U Slater APPROVAL OF THE MINUTES Motion was made by Clm Roberts and 2nd by Clm Hatfield that the minutes of the town board meeting held May 8th , 1990 be approved as submitted . Carried Motion was made by Clm Roberts and 2nd by Cirn Hatfield that the minutes of the site plan review and town board meeting held April 24th , 1990 be approved as submitted . Carried COUNTY BRIEFING Co . Rep Evans -- reported the county has passed a resolution to ✓ eview additional sites for the landfill . The county has also purchased a parcel of land on Elmira Ro ad for their central processing facility . The trash tag subsidies will be for the e lderly who are qualified for tax exemptions and people who are 4111 • luring in subsidy housing . Also considered is WICK and those individuals getting off the welfare rolls and still living below the 200 % of the poverty level to extend that subsidy for one year . Margaret Joyce9 505 Lower Creek Rd - wanted to know what progress has been made on solving the problem of the drainage on her property . She has had a buyer interested in purchasing that piece of property . Mrs . Joyce has told her she would not sell h er the property until the drainage problem has been solved . S '.tpv Sch ". g - Hi -Speed Checkweigher is willing to help solve the problems of drainage down stream . The town will have to get with o ur engineer along with Dave Abbc' tts engineer and look at the Calrriell plan to see what can be done to solve the drainage problem . Jim Willard - wanted to know if the town was considering a drop o ff center for recycling . Supv Schuq - the County wants the municipalities to pay all the taxes , insurance , build a fence and guard the location . The town h as little or no property that belongs to the taco and the property that is used oust be owned by the municipality . The town is trying to work with the county to try to establish an area in the Town of Dryden away from the population centers that are served by pickup . Under consideration would be Hoosfaw Rd and West Dryden Rd and we are trying to work with Cornell U niversity to see if they would sell the Town of Dryden a piece o f land big enough to do the ,job . The town is also looking at bigger site. with Cornell so that there could he yard waste compost available , Iris Goldfarb , 3 Hall Woods Rd ,- was concerned about the dr' a 'inage problem from the Wilcox press site . It has been discussed for about c years with some of the problems associated w ith that site which included noise , poiiutioo , traffic and drainage . One of her main concerns was the drainage cooing off the property . Last month there was an incident what exactly they predicted was going to happen with the poor drainage off those soils based on the 1 00 year flood projections . The water level w ent to the level of the railroad track and on a crisis e mergency tansies basically drought on by Wilcox Press by not maintaining their drain they had to hare two mechanical drains brought in which blasted wat sr a l l over her property and the land was trespassed on . She is not covered for flood insurance for this sort of damage and she has been assured by the Town that the rate of water runoff from that property and construction site was not going to change and that Wilcox Press w as going to be responsible for maintaining that 'drain . She w ould like to know where she stands , where the Board stand , and the construction site stands in terms of drainage from that property of 23 acres flood conditions onto her I . bb acres and her little creek that cannot handle it . The Town Board members have received a letter from her regarding this problem . TS & -- 1E- - 90 page u • C M Walbridge I- felt sympathy for some of the issues but is not clear as to whether the drainage objection, } correct . It is an exaggeration that the drain will be plugged every time it rains . It was an unusual situation . Iris Goldfarb -- if Wilcox Press will maintain the drain her creek can handle the water , but it cannot handle these emergency f 1 end conditions and cannot handle the railroad bed being jeopardized and all of the houses and property on that road . Also where are we going to be responsible if either the property o r any people are damaged by these flood waters being allowed to build up because Wilcox Press is not maintaining the drain , This is year one of the 100 year flood pro .j ect _ on , This is going t o happen every time we get a heavy rain unless there is some specific proposal made to provide for flood run - if water , from the Wilcox property because her little creek cannot handle it . They have taken the wetlands and 23 acre early stage forest and leveled i t so the water has no place t o g . G upv Schug - was out of town when this happened , but Atty P erkins was there to see what was happening , Atty Perkins - the problem did not have anything to do with the drainage or the capacity of the pipe or anything else to handle t he water . The problem was that the drain was plugged on the W ilcox Press side of the railroad berm . When Wilcox Press was made aware of the situation they had a crew down there with several pieces of rerod to force the drain open to drop the amount of water that had built up on the other side because it h ad been plugged . When the drain came through it filled the ditch on the south side of Hall Rd and was being to cascade over the roadway . The contractor then placed a pump into the open ditch and a discharge hose across the road into the waterway on the other side of the road . That began to alleviate the problem and the contractor then got another larger pump to also discharge into the same water course , This brought the water level in the ditch down and allowed the culvert under Hall Rd to handle the flow . The reason the mechanical pumps were installed w ere to protect and preserve the road itself and so there would n ot be a continual cascading over it . By preventing the cascading of the water over the road we were able to keep the w ater in the established course thereby minimizing any damage to the property on the north side of the road which might otherwise have been flooded by the road being flooded . Iris Goldfarb - there were witness there that said the water that was discharged did not go into the creek and existing drains but flooded her low land , She received an emergency phone call about that and a warning was given to them at least 24 hours prior not counting all of the weather reports of the 2 TU6 - 12 - 9O page 4 weeks of rain , but