HomeMy WebLinkAbout1995-09-051 �z TOWN BOARD MEETING PUBLIC HEARING - Sub Shop - Tim Cornelius SEPTEMBER 5, 1995 Supv Schug called the public hearing to order at 7:45PM Supv Schug read the notice that was published in the newspaper concerning the Sub Shop - (copy in minute book) QUESTIONS AND /OR COMMENTS Tim Cornelius - I would like to do a take out sub shop. It would be on the same order as Tucker's Take Out was. Supv Schug - if the board grants the permit it will have to be subject to health department rules and regulations. Henry said the permit is at the health department, but has not heard back from them yet. Supv Schug - wanted to know the hours he would be open. Tim Cornelius - I would like 10 :OOAM to 10 :OOPM no later than 11:00PM six days a week. Monday thru Saturday. Clm C. Hatfield - wanted to know how many employees he would have. Tim Cornelius - just myself and maybe 2 others, whatever is needed. • Clm T. Hatfield - wanted to know if the people would be eating at the site or is it strictly take out. Tim Cornelius - it would be strictly take out. I would like to put one booth in for a quick sandwich for a working man. It would be no restaurant type whatsoever. Clm Roberts - wanted to know how many customers he would have at peak times. Tim Cornelius - I have no idea. Clm Roberts - asked Henry if the parking was sufficient. Z.O. Slater - the parking plan is sufficient for all of the businesses located there. Clm Roberts - wanted to know if he was going to have a sign. Tim Cornelius - did not know. It would not be any bigger than the sign that is there now. It will have to be approved by Henry. Ms. Cornelius is requesting a modification of her valid Special Permit granted on April 25th, of this,year by the Dryden Town Board. At that time, the Special Permit authorized Ms. Cornelius to construct a (4) unit store /office structure at 2215 Dryden Road, Town of Dryden. At that time, the Special Permit also approved (2) tenants, one was her own shop called the Glass Slipper and a second for a hair- salon. Hatfield Roll call vote - all voting Yes CITIZEN PRIVILEGE OF THE FLOOR Robert Beck - regarding Malloryville Bog - would like to invite all officials to visit the bog. I want to thank Atty Perkins for all of the letters he has written to DEC on this issue. There have been 3 applications for a gravel mine immediately adjacent to and up slope from the wetlands at Malloryville. The first two applications DEC issued positive declarations requiring a draft environmental impact statement in each case. In both cases I TB9 -5 -95 Page 3 the applicant chose to withdraw. Those occurred in 1987 and 1989. • There now is a third application and Mr. Eddy chooses this time to operate the gravel mine himself. In this case DEC issued a negative declaration which was rescinded upon massive comments from scientists at Cornell and Syracuse Universities, neighbors and others from the town. DEC now is requiring them to have a draft environmental impact statement. That draft environmental impact statement was completed about a year ago and was reviewed last summer. Again massive input was put into that and over the fall and winter DEC reviewed our comments and further comments from the applicants consultant. In April of 1995 DEC wrote a letter to Alfred Eddy, the applicant, stating they could not j issue a permit. This was the official denial of the permit. Denial based upon our comments, specifically the comments from the scientists concerning the hydrology and the effect of the changes in the hydrology for the water source in the wetland might impact the quality of the wetland. That lead to a meeting in July 1995 which Supv Schug and Z.O. Slater attended and a lot of issues were covered. The next step is for the applicant. The permit has been denied, but the applicant has the opportunity to pursue it through an adjudicatory hearing which is to be j scheduled. This should be sometime in September or October. To my knowledge it has not been scheduled yet. The adjudicatory hearing would be the last step within the DEC for review of this case. Beyond that if there was further contention it would go to the courts outside of DEC. The adjudicatory hearing would involve an ® appointed administrative law judge, who is an employee of DEC. That judge would then hold a formal hearing involving sworn testimony and cross examination. You have to petition to be party of that hearing in advance. The judge rules as to who gets to have party status. This is a very important step and the judge would write up his review and recommendations. This would then be sent to the commissioner of DEC in Albany who makes the final decision. This case has gotten a significant amount of state wide attention. The reason is the wetland we are talking about is very special and the best we have in this part of the state. There are j ongoing studies with scientists, ecologists, botanists, entomologists, hydrologist, geologists who are doing studies and papers have been published on the formation of this wetland in Malloryville. The wetlands are very complex and that is part of the reason that it is so special. There are numerous different kinds of wetlands and are all in close proximity to each other. Several of those wetlands are very fragile. They are unusual and very sensitive to the surroundings and exact conditions. That is why we