRIVILEGE OF THE FLOOR Lonny Palmieri, Lake Manager - went over project that is going on at the Owasco Lake Watershed. The Town of Dryden is a participant in this project. One of the reasons for the project is to produce a management plan for the watershed. They will look at the watershed in terms of resources of the water running through it. This project is hoping to acquaint upstream and downstream users with each others situation and to address issues and concerns with local communities. This project is driven by the EPA. In the early AO's when the Clean Water Act was signed said that every watershed had to have a State of the Lake Report to receive funding for water issues. EPA has decided that the State of the Lake is a requirement and the initial reason for everyone getting on board. The State of the Lake is a report that will be a requirement. The first step is to identify everyone who has a stake in the watershed. The second step is to identify watershed issues and lake issues. The third step is to compile a State of Owasco Lake Report. This report will contain scientific information about the lake, a description of the watershed, and land uses, and summaries of resident's issues and concerns. The fourth step is to generate recommendations using the State of the Lake Report. The recommendations on which the stakeholders will be used to build the Watershed Management Plan. The last step is to create an action plan reflecting community priorities for the watershed and recommendations for implementation. Clp Grantham - how will you get information about State of the Lake.? Lonny Palmieri - gave board members copy of a planning board document information for their review. We are looking for the to give us their issues of concern. We are looking at a time totown table of March 1st. CAYUGA LAKE WATERSHED NETWORK ® WHY DID *IT GET STARTED AND WH.N? In the spring of this year (1997) people living in the Cayuga Lake watershed recognized that communities in the watershed would be at a decided disadvantage in regard to allocation of Clean Water, Clean Air Bond Act funds, compared to other Finger Lakes, if there was no organized citizens group to speak for the needs of the Cayuga Lake watershed. Each of the other ten Lakes has such a group. The Cayuga Lake watershed is the largest in the Finger Lakes (722 sq. mi.) and includes parts of 5 counties and .40 municipalities partially or wholly in the watershed. It was-recognized that a watershed network could make a difference in stemming the rising tide of local property taxes by assisting multi - community collaboration, avoiding duplication of services and tieing together environmental and economic partnerships. HOW DID IT GET STARTED? The network began with phone calls to identify individuals in the 3 principal watershed counties - Cayuga, Seneca, Tompkins- who would be willing to volunteer their time to participate in a temporary steering committee to consider the pros and cons of a network. Two goals were emphasized from the start - -that we would strive for approximately equal representation from all three counties and that we would emphasize the positive nature of the network -- established to be for things that benefit the watershed and are cost effective, not to oppose specific actions or activities. Six meetings since June have circulated around the watershed and have included many stakeholders, including local officials. However, we intend that the network be a not -for- profit citizens' organization of individuals, groups and businesses, including, but not dominated by government agencies or officials. Representatives of other watershed groups -- Canandaigua, Keuka, Seneca -- have informed us about their activities and we have discussed _structure, activities, issues and membership. The network is now organizing itself into a more formal structure, has adopted a mission statement and during the coming year expects to involve a significant number of individuals.and groups to work with local governments and local agencies in the shared task of maintaining and improving the ecological health, economic vitality and beauty of the watershed environment. HOW DO I JOIN THE NETWORK OR KEEP INFORMED ABOUT WHAT IT IS DOING? Easy. Just give your name, etc.,to Tim Pezzolesi of Cayuga County Cooperative Extension who is serving as secretary for the network. Lonny Palmieri - it is voluntary at this point. Clp Grantham - these watershed management plans are not regulatory. What is driving them is the promise of funding or the threat of riot getting funding for doing any kind of environmental management. It is coming from the federal level of the Environmental Protection Agency through the State Department of Environmental Conservation and at some point when we want money from the state to do various projects we won't get it unless we have participated in a watershed management planning process such as this. Kekua Lake has done a huge amount of watershed planning and one thing they did was draft local laws and all of the municipalities in the watershed agreed to adopt the same local laws regarding their watershed management activities so they are all operating under the same laws, but they are all local municipal laws. They are not state, federal or regional laws. The funding is shared as well. I don't think these watershed management plans have that intent initially, but I do think non point source pollution is a problem in every community. It is not regulated for the most part, but it is a problem and a major problem in every community. However, there are regulations that are coming and I think that in a few years we will be regulated ®from the federal and state levels unless we have already managed to put our own plans in place. One of first ones to get regulated probably will be the farmers. .Janet Hawkes - spoke on Cayuga Lake watershed - Cayuga Lake watershed includes 42 municipalities and included in that are 36 towns and villages. It is about 700 square miles. There are a lot of issues and a group is looking at those. The organization has talked about the