( copy in minute book ) QUESTIONS AND /OR COMMENTS Jeff Frederickson - Would like to move their construction business to Cortland Road. They plan on using the barn that is there to store their warehouse material and any equipment they have. They plan on having their office in the house and would like to rent out the second floor to an engineering firm or some other type of compatible business. The dUmpster will be out back so that it is not in view t• � the public and covered. All of their trucks will be taken home at night when the workers leave. There will also be no rather cars there at night. The reason they would like to move their business to this location is that they do 65'* percent of the business near Ithaca. Slater - the building in question is on the long side of a driveway. The gentleman is correct, the turn around is about one third of the way up. When Mark was in here looking for subdivision approval he had a small approval cif which any future development hinged on the installation of public water and sewer. Mark was here at the last planning board meeting for his Phase II plat. Adam Reganbcogan - originally when he purchased his property, there was a plan, and may not have been approved of by the town, but the builder was committed to a plan of developing houses in that area. Mark built this structure which he had a lot of negative feelings abut because it seemed to him that would attract ether people later who might consider to be buyers in that development. It seems like the use in that area was getting very mixed. Mark has a habit of building things and then having them grandfathered in by the fact they are there. Even though he doesn't get permission initially he is able after- some time lapses to pretty much do i what he wants. Further mare, there doesn't seem to be a plan now with all of the different things that are going on there and all of the existing problems. It was originally for 11 lots for houses and this proposal dries not seem in concept in a housing development. • Atty Perkins - asked Z.O. TB4 -26 -94 Page 8 Adam Reganbogan - at one time there were drainage cavities where the water would go through along the hill and be distributed evenly to flow down the hill. Now the drainage cavities have not been taken care of and the water goes wherever it can. Adam Reganbogan - he understands this property does have a structure on it. A structure can be used by special permit. It is at the discretion � �f this particular body t� � make a determination whether a special permit be granted or not. He thinks there needs to be made a determination as to whether this special permit is in keeping with the spirit and the planning that needs to take place relative to this Turkey Hill area. If this board grants the special permit, basically yoi..t are making a very firm decision in a way. You are saying that this particular company now has a stake in this particular project in becoming a commercial land project as opposed to becoming a community of homes. You would be setting up different interests within this area. Once you set a use that runs against the plan of building houses you are setting up a future conflict. Supv Schug - Mr. Reganbogan has a right to his point of view, but the town board and planning board can only operate with what is in the law. Marcia Torrance - they were told that houses were going to built there. When Mark put that garage in he intended to put in a $200,000 house next to it. The man did not have a plan, he never intended to build that house, he just needs money and he needs it where he can get it.
