Closed public hearing , Members and guests 'participated in the Pledge of Allegiance Roll call was by the Town Clerk P resents Supv Schug , Clm Roberts , Clm Walbridge , Clm H atfield , Clrn Corrigan , Atty Perkins and Z . O . Slater APPROVAL Or THE MINUTES - Motion was made by Clm Walbridge and EZnd by Cllm Hatfield that the minutes of the Site Plan Review held G - 12 . 90 and Town Board meeting held 6 -- 2. 5 - 90 be approved as submitted , Motion was made by Clm Walbridge and End Clm H atfield that the minutes of the Town Board meeting held e - 1i-90 be approved except Resolution 4149 until Atty Perkins can check to make sure that the wording is correct and all necessary information i s included . The wording to be corrected is -- If the S tate Comptroller rejects the formation of the Turkey Hi 11 Water D istrict , the Reeds will be required to connect to the Monkey Run Water District within six ( 6 ) months from notice of such d ecision by the State Comptroller . RESOLUTION f ;175 ZONING _ ORDINANCE AMENDMENT C1rFi Walbridge offered the following resolution and asked for its adoption ; RESOLVED , that this Tern Board approved the amendment to the Town of Dryden Zoning Ordinance . The proposed amendment is as fellows : Section 5 . ( Reimbursable Costs . ) of Article XXTV of the Town of Dryden Zoning Ordinance ( Site Plan Review ) is hereby amended to read as follows : 5 . The reasonable and necessary casts , fees or disbursements incurred by the Town or its officials for consultation or review by professionals including architects , engineers , landscape architects , surveyors or others of any Application for a Building Permit , Certificate of Occupancy , Appeal to the Zoning Board of Appeals , Application or Subdivision Approval , Application for a Planned Unit Development ,, Special Permit for a mobile home park or Site Plan Review and Approval shall be paid by the applicant . This amendment shall t {eke effect after publication and as provided by law , 2nd Clm Corrigan Roll call vote - c 1 1 voting Yes 110 , , NOTICE OF PUBLIC HEARING ZONING ORDINANCE AMENDMENTS TOWN OF DRYDEN PLEASE TAKE NOTICE that the 'Town Board of the Town of Dryden w ill hold a public hearing on a proposed amendment to the Town of Dryden Zoning Ordinance . The proposed amendment is as follows : S ection 5 . ( Reimbursable Costs . ) of Article XXIV of the Town of D ryden Zoning Ordinance ( Site Plan Review ) is hereby amended to ✓ ead as follows : 5 . Susanne Lloyd Town Clerk r 1/ 1B7 - 10 -90 page 2 CITIZEN PRIVILEGE OF THE FLOOR , ill Leighann Sibal - County Coordinator for the Healthy Heart Program of Tompkins and Cayuga counties . The purpose of the program is to promote educational programs to improve health on your heart . She is in the process of developing a community subcommittee and is looking fo_or volunteers from the Dryden area . The programs that they offer are fitness events , walking programs , taste testing programs for low fat , low cholesterol f oods , educational programs within the school systems , communities and also the work place . She is looking for interested people in the Town of Dryden who would like to ✓ olunteer some time to spend with this program . E rica Evans , Turkey H i l l Rd - wanted to know the status of the Turkey Hill water and sewer district end if anything has been forwarded to the state . ditty Perkins - all of the paper work has been forwarded to the state and the town is waiting for their reply . B ill Harding , Yellow Barn Rd - wanted to know if the towel was looking into a recycling center since the garbage haulers will n o longer accept leaves and debris from your lawn . Supv Schug - the town is negotiating with Cornell University hoping to set up a compost location for Cornell and the Towns of Dryden . The Village of Dryden and Freeville also need a place for their compost material . If everything works out there should be a public hearing in late August and in operation by the end o f September or early October . Catherine Brown , Lower Creek Rd - was concerned about a recycling center for glass and other recyclable items to be located in the Town of Dryden , since it is inconvenient now to go to the City of Ithaca because they have changed their hours o f being open to the public . S upv Schug a at a previous board meeting a suggestion was made by the chairman of the county board that there would be county wide curb side pickup . The last notice that he has received is that county wide curb side pickup should be a reality in April or May of 1991 . The Town Board did talk about putting in their own recycling center in the Town of Dryden and when he heard that the curb side pick up would be a possibility he could not see spending the time , rn000ney and effort t o build a recycling drop off center when they would be picking everything up . The county is considering the towns that do not have drop off sites , get together and work out a way to staff the drop off center at Willow Ave . from now until next May rather than build another one in Dryden cr any place else . Hbpef u 1 1 y it will be open and monitored ` days a week Tuesday thr• u Saturday . 