future for the lake and some of the issues that are concerns. There isn't a management plan in the future, but may help contribute to that if one gets started. Cayuga Lake is the largest of the Finger Lakes and does not have a management plan or a lake association. We are not available for bond act funding sin there is some initiative for the neighbors. They are interested in communication, education and trying to provide some leadership. Dan Seewald - Yellow Barn Rd. - showed the board members and guests a video tape of tributary 14a flood. Supv Schug - Henry is checking the map to get all of the names and addresses of the people who would be affected by the stream. Atty Perkins will put together what is entailed'and let everyone who lives in the area knew and hold a public hearing and vote on a watershed protection district. They would also have to •understand that on some basis they would be responsible for paying a portion of fixing the stream. Jody Soroka - 63 Yellow Barn Rd - it is about 15 feet from our swimming pool and something has to be done. Supv Schug - there are things that can be done to slow the stream down. Soil and Water Conservation was there to look at the situation several years ago. Stephen Bright - wanted to know what steps would be taken. Supv Schug - the town will put together an agreement for all of the neighbors. They will then have an opportunity to vote and choose whether or not they want to be part of it. We will try and get the county, state and Soil and Water Conservation service, problems wherever there is some help to defray the cost of fixing, spend cleaning and getting experts to tell us the best way to fix the stream and protect what is there_ this process to the Co. Rep. Evans - the county has a fund now that will contribute one third $37,,500.00 of that county wide. cost. that I paid to have Co. Rep. Lane - we put in more money this year but still only have $37,,500.00 where the creek goes county wide. Jack Harding, 55 Yellow Barn Rd - there is such a thing as sweat equity. You will not find anything or debris where the creek goes by my house. There was a turn in the creek that I paid to have straightened out. It is very easy to do viork on a stream and cause much greater problems down stream and up stream. Atty Perkins - whether the use will be more objectionable or depreciating to adjacent and nearby properties by reason of traffic, noise, vibration, dust, fumes, smoke, odor, fire, hazard, glare, flashing lights or disposal of waste or sewage than the operation of the allowed uses of the zone. Hatfield - the property has been vacant for a number of years so it is better to have it occupied and taken care of. Supv Schug - wanted to make sure he had enough room inside of the building for what he wanted to do. Robert Lehto Sr - yes, there is enough room. Clp Grantham - is there a building size requirement for the special permit? Supv Schug - no, as long as he stays inside. He is not going to change anything or add to the building. Atty Perkins - whether a non - residential use adjacent to an existing residential use shall be screened by a landscaped buffer strip or suitable fencing. Atty Perkins - one side is his residence and the other side is a used car storage lot. Do we have to take this the into account. Atty Perkins - no, that has absolutely nothing to do with the board making your determination for the special permit. It is a matter for the Dept. of Social Services and Social Security Administration not this board. Supv Schug - he has a business permit so he should be collecting sales tax. This kind of a business does not need public bathroom facilities. Z.O. Slater - you may want to consider a non transferable clause. Atty Perkins - you would make the use non transferable not the applicant. The conditions are lighting, moving the Christmas trees, no outside storage of materials for sale or otherwise or no yard sales or other goods to be offered for sale at the residence, hours Monday through Thursday 9:O0AM to 5:O0PM, Friday and Saturday 9:O0AM to 6:0OPM and Sunday 12:00 noon to 6:O0Pm, trash shall be kept out back and screened in and the sign shall meet the sign ordinance. John Tottey - would like to have this checked into. Also, felt the town should be paid by check from the junk dealer instead of cash n or prior should be inspected Roger Hatfield - I was under the impression that Article 1221 of the state code has been amended to read any double wide mobile home etc, that is subject to 1976 or prior should be inspected for safety, electrical and plumbing and if so each case should be merited on its own and not lumped into one set of problems. It has been a problem for me for about 6 years. I don't think this is what the board intended to do when they passed this rule. The State did the same thing, but they amended theirs back a couple of years ago is my understanding. I think if the house is safe and sound and electrically passes should be allowed to be put in any area that is zoned for the residential area. I would like to see the town board at least look at it. Atty Perkins - the Town Board on two prior public occasions have already visited this issue. What Mr. Hatfield asks is that the town amend its mobile home ordinance to permit pre HUD era homes to be placed in the Town of Dryden upon inspection. Currently pre HUD era homes are allowed to remain at their present location. They can not be moved or relocated. If they are moved they must be from the Town of Dryden. They may be replaced by a HUD era home. The position of the town was a legislation decision enacted when the town enacted the mobile home ordinance. They decided to improve their housing stock by phasing out pre HUD era homes in not allowing them to be replaced in the Town of Dryden or recited in the Town of Dryden or brought into the Town of Dryden. If the board wants to revisit this issue for the third time it certainly can. On the two prior occasions they decided not to make a legislative change. Supv Schug - the town also spent a lot of money defending the mobile home ordinance. 