are so concerned because the water from the gravel mine provides the water to the wetland. The applicants consultant says at least part of the water bypasses the wetland. Professional hydrologist and geohydrologist say that is not the case. There are numerous springs along the west side of the wetland immediately adjacent to the proposed gravel mine. Supv Schug - wanted to know when the town needed to apply as a ® concerned party. q5 TB9 -5 -95 Page 4 Robert Beck - it would be after the hearing is scheduled. I was told we should have received those by now. All of the parties should receive this information at which point the judge will spell out the rules as to when we need to apply for petition status. There is a new regional director for DEC who covers our 9 county territory from Lake Ontario to Pennsylvania. He asked to be taken on a tour of the 2 most significant bio diversity sites in central New York. One that was suggested was the Malloryville Bog which he visited. He was very impressed with the wetland. Ralph Mano, in regulatory services division, called me and was very encouraging. Ralph told me that regulatory services division of DEC would be a party to the hearing and present it case as to why they can not issue a permit. They have been very careful so it will not be overturned. An active participation by the Town of Dryden is very important part in this case. This hearing is very important. The nature conservancy has a very definite interest in putting together a permanent nature preserve at the site. They only go after the best, and this is one of the best. They have offered Alfred Eddy money for the gravel mine property and so far the answer is no from him. We are hoping in time he would like to do business with the nature conservancy. This is the first step and is critical because the long term protection of the wetland depends on what happens to that 110 acre gravel mine property. I The conservancy would like to create a 300 acre permanent wetland. My 38 acre property is already being used for scientific research and is being used by school groups, individuals, and environmental groups. The nature conservancy has regular tours j ® there. It is being used for educational, recreational, and scientific purposes and that will continue. I view this as a wonderful thing for the Town of Dryden. I am asking if it is possible for the town to take a position to be an active participant at the hearing and to state clearly what the towns position is in terms of zoning, condition of the roads, concerns for the neighborhood and concerns of the wetlands. The value to the town of a preserve there that can be enjoyed by all of us. If we don't continue to take a strong stand and do everything we can we could very easily lose the case. The commissioner himself can over rule the judge so we have to have a good case. Supv Schug - from the towns standpoint in going to the hearing is to make sure that they understand if DEC does issue a mining permit, the mining permit is subject to a zoning variance by the Zoning Board of Appeals. Z.O. Slater would speak for us to make sure everything is clear if a permit is issued. Robert Beck - the neighbors are against it because of truck traffic, dust, noise, and change of character of the neighborhood. The truck traffic would go from 1 truck every hour to 1 truck every 5 minutes. 100 per day so that is a big change in the neighborhood on these narrow roads. i n U 0 TB9 -5 -95 Supv Schug hearing is Page 5 the Town of Dryden will be a party to this when the scheduled. Robert Beck - there have been cases where the state has issued permits and the town has not. The applicant started mining and continued mining. The town would then have to sue to try and stop them. This is scary if a person has a state permit and mines and claims the town can not stop them because it should be grandfathered or whatever. has long been abandoned. it to get to that point. Dave Putnam has supplied a letter of items still to be done before the sewer line can be accepted. We have the road almost to final grade to receive the base of the road. After the water lines are installed we put the base in for the road. NYSE &G is scheduled to come on the 18th to run the utility lines out of the town right of way. The water lines will be statred on Thursday Sept. 7th. I have supplied Atty Perkins with all of the material that he has asked for. I am interested in getting the people in the house. They are the only customer they have now and are hoping we can get a certificate of occupancy. We have a permit for that particular lot. We expect to have the sewer and water line complete, the base of the road down, NYSE &G hooked up to the house in order for us to have the final inspections for the plumbing and electrical. We are hoping to get the customer moved in after NYSE &G is hooked up, if we can get a C.O. from the town for that one house. We are hoping to complete everything that we need for the road, the shoulders, seeding, walkway and everything that needs to be done including the planting for the mitigating measures for some of the neighbors. We are hoping to get everything done and not put up any bond for anything since it is one and a half times what it costs. It would be easier for us to complete the work if we can get that one customer in. I would anticipate we would come in November and