7' 87- 1 - pane Aik COUNC I LMflN PRIVILEGE OF THE FLOOR Clm Roberts °- recommended that the Town Board increase the uninsured motorist protection to one million dollars per vehicle . This would protect the Town in the event that a town employee was injured . The cost would be $ 1 , 150 . 00 per year for the extra coverage as opposed to $ 20 , 000 . O0 per vehicle at a cost of $ 100 . 00 . it would be % 4E, . O0 per vehicle for the 25 vehicles RESOLUTION 0 177 I CRf R .8E __I NSU RPNCE gm TIQNN VEHICLES --- Clm Corrigan coffered the following resolution and asked for its adopt ion ; RESOLVED , that this Town Board accept the recommendation from Clm Roberts that the Town increase the insurance to $ 1 , 000 , 000 . 00 per vehicle for uninsured motorists . 2nd Clm Roberts Roll call vote -- all voting Yes ATTORNEY Hall Road water and sewer are going along _ n schedule , tatty Perkins -- suggested that the Town Board not take any action at this time regarding the renewal of the ci blevision 'franchise since there is a rule at the present time in Congress to take back some of the controls that the Federal Communications Commission gave up . ACC contract does not expire until 1991 and he should have more information by October of this year . Atty Perkins - sent all Board - members a draft of the revised " boiler plate conditions ' RESOLUTION 4178 ACCEPT BOILER PLATE CONDITIONS Clan Corrigan offered the following resolution and asked for its adoption ; THE TOWN OF DRYDEN - BOARD APPROVAL OF - APPLICATION FQR The applicatic+ r. of - — I-- - for a project fit a L- `4 Dryden , New York is approved upon the following conditions : 1 . The Environmental Assessment Form prepared in connection with the project is approved and accepted based upon the fact that the project will have no adverse environmental impact . A negative declaration is to be filed . a . The project shall be constructed according to the plans submitted by the applicant and approved and filed with the Town of Dryden . TP7 - 10- 90 page 4 3 . That the project during and following construction shall cr{ mply with all applicable Town , County , state and Federal laws , statutes , codes , ordinances , approvals and rules and regulations . • 4 . That the prnject during construction and upon completion shall not constitute a public or private nuisance . � . That when municipal water or municipal sewer is available to the site the applicant shall connect to the same upon notice to dry so from the Town . b . That should the Town require easements for municipal water lines or sewer lines and necessary appurtenances in connection with the construction of a municipal water system or sewer system that the applicant , its successors and assigns , grant the saute to the Town without the necessity for compensation . 7 . That the rate of discharge of surface water from the site not be increased during or following construction and that measures be taken by the applicant to insure such control of the discharge of water . Any drainage improvements constructed by the applicant to comply with this condition shall be maintained by the applicant . S . That if a buffer is required to be planted then it shall be maintained by the applicant . 2nd Clm Hatfield Roll call vote - all voting Yes Rtty Perkins - reported that Oak Brook Drive has finally been completed to town specifications . The Town Board needs to pass a resolution releasing the letter of credit which was posted to insure compliance . Clm Walbridge - wanted to know if the Town should double check to make sure that the grades have been done in the proper way . George Schlecht - did not find any problems with the road made . RESOLUTION # 179 RELERSE LETTER OF CREDIT OAK BROOK�DRIVE - ^ Mark. Stevens Clm Hatfield offered the following resolution and ' asked for its adopt ions RESOLVED , that this Town Board release the original Irrevocable Letter of Credit No . 