0 Atty Perkins - that is correct, which was upheld by the appellate division. /960 TD12 -93 97 Page 12 ®Roger Hatfield - since that time hasn't the State revisited their thinking on this Article 1221 and a house based on its own merit. That if it meets all of the criteria etc of the zoning departatent it should be allowed to be put in that location. Atty Perkins - the State may have amended that, but it is still a local option. Roger Hatfield - I don't think the board intended to cut off the feet of the 5, 000 people. Atty Perkins - the you are board intended people to improve its housing stock when they adopted those regulations who in the mid 80's. paid Clp T. Hatfield - the board can revisit the issue. Roger Hatfield T. - when you are forcing all of these people who own these units to sell them dirt cheap, which is not really the fair to the people who have invested their time, effort and paid their tax dollar for years and years to just somebody who just turns them over to the Town of Harford which is just 4 miles down the road and they are fine. There is somebody down there buying them for nothing and not giving the people a fair chance to sell his property. The trailer was not moved from one lot to another, it was moved from one trailer park under a different ownership to his trailer- park. Roger Hatfield - all within the Town of Dryden, right. Atty Perkins - that case has not been resolved. Z.O. Slater - that is correct. Roger Hatfield - the one unit I have is a special built unit and was built after 1976 and does not require a HUD seal by New York State and they were allowed in many parts of the State. The only one that says we can't have them is the Town of Dryden. I don't think that is fair regardless of whether I own it or my daughter it. My daughter owns the trailer and I own the land. This •owns has restricted me from renting it out. It is probably better than TB 12-9-97 Page 13 ®what was there. I have invited several of you out to look at it to see for yourself. I don't feel anybody who owns such a unit should be restricted to it. We have taken a special permit and changed a chicken house into a beauty shop, yet you can't transfer a house that was built for a rental unit into a house. This doesn't make sense to me. I have seen old barns converted to houses and they look pretty decent to me. Why should we restrict these people who own these units. Supv Schug - the town will be happy to review this issue again. COUNTY BRIEFING Co. Rep. Evans - public safety will be going to a home monitoring system for certain people in the jail on the 1st of January. These will be non violent individuals. This is in regard to the problem we have, since we are boarding out 41 prisoners with the jail at full capacity. It is costing the county about $900,000.00 a year to do this and this is an attempt to reduce those costs. Some members will be meeting with the State to discuss double bunking and is only a temporary measure. Co. Rep. attempting Evans to implement - in the area job requirements. of welfare reform the county is It will be an issue in trying to find .jobs for these people. ® Co. Rep Evans - the county beard passed the budget unanimously for the first time in 16 years. Co. Rep. Lane - the county did pass the budget and the solid waste is going down again by $4.00. We talked about personal safety type programs that are already in place in the school system arid other parts of the county and options what we might do here. We left it with the agency people to put together a draft plan for a program here in Dryden. We will meet again the third week in January. At that meeting we will look at the draft plan. Clp Grantham - reported that Carol Ast from 9 Hunters Lane put a news item in the Ellis Hollow Gazette in asking people in the neighborhood if they were having problems with their wells to contact her. At this point she has received very limited response. People down hill are not having a problem because their wells are in a shallow aquifer. The people above her are having problems because they are using bedrock wells so they are all using the same water and having trouble. She was supposed to write a letter addressing their concerns and how they would like the town to address things in the future. One process the town could go through when they look at subdivisions concerning water availability. Supv Schug - would like her to let us know the names and addresses of the people who are having water problems. Clp Grantham - I have asked her to do that. The people who have responded are not the least bit interested in municipal water. Clp Grantham - the Varna Community Center is planning to respond to the Commercial Center of Revitalization program application. They are asking for a letter of support from the town. Since we had (4) qualified applicants, I did not consider the two Unqualified persons, Of the four persons we interviewed, one Kevin Ezell, clearly stood out above the rest. Kevin is currently working as Code Enforcement Officer and has seven years plus experience and comes highly recommended by the New York State Codes Division and the City of Cortland Codes and Fire Department. Also, Ms. Keller did not seem particularly interested whether or not she was the successful candidate. Sensing this, I asked Ms. Keller why she applied, "she said she saw the ad for the position, so she decided to see what the job was about and would take it if offered ". The last qualified person, Thomas Stowell from the Marathon area, was the person who lived 20 plus miles away but was not interested in moving to this area which sort of ended the interview. This Ordinance shall be known ad cited as the Town of Dryden Traffic Ordinance. 2.) This Ordinance is adopted pursuant to Article 41 of the New York Vehicle and Traffic Law and Article 9 of the Town Law. �.) This Ordinance shall apply to all the Town Highways outside of the Villages of Dryden and Freeville. 