Hatfield called the meeting to order at 7:00PM Members and guests participated in a moment of silence followed by the Pledge of Allegiance. Roll call was by Town Clerk Lloyd: Present: Deputy Supv. C. Hatfield, Clm Baker, Clm T. Hatfield, Clm Roberts, Atty Perkins and Z.O. Slater Absent: Supv. Schug Deputy Supv. C. Hatfield read the notice that was published in the newspaper concerning Snyder Hill water district. (copy in minute book) QUESTIONS AND /OR COMMENTS Larry Fabroni - went over the boundaries of the Snyder Hill water district with the board members. Atty Perkins - this is a requirement of the Varn subdivision so that it can connect to the Town of Ithaca. This would be a joint cooperation between the Town of Ithaca and Town of Dryden in reaching some agreements on conditions for approval of the subdivision plat. In order to do that Mr. Varn will have to connect to the Town of Ithaca property that they also own. This is why the water district has to be extended to this additional property which they didn't own at the time of the original district formation. Atty Perkins - this makes the water district as extended to coincide with the sewer district. This makes all of the Varn property in a water and sewer district. Atty Perkins - he has reviewed both the petitions for the Snyder Hill water and sewer districts and they conform to the legal requirements set forth under town law with respect to the form and the number of signers and are properly acknowledged. He reviewed the petitions and signers against the latest completed tax roll and determined that the sufficient number of signers have signed the petitions to meet the statutory requirements. Even though the latest completed tax roll does not list Peregrine Partners as the owners he has had given to him documentary proof to show they are the owners. It is not their fault the tax roll has not been changed. They have established to his satisfaction they are the owners, but the fact of the timing of the recording of the deed they are not on the roll as the owners, but they are the legal owners and are entitled to sign the petition. As far as compliance with the statutory requirements they have meet all of the requirements. The procedure for the town board is after the public hearings are closed is make certain determinations. You must determine whether the petition is signed, acknowledged and otherwise sufficient. The original petitions are filed with the Town Clerk and they have met all of these requirements. The board has to determine as to whether all of the property and property owners within the proposed district or extension will benefit. This is a condition of the subdivision approval for Peregrine Partners and Varn brothers that they form this water and sewer district. The board will have to determine as to whether all of the property and property owners benefited are included within the limits of the proposed extension. Clm Roberts - wanted to know if lines would be painted on the road surface to show the people where to park. Chris Hicks - he has not discussed this with Mr. Westerling He can suggest this to him since he would have to be the one to make the decision and give the okay. Clm T. Hatfield - wanted to know if all health departments have been applied for and approved. Chris Hicks - depending on the boards approval, there was a permit for Screamers which is still in force. He checked with the health department and with the current application the permit for the mobile unit does not include the use of soft serve machines and this needs to be addressed. It only requires the signing of a permit. Clm Baker - wanted to know if it was determined how many parking spaces were required for the mobile unit. I have reviewed the Application for Special Permit to operate a mobile ice scream stand at the Kiwanis Christmas Tree lot on the lands of Little Creek Trailer Park and visited the site. Unless the Board assigns conditions to the permit that requires review prior to occupancy or requests that some existing improvement be investigated, I don't believe an Engineering review is necessary. Would there be room enough for a car to come in and go out at the same time. Chris Hicks - yes, there would be room enough. Z.O. Slater - if you used his portable unit and used 2 square feet of parking for every square feet building would not be practical since you would only come up with a couple of spaces. So he looked at what the site would permit. The site would handle 20 cars at any given time. He did not think there would be any flow problem. Clm Baker - thought there should be a parking plan. Clm Roberts - wanted to know about stripping. Clm Baker - thought there should also be striping so people would know where to park or marked some how. Clm T. Hatfield - wanted to know hours of operation. Chris Hicks - he would like to be open 11:OOAM to 10:30PM seven days a week. • Clm Baker - wanted to know the plan for general lighting. Chris Hicks - would be a colored flood light so it wouldn't interfere with traffic and