Supervisor Oltz called the regular meeting of the Town of Danby
Town Board to order at 8 : 00 P . M . and led all present to the Pledge
of Allegiance to the American flag .
Approval of Minutes of August 10 . 1992
A motion was made by Councilperson Schwartz and seconded by
Councilperson Miller to approve the August 10 , 1992 Town of Danby
Town Board Meeting Minutes as published .
A roll call vote on the motion resulted as follows :

Tompkins County Representative Report :
County Representative Proto reported the following :
1 ) Redistricting - A Local Law for Redistricting for the purpose
of Tompkins County Election Districts has been passed by the
Tompkins County Board of Representatives . There is no change
for the Town of Danby . Copies of the redistricting report
are available from the County .
2 ) New Solid Waste Office Building - A new building for the
County Division of County Solid Waste has been approved .
3 ) Sales Tax Increase - An increase in the Tompkins County Sales
Tax of one ( 1 % ) per cent was approved . This tax increase has
been limited to one ( 1 ) year so that it can be re - evaluated .
4 ) County Planning Items :
a ) Water Quality Survey - County Planning Department has
passed a Water Quality Survey Plan .
b ) Comprehensive Housing Affordability Building - County
Planning has developed a Comprehensive Housing Affordability
Building Strategy to look at the whole affordable housing
q uestion . j :. .
5 ) New York State Bond Act - Environmental Trust Fund . Part a )
of this Bond Act relates to solid waste and how the State can
h elp local municipalities get funding for solid waste issues
and Part b ) the acquisition of land and land use policy .

6 ) Children With Special Care Needs Program - New York State has
expanded the Children With Special Care Needs Program to
include zero ( 0 ) to two ( 2 ) year olds .
7 ) Union Contract Negotiations at TC - 3 - Professional Staff have
submitted a contract with an increase that is less than
inflation .
D iscussion followed Representative Proto ' s report regarding the
cost of operation of Tompkins County Division of Solid Waste ,
n umber of employees , ( especially engineers ) cost of a new building ,
and a proposed additional tax on property to cover costs .
Councilperson Miller asked Representative Proto how the County can
cut nine per cent ( 9 % ) of the Town Highway funds for snow removal
from the 1993 . contract .
PRIVILEGE OF THE FLOOR :
Carol Beniamin - 2190 Danby Road reported that the Taxpayers Group
submitted a few questions and concerns to Councilperson Schwartz
to be presented to the Town Board . They would like to have their
q uestions answered to report at the October 6 , 1992 Taxpayers
Meeting .
Howard Steiner - 1050 Coddington Road asked when the budget process
for the Town Starts . Mr . Steiner asked if the Town has considered
t he option of handling their own solid waste through private
industry .
Rick Dobson said he was concerned that the Code Enforcement Officer
asked him to purchase a permit to erect a tent on his property .
COMMUNICATIONS :
1 ) Intermunicipal Recreation Commission will meet on September
24 , 1992 at 7 : 30 P . M . at the Youth Bureau . Sam Cohen has
invited Municipal Officials to attend the meeting .
2 ) Dog Control Officer ' s August 1992 Report .
3 ) Code Enforcement Officers August 1992 Report .
Senior Citizen ' s - Edw . M . Roberts reported that the Senior
Citizens are planning to take two ( 2 ) more trips in 1992 if there
is money available in their budget .
Town Hall Maintenance
E dw . M . Roberts reported that the Town Hall carpets will be cleaned
o n Monday September 28 , 1992 .
Code Enforcement Officer Report
Susan Beeners reported that she is working on draft of changes to
the Zoning Ordinance . The draft language for Standardizing the
Public Hearing Notification Process and a Public Hearing Sign for
posting is nearly complete .
Fire District Report
Supervisor Oltz reported that the New Danby Fire District building
is on hold .
Planning Board Report
Chairperson Nancy Weitzel reported on the following Planning Board
activities :
1 ) Two ( 2 ) Public Hearings will be held on Wednesday , September
16 , 1992 .

2 ) The Planning Board approved two ( 2 ) subdivision proposals at
their August 19 , 1992 Meeting :
1 ) Marcia and David Radin - Comfort Road
2 ) John C . and JoAnne Koval - South Danby Road
3 ) The Planning Board went on a field tour of the Phinney
property .
4 ) An update on Hillview Mobile Home Park will be presented at
the September 1992 Planning Board Meeting .
N EW BUSINESS :
Budget Work Session Scheduled
Supervisor Oltz reported that she would like to schedule a Town
B oard Meeting for a Budget Work Session on Monday , October 5 , 1992
at 7 : 30 P . M .