1180 from Binghamton Savings Uank dated November 1S , 198 and release the original Irrevocable Letter^ of Credit No . 1a3b, from Binghamton Savings Bank dated November 79 1959 . and Clm Roberts Roll call vote - all voting Yes r G' ff • TE7 - 1iJ - 9O page 5 0 ditty Perkins - reported that Town Clerk Lloyd was served with a n otice of petition to review the assessment of the Buckeye Pipe L ine Co . Under the provisions of the Tompkins County Charter it is the function of the county to defend the town in actions such as this This matter has been turned over to the Division of (Assessment for them to respond to their attorney . The town does not need to take any action . TOWN ENGINEER Supv Schug - regarding Snyder Hill and Route 79 the town asked for engineering bids for that project and the town has only ✓ eceived one to date which is Hunt Engineers . Supv Schur wanted to know if George Schlecht had any bid figure; available . G eorge Schlecht - he did not have figures availeblet but he has spent soma time to define what would be a reasonable study . He w as not clear at what the town wanted to consider within that study area . He did spend some time with the USSG maps to see how the study area might be defined and based on that he intends to submit a proposal to look at that study . ha discussed in the past he thought that same studies are limited to a to small an area and might see what would be a reasonable feasible area . S upv Schug - if he had his figures now the town could move forward . G lm Corrigan - wondered if the town would be looking at two different estimates for two entirely different things . The Town Board decided to wait until they had the two bids for Snyder H i l l and Rt 79 proposal . S upv Schug - regarding Cortland Rd eater district . The town has a Cortland Rd sewer district now and there are people who are interested in a Cortland Rd water district . Mayor Lane said that he would sell water to the district . Because we have most of the w ork done he thought that George could give us a rough idea of what it would be to figure the pipes ; cost and the scope of the w ater district to match the sewer district . He wanted to know if G eorge could have the figures by the next board meeting as to w hat it would cost to he the engineering study . kitty Perkins - thought that we already had something like that study . S upv Schug - the sewer district study went so far and the water district study was a bigger area . The study area should include the commercia ]. areas . Box. 34 , Dryden , New York to establish and operate a three ( 3 ) Dwelling UJn :i. t and Convenience Store at 2 Etna Lane within the H amlet of Etna . Mr . Katsiroumbas is requesting a variance to section 751 of the Town Zoning Ordinance . A public hearing was duly conducted by the Town of. Dryden Board of Zoning Appeals on Tuesday , June 5 , 1990 with members present : Acting Chairman Francis DiTommaso , Dominic Bordonaro and Alan LaMotte . FINDINGS : 1 . Neighborhood comment was two in support of the store and one against the apartments . • 2 . The land has unique features , and no allowed use would yield a reasonable return . 3 . The Board doesn ' t feel there would be significant change in the neighborhood as a result in granting the variance . 4 . The store alone is not economically viable , apartments added to the store create economic viability . You can ' t have any new businesses because you don ' t have any capacity . The present ones and the new businesses would go forward together . S upv Schuq - we are still waiting for the engineers report on the village plant and if you wait any longer for that to be built it will again be obsolete before we have a water district . Mr Novelli has had the study for over 3 months that the town has approved the money for . Supv Scht - should the town release Mr . Goddard from our drilling rights ? Atty Perkins - we already have because that expired under its own terms and he has been advised , but he will check on it . ZONING OFFICER - report given to $ cord members Z . G . S upv Schug - will they access to Abbott Rd ? Z . f] _ Slater - there is no access available to Abbott Rd . They can not get a r - e. - w across the state land to Abbott Rd . Clrn Walbridge •- they stated that it would be easy to get at the site plan review hearing . S upv Schi.tg - WHCU said they would go along with that and Dave Abbott said that he would see that they got it . Clm Walbridge - was referring to their intension which was made publicly they would make an effort to get access to Abbott Rd . It sounds like they are waiting until it appears in front of them . She wants to make sure that they have made an effort . 