have everything 100 percent done. yC F I TB9 -5 -95 Page 6 Z.O. Ralph Varn - if we could get the customer in I would be able to come to the November board meeting. Supv Schug - with regard to the one customer for the one house, I i ® believe when we issued the permit for that one house you must have municipal water and sewer before the house was built. As far as you are concerned even though the plat is approved why wouldn't you issue a C.O. and just not issue any more building permits until the road was dedicated. j Ralph Varn - that would be satisfactory with him. Z.O. Slater - the lot right now is like an island out in the middle of an ocean. Supv Schug - wanted to know if the plat had been filed. I Ralph Varn - yes, the plat has been filed and I own all of the land around it. Atty Perkins - the owner doesn't own the building lot, you own the building lot. There is the difference between a flag lot in this situation. The flag lot, the owner of the lot actually owns 125 feet of road frontage. In this particular situation he doesn't own it, he owns the island with no road frontage. Ralph Varn - I don't want to do this if we can avoid it. Certainly we could deed him that 125 feet and take it away later. Atty Perkins - you can't do that without being in violation of ® the zoning ordinance. Atty Perkins - for this to be established the town would have to form a town wide ambulance district including the villages of Dryden and Freeville. This will allow the town to accomplish what it wants to do and that- is-�to- furnish town wide ambulance service and have a special line item on the tax bill. In order to do that both of the villages would have to consent to be part of the district by a local law or resolution. Before an ambulance district can be formed we need to have some idea what the costs will be on an annual basis and when it will start. The issue of whether or not the town can actually employe these individuals who are actually going to be emergency medical paramedics. I still have not been able to resolve the definition as to whether or not the town has the authority to employ them or whether they will have to be employees of Dryden Ambulance. I think the vehicle is the ambulance district and in order to take the necessary steps we are going to need some costs as to what the first year costs are going to be. Walter Groman - I can get that information to you. Another option we have is we can bill since it is within the regulations. Atty Perkins - there is no where in the statue where it uses the word employ. That is why I think it is an open issue as to whether the paramedic is an employee of the town or Dryden Ambulance. The town would prefer they would be an employee of the town. R I Supv Schug - could the town I hire the employee and part of the job description is that he be a paramedic. Atty Perkins - that would be considered a legal fiction. • TB9 -5 -95 Page 8 Atty Perkins - there are questions that need to be answered. If it has to start before the first of the year then how do we go about amending this existing contract that we have already had a public hearing on and approved last year. If you start January 1st you will have some idea as to how much it will cost and those figures can be advertised. Walter Groman - they as a department have committed themselves to watch their spending and fund this position until the end of the year within the revenues they have currently within the contract. Supv Schug - we should move forward to make a resolution to form a town wide ambulance district. Atty Perkins - we need the maximum amount proposed to be expended per contract for next year. The alternative is some other procedure. Another alternative would be they couldn't do the work until there is another board meeting and we can propose a possible change. Does the board want to say, you have to wait until the next board meeting if you have made arrangements with the state bid and they can't come through, what will we tell Don. He has to wait until the next board meeting before we can give him approval to try a different person. ; Supv Schug - there are two state bidders. Supv Schug - wanted to know if those were the bills from the first part of June when the work was done. Clm Roberts - there are some June dates, one May 31st and July 3rd. Clm C. The point is you don't have to pave a road tomorrow. You schedule it and you schedule it ahead of time. Clm Roberts - so my proposal would be to authorize these bills to be paid and for Supv Schug to write a letter on behalf of the town board that he has option 1 to use any state bidders he already has and option 2 to bring any changes to the next board meeting. I would also put in the letter he is put on notice that if he does not follow procedure in the future the town board will not honor the bills. CORRESPONDENCE Dryden Lake police report for the month of July DISCUSSION Supv Schug - purchasing update - the computer has been installed, but is not complete yet. The system should be working by the 1st of October. PAVE program - board members have copies of information. The Town Board authorized Supv Schug to write a letter and refer them to the youth commission. There was discussion regarding the town putting in a sidewalk from Empire Livestock to the Town of Dryden highway pavement and stripping an area for sidewalk use to the town hall.
