There would only be 2 or 3 clients there at a time so there would be minimum traffic. Supv Schug - the sign would have to go on the building since it would not meet the set back requirements in the sign ordinance. Supv Schug - commented on early meetings at the county. They are very difficult to attend downtown since you have to pay for parking and then go through security before you can get through to the meeting place. The county would get better attendance if it was held some other place. Co. Rep. Lane - reported they had another meeting with Time Warner Cable and they are making progress. Co. Rep. Evans - they have set a public hearing on the ethics law for the county. Co. Rep. Evans - the Board of Health Dept. and Health Dept. has celebrated 50 years of existence and honored Jim Rice who has been a member of that board for the full 50 years. Solid'Waste Law Enforcement 1996 Annual Report In 1996, the Solid Waste Management Division recorded a total of 380 cases Motals. Table 1, slows a comparison to past TABLE 1. Of the 273 illegal dumping cases recorded: 1. 84 involved unauthorized use of dumpsters. 2. 24 were property owner dumps. 3.94 had no traceable evidence. 4. 155 or 57% were resolved successfully. A total 3 cases are still.pending. 30 cases were handled by the County Attorneys office. There was also $1935. in illegal dumping fines collected in 1996. In general, people seem to be increasingly satisfied with the handling of cases reported. In particular, they like the way in which fine monies are used to fund the County's clean -up plan. However, most munioipalities find it difficult to take advantage of this, citing that it is hard to justify sending out a vehicle to pick up one bag of trash. The Solid Waste Management Divisions purchase of a pickup truck in 1997 should help in getting the material removed quicker than in. the past. Municipalities would then only be contacted where large amounts or heavy objects were dumped. TABLE 3 Summary of cases by municipality. We think there is an advantage because our product will be fresher. We started on this project 8 years ago and decided to use leaf lettuce for a marketable product. We have done this with the support of some utility companies because we use a lot of electric power for supplemental light. The support we received from the utilities is they wanted us to set up a commercial demonstration. The greenhouse will be about 8,000 sq ft. It will be about 35 days from seed to saleable lettuce. They will turn out 1000 heads of lettuce a day. Atty Perkins - wanted to know the source of water. Robert Langhans - they would be using town water from Bolton Point. When the water goes into the ponds we do not drain it, we just add more water to it. We estimate 650 gallons a day. Atty Perkins - you will be on public water, but your plan states you will have a private septic system. Robert Langhans - we can go that way or they talked about pumping it up hill. Supv Schug - when we first talked about it we talked about them just hooking up to sewer. The water that is used in these tanks would not kill the sewer plant, but this water will not be dumped anyway. If there is ever any reason to drain the tanks it would be nutrient rich and could be pumped into trucks for use on golf courses, etc. Robert Langhans - this project will be 1 year to build and 1 year for marketing demonstration. They plan on marketing through Wegman's. Agway will continue using the building as a training center. The building will be modular so that it can be moved away. The Town Board gave them permission to have their ground breaking ceremony on June 23rd before their public hearing. Site Plan Review hearing is scheduled for July 8th. COUNCILMAN PRIVILEGE OF THE FLOOR Clp Grantham - has not heard from Don Trombley on safety and security with the school. ATTORNEY Atty Perkins - Cortland Paving (Ottenshot) - executive session. Atty Perkins - wrote letter to Mr. and Mrs. Reed reminding them of their obligations to make connection to the Turkey Hill water district. Cahill Acting Commissioner In response to your letter of 6116197 the following should provide you with more background and answers to at least some of your questions. 1) What is the NYS Open Space Program? In 1990 the State Legislature adopted Title 2 of Article 49 on the Environmental Conservation Law which charged the Environmental Conservation Department (DEC) and the Office of Parks, Recreation and Historic Preservation ( OPRHP) with preparing a comprehensive inventory of lands having statewide or regional significance" and with preparing a State Land Acquisition Plan to guide project selection. This legislation also established criteria for creation of Regional Advisory Committees and a State Land Acquisition Advisory Council. Subsequent legislation in Article 54 of the ECL further refined the open space preservation process. The enclosed copy of page 1 from the 1995 Open Space Plan will provide further insight. 2) How were the sites chosen to be placed on the open space list? Initially, both DEC and OPRHP sought input from staff, county & town governments, friends of groups, land trusts, special interest groups such as sportsmen, hikers, birdwatchers, etc, our Regional Advisory Committee members and the general public. All nominated projects were compiled into a comprehensive inventory of potential sites. The Regional Advisory Committee than reviewed the candidate projects and received input from staff, members and other parties familiar with the sites. Projects were chosen that should receive priority attention, resulting in the creation of the first Regional list. Because of the large number of projects statewide it became necessary' to limit the number of "Priority Projects" in each region. Consequently "Priority Projects" lists and 'Supplemental Projects" lists were developed for each region. 