M . Motion for Executive Session : A motion was made by Ken Horst and seconded by Arch Dotson to recess to Executive Session to discuss possible litigation . Carried Unanimously The regular meeting of the Planning Board reconvened at 8 : 10 P . M . Corrections of June 17 , 1992 Planning Board Minutes : 1 ) Page # 3\ -- under Daniel and Jeannette Malone - delete 1 . 7 acres and insert " 1 . 07 net acreage " ; 2 ) Page #1 - under Hillview Terrace Mobile Home Park Expansion Proposal - insert " introduced as former owners of 3 ) Page #3 - under 2 ) insert the word " a " before " total sketch plan " ; 4 ) Page #1 - first paragraph insert " , as he stated " after the word because ; 5 ) Page # � - last paragraph - delete the first " on " after shown . Approval of the June 17 , 1992 Planning Board Minutes : A motion was made by Paul Viscuso and Seconded by Arch Dotson to approve the June 17 , 1992 Planning Board Minutes as corrected . Carried Unanimously Approval of June 17 , 1992 Planning Board Public Hearing Minutes - Hovanec - Becker A motion was made by Joel Gagnon and seconded by Arch Dotson to approve the June 17 , 1992 Planning Board Public Hearing Minutes - Hovanec - Becker as submitted . Carried Unanimously Approval of July 6 , 1992 Planning Board Public Hearing Minutes - Malone Subdivision and Special Permit Request A motion was made by Arch Dotson and Seconded by Bill Farrell to approve the July 6 , 1992 Planning Board Public Hearing Minutes - Malone Subdivision and Special Permit Request as submitted . if Carried Unanimously Approval of July 6 , 1992 Planning Board Public Hearing Minutes - Proposed Local Law Amending the Zoning Ordinance Regarding the Board of Appeals A motion was made by Joel Gagnon and seconded by Arch Dotson to approve the July 6 , 1992 Planning Board Public Hearing Minutes - 63 2 Planing Board Minutes July 15 , 1992 P roposed Local Law Amending the Zoning Ordinance Regarding the B oard of Appeals . Carried Unanimously Proposed Subdivision - Charles and Eloise Phinney Harriet Moore submitted a new Sketch Plan Review for the Charles and Eloise Phinney proposed subdivision on Parcel # 1 . - 1 - 19 . 2 near West Jersey Hill and West King Roads . The Planning Board continued to review the Sketch Plan for the proposed subdivision . Harriet explained the area including the lands that are to be retained and remain with the homestead property . Susan explained that the hypothetical plat is to demonstrate that the land can be divided according to zoning requirements . The cluster plan is the one that Harriet is proposing . Discussion followed on the following : 1 ) lot sizes of two ( 2 ) acres 2 ) drainage 3 ) location of pipeline 4 ) location of the creek 5 ) proposed building envelopes should be shown with setbacks showing housing placement and buffers 6 ) Field Trip to view the area D iscussion followed regarding a site visit . The Planning Board will meet on August 19 , 1992 at 6 : 30 P . M . at the P hinney ' s carriage house on West Jersey Hill Road to tour the proposed subdivision site . The regular meeting of the Planing Board will follow the site visit at the Town Hall as scheduled . Proposed Subdivision - - John Keshishoglou Susan Beeners submitted a Sketch Plan from John Keshishoglou for a proposed subdivision of the Town of Danby Tax Parcel # 4 . - 1 - 34 , located on Troy Road and Nelson Road into three ( 3 ) lots . The Planning Board reviewed the new Sketch Plan . Motion to Proceed - Keshishoglou Sketch Plan A motion was made by Arch Dotson and seconded by Ken Horst that the Town of Danby Planning Board instruct the Code Enforcement Officer to advise John Keshishoglou to proceed at his option with the preparation of a Preliminary Plat or a Final Plat for the proposed subdivision of Town of Danby Tax Parcel # 4 . - 1 - 34 . Carried Unanimously OLD BUSINESS : Radin Subdivision Susan Beeners gave a brief update on the Radin Subdivision - - A modular home has