would be directed away from Route 13. There are provisions for a fenced in area so lights can be mounted on the posts which will shine onto the unit and seating area. There is also a permanent pole with a light on it which is owned by Mr. Westerling and maybe arrangements could be made to use that light. Clm Roberts - wanted to know if the unit would be parked there through out the season. Chris Hicks - no, he will move it in the month of October and anything else that he has put there. Clm Roberts - wanted to know how the electrical hook up worked. Chris Hicks - that would be correct. Clm T. Hatfield - wanted to know if this out door facility was acceptable by the health department. Chris Hicks - the portable john would not be in the public eye. It would be in an enclosed area behind the portable unit. Clm T. Hatfield - wanted to know about waste products from the public and dumpsters. Chris Hicks - for the public there would be waste cans and he would remove that daily. He does not have any plans for a dumpster there at the present time. Hatfield called the hearing to order at 7:55PM and read the notice that was published in the newspaper. (copy I n minute book) QUESTIONS AND /OR COMMENTS Mr. Lilley - they would like to move their operation from Richford to Dryden since they have out grown their present location. Part of the building will be showroom and the other will be storage area with a drive through the middle of the building for service. Clm T. Hatfield - wanted to know the number of customers he would have at any given time. Mr. Lilley - it is a continuous flow and the average time for a customer is about 5 to 10 minutes. I have visited the site and reviewed the Application for Special Permit to change the occupancy of the building at the intersection of Route 13 (Cortland Road) and Livermore Cross Road. It appears a second driveway culvert, some regrading, and parking lot expansion will be necessary-to accommodate the proposed parking on the east end of the building. Additionally, some work is needed to bring the existing stone and gravel parking areas back into useable condition. Unless the Board assigns conditions to the permit requiring review prior to occupancy, or, requests that some existing improvement be investigated, I don't believe further Engineering review is warranted. Mr. Lilley - he would like 9:00AM to 5:30PM Monday through Friday and Saturday 9:00AM to 2:OOPM. He felt they would be finished working by 6 :OOPM. No hours on Sunday. Z.O. Slater - there is parking space available all around the facility since it was previously used as a vegetable and fruit stand. Clm Roberts - wanted to know if there would be signs installed to direct the public. Mr. Lilley - he had planned on putting up entrance and exit signs at the driveway and on the building. Clm T. Hatfield - wanted to know if there would be any on site refuse. Mr. Lilley - everything that comes in is prepackaged. The only thing they would have would be cardboard containers that he would break down and recycle, which would be inside of the building. Deputy Supv. C. Hatfield - wanted to know about the signs. •Mr. Lilley - there is a sign already there which he plans on using and illuminating. He also plans on having his name on the side of the building. He plans on having under the eaves lighting to light the building all the way around. Dave Putnam - he did not see anything wrong with the proposal other than having a second driveway culvert and his driveway pattern may have to be improved on the east side of the building. Hatfield introduced Local Law #1 - 1995 and asked for its adoption: of certain obligations in lieu of such retained RESOLVED, that this Town Board schedule a public hearing on April 11, 1955, at 7:30PM providing a procedure for the withdrawal of retained percentages from contract payment amounts withheld to certain contractors under public works contracts upon the deposit of certain obligations in lieu of such retained amounts. 2nd Clm Baker Roll call vote - all voting Yes RESOLUTION #116 #117 ACCEPT SHORT SEAR EAF NEGATIVE DECLARATION & FEED - LILLEY'S TACK & FEED Clm Roberts offered the following resolution and asked for its adoption: RESOLVED, that this Town Board accept the short SEAR EAF form as filed. It was determined there was no significant environmental impact and a negative declaration should be made. 2nd Clm Baker Roll call vote - all voting Yes RESOLUTION #117 GRANT SPECIAL PERMIT LILLEY'S TACK & FEED Clm Roberts offered the following resolution and asked for its adoption: RESOLVED, that this Town Board grant the special permit to Lilley's Tack & Feed with the following conditions: 1 - Hours 9:OOAM to 6:OOPM Monday through Saturday; 2 - separate entrance and exit driveways; 3 - signs to indicate entrance, exit and j drive through traffic flow; 4 - "Boiler Plate Conditions" adopted 7- 10 -90; and 5 - exterior lighting to shine on side of building on signs. Not to shine on Route 13. 