Lane - reported on parcels of land in the Town of Dryden on Route 13 across from the Willow Olen Cemetery_ Some of the parcels have come in the counties possession due to tax foreclosure. This is designated a commercial park in that area. Part of the county policy with respect to land transactions require that each parcel before it is sold by the county to be reviewed to see if there are any other potential uses that they should take into consideration and see if there are any environmental problems. Since there is a big parcel with a lot of little parcels in the subdivision the planning department recommended that we not go to auction with that property until we can sae if thera might be other uses for it. The county is looking for input from the Town with respect to that issue. Z.O. Slatar - when that subdivision was built it was contingent upon a service road being built. Will mail copy to Co. Rep. Lane - reported on sales tax - the state legislature ®continues talking about repealing the sales tax on apparel statewide. If that happens in Tompkins County that would mean a shortfall of about $408,000.00 based on last years figures. That is about 2.3 percent of our sales tax collection. There also would be a similar effect on the city and towns. Some counties are asking the state legislature to give them permission to repeal the sales tax on apparel only at the county level no matter what the state does. Toopkins County has been asked if they plan to do the same, but at this point we have taken no action. We are surveying the community for there opinion. Co. Rep. We now have a committee that is looking at cable governance models. I will report more on that later. CITIZEN PRIVILEGE OF THE FLOOR Supv Schug - board members have copy of request from Mitch Collingsworth for a cemetery. Atty Perkins - it should be kept in mind there are 2 distinct possibilities. Mr. Collingsworth wants to establish a cemetery and Rhoades dealt with a private burial ground. (1 grave site) Mitch Collingsworth - at the time I wrote the letter I was not aware there were 2 possibilities. Atty Perkins - before the board can proceed you need to define your request. If you are requesting 1 grave site the board is free to permit the establishment of a private burial ground by agreement. If there is a cemetery to be established there are other considerations which need to be addressed. Mitch Collingsworth - would like to request just the private burial ground for 1 grave site at this time. The current software that is available today will cost about $8,500.00. In order to move up to that level of softwar4a it is going to cost them another $6,000_00 in hardware, operating systems, data base, software, etc, I could not find any significant benefit to go into the new software that the old software wouldn't do after speaking with the representative. If you want to go with the old proposal of 58,500.00 with the Sweetsoft Company we are willing to go in that direction. There is still the opportunity for the future if you want to upgrade the program and there will be an additional cost. There were a lot of hidden costs that we exposed. Supv Schug - the only thing that wasn't provided for was the travel expense, hotel and car rental. Bill Ackroyd in their proposal it states 5495.00 per day plus travel expense. (copy in minute book) QUESTIONS AND /OR COMMENTS Susan Boutros - they have an environmental laboratory and do environmental testing on water samples. They have about a dozen employees and would like to relocate the bulk of the business to the Ithaca /Dryden area. Right now they have space at Langmire Lab. They would like to have the business completely in their garage which is adjacent to the house. The permit application states 3 employees which we have at the present time. We were advised we would have to get another permit if there were more than 3 unrelated employees. We feel we might go up to 10/12 people, but this is going to take time. If the business does expand we would consider moving the business to a different location. We have to comply with EPA regulations. Since we would be living on the property the business would be open all the times. We will not be changing the exterior of the property, since it is in a residential neighborhood. Supv Schug - the EPA sounds like you will be using chemicals in the testing and wanted to know what would be done with the water when you are finished with the testing. Susan Boutros - we use some chemicals. We samples and there is some wastewater, but are potable water. We do not handle really like they do in a chemistry lab. They will with the wastewater. However, the US EPA has indicated concern over the lack of total enforcement capabilities by the City within the Town of Dryden. Such capabilities are necessary as the City is named on the pen-nit. This concern is addressed with the Town named on the permit. The Joint Sewer Agreement of 1984, approved of by each municipality and signed by the principal executive officers clearly illustrates that each municipality agreed to be named on the permit. 10 In support of this request please refer to the Joint Sewer Agreement of 1984 in general and the following sections specifically. These sections further signify the shared efforts and liabilities of the individual entities. • Page 2 Amend Discharge Permit Refer to Section 9, Operation, which states: "All parties to this agreement shall be named as permittee on the SPDES Permit for the Ithaca Area Waster Treatment Plant. Refer to Section 3, Title to Property, which states: "Title to all real property and improvements thereon, including the wastewater treatment plant site location and the rights -of -way to jointly owned sewer lines and other facilities shall vest in the parties hereto as tenants in common in proportions outlined in Appendix I." As far as unrelated people 4 of the people are 2 married couples. Z.O. Slater - definition of related people is married, adopted or blood relative. Clp Grantham - the initial permit would be for 2 employees. Supv Schug - she is saying she wants 3 employees so she would have to go to the ZBOA for a variance. Susan Boutros - but I can start with 2 people. Supv Schug - wanted to make sure Mrs. Boutros understood that she can only have 2 unrelated employees working until she receives a variance from the ZBOA. Z.O. Slater - I am concerned about where the parking will be located since the approach to Route 79 is uphill. I have written to the Boutros asking