TOWN BOARD MEETING
NOVEMBER 1 , 1990
S upv Schug called the meeting to order at 7 : 00PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk :
Present : Supv Schug , Clm Roberts , Clm Walbridge , Clm Corrigan
and Atty Perkins
Absent : Clm Hatfield
Motion was made by Clm Roberts and 2nd by Clm Walbridge that the
minutes of the town board meeting held 10 - 9 - 90 be approved as
submitted . Carried
S upv Schug - Atty Perkins has written to Mark Stevens regarding
h is special permit application that if the Town Board did not
h ear from him within a certain time limit then the Town Board
would consider that he has withdrawn his application .
S upv Schug - as of November 1 , 1990 the Town Board has not had
any response from Mark Stevens so it is considered that he has
withdrawn his special permit application at this time ,
RESOLUTION # 258 RESCIND RESOLUTION # 180

® Clm Corrigan offered the Wfollowing resolution and asked for its

RESOLUTION # 259 WHCU / WYXL
Clm Walbridge offered the following resolution and asked for its
adopt ion :
RESOLVED , that this Town Board require WHCU / WYXL prior to the
issuance of a building permit the landscape plan contemplated by
condition # 1 in the site plan approval on 11 - 2 - 89 be supplied to
the code enforcement officer and the applicant present to the
t own engineer an engineering report and / or- drainage plan . Also
W HCU / WYXL will be permitted to access on to Hanshaw Rd .
2nd Clm Corrigan Roll call vote - all voting Yes
S upv Schug - reported that ACC cablevision is rebuilding the
cable on Rt 79 and the entire town should be finished this year .
S upv Schug - reported on Pinckney Road bridge . Hwy Supt . Gilbert
h as written to NYSDOT accepting the approaches , decking and
d itches since they have met the town highway specifications . The
bridge now has railings on it , but does not have the approach
g uide rails installed at this time .
RESOLUTION NO . 258
Councilperson Corrigan offered the following resolution
and asked for its adoption :
WHEREAS , the Town of Dryden Site Plan Review Board on November
2 , 1990 granted site plan approval to the application of WHCU / WYXL
for the construction of an office building and related
appurtenances on Hanshaw Road , and
WHEREAS , certain representations were made to the such Board
that such access to the Project site could be obtained by either
D avid Abbott or the applicant over property owned by the State of
N ew York , and
WHEREAS , the site plan approval had as condition # 8 the
✓ equirement that the applicant make arrangements with the State of
N ew York and / or David Abbott for a driveway across property owned
by the State of New York to Abbott Drive to avoid further curb cuts
on Hanshaw Road , and
WHEREAS , the applicant now alleges that it is unable to obtain
such access to comply with condition # 8 of such approval and that
it should be relieved of it ' s prior representations , and
410 WHEREAS , there has been no showing of any reasonable effort
made by the applicant to obtain an easement , license or other
approval to use State owned property for purposes of ingress and
egress to the applicant ' s site to avoid a curb cut on Hanshaw Road ,
and
WHEREAS , the Site Plan Review Board it feels that it was not
fully advised as to the likelihood of the applicant obtaining such
easement , license or other agreement with the State of New York for
access over such property before it granted such approval ,
NOW , THEREFORE , BE IT RESOLVED AS FOLLOWS :
1 . The Site Plan Review Board hereby expresses its
d ispleasure with the applicant and its lack of a good faith effort
t o obtain access across State owned property to avoid a further
curb cut on Hanshaw Road .
2 . Resolution # 180 adopted July 10 , 1990 is hereby rescinded .

® Supv Schug - has received information from the state soil
conservation service that Virgil Creek watershed project is now
moving forward but will depend on fund ing .
S upv Schug - board members received information from Henry
✓ egarding the time table for moving to the Wilcox Press site .
Clm Walbridge - wanted to make sure that the Hall Woods Rd
✓ esidents received a copy of this schedule . Also it states that
some of the planting can not be done and felt that it should be
d one by spring and no later . There is no mention of a drainage
plan being completed or the air quality permit .
S upv Schug - the town would have to notify DEC and they would be
✓ esponsible for the air quality . George Schlecht has been asked
to review the drainage plan .
Clm Walbridge - recommended that they not receive a temporary
certificate of occupancy until the drainage plan has been
approved by George Schlecht .
Atty Perkins - reported on litigation . Amos Brown vs the Town of
Dryden , motion has been made to dismiss the petition and we
awaiting their decision . If the court does not grant the motion
t hen it will have to go to full defense under Article 78
proceedings . Their was a scheduled trial yesterday regarding the
Town of Dryden and George Stetson . Mr . Stetson was evicted after
a plea of guilty to a few charges and was sentenced to one week
in jail for each violation and sentencing was to run
consecutively . Today he has appealed that decision for his
sentence . He is to begin serving his time on Monday .
