Hatfield, Clp C. Hatfield, Clp Roberts, Atty Perkins and Z.O. Slater Supv Schug read the notice that was published in the newspaper concerning the zoning changes. (copy in minute book) QUESTIONS AND /OR COMMENTS Avery Park - had submitted the petition signed by the people who were in favor of the zoning change, to a RD Zone. The primary reason they are asking for the change is it gives the property owner a right to chose to put a house or business there. Mrs. Barkdoll - did not realize they were in a MA Zone and was in favor of the RD Zone. Supv Schug - this town board feels if there is an inequity then lets change it. ® Letter from Mr. Hillman in favor of the zoning change. (copy in minute book) QUESTIONS AND /OR COMMENTS Clp Roberts - wanted to know how many rooms would be used for the bed and breakfast. Mr. Railsback - there are 2 spot lights from the house that lite up the walkway to the parking lot and I am in the process of putting in a security light on the corner of the barn. Clp Roberts - wanted to know if there would be any signs. Mr. Railsback - they do not plan on putting any signs out. They might have a sign for the house since it is a historical house. If I did it would be a 2 line wooden sign on the house which would say Snyder Hill Homestead Bed & Breakfast. This is not finalized yet. Clp Roberts - wanted to make sure he checked with Z.O. Slater when he was ready to put up the sign to make sure it met all of the requirements. Clp Roberts - wanted to know if he was the owner of the property and if he was going to continue to reside there. Mr. Railsback - yes, I am the owner and will continue to live there. • Clp Roberts - wanted to know how the trash was going to be handled. Mr. Railsback - did not plan on any extra than the normal household trash. They do have an attached woodshed where they would be keeping their recyclables and normal house trash. Since they would only be serving breakfast I do not think there will be any noticeable change. j l Clp Roberts - will there be any changes to your home. Mr. Railsback - no, they plan on keeping it small. Clp Roberts - wanted to know if a SEAR review form had to be filled out. i Clp Roberts - wanted to know what the walkway from the house to i the barn was like. Mr. Railsback - it is just lawn. There is a stone driveway with a flagstone walk. There would be no reason for anyone to go near the barn since it is not near the house. (copy in minute book) QUESTIONS AND /OR COMMENTS Dan Alfreds - I am a collector of pewter pieces and the only place they can be purchased are Syracuse or Schenectady. I contacted the club that makes the pewter to see if it was possible for me to be a retail distributor. Since this was not a problem that is why I am here for this special permit. There would be one room in my house with pewter pieces consisting of dragons, lizards and castles. The business would only be open when I am home. Clp Roberts - wanted to know if he would be selling curio cabinets as well. Dan Alfreds - yes, but would only have 6 on hand. If they wanted the bigger cabinet they would be special order and shipped directly to their house. expect ® Clp Roberts - wanted to know how much parking was available and how many customers. Dan Alfreds - there would be room for 4 or 5 cars in the driveway and did not expect more than 1 or 2 customers at any given time. Clp Roberts - wanted to know if he planned on having a sign. Dan Alfreds - would like to put a sign out by the road. It will have a closed and open sign. Since I have a full time job I would only be open on weekends and evenings. Clp Roberts - wanted to know the hours he planned on being open. Dan Alfreds - I would only be open when I am home with no set hours. I would have my phone number on the sign so people could call and make appointments. This would only be a small operation and part time. Clp Roberts - wanted to know the latest hours during the evening and if he would be open on Sundays. Supv Schug - wondered if there was room for people to turn around once they are up in his driveway so it wouldn't requiring backing onto the main highway. Dan Alfreds - no, there is a turn around area for the customers or for whoever is there and will make them aware of this. Richard Beckwith - had no problem with what he wanted to do but was concerned about people parking on Hile School Road and also the visibility. Clp Roberts - we could make that a stipulation of the approval. Closed public hearing - 7:10PM TOWN BOARD MEETING MAY 28, 1996 Supv Schug called the meeting to order at 7:45PM • Members and guests participated in a moment of silence followed by the Pledge of Allegiance. Roll call was by Town Clerk Lloyd: Present: Supv Schug, Clp Grantham, Clp T. Hatfield, Clp C. Hatfield, Clp Roberts, Atty Perkins and Z.O. Slater Supv Schug - with regard to the zoning change, by law there has to be a long SEOR EAF form filled out. There will not have to be another public hearing, but the board will act on this zoning