MORRIS A. NOSS, MAYOR
November"'24,. 1967. 4
John J. Gardner, Esq.
Attorney, Town of Cortlandville
l Main Street
Cortland, New York
Dear Johnk
"• Regarding your inquiry covered in two letters dated
November 2 and November 17, regarding sewage facilities
for twenty—two acres of land on the Starr Road in the
Town of Cortlandville, under contract to Pinehurst Devel—
.opment Corporation, we have carefully checked our contract
s with the Town of Cortlandville and we are of the feeling
that the anticipated enlargement of the Sewage District.
to make this development falls within the scope of the
original contract. At the regular meeting of the Common
Council on November 21, 1 informed the Council of this
and we; therefore, commit ourselves to the Increased use
of the Tompkins Street sewer main -and the city sewage
treatment plant as proposed in the above mentioned letters.
We.are very pleased to see the growth of the Town of
Cortlandville because we feel that your growth is good for
us too. We wish you and the T6wn of Cortlandville good
luck in ..this new expansion and venture.
Sincerely,
:.Morris A. Noss, Mayor

ATTORNEY AND COUNSELLOR AT LAW

CORTLAND, N. Y. 13045
AREA CODE 607 753-3081
Nov. 17, 1967
Hon. Morris Aa Noss, Mayor
City of Cortland
23 Court St.
Cortland, N. Y.
Dear Morris:
You received a letter from me, dated November 2, 19670
concerning the 2.2 acres of land on the farm owned and operated by Don-
ald Morton, located south of the Starr Road in the Town of Cortland-
ville, which are under contract of sale to the Pinehurst Development
Corporation, contingent upon certain facilities being available in-
cluding an enlargement of Sewer District No. 1 of the Town.
This development corporation. is planning to construct 300
apartments on this land and use the Town of Cortland Sanitary Sewer.
This would mean an increase in the use of the Tompkins Street Inter-
ceptor Sewer main and the Treatment Plant owned by the City of Cortland.
When I wrote this letter, I did not think it important to
include a small parcel of land owned by Harold J. Cleveland, located
south of the Starr :Road, adjacent to the Morton property because it
would only mean the addition of one more family unit to be using the
sewer facilities. Nevertheless, Supervisor Frank K. Taylor thinks this
is very important and he has asked me to write .you another letter.
Enclosed with my letter to .you under date of November 2nd,
was a copy ofthe information of Pinehurst Development Corporation, con-
cerning,, their plans for development and use of the Town's sewer. To
this should be added the use of the Cleveland family, which would change
the figures to read as follows:
Year, Apartments Quantity (Gallons per day)
1968 49 27,555
1969 14.5 81,555
1970 24.1 135,555
1971 901 168,555
I trust that the change in these figures will not incon-
venience .you and that .you will be able to use tam at .your next Common
Council meeting to be held on November 21st.
Please advise me as to whether the City of Cortland will
commit itself to this increased use of the Tompkins Street Interceptor
Sewer Main and the City Sewer Treatment Plant.
Very truly _yours,
