M . and led. all present to the Pledge of Allegiance to the American flag . Approval of September 14 , 1992 and October 5 , 1992 Town Board Minutes A motion was made by Councilperson Marisa and seconded by Councilperson Schwartz to approve the September 14 , 1992 and October 5 , 1992 Town Board Minutes as published . A roll call vote on the motion resulted as follows : Marisa Aye Miller Aye S chwartz Aye O ltz Aye Carried Unanimously Additions to the Agenda : 1 ) Town Clerk , Carol Sczepanski asked for the addition of E lections Inspectors Warrant No . 2A to the Agenda . 2 ) Supervisor Oltz requested an Executive Session of the Town B oard after Privilege of the Floor to discuss possible litigation . N o Board Member objected . P rivilege of the Floor : Councilperson Marisa reported that the Town Board has started the budget process for the Town of Danby Fiscal Year 1993 Budget . With. zero ( 0 ) increases in the budget including salaries , we may be looking at a tax increase in the Town of eighteen per cent ( 18 % ) . The budget is still in draft stage . Councilperson Schwartz said that given the State Aid cuts we are faced with either raising taxes or making massive cuts in the Town programs . He urged anyone who has an opinion either way to contact Board Members to make their feelings known regarding the budget . He said he is looking into the possibility of having sales tax revenues paid directly to the Town . Tompkins County Representative ' s Report : Representative Proto reported on the following : 1 ) Sales Tax Collection - explained the method Sales Tax is collected and how the percentage is applied to townships in Tompkins County ; 142 2 Town Board. Minutes October 12 , 1992 2 ) Tompkins County Budget - some of the programs that may be cut are : positions in the Health Department , bus service to ✓ ural areas , service work alternative program , Sheriff ' s patrol for illegal dumping of trash , advertising and publication for solid waste , an engineer ' s position at the Solid Waste Department and free trash tags . The Board of Representatives is will be voting on the final County Budget in December . 3 ) Bridges -- there are five bridges out in his district . Four ( 4 ) bridges in the Town of Caroline ( three are closed ) and one o n Comfort Road in the Town of Danby . CHIPS funds are gone and there is no money to do bridge work in 1993 . 4 ) Public Works Budget - the Public Works Budget must be cut by $ 1 , 000 , 000 for roads in 1993 . 5 ) Landfill Neighborhood Protection Committee - the County will ✓ etain the Hillview Landfill Neighborhood Protection Program and the Water Well Protection Program for the Hillview area will continue . D iscussion followed regarding private sectors for trash disposal . Tompkins / Cortland Habitat for Humanity , Inc . B en Curtis Tompkins / Cortland Habitat for Humanity , Inc . addressed t he Board and gave a brief history of the organization . Habitat for Humanity has planned a One - day Build at 497 Brown Road , West D anby . The build is scheduled for Saturday , October 17 , 1992 and h e requested permission to use the West Danby Ball Park area to set up tents for the workers . P rivilege of the Floor : H oward Steiner of 1050 Coddington Road addressed the Board and said h e is concerned with service the County provides regarding public safety i . e . five ( 5 ) bridges down , loss of $ 60 , 000 in revenue from the County , County increase in sales tax from 7 % to 8 % . He said someone needs to explain the priorities . He thinks the Town of D anby needs to address these issues and understand that our priority is on our roads and bridges . He believes that we should g et our sales tax monies direct . He does not want to see his taxes go up this year . Roy Casterline addressed the Town Board on behalf of the West Danby W ater District . He asked what was going to happen to the $ 7 , 000 . 00 paid to the Town for West Danby Water District Land for the purchase of property for the Danby Fire District . Supervisor Oltz responded that the Town of Danby has not made a d ecision at this time . Carol Benjamin of 2190 Danby Road reported that a County meeting is scheduled for Tuesday , October 13 , 1992 regarding the starting of the Tompkins County Budget process for 1993 . She said she believes the meeting is scheduled for 7 : 00 P . M . Adjournment to Executive Session : A motion was made by Councilperson Schwartz and seconded by Councilperson Marisa to adjourn to Executive Session to discuss a matter of potential litigation . M . Meeting Reconvened at 9 : 50 P . M . The Meeting of the Town Board reconvened and called to order by Supervisor Oltz at 9 : 50 P . M . Communication : 1 ) Code Enforcement Report - September 1992 2 ) Dog Control Report - September 1992 Committee Reports : Supervisor Oltz reported that she would contact our EMC Representative regarding the EMC Committee Meetings and ask for monthly reports . Zoning Report : Code Enforcement Officer - Susan Beeners reported on the following : 1 ) she is preparing some housing start figures for comparison ; 21 Tompkins County Water Quality Strategy Plan Public Information Meeting ; 3 ) the department is looking into the purchase of a computer for the Zoning Office . P lanning Board : P lanning Board Chair , Nancy Weitzel reported that the Planning B oard held two ( 2 ) Public Hearings in September 1992 and approved t he following : 1 ) Durfee Hill Road - L ' Amoreaux Subdivision 2 ) Muzzy Road - Shepardson - Special Permit OLD BUSINESS : W est Danby Water District Land Conveyance : S upervisor Oltz reported the Fire District Land Conveyance for the purchase of land by the Fire District in West Danby from the Town has been completed . W ater Commissioner Roy Casterline asked the Town to consider t urning the $ 7 , 000 . 00 from the Fire District for the land purchase t o the West Danby Water District to be used for emergencies . W est Danby Water District is completely funded by the Water D istrict . Thomas G . Campbell Judgement : Supervisor Oltz reported that the Town of Danby Judgement against t he Thomas G . Campbell Estate will be settled soon . N EW BUSINESS : A Special Meeting of the Town Board will be held Tuesday , October 13 , 1992 at 7 : 30 P . M . to work on the Fiscal Year 1993 Budget . Approval of Warrants : Approval of General Fund Warrant No . 10 of 1992 A motion was made by Councilperson Miller and seconded by Councilperson Schwartz to approve General Fund Warrant No . 10 of 1992 in the amount of $ 5 , 431 . 03 . A roll call vote on the motion resulted as follows : Marisa Aye Miller Aye Schwartz Aye Oltz Aye Carried Unanimously 14 4 Town Board Minutes October 12 , 1992 Approval of Highway Fund Warrant No . 10 of 1992 A motion was made by Councilperson Miller and seconded by Councilperson Marisa to approve the Highway Fund Warrant No . 10 of 1992 in the amount of $ 6 , 570 . 78 . A roll call vote on the motion resulted as follows : Marisa Aye Miller Aye Schwartz Aye Oltz Aye Carried Unanimously 145 5 Town Board Minutes October 12 , 1992 Miscellaneous : The Town Board discussed legal costs to the Town for American Cablevision Communications Negotiations and proposed road abandonment . The Board requested our Town Supervisor to negotiate with ACC regarding the Town of Danby and ACC Franchise Agreement . ADJOURNMENT : On a motion the Town Board Meeting adjourned at 10 : 25 P .