RESOLUTION NO . 54 OF 1992
A RESOLUTION AUTHORIZING THE ISSUANCE OF $ 83 , 700 IN SERIAL BONDS
OF THE TOWN OF DANBY , TOMPKINS COUNTY , NEW YORK , TO FINANCE THE
COST OF THE ACQUISITION OF A HEAVY - DUTY DUMP TRUCK WITH PLOW FOR
THE TOWN OF DANBY .
By Councilperson Hile : Seconded by Councilperson Schwartz
B E IT RESOLVED by the Town Board ( the " Town Board " ) of the Town
of Danby , Tompkins County , New York ( the " Issuer " ) as follows :
Section 1 . Based upon the review of this action by the Issuer ,
the Town Board hereby determines that it is a Type
II action under the State Environmental Quality
Review Act ( Article 8 of the Environmental
Conservation Law ) and therefore no further
environmental review is required .
Section 2 . For the object or purpose of paying the cost of the
acquisition of a heavy - duty dump truck with plow for
the Issuer , there are hereby authorized to be issued
$ 83 , 700 in serial bonds ( the " Bonds " ) of the Issuer
pursuant to the provisions of the Local Finance Law .
Section 3 . It is hereby determined that the maximum estimated
cost of the aforesaid object or purpose is $ 83 , 700 ,
and the plan for the financing thereof is by the
issuance of the Bonds pursuant to this resolution .
Section 4 . It is hereby determined and declared ( a ) that the
period of probable usefulness of the object or
purpose for which the Bonds hereby authorized are
to be issued is fifteen ( 15 ) years and ( b ) that
subdivision 28 of paragraph a of Section 11 . 00 of
the Local Finance Law of the State of New York is
applicable thereto .
Section 5 . The proposed maturity of the Bonds will be in excess
of 5 years .
Section 6 . An annual appropriation shall be made in each year
sufficient to pay the principal of and interest on
the Bonds as the same shall become due and payable
each year . In addition , the faith and credit of the
Issuer shall be and are hereby pledged for the
punctual payment of the principal of and interest
on the Bonds as the same shall become due and
payable .
Section 7 Subject to the provisions of the Local Finance Law ,

the power to authorize the issuance of and to sell
bond anticipation notes in anticipation of the
issuance and sale of the Bonds herein authorized ,
including renewals of such notes , is hereby
d elegated to the Supervisor as chief fiscal officer .
The Bonds and any bond anticipation notes shall be
o f such terms , form and content , and shall be sold
in such manner as may be prescribed by the
Supervisor , consistent with the provisions of the
L ocal Finance Law .
Section 8 . The validity of the Bonds and any bond anticipation
n otes may be contested only if :
a . such obligations are authorized for an
o bject or purpose for which the Issuer is
n ot authorized to expend money , or
b . the provisions of law which should be
complied with at the date of the
publication of this resolution or summary
thereof , are not substantially complied
w ith , and
an action , suit or proceeding contesting such
✓ alidity , is commenced within twenty days after the
d ate of such publication ; or
c . such obligations are authorized in
✓ iolation of the provisions of the
constitution of the State of New York .
Section 9 . This resolution shall be published in full in The
Ithaca Journal , the official newspaper of the
Issuer , together with a notice of the Clerk of the
Issuer in substantially the form provided in Section
81 . 00 of the Local Finance Law .
Section 10 . This resolution is adopted subject to permissive
referendum in accordance with Section 35 . 00 of the ,
Local Finance Law . This resolution shall take
effect thirty ( 30 ) days after its adoption or , if
a petition is filed pursuant to Article 7 of the
Town Law , upon the affirmative vote of a majority
of the qualified electors of the Issuer voting on
the referendum .

RESOLUTION NO . 55 OF 1992
AUTHORIZE HIGHWAY SUPERINTENDENT TO POST WEIGHT LIMITS ON TOWN OF
DANBY ROADS
By Councilperson Schwartz : Seconded by Councilperson Miller
RESOLVED , That the Town of Danby Town Board authorize the Town of
Danby Highway Superintendent to post weight limits on Town of Danby
Town Roads at his discretion .

Community Council - Grant Proposals
Supervisor Oltz reported that Community Council would like the Town
Board ' s approval to re - submit A Grant Proposal for a Youth
Recreation Center . The proposal is basically the same as a
$ 1 , 200 , 000 grant proposal submitted in December 1991 for the
renovation of the Old Highway Barns or a new facility .
Discussion :
Councilperson Miller reported that one of the concerns addressed
to her by Town residents is that if the Town asks for large grants
and get money , for example to start a youth center , the Town would
inevitably end up staffing it . She would like to be better
informed and know exactly what Community Council is submitting .

A motion was made by Councilperson Schwartz and seconded by
Councilperson Hile to approve the General Fund Warrant # 9 of 1992
in the amount of $ 8 , 603 . 18 .
