Public Hearing 7:30 P.M. Held by Town Board, Town of Cortlandville..
Public Hearing in the matter of amending the zoning ordinance
pursuant to section 264 and 265 of the Town Law and article 17,
section1702 of the zoning ordinance.
,, ll Town Clerk Lelan M. Brookins read the Legal Notice of pub-
lication. No one appeared to object to the proposed change, therefore
on motion of f,Mrr .Fish seconded by Mr. Miller that'_the�Lhearing be closed..
Motion was carried.
Regular meeting called to order by Supervisor Frank K. Taylor
Board members present were,Justice's Don Eaton and Ron Fish, Council-
men Ray Miller, Sherman Griswold, also Book-keeper for Supervisor,
Rudy Krauklis, Town Engineer Wm. Rowell, Town Attorney John Gardner
Town Assessor Henry Wadsworth, Town Hgwy Sup't. Harry Cooper and
Fred Walker,Water Maintenance Sup't.
Minutes of the last meeting were read by the Town Clerk and they
were approved.
Motion was made by Mr. Fish seconded by Mr. Miller that the
amenment to the Zoning Ordinance be adopted. This motion was carried.
Amendment as follows:
Article X111, Special Permit Uses:
Section 1300 paragraph 1 subdivision "G" shall be amended to strike
out the words "Private or" from said paragraph. Said paragraph to there-
after read: Public Swimmimg Pools which shall be enclosed as provided
in Section 1411 hereof.
A new subdivision '°J" shall be added to Article X111
Section 1300 paragraph 1, said new subdivision to read: Private
swimming pools shall be permitted in any district without the approval
of the Zoning Board of Appeals but no private pools shall be con-
structed without the approval of petitioners plans by the Zoning Officer,
of the Town of Cortlandville upon a showing that said pool and the plans
theref om comply with the requirements of this ordinance and in particular
the provisions of Section 1411 of this Ordinance.
#-19Motion was made by Mr. Fish seconded by Mr. Miller that after a
Public Hearing held on May 21, 1969 that the petition of Laverne and
Carl Neiderhofer for the establishment of Water District # 3 be
approved. This motion was carried unanimously.
'_�IOMotion was made by Mr. Eaton seconded by Mr. Miller that a 4 foot
chain Link type fence be erected on the property line between Town
property and Herbert Seherz , Cortland Foregin Motors, said fence to be
erected 1 foot on Town side of property line. This motion was carried.
Motion was made by Mr. Miller seconded by Mr. Eaton that the bid of
Sears & Roebuck for a 4 foot fence installed at $240.00 be accepted with.
provision that this fence be erected within 30 days. This motion was
carried.
Motion was made by Mr. Eaton seconded by Mr. Fish that the Bid of
Willcox Company to erect a 4 foot fence on the Water District Land, corner
of McLean and Terrace Road at the price of $695.00 to be erected within
30 days�be accepted. This motion was carried.

Mot tnn by Mr. Fish seconded by Mr. Miller that the Town Atto-rney
write a letter to the Credle Equip. Co. Utica New York to negotiate a
bill they claim the Town owes them, offering to settle claim as follows
30 hours labor plus parts used. Motion carried.
4JMotion by Mr. Griswold seconde by Mr. Miller that Mr. Walker be
allowed $25.00 to attend pump school at Syracuse, N.Y. July 9thru 13,
1969. This motion was carried.
4q Motion was made by Mr. Griswold seconded by Mr. Fish that Supervisor
F.Taylor and Toti=gin Clerk be authorized to sign N.Y.S.Youth Program Appli-
cation. Motion was carried.

On motion of Mr. Griswold seconded by Mr. Fish the following
election inspector's 'were appointed for July 1969 thru June 30th-1970-
Motion was carried.

Motion was made by Mr. Griswold seconded by Mr. Miller that the

This motion was carriedi there being no further business at this time
meeting was adjourned.

RESOLUTION.
WHEREAS, A petition for the creation of a. Water District to bJ
known as Water District No. 3 in the Town of Cortlandville, Cortl
'County, New York, the said petition being dated April 18, 1969, was
duly presented to this Town Board, together with the necessary map

;and plans attached thereto; and
WHEREAS, An order was duly adopted by the Town Board on May 7
1969, reciting the filing of said petition, the improvements propos�d,
the boundaries of the proposed District and the proposition that al:
of the respective costs of the proposed improvements therein are;to
be borne by two of the petitioners, Laverne Niederhofer and Carlton
J. Niederhofer, and specifying May 21, 1969, at 7;30 o'clock P. M.
as the time, and the Town Hall at 3577 Terrace Road in the Town of
Cortlandville, as the place where said Board would meet to consider.
the petition and hear all persons interestedin the subject thereof
concerning the same; and
WHEREAS, Such order was duly published and posted as required
by law; and
WHEREAS, A hearing in the matter was duly held by the said.To
Board on the said 21st day of May, 1969, commencing at 7;30 o°clock
P. M., at the Town Hall, 3577 Terrace Road in the Town of Cortland-
ville, and considerable discussion Lpon the matter having been had,
and all persons desiring to be heard having been duly heard;

RESOLVED AND DETERMINED, That (a.) The petition aforesaid is
signed and acknowledged or approved as required by law, and duly co�-
plies with the Section 191 of the Town Law as to sufficiency of si

District shall be designated and known as Water District No. 3 of
