PLANING BOARD MINUTES
Regular Meting 7 : 30 P . M . October 21 , 1992

Chairperson Weitzel called the meeting to order at 7 : 41 P . M .
P rivilege of the Floor :
J oel Gagnon asked that the Planning Board discuss the following
items :
1 ) Top Soil Stripping on Hillview Road in conjunction with the
Tompkins County Landfill closure .
2 ) News coverage for Town government .
Corrections to Minutes :
P ublic Hearing No . 1 of September 16 , 1992 - L ' Amoreaux Subdivision
1 ) Page 1 - correct address - Joseph Schwartz , Durfee Hill Road
2 ) Page 1 - fifth paragraph - insert the word " to " after Mr .
L ' Amoreaux .
P ublic Hearing No . 2 of September 16 , 1992 - Special Permit — Sherardson
1 ) Page 1 - Paragraph 4 - insert the word " and " after
installation ;
2 ) Page 2 - Paragraph 1 - insert the words " inches per " after
5 . 09 ;
3 ) Page 2 - Paragraph 3 - last sentence - delete the word " the "
after piers and insert the word " is " - - correct spelling of
concrete .
Approval of Planning Board Minutes for Public Hearings of September
16 , 1992 - L ' Amoreaux Subdivision and Shepardson Special Permit .
A motion was made by Joel Gagnon and seconded by Ken Horst to
approve the September 16 , 1992 Minutes of Public Hearing No . 1 -
L ' Amoreaux Subdivision and Public Hearing No . 2 - Shepardson
Special Permit .
A vote on the motion resulted as follows :
Carried Unanimously
Top Soil Removal on Hillview Road for Capping of the Landfill
J oel Gagnon reported that Tompkins County applied for and received
a Mining Permit to mine clay from an adjacent land to the landfill
approximately three ( 3 ) years ago for a partial capping of the
landfill . Stripping of top soil is now in progress and is out of
compliance with our current zoning ordinance and is not in the
County Closure Plan .
Discussion followed :
J oel Gagnon asked the Planning Board to request the County to
submit the Reclamation Plans for the area stripped for top soil to
cap the landfill for the Town to review .
Motion to Request the Town Board to Request a Review of Tompkins
County Reclamation Plans from Tompkins County for the Landfill Site
A motion was made by Joel Gagnon and seconded by Billy Kelley that
the Town of Danby Planning Board requests that the Town Board

request Tompkins County to voluntarily submit for review the
Reclamation Plans for the area being stripped for top soil and
transported to the landfill site from an adjacent Town of Danby
property located on the TH1154 Or side of the landfill .
A vote on the motion resulted as follows :
Carried Unanimously
D anby Area News Coverage
J oel Gagnon said that he has remarked with dismay that there is no
coverage of Town government activities in the Danby Area News .
Chairperson Weitzel reported that there will soon be many changes
in the Danby Area News and she said it is her understanding that
the Town Board will make the decision of who reports for Town
G overnment .
D iscussion followed regarding who is responsible for reporting Town
B oard and Planning Board activities for Town government .
Code Enforcement Officer Report :
S usan Beeners submitted the August 1992 Code Enforcement Officer ' s
report and answered questions from the Board regarding value of
construction and fees . She reported on the Cortland / Tompkins
H abitat for Humanities , Inc . the one - day - build on Brown Road in
W est Danby , Saturday , October 17 , 1992 .
P reliminary Drafts of Possible Revisions to the Zoning Ordinance :
Susan presented an outline of Proposed Legislative improvements
that need to be addressed for discussion :
1 ) Public Hearing Notification ;
2 ) Doublewide Mobile Home Design / Construction Standards ;
3 ) Fee Schedule ;
4 ) Zoning Ordinance Section 1101 - Permit to Build ;
5 ) Zoning Ordinance Section 516 - Extraction Deposit of
Fill , etc ;
Susan Beeners submitted materials for review related to proposed
amendments to the Zoning Ordinance and Subdivision as follows :
1 ) Special Conditions for Doublewide Mobile Homes ( Section
902 ) ;
2 )
Failure to Provide Certain Notifications Related to
Public Hearings ( Section 1108 ) ;
3 ) Subdivision Regulations - Public Hearings ( Section 105 ) ;
4 ) Public Hearing Notifications ( Section 806 ) ;
5 ) Procedure for Special Permits ( existing Section 806 is
renumbered as Section 807 ) ;
6 ) Appeal of Planning Board Decision ( Section 906 ) ;
7 ) Subdivision Regulations ( Section 209 ) ;
8 ) Minor and Major Subdivisions - Application for Final Plat
Approval ( Section 210 ) ;
The Planning Board suggested the following revisions to the drafts :

1 ) Public Hearing Notification Procedures for Site Plans :
The Public Hearing Notification Procedure should contain
language to say that the Town will supply the applicant with
a list for notification , a copy of the public hearing notice
and they can either send certified mail or collect signatures
I' of neighbors for proof of notification for site plans .
2 ) Replace the seven ( 7 ) day notification to nine ( 9 ) days in all
sections .
The Planning Board suggested the following amendments to the
P roposed Local Law .
Proposed Local Law - AMENDING THE TOWN OF DANBY ZONING
ORDINANCE RELATING TO POSTING PUBLIC NOTICE SIGNS OF LAND USE
CHANGE APPLICATIONS .
1 ) under ( c ) last line delete the word " than " and insert
" that " .
2 ) Section 2 . - - delete the word " meeting " and insert
" public hearing " .
3 ) Joel suggested the following change to - - Section 1 . No .
3 to read : New text is underlined , [ brackets - - deleted
text ] .
4 ) " The Sign shall be posted on the property under
consideration in a location clearly visible from the
roadway at or near the center of [ each of ] the property
line ( s ) [ of the property under consideration which
property line front ] fronting on an existing public or
private roadway . If the road frontage exceeds 1 , 000
feet , Signs shall be posted at 500 foot intervals along
the frontage .
5 ) Last sentence : delete the words " may be " .
D iscussion followed regarding how to insure that the signs would
be returned . It was suggested by Joel to add an additional fee to
the permit fee for signs that are not returned .