change at the next board meeting. Board members went over EAF form as filed by applicant for Bed and Breakfast. The comment Dave made based on the letter regarding any other use or any town purpose. Dave stated there was plenty of room for water and sewer, but what was any other purpose. Atty Perkins - any other for. It is not presently purposes. Dave Putnam - I can't think of anything it would be used for. Supv Schug - the first consideration the board has to make is we have an appraisal for approximately .2 acres at $100.00. It is up to the board if they want to accept the $100.00 or if they want to change the amount. Doug Foster - may I ask what you are referring to because I am a little confused. Supv Schug - it was a letter to the board members. Doug Foster - all the town owns is the easement to install the water and sewer so what you are selling is just the easement. Supv Schug - you have to remember Mr. Foster bought this property knowing that part of the house built there was built within the easement area. There was a comment made before that you couldn't remove the house, but that is not totally true. I would rather have him stay there and fix it up. Clp Roberts - if we should release the easement what would be • involved in paper work. Supv Schug - there would have to be an accurate survey by a licensed surveyor. There is paper work to be done and we would have an agreement from Mr. Foster to do the transfer for him to allow the town temporary use of the Foster property in connection with this utilization of the permanent easement obtained by the town. If we had to get to the sewer or water lines he would permit us so we would not have to come and ask for an easement to go across his property. What we are asking for now is an easement to go across his property. The reason for that is if there is an emergency with the lines since the town is giving an easement the town would like to obtain the ability to cross his property. The filing fees and town expenses would have to be incurred by Mr. Foster. Doug Foster - the temporary easement, is that something different than you ask any other landowner to do. If the line burst and you need to go across my property that is no problem. Supv Schug - when you put in a water and sewer line there is a 20 foot wide permanent easement to work on the lines. What we are asking for in your case is because the line is higher than the easement and we have to have access. We already have a temporary or fixed easement to get equipment to. You are not going to build into that easement area, you just want to get the easement out of your living room. Doug Foster - yes. /a3 i n TB5 -28 -96 Page 7 • Supv Schug - we would release our permanent easement to you and then we would ask for a temporary easement for whatever it takes to go across your property to fix the lines. Doug Foster - is the temporary easement the same. • • gay Atty Perkins - no. Supv Schug - where your living room is we are not going to go I through, but if you add onto the property you would add on in a different direction so we could still go across the lot. Doug Foster - you are obtaining a temporary easement. I am not asking you to release the entire easement, just a portion of it. Supv Schu g J ust the portion that is drawn on the map. Doug Foster - correct. The rest is a permanent easement for the town. Supv Schug - the only thing we would ask for is the necessary temporary easement already agreed to by you to go across your property to do whatever has to be done. Doug Foster - is there a configuration as to where the temporary easement would be. Clp Roberts - he would still have free access to develop his property as he wished. We would just use whatever access points we could use that were available. Is that what we are talking about. Clp C. Hatfield - which might never be, but it is in place if we need it. Supv Schug - if we are giving up the permanent easement then we would like the ability to go back in there if we have to without coming to get approval. We are doing something for you and we are asking for something in return. Doug Foster - it sounds all right to me except I don't have a concept as to what it entails. Is that a temporary easement you are asking for now indefinitely or something you will be able to ask for. Supv Schug - a temporary easement is something we will use whenever we have to use it. If we have to use it sometime now or in the future. I TBS -28 -96 Page 8 • Clp Roberts - it wouldn't stop you from doing whatever you wanted to do on your property, developing your property however you wanted to. It would just allow us to cross your property if we needed to bring in pipes or whatever to fix the lines. We could cross your property without negotiating an agreement. • is Atty Perkins - no town improvements can be within a temporary easement area. It would be a means of temporary ingress and egress, temporary storage of materials, etc. Temporary easement means we are not going to leave any