PUBLIC HEARING #1 NYSE &G AGREEMENT Supv Schug called the meeting to order at 7:OOPM Roll call was by the Town Clerk: Present: Svpv Schug, Clrn Roberts, Clm Walbridge, Clm Hatfield, Atty Perkins and Z.O. Slater Absent: Clm Corrigan SwpV Schug read the notice that was published regarding pole line easement. (copy in minute book) QUESTIONS AND /OR COMMENTS Supv Schug - NYSE &G will agree to install a light and pay for it for 3 years. After the 3 years the town will pay the nominal charge of less than $100.00 a year for the service. Atty Perkins - NYSE &G is proposing to install a light and pay the cost for, operating it for 3 years. They are suggesting that this is a fair and equitable consideration for the town to grant thern an easement across town property. ' rhere are terms in the easement which should be crossed out and give them the right to use chemicals to control vegetation growth and limit this to the present location. The issue before the beard is to decide if this . is A fair and equitable consideration. QUESTIONS AND /OR COMMENTS Clm Walbridge - wanted t9 know if there was any reason for the change in the length of the term. Atty Perkins - he was asked to research and prepare a local law. 2 years is set by the state statue and by local law you can supnrcede state law. Clm Walbridge - wanted to kn•_.w the length of the terms for other highway superintendents in the county. • NOTICE OF INFORMATION MEETING NOTICE IS HEREBY GIVEN that the Town Board of the Town of Dryden, Tompkins County, New York will hold an informational meeting on a proposal for the Town to grant a pole line easement to New York State Electric & Gas Corporation over Town property at the intersection of Sodom Road and Snyder Hill Road in said Town. Said public hearing will be held Tuesday, July 30, 1991 at 7:15 p.m. prevailing time, at the Varna Community Center, Varna in said Town at which time all persons will be heard. (2) That it is hereby determined that fair and adequate consideration for the grant of such easement is the agreement on behalf of New York State Electric & Gas Corporation to furnish and install a street light on a pole to be set within the easement and to provide electricity and maintenance of the same at its expense for a period of three (3) years following such installation.