them for information since they have mentioned EPA and Health Dept. Something from either or both of these 2 agencies either certifying their system or releasing them from their jurisdiction. I have not received anything from either agency at this time, nor have I received their parking plan. I have not yet received a response from County Planning and their recommendation under 239L &M. Susan Boutros - some of the work they do does not come under the EPA regulations. (Gave copy of Qualifications for ICR Microbial Testing to Z.O. Slater). I don't need EPA regulations until I do ICR work. Susan Boutros - thought I had given the Zoning Officer a diagram of the parking lot. Z.O. Slater - you did, but I felt it was inadequate for that site to park in front and along the side of the building because it limited the ability to maneuver, turn around and drive out of the facility. I made a suggestion to park in back of the building since there is plenty of room to do so. Susan Boutros - I don't have any problem with that. I thought it was on the diagram. Atty Perkins - my understanding is what they are proposing to do is to use an existing 2 story garage and convert that for business use. Z.O. Slater - that is my understanding. Atty Perkins - will you have any employees in the house. Susan Boutros business tends - could not answer that since I do to be a 7 day a week type and that not is know. This one reason for wanting to have the extension near the house. I would like to keep the house downstairs. as a house, but I could be using 1 or 2 rooms Supv Schug - wanted to know if she owned this property now. Susan Boutros - no, we have an offer contingent upon the outcome of this hearing. Joseph Westbrook, 1796 Slaterville Road - I live directly across the street. I am here tonight to receive some information about this proposed business. I am concerned about vans coming and going, people parking, normal business hours since this is a residential neighborhood. I was hoping to see a parking plan and business plan. Instead all I am hearing is something she or may not be doing, nothing is very clear. Atty Perkins - for the boards information the ordinance defines home occupation as a subordinate use of a commercial or service isnature located on a lot whose primary use is residential and which is not detrimental to the residential character of said lot and the surrounding neighborhood. Home occupations shall be such things as hair dressing, tailoring, teaching, carpentry, electrical and plumbing work and similar activities, and professional offices such as doctors, lawyers, architects and licensed real estate brokers. The board can use this as guidance. Joseph Westbrook - I am also concerned about ground and well water. I have not heard any plan if there is an emergency with contaminated samples. Susan Boutros - the majority of the samples are very small and well packaged so there would be no spillage. Joseph Westbrook - I am also concerned about the time the business would be open. Susan Boutros - I am the one who works 7 days a week and that is why I want my business near my home. As far as working out of the garage or house, I am working out of an apartment right now. I make phone calls from 7:OOAM to late at night. I try and not keep the employees after hours since I would have to pay overtime. 6 (. Susan Boutros - I won't let the town dictate my hours of operation. Atty Perkins - that is the purpose of th hearing. Partly because of the nature of her business and because she conducts herself very professionally. If it were next door to me this would not be a problem knowing what she does. I think in having her relocate her business to this area 46 is valuable to the community. I think based on what I know about environmental protection this would be valuable to jobs in the long run. If we can work out some of the concerns I would strongly support this application some way or the other, even if it is temporary. Margaret Hobby, sales person for Audrey Edelman - I am compiling this purchase offer and there is space at the back of the building for parking so it would be screened from the neighbors. Supv Schug - asked Henry if we had a parking plan or a turn around plan. Z. 0. Slater - I do not have either of the plans although they were requested. Their site plan shows the driveway and the area that is developed. Supv Schug - we need an official parking plan, where you are going to put it, how many cars and where they are going to park. UPS and Federal Express turn around. The proposed hours of operation and how many people working there. These are the questions that need to be answered. Supv Schug - suggested she work with Henry to find out the required number of parking spaces needed, but you are going to have to tell us how many people are going to be there and how many cars. The Town Board can approve the business for you and your family. If you are going to only have a couple of people outside of your family you don't need to go to the ZBOA. The board needs more definite information to help the neighborhood. We don't want to micro manage your business, but if it is a safe project great. TB5 -13 -97 Page 5 Supv Schug - the questions Z.O. Slater has posed to you have to be answered. Basically, the hours of operation. You can work 24 hours a day, 7 days a week in your home. Susan Boutros - sometime we get projects where we would have to work 2 or 3 shifts a day. This does not happen very often, but I wouldn't want to say we work 9 :OOAM to 5 :OOPM and something comes up on a Saturday and then the neighbors were told the hours would be from 9:OOAM to 5:OOPM. Supt/ Schug - this is a quiet inside operation, and the people are parked around back the neighbors will not care in an emergency. It is routine hours of work would be from 7:OOAM to 7 /8PM with emergencies if needed. This should be stated in the application. You will have to come back to the board with a parking plan, stated hours of operation, disposal of gray water and number of employees. If there are more than 3 unrelated people you will have to go to the ZBOA for a variance and them come back to the Town Board. Supv Schug - wanted to know if the Health Department had approved the septic system and the gray water system. Z.O. Slater - I have asked for that information and have not yet received it. Information needed for the town board - good parking plan, hours of operation, number of employees, health department approval and gray water recycling.