4.) Upon the recommendation and report of the Town Highway Superintendent indicating that it is in the public good and in the best interests of the Town road in question, the Town Board may by order: (a) Temporarily exclude from any portion of any Town highway any vehicle with a gross weight of over four or more tons or any vehicle with a gross weight in excess of any designated weight on any wheel, axle, any number of axles, or per inch width of tire when in its opinion such highway would be materially injured by the operation of any such vehicle thereon. Such exclusion shall take effect upon the erection of signs on the section of highway from which such vehicles are excluded, and a notice that such vehicles are excluded shall be published in the official Town newspaper. • The exclusion shall remain in effect until the *oval of the signs as directed by the Town Board. Upon written application any operator of a vehicle subject to this section, the Town Board may issue ermit providing appropriate exemption to such vehicle, if it is deemed that said vehicle is performing essential local pickup or delivery service and that a failure to grant such permit would create hardship. Every such permit may designate the route to be traversed and contain other reasonable restrictions or conditions deemed necessary. Every such permit shall be carried on the vehicle to which it refers and shall be open to inspection of any peace officer, acting pursuant to his special duties, or-to any police officer. Section 2. Definitions. For the purposes of this local law, a telecommunication tower shall be described in and governed by Telecommunication Act of 1996. Section 3. SECTION 2: Purpose The Town of Dryden Zoning Ordinance establishes zoning districts and regulations concerning the use of land and structures. The statutory grant of power to regulate the use of land and. structures includes among the purposes of such regulation promoting the health, safety, morals or the general welfare of the community. The Town Board is concerned that the lack of specific regulation of adult uses of land and structures may result in the attempted establishment of an adult use in an undesirable location. The Town Board also recognizes that there are important constitutional issues and protections which must be identified and addressed in any regulation of adult uses. In order to address all concerns and issues in a lawful, thoughtful and reasoned manner the Town Board determines that it must declare a moratorium on the establishment of such uses pending the review and enactment of appropriate legislation regulating the same. SECTION 3: Definitions (A) Adult use. An adult use is the use of land or structures for an "adult entertainment business" or an "adult physical contact establishment" as herein defined. (B) Adult entertainment business: ® (1) A public establishment which features topless dancers, nude dancers or strippers, male or female. (If additional space is needed, attach pages the same sire as this sheet, and number each.) DOS -239 (Rev. 7/90) (I) l (2) A building or structure used for presenting, lending or selling motion picture films, video cassettes, cable television, or any other such visual media, or used for presenting, lending, or selling books, magazines, publications, photographs, or any other written materials distinguished or characterized by an emphasis on matter depicting, describing or relating to "specific sexual activities" or "specific anatomical areas" as hereafter defined. (C) Adult physical contact establishment. Any establishment which offers or purports to offer massage, whether or not licensed, or other physical contact by members of the opposite sex. Medical offices, electrolysis, karate, judo and dance studios are not "adult physical contact establishments ". (D) Specified sexual activities: (1) Human genitals in a state of sexual stimulation or arousal; or (2) Acts of human masturbation, sexual intercourse or sodomy; or (3) Fondling or other erotic touching of human genitals, pubic region, buttock or female breast. (E) Specified anatomical areas. (1) Less than completely and opaquely covered human genitals, pubic region, buttock, and female breast below a point immediately above the top of the areola; or (2) Human male genitals in a discernible turgid state, even if completely and opaquely covered. SECTION 4: Scope of Controls (A) During the effective period of this local law: (1) The Town Board shall not grant any approvals by means of a special permit, site plan review, zoning change or otherwise for the establishment of an adult use. (2) The Town Planning Board shall not grant any preliminary or final approval to a subdivision plat or any other approval which would result in the establishment of an adult use. 4a ® (3) The Town Zoning Board of Appeals shall not grant any variance for any use which would result in the establishment of an adult use. (4) The Code Enforcement Officer shall not issue any permit which would result in the establishment of an adult use. (5) No person, firm or corporation shall establish or use any land or structure for an adult use. (B) The Town Board reserves the right to direct the Code Enforcement Officer to revoke or rescind any Building Permits, Certificates of Occupancy and /or Certificates of Compliance issued in violation of this local law. SECTION 5: No Consideration of New Applications No applications of any kind for the establishment of adult uses as defined in this local law shall be considered by any board, employee or other representative of the Town of Dryden (whether elected or appointed) while this local law is in effect. SECTION 6e. Term This local law shall be in effect for a period of 180 days from its effective date or until the enactment of a comprehensive set of regulations pertaining to adult uses, whichever comes first. SECTION 7: Penalties (A) Any person, firm or corporation that adult use in violation of this provisions of shall otherwise violate any of the provisions shall be guilty of a misdemeanor and upon sentenced to a period of imprisonment not to fine not exceeding $1,000 or by both such fine shall establish an this local law or of this local law conviction may be exceed one year, a and imprisonment.