water or sewer lines installed underneath the ground. It is basically used as surface rights. Doug Foster - is that for always through the house. Supv Schug - this would be just over the existing easement we are transferring to you. Just over that area. Doug Foster - I have no problem with the front yard and part of the back yard. We are not talking about much land here. I don't see a problem with that. Supv Schug - wanted to know if the board members felt $100.00 was a fair price. Clp C. Hatfield - and he is going to absorb the fees that are associated with this. Supv Schug - exactly. Doug Foster - the survey and legal fees. Atty Perkins - the board might want to consider to include in this his use of the permanent easement area for recreational purposes. Supv Schug - we can put it in so he knows when the trail goes through people will be walking up and down there. This is so that Doug knows it is there now and it could be expanded. It probably will be when we get our state money to improve the trail. Clp C. Hatfield - we are making sure that you understand that in the future the railroad bed r -o -w will be developed for biking and hiking trail so there will be more traffic. Doug Foster - I am sure that is coming. Supv Schug - it is already there with people presently using it. /a5' I TB5 -28 -96 Page 9 Doug Foster - but in a situation like that the town would improve it. That is another thing and a lot of issues with that are as to how it will be improved. We will have concerns as to how it will come through and will there be any screening or vegetation put in there. 0 Supv Schug - normally with the railroad tracks other than keeping it mowed and gravel that is already there makes a trail. No we are not going to put up pine trees to screen your property. You can put them on the edge of your property if you want to. Doug Foster - there are different ways to develop a trail. In my case it is not a big deal because the flat area is already there. Supv Schug - all Atty Perkins wanted to do was to put this in our agreement that when we transfer the property that you know it will be there. Atty Perkins - all you need to know is the condition the board is going to make that the easement is not applied to include the development of the permanent easement area by the town for recreational purposes over the top of the water and sewer lines. Clp C. Hatfield - which wouldn't affect what you are talking about at all, except letting you know that the town might develope the r -o -w on top which is ours anyway. Supv Schug - which is our permanent easement. Doug Foster - no, your easement allows the installation and maintenance of water and sewer lines not to allow recreational trails. Clp Roberts - wanted to know if we own the railroad bed. Atty Perkins - no. Doug Foster - I own part of it, the town owns the right to install and maintain the water and sewer line. Atty Perkins - what I am trying to do is make sure the town doesn't get held up in the future. Doug Foster - I could be your strongest advocate because I fully support this trail. Supv Schug - to save us a lot of time you have no problem with granting us the use for this trail. tl TB5 -28 -96 Page 10 • Doug Foster - this is sort of a last minute thing. My concern is before I give up the right to allow anybody to go through back there I would want to know how it will be developed. If you install a blacktop area I might be less inclined to agree to that because it might be more obtrusive. Clp Roberts - I don't think we have black topped anything. Supv Schug - approaches to bridges, going down the hill to the railroad track. We fixed the road down hill so we can get trucks down to plow the snow for the lady who used to live there and now for him so we can turn them around and get back up the hill. Supv Schug - the board is in a position to move forward. Atty Perkins can write up the agreement and forward it to you with the price, survey, legal fees, and what the trail easement would be. Clp Roberts - wanted to know if the board members would also receive a copy of this agreement. i Supv Schug - yes. Doug Foster - that is a big change so I would appreciate in having something sent out specifying what it is that you are ! saying so I can review it. Tim Cornelius sub shop. Z.O. Slater - reported that a special permit was granted to Tim Cornelius to open a sub shop at 2215 Dryden Rd. He does not want to run the shop now even though it is ready to open. The special permit was specifically granted to Tim and his sister in law now wants to open the shop so they would like to have another public hearing so she will be able to operate the business. Brandie Smith instead of Tim Cornelius. Town Board scheduled public hearing for 7:30PM on June 11th. Supv Schug - Caswell Cemetery, located on county property and the towns responsibility CASWELL for the upkeep. For work done including pipe, gravel, labor, travel, culvert etc and renting a small dozer $11,749.60 to clean up the property.