3) What does it mean to a community to have a site "on the list" ? Having a site "on the list" really doesn't do much more than recognize that a site has attributes that make a property worthy of being preserved as Open Space. There are no state regulations, restrictions or controls affecting the use of a property as a result of a site being "on the list", Hopefully local government will benefit from the knowledge that the site exists within their area and is deserving of special consideration during their deliberations. If the local community, or a qualifying not for profit land trust desires to preserve a site "on the list" and seeks a grant of state funds for the acquisition and appropriate open space development of the site, the fact that it is "on the list" will give the project additional points in the rating system used by OPRHP in evaluating grant applications. This could benefit a community working on a "on the list" project as opposed to a community working on a project not aon the list ". 4) What are the options available to a community to protect a site on the list. • Acquisition of easements OR fee title to the lands by: DEC - OPRHP County Town City /village Qualifying land trust ) By outright purchase or gift. a to u n a Grants are Available For up to 50% Of acq. Costs o Local government also has some options available in the form of zoning, planning and the development approval process. 5) What is the latest information on the Environmental Bond Act's Open Space Program funding? The Bond Act allocation for the Open Space Preservation program totals 150 million dollars. This amount is to be shared by DEC and OPRHP for open space acquisitions and by Ag. & Markets for their farmland protection program. The budget for fy 96 -97 appropriated 8 million dollars for the open space portion of the bond act. All of this money is either spent or firmly committed. The Governor's budget request for fy 97 -98 seeks a 15 million dollar appropriation for the open space portion of the bond act. The amount that is in the final budget will, of course, depend upon the budget approval process. Until a budget is adopted we have no spending authority. 6) How can the town be more involved in nominating sites in the future? Any site can be nominated at any time by anyone. The town should submit a site for consideration through DEC or OPRHP Regional Directors, or through any Regional Advisory Committee member, or to me directly. We need a sketch map showing the site location and other pertinent data such as acreage, etc. We also need a narrative about the site explaining the attributes and characteristics that make it worthy of protection, if and how it might be threatened, a conceptual description of how the site should be used or managed, as well as which agency or party should be the responsible manager. The package should not be more than two or three pages. Nominated projects will be submitted to the Regional Advisory Committee for their consideration at a future meeting. The plan is reviewed and lists updated on a two year schedule. ®Your understanding of the three primary ways to protect listed open space sites is generally accurate but I would point out that the grants program has a MAXIMUM participation by OPRHP of 50 %. There are many instances where the state share is less than 50 %. You are correct that being °on a list" does not necessarily mean that the state will acquire a site. In the case of the Beaver Brook Complex, acquisition by the state would be possible but relatively unlikely. The project no doubt would meet minimum qualifying criteria within some of the DEC acquisition categories (see enclosed chart from page 47 of the plan) but would have to undergo the screening and Resource Value Rating process to determine its appropriate priority rating statewide. Yes- -OPRHP administers the grants program. Yes, they are very competitive. Listed sites do get extra points. OPRHP receives annual allocations for the grants program from BOTH the Environmental Protection Fund and the Bond Act. Legislation establishing the EPF and the Bond Act BOTH require that when funds from these sources are to be used , town government must receive notice of our intention to to land in their town and be given an opportunity to object to the acquisition. The town is given 90 days to respond. If the town objects we do NOT proceed with the acquisition. No action within the 90 days is considered approval to proceed. EXEMPT from local government notification requirements are: • • Projects on the original "Priority Projects" list, * Gifts or projects funded from sources other than EPF and the Bond Act, The Virgil Creek site was presented by the DEC Fisheries unit at our meeting at the Lime Hollow Center. For some reason I accidentally left it off the list on the first go around. Its addition at this time is merely to correct that error. The proposed project consists of the acquisition by DEC of a parking area and access to Virgil Creek for fishermen. It is located in the Town of Freeville near Johnson Road. I'm also enclosing a copy of the publication "Local Open Space Planning - A Guide to the Process' This may be of assistance to you or the Town of Dryden. They have relocated the driveway, have done some road grading, the ditches and working on the water system,. They have made some progress. Clp Grantham - wanted to know if planting yet? Dave Putnam - they have done some some planting along the Reed prop healthy except one. They do have as putting in the curb and sidewa they have they done any of the staking for trees and have done erty. All of the trees look more work to do in that area such lk. Clp Grantham - was concerned about the trees because they only seemed to be just set in the holes and not properly planted. Clp T. Hatfield - asked Don if the town did not give Ralph the additional time he asked for when would he be able to do the project given his other priorities and schedule. Don said he would not be able to get to it until after the 30 days anyway. We should have Don put it on his schedule so another summer does not go by. If Ralph doesn't have it done in 30 days then we will have it on our schedule to get it finished. Clp Grantham - if Don can't get there before the 30 days then OK, but I am not in favor of any extension. 