2 TES7 - 1O - 9r) page 7 Dave Abbott has said that he would help to make sure that it has been done . Z . O . Slater -- you w i l l have to direct me if you want me to deny the permit until they have proved they can ' t get to the read . Atty Perkins . in getting an easement from the State of New York is from 18 months to a 2 year project . There are other methods the State sometimes allows which they can use locally such as a license nse agreement . It is appropriate that some type of proof is in the file as to what efforts WhbU has made . RESOLVED , that this Town Board is requiring in writing from WHCh that an effort has been made for requesting the easement for a d riveway to Abbott Rd fr0000 the State of New York before the building permit is issued . 2nd him Corrigan Roll call vote - all voting Yes CORRESPONDENCE Ambulance report D og report D EC - Division of Regulatory Affairs has issued AN air contamination permit to Wilcox Press which was received en June 25th . The building permit has one been issued to Wilcox Press . ACC -- They w i l l be dropping Channel 44 because the tower i s f alling down on Connecticut Hill and will be replaced with something else . This will be advertised and will not happen until July 29th . D ISCUSSION Tax installments - Kathy West said that she would come out and talk with the Town hoard if they were interested . S rpv Sohut - only h percent of the people in the town do no pay their taxes , which are the same paahie every year . A good share of them the taxes are no high at the beginning of the year because they fail to pay their school taxes in September . th percent of the people in Dryden budget their money properly . Clm Walbridge -- she did receive one letter requesting the installment plan because taxes were going up so , and he and his Tr17 .- 10-90 page a neighbors were going to be forced out of their houses and this would be the only way he would be able to keep going . Atty Perkins - wanted to know who would take advantage of the installment payrnerrnt plan before you install the program . S upv Sch '.sg - gathy West is to come and eKplain it more . If you read her letter i t st at ea} that the town w i l l be reimbursed and he wanted to know if that was by the county . He q uestioned that if everybody in that county was going to pay for the people who are corning in late and Kathy told him no . Co . Rep Watros said that the people who are going to pay the split payments are going to pay for all of the costs of doing this and it will he expensive . They are not going to save any money because they are already getting a higher charge in their taxes by paying a split tax . Atty Perkins when you receive yr_ ur Jan tax bill there would be 2 parts . You can pay the f u l l amount by sending in both stubs and if they want to pay in installments they would send in the first stub , Town Clerk Lloyd - the county will be collecting the second half and she would be only collecting until tan 31st and have to turn the list over to the county by Fab 1st . If this does pass they fd, might have to change the date from Feb let because you are still ✓ eceiving mail dated fan 31 a week latter . Ws are still putting money in the bank and receiving mail by Feb 15th . h is Corrigan - questioned the one dollar extra , if it was for every taxpayer or just the ones that choose for the installment plan . S upv Snhrt -- was told that it was just for the ones that choose the installment . ble Corrigan -- wanted to know where they come up with the e stimated hb per cent on adopting the installment method . She felt that it is more trouble than it is moth and we have already passed a resolution to that effect . S upv Schug - there was concern abort the noise of the dump trucks hauling atone at the site of Wilcox Press in the early morning , but it has not happened recently _ S upv Schog - bids for the engineering design of the addition to the town hall . we have 2 estimates , one is from horslli Engineers at $8 , 000 . 00 and another one from McFall Builders at $5 , 000 . 00 . navelli usually charges S . 6 percent of the total e stimated cost of 4120 , 000 . 