2nd Clm Baker Roll call vote - all voting Yes Board members went over short EAF SEAR form for Screamer's Ice Cream. RESOLUTION #118 ACCEPT SHORT EAF SE9R NEGATIVE DECLARATION - SCREAMER'S ICE CREAM i Clm Roberts offered the following resolution and asked for its adoption: RESOLVED, that this Town Board accept the short SE9R EAF form as filed. It was determined there was no significant environmental impact and a negative declaration should be made. 2nd Clm Baker Roll call vote - all voting Yes 0 0 E TB3 -28 -95 Page 8 RESOLUTION #119 GRANT SPECIAL PERMIT SCREAMER'S ICE CREAM Clm Roberts offered the following resolution and asked for its adoption: RESOLVED, that this Town Board grant a special permit to Screamer's Ice Cream with the following conditions: 1 - current applicant only; 2 - current location only; 3 - designated parking spaces; 4 - health department permit updated; 5 - entrance and exit signs; 6 - port -a -john approval from health department. If approved it is to be marked for employees only and in an enclosed area, 7 - verification of health department approval for toilet facility; 8 - hours 11:OOAM to 11 :OOPM 7 days a week, 9 - night time lighting provided, shielded and directed down; 10 - no on site dumpster; 11 - refuse removed daily; 12 - verified NYSDOT requirements and 13 - "Boiler Plate Conditions" adopted 7 -10 -90 where applicable. 2nd Clm T. Hatfield Roll call vote - all voting Yes Chris Hicks - questioned whether or not he could dispose of gray water on site or would it have to be removed daily. Atty Perkins - he would be dumping waste water in the sewer system without paying for it which would not be permissible. There would have to be something worked out. Chris Hicks - said he would check on this and it would not be a problem for him to remove it if he had to. RESOLUTION #120 APPROVE EXTENSION OF SNYDER HILL WATER DISTRICT Clm T. Hatfield offered the following resolution and asked for its adoption: (copy in minute book) 2nd Clm Baker Roll call vote - all voting Yes RESOLUTION #121 AUTHORIZE DEPUTY SUPERVISOR TO SIGN THE APPLICATION FOR PLANS - SNYDER HILL WATER DIST. Clm Roberts offered the following resolution and asked for its adoption; RESOLVED, that this Town Board authorize Deputy Supervisor C. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Dryden, Tompkins County, New York, relating to the extension of the Snyder Hill Water District; and WHEREAS, said map, plan and report were prepared by a competent engineer, duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any persons interested in the subject matter thereof; and WHEREAS, the extension of said water district shall be bounded and described as hereinafter set forth; and WHEREAS, the improvement proposed for the extension of said water district consists of the installation of 2200 feet of 12 inch ductile iron pipe, 2345 feet of 8 inch ductile iron pipe, 8 hydrants and valves, gate valves, corporation stops, fitting, valves and necessary appurtenances thereto, as more fully described in the aforesaid map, plan and reports and WHEREAS, the total estimated cost thereof is to be paid by the developer of the subdivision known as Peregrine Hollow and dedicated to the water district at no cost to said district as a condition of final subdivision approval of Peregrine Hollow; and WHEREAS, compliance with the provisions of the State Environmental Quality Review Act have been performed and the I G • • 0 extension of the Snyder Hill Water District of the Town of Dryden and the improvements proposed therefor have been determined to be an unlisted action, as to which a negative declaration has been made determining that said extension and the improvements proposed therefor would not result in any significant environmental effects; O i WHEREAS, an order was duly adopted by said Town Board on March 14, 19.95 reciting a description of the boundaries of said proposed water district, the improvements proposed, the fact that said map, plan and report, were on file in the Town Clerk's Office for public inspection and specifying the 28th day of March, 1995 at 7:00 o'clock p.m., prevailing time, at the Town Hall, 65 East Main Street, Dryden, New York, in said Town, as the time when and the place where said Town Board would meet for the purpose of holding a public hearing to consider the extension of said water district and said map, plan and report, filed in relation thereto and to hear all persons interested in the subject thereof concerning the same; and WHEREAS, notice of the aforesaid public hearing was duly published and posted in the manner and within the time prescribed by Section 193 of the Town Law, and proof of publication and posting has been duly presented to said Town Board; and WHEREAS, said public hearing was duly held at the time and place in said order, as aforesaid, at which all persons desiring to be head were duly heard; and WHEREAS, said Town Board has duly considered said map, plan and report, and the evidence given at said public hearing; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Dryden, Tompkins I i 11 • • County, New York, as follows.