been placed on the property with a full basement and garage . A survey of the property will be done soon . NEW BUSINESS : • Susan Beeners reported that she has received the following : Proposed Subdivision - Koval to Smith Proposed subdivision on South Danby Road near the LaRue Road intersection - Mrs . Koval has submitted a survey map , SEQR ( short environmental assessment form ) and the application is complete enough for the Planning Board to set a Public Hearing Date . Motion to set Public Hearing - Koval to Smith A motion was made by Joel Gagnon and seconded by Arch Dotson that the Planning Board of the Town of Danby set a Public Hearing to be held on the 19th Day of August 1992 , 8 : 30 P . M . at the Town Hall , 64 3 Planing Board Minutes July 15 , 1992 1830 Danby Road , Ithaca , New York to consider the proposed subdivision - Koval to Smith . A vote on the motion resulted as follows : Carried Unanimously Subdivision Proposal - Seventeen - Nineteen Lots Corner of Troy Road and Muzzy Road A Subdivision Sketch Plot for the Piwczyk property was viewed by the Planning Board for a proposed subdivision of seventeen ( 17 ) to n ineteen ( 19 ) lots of five ( 5 ) + acres each on Town of Danby Tax P arcel # 4 . - 1 - 40 . 2 near the corner of Troy Road and Muzzy Road . The proposed Sketch Plan may change as the acreage is calculated from t he center of the road and may not be net acreage of five ( 5 ) acres . H illview Terrace Mobile Home Park Proposal - Update Susan reported that our Town Attorney will send a response to the P lanning Board related to the information presented by Attorney Rich John at the June 17 , 1992 Planning Board Meeting . G oodwin - Variance for Mobile Home Permit Susan Beeners reported that William Goodwin was granted a variance to place a Mobile Home on the Frederick and Barbara Goodwin property . The variance was extended until August 7 , 1992 and Mr . G oodwin has been in touch with the Code Enforcement Office on a ✓ egular basis with progress reports . Susan reported that Mr . G oodwin may submit an application for a Special Permit to place a doublewide on this property . Procedure Related to Certain Public Hearings Susan Beeners submitted a draft for Planning Board consideration ✓ elating to modification of procedures for the scheduling of public hearings for minor projects . D iscussion followed : RESOLUTION NO . 9 OF 1992 RESOLUTION TO ADOPT PLANNING BOARD PROCEDURE RELATED TO CERTAIN P UBLIC HEARINGS B y Joel Gagnon : Seconded by Paul Viscuso WHEREAS , the Town of Danby Planning Board has determined it is n ecessary to modify the procedures related to the scheduling of public hearings for minor projects , and WHEREAS , the modification of procedures would not adversely impact the level of public notification desired , and WHEREAS , the modification of procedures would assist the Town of D anby Planning Board in streamlining minor development review , now be it RESOLVED , that the Town of Danby Planning Board adopt the following P lanning Board Procedure related to certain public hearings . PLANNING BOARD PROCEDURE RELATED TO CERTAIN PUBLIC HEARINGS In the case of an application for the approval of a Minor Subdivision or a Special Permit for a Doublewide Mobile Home , the Planning Board Chairperson may schedule a Public Hearing for the next regular meeting date of the Planning Board . Prior to scheduling such Public Hearing , the Planning Board Chairperson shall determine that the application is sufficiently complete for Public Hearing . Any such application must be received by the Planning Board Chairperson at least three ( 3 ) weeks prior to the next regular 6 5 4 Planing Board Minutes July 15 , 1992 meeting of the Planning Board . Notice of such Public Hearing shall conform with the notification requirements where applicable set forth in New York State Town Law , the Town of Danby Zoning Ordinance and Subdivision Regulations , and Open Meetings Law .