00 . Atty Perkins -" questioned i f they were licensed t o do this kind of work , ay TB7 - 10 - ' Ca page 9 Supv Schug - you don ' t reed a licensed engineer to do this kind of work . Clm Walbridge - don ' t you need an architecture seal when they do the plan . S upv Schug - not under state law under so many square feet you d on ' t need a licensed architecture . Atty Perkins - that is only for a single family dwelling . He thought you needed a licensed architecture and will check on the legality before the next board meeting . S upv Schug - the Town of Dryden will be 200 years old in 199 ' and would like the Board members to be thinking about committees . There was a book published and revised in 1975 and this should probably be updated . When it comes to budget time there Should be some money set aside _ S upv Schug. - there is a draft resolution where the county wants to . put in every contract that so many people on every job contracted out to hire as many people from Tompkins County as possible . RESOLUTION 0181 AUTHORIZE JUSTICES,TTO ATTEND MANDATORY JUDICIAL T RAI N l N i Clm Walbridge offered the following resolution and asked for its adoptions RESOLVED , that this Town Beard authorize Justice Sweetland and J ustice Lloyd to attend mandatory judicial training at St . L awrence University and to pay expenses . E nd Clm Corrigan Roll call vote - all voting Yes S upv Schug - needs a resolution regarding the formation of the youth commission , Clm Walbridge W was concerned about the youth commission being only related to the Dryden School and the statement of Dryden do Central Bch1-4 �,I1 , Dryden Police Dept . , local clergy ; Sertoma Club , Kiwanis Club and the Masons because this is a lot for this portion of the town . What about the part of the district that is in the Ithaca School District and Caroline School . She would like a balance of the statement so that it does not seem that it is for this portion of the town . Supv Schug - the commission would be set of 2 from each village of 3 from the 'Lawn and advisory appointees such as community groups such as - - - Clm Walbridge - thought that it should be expanded to read Dryden, School , Ithaca School etc . f T87 - 10 - 90 page 10 Atty Perkins it could read schools serving the Town of Dryden children . S upv Schug - the To-own of Dryden has a youth program that the town spends about $ 6 , 000 . 00 to $ 10 , 000 . 0Q a year and some of that is reimbursable by the State . There is more matching funds available and the villages do not have the money to take advantage of the additional funds from the State and the County . It the Town and Villages could pool their money together he would like the youth commission to take a look at what we are spending our money on today , what they feel would be an additional place to spend the money and / or drop some of the old programs to do it and do a better job for our children . RESOLUTION # 182 FORMATION OF YOUTH core[igsigN E lnr Roberts offered the following resolution and asked for its adoption : RESOLVED , that there be established a joint Village of Dryden , Village of Freevi11s , and Town of Dryden Youth Commission to consist of two appointees from each Village and three appointees from the Town of Dryden . The Commission may seek advisory appointees from community groups such as : schools # the Dryden Police Department , the Local Clergy , the Sertonie Club , the K iwanis Club , the Masons , and other appropriate community IMPagencies so that the entire township is represented . FURTHER RESOLVED , that said members shall : a ) gather data and evaluate existing programs and needs , specifying particular " problem areas " . b ) determine public opinion regarding program reeds or possible changes . c ) explore and evaluate a variety of sources for funding for program needs . FURTHER RESOLVED , the Youth Commission shall coordinate the planning , provision , and financing of recreation and youth development services throughout the Village of Freeville , Village of Dryden , and the Town of Dryden . Catherine Brown .Y she had understood that the first thing that they were going to do was to work on the berm in back of the residential properties and warts to make sure this is done properly and correctly before they have a drainage problem there . ftty Perkins - thought that the berm was to be constructed in S he future before the other two parcels were developed and would not pertain to Hi '- Spied Check Weigher site . S upv Schug - said that he would check to see when the berm was going to be built . S upv Schug reported that the county highway department is going to check on Hanshaw Rd between Lower Creek Rd and Bt 12 .