0 ENGINEERING Dave Putnam - Pinckney Road drainage study - gave Supv Schug and Hwy Supt Gilbert a plan recommending areas for stream bank protection. The cost that I gave you is only for the stone and not the installation. We also recommended where the stream is parallel to the creek that a guide rail be installed after the work has been completed. Supv Schug - so the cost for the material will be about 835,000/540,000 not including pipes or installation. We are talking about $75,000/8100,000 or more. Dave Putnam - the culvert under Sunset West Circle and Sunset West are starting to deteriorate like the one on Keith Lane so these should be replaced. Dave Putnam - Hwy Supt Gilbert asked me to look and see what could be done so the road would not be washed away during high water. It would be heavy stone fill rip rap along the side of the road. This is the area of the stream bank that we recommend to be protected. This project is not complete since more work has to be done on Sunset West Circle and Sunset West. ®Supv Schug - wondered if it would be better to wait until the complete drainage plan was submitted before we start any work. 75` TB6 -10 -97 Page 5 Dave Putnam - you could do that, but the first section of Lower ®Creek Road is independent of whatever else we do. No decision was made as no accurate survey of the two properties was available. The hearing was adjourned until Maybee could produce a survey which they did and the hearing continued in November of 1996. In January the board approved a new computer system with a data base for the court. The system was installed on the 10th of January and I waited until the 10th to run the December audits. It used to take me 8 days into the month to run the audits. On the 10th of January when the package was installed it took them and myself 4 days (Jan 16th) the following week to learn all of the different screens. It was a big package and at the same time on Jan 27th we had a court calendar of 78 people of which 41 showed up for court hearings. The next Tuesday the computer program crashed which we are talking Jan 27th and we have another audit coming up. So at that time I went to the personnel office telling them I realize I can get some part time help, but I don't know the screens myself so how could I train someone else and take more time away from us. I asked if it would be unreasonable for the felony hearings that the court has scheduled for a stenographic service so that we could stay in our room and keep the computer program running while they taped the felony hearings. That is what we did and I know we are not a court of record. We normally don't use them only during jury time where a jury might want sections read back and on a tape recorder that is very hard to do so we always allow for that and pay for that. I did use them and I knew there would be a stop to it. We used them for a total of 8270.00 which was 27 hours of part time work, but for that 27 hours to have someone come in part time would take our time to teach them when we didn't even know what we were doing with the program at that point. Another factor my mother was ill and I didn't have a lot of time to use for the overtime needed. That was the reason we used them. It was strictly a matter of where could we get the best benefit. We are now sending in the reports on time of about $12,000 to 816,000 every month and very pleased with the program. If something ever happens like this again I would like to feel free to be able to do that since it is so hard to train someone when you don't need them. That was the reason why we had Verbatim unless you prefer we hire a part time person in some other area. Whatever your pleasure is. Supv Schug - how soon mould you be able to pick up the work that Ralph is supposed to be doing. Hwy Supt Gilbert - about a month and a half. Supv Schug - if we write Ralph a letter that by the first full week in July if he is not done the town will finish up what he hasn't done. Hwy Supt Gilbert - I have work already scheduled and I can't guarantee I can get to it in a month and a half, but I can put it on the schedule. Hatfield - if the town board delivers that concept to this gentleman that if the work is not done by a certain date then you will schedule the work to be started on a certain date. You will be prepared to begin the work by the town at his expense, as of July 14th. You have to be prepared to back that up if the town board sends this letter. Hwy Supt Gilbert - will I be able to get an extension if I say July 15th and can't get to it at that time. Supv Schug - no. Atty Perkins - the town owns the road and Ralph has some money that is tied up that the town has. We can stop him from working on the road at anytime. What the board is looking for is when is the soonest reasonable time you would be able to start the work. 0 Hwy Supt Gilbert - I can be ready to start the work July 15th.
