HomeMy WebLinkAbout1997-02-1131 TOWN BOARD PUBLIC HEARING #1 FEBRUARY MEETING University Cycles 11, 1997 Supv Schug - called the public hearing to order at 7:3OPM Supv Schug - read notice that was published in the newspaper concerning modification to special permit for University Cycles. (copy in minute book) QUESTIONS AND /OR COMMENTS Hamilton Allport - is requesting longer business hours and to hold meetings at his place of business which is a modification from the original permit. Harold Simons, 836 Dryden Rd. - wanted to know what he was proposing and what kind of traffic will be promoted and how will It affect the neighborhood. Hamilton Allport - I have been operating there for 3 years now and you have been able to ascertain the level of what has been going on there. I am not looking to change anything. When I received my initial special permit I was asked when I would like to be open and I stated the hours from 12 noon to 6:OOPM Monday through Friday and 9:00AM to 12 noon on Saturday. All I want to do is have the option to set my own hours when I feel that I need to at an appropriate time. This is why I am asking for the right to set my own hours any time between 9:OOAM to 9:OOPM. I might be open late one evening a week that is all and there would be no other changes. In terms of the meetings held there it would be nice to have the option to use my place of business to have a small meeting. I am not planning on any meetings. Most of the organizations that I belong to have been in existence for many years and they have other places to meet. As a matter of principle I feel that I need to have that option. If I am granted permission to operate my business I need to have a little bit of latitude as to how I run my business. Harold Simmons - about how many people would be at a meeting. Hamilton Allport - there are 2 groups one being a motorcycle safety club with 7 people. We provide motorcycles to train the beginning motorcyclist on. When we do maintenance on them I would like to be able to offer my facility to work on bikes which is maybe once or twice a year. I really don't think this group is interested in meeting at my facility. The other group has about 35 people and at any given meeting there are 4 to 8 people present. You have seen the level of my business and I do not see that changing. Valerie Vasse - her father owns apartments on Game Farm Road and he is concerned about late night meetings and was not in favor. (copy of letter in minute book). He thought the 9:OOAM to 9:OOPM hours of operation would be a problem with the tenants in his apartment. Alsp, Putnam there is a written comment comment submitted by John Vase, owner of Game Farm Road Apartments_ The third document, is ar 23P9 L &M Report submitted by Tompkins County Planning Department which clears the way for the Town to act as it sees fit with the Sub Shop request at 2215 Dryden Road. Dave Putnam has no comment for either4 of these requests and has not submittedl a report for either. Every place I have bought in Varna was in extremely poor condition and I have fixed these houses up to improve the neighborhood. Rep. Lane - at the request of Supv Schug I have taken the 0 issue as to whether or not there would be any grant money for the Bicentennial. We did talk about having some funding available for celebrations_ It was discussed at budget time with the idea that a gift of appropriate allocation was to be allowed from the contingency fund. Supv Schug - wanted to know if the county was going to get involved with what has been going on with public access on cable television. Co. Rep. Lane - as far as public access and the actions of Time Warner. First of all they suspended that producer and also came up with guidelines with time shift for these kinds of indecent or sexually explicit programing. There is a large group that is protesting any thing we do they say is a violation of the first amendment of the constitution, Some of us don't believe the first amendment prohibits any actions with respect to the impacts of each. There are certain types of speech which are not protected by the first amendment. The county board passed a resolution supporting those actions. We don't become involved with the District Attorney's prosecution. The cable commission has also passed a similar resolution in supporting what Time Warner did. It is a very difficult issue because if you have public access then you are limited to what kind of restrictions you can put on. Supv Schug - I asked for information from the Town of Groton some time ago and it just came so the board members have not had a chance to review it. We were told the cost to operate the one in Groton was 8500.00 a year which should have been 85,000.00 a year. The county has told Groton they can't use their property any more so that means they would have to find someplace else for It. ZONING OFFICER Monthly report - board members have copy Z.O. Slater - regarding Varna Fire Dept fees - the total would be 81,475.00 for the zoning and building permit. We are asking the taxpayers to pay for this since the town funds the fire department. I feel the board should consider waiving the fees for this project since I am here during the day working on this project and it is not the busy time of the year. Atty Perkins - you would have to amend the local law that sets the permit fees. You can not create a special exception to the permit fees for the Varna Fire Dept. I am not opposed to that kind of relief, but you need to be concerned about a precedent you are starting. This will create potential problems because not all fire departments will be treated equally. You should think carefully about the precedent you are setting and what about the next not for profit organization that renders a service. You will be creating all kinds of exceptions to the rule and that may be something you don't want to do. The board has time to think about this and I don't think you should act on it right now. Z.O. Slater - Peregrine Hollow - I received a letter from Atty Perkins last August advising me not to issue any further construction permits until the dilemmas of that current time were resolved between the developer and the town board. I have been informed that I am about to be asked for a construction permit by another party who has one of those lots. Do we still take that position or am I free to issue construction permits. Atty Perkins - could not tell right now without checking the file. ENGINEERING Kimberly Drive drainage - board members have copy of report. Clp Roberts - wondered if it was possible if a larger pipe was Installed on the Olds and Rhoades property line whereas it is now in front of Rhoades house. • Dave Putnam - there would have to be a very deep ditch in front of Baileys to get the water down there. Hatfield - I think the point is well taken, but I am concerned about the 2 owners who modified what was originally there with or without permission. Clp Grantham - they are asking the board to correct the original problem and the additional problem they created by not maintaining what was already there. Clp T. Hatfield - the problem today is not so much the original design Town Board authorize the purchase things have changed since this development was started. I think what they are dealing with is of their own making or previous owners making. The property owners are the ones that have to deal with this not the taxpayers. Supv Schug - will let Mr. Rhoades know the position the town will take. Atty Perkins - the Planning Board has done a commendable job especially with the Peregrine Hollow subdivision. Supv Schug - my only suggestion is to let them know how an insufficiently planned program can create a problem later on. I also feel they have done a commendable job with subdivisions.