a full 24 hours before Beth Herron called W ilcox Press to tell them the water level was rising . Yt is her estimation that they allowed this to reach a crisis proportion . ✓ im Walbridge °- area you suggesting something in particular that the board needs to do . Iris Goldfarb - she is suggesting that they are going to have to look into alternative methods of water drainage to get it into the main creek without going through her little creek because it cannot handle it . , S upv Schug - a years ago Wilcox Press talked to the neighbors about the possibility of building a drain down through their property to get it off the Wilcox property . Iris Goldfarb - she sees what they did to their property and she sees what her property loks like and there is no way that they are going to devastate that land and put A drain through and replace the trees that are there . It is forest and it is doing to remain as a forest . Just look at what they have done to their property to make e structure . Is that what they are going to ✓ equire to allow for drainage . if it is they are going to have to find another drainage source . There is just no way that land is going to be converted into a cavity to allow for drainage f rom their property . It has bean brought up at many meetings before . They have discussed divert ing the water down the ditch along Rt 13 down into the main creek and Wilcox Press has d ecided it was to expensive , maybe_ it will not be to expensive . h im Walbridge - the Army Corp of Engineers does not allow them to drain it into that ditch . Clm Corrigan - if the drain had been kept clear there would have been no problems . Atty Perkins T the drain was plugged with old waded up railroad fence wire , e mattress and bales of hay . They had cleaned out the drain just before the flood . There was some discussion about pvc pipe that has bean dumped on the site . hupv Schug will meet with Jim Willard and f . h . Slater t o check and see if there has been any illegal dumping on the site . P ie Walbridge - wanted to how the Town could enforce rather than e ncourage e builder to keep up the drainage that they said they w ould maintain . At t yF Perkins - just e request to start with . They have been ✓ equested to monitor the drain more carefully to make sure this doesn ' t happen again . You can ' t revoke their building permit o nce there is a violation of the code , but you could revoke the TB S- 12- 90 page 5 site plan review approval because there are conditions attached • which you allow you to take action against them . 2C1m Walbridge - suggested that the Board think about this sort o f drastic action . Clm Cor'ritn - would like the Town at least in writing to W ilcox tell them there has been these repeated concerns from the n eighbors and itemize what they are and would they please investigate with their contractor . The Town should be sure of their facts . Clna Walbridge -- wondered while that sort of statement might help • u s legally down the road if we go to court with theme but it is n ot going ti_l help the situation right now . S upv Schug - we can ' t put them on notice what has previously happened9 but we will talk too them about the waste material and ask there what they plan to do to monitor the drain to make sure that it is kept open . • G eorge Schlecht - the entrance to the culvert underneath the ✓ ailroad bed the problem might be solved by improving the e ntrance to allow more water to go through it but is counter productive based on the criteria that has been laid out . The size of the pipe is such that the water is meant to build up behind the railroad bed to retain the flow from going aver . The • site plan approval has an emergency spillway that is supposed to • be built over the culvert in the railroad bed to take care of this problem an that when and if there was e very large event of a 100 year storm or there was plugging in the culvert that the water would go over the stone lined spillway in the railroad bed . This could he asked to be , done early on if they haven ' t been asked already . G eorge Schlecht - there is a culvert under Hall Rd which is the Town ' s responsibility and that culvert has been identified as being undersized , but this is a separate issue from Wilcox P ress _ G eorge Schlecht - like what the lady stated when it wasn ' t plugged it rises lip and goes through and wasn ' t the problem because this is what it is supposed to do . Having mattresses stuffed in the pipe no matter how they got there wehlt cause a problem _ The Town hoard decided to suggest this in the letter to Wilcox P ress that they start with the spillway to help alleviate this problem which is a requirement in the site plan approval anyway . 00 TIDE- 12 - 190 page 6 D an Eastman , Lower Creek. Rd ••' since 1988 when he first wrote a letter t o the Town Board requesting that Durruss Transfer comply • (Il with the zoning variance to keep their trucks off Lower Creek. Rd . He his had continuing correspondence every single year . Each year Burr" usa Transfer change the rules and say that this is not going to happen . The original variance that they had to go with t he additional building was given to them after they started the building and they said that all of their traffic was going to exit on Rt 13 . They are consistently using Lower Creek Rd . and h e has received a letter from them stating that is for the residents to figure out the problem and not theirs . D an Eastman - Burruss has been warned and a letter from Clint Cotterill , back in June 1988 telling them not to use Lower Creek Rd and exit and enter from Rt 13 only , Supv Schug sere; there a letter a year ago telling them not to use Lower Creek Rd . He has current letters to them telling there that they shouldn ' t be doing it . They are not going to change , but they do have a sign up front which supposedly meets the a variance requirement . Supv Schug - since there is a weight limit on that road and there is a regular time the Town could request the Sheriff to patrol that portion of Lower Creek Rd for awhile . D an Eastman -- when Flurruss Transfer applied for the variance at the meeting they stated that they adamantly would not use Lower Creek Rd and this is the road they use all of the time Cim Walbridge °- wanted to if there was something that could be o ne way when someone promises at a site plan meeting to do one thing and then does not comply . Atty Perkins - this problem is more a question of enforcement than anything else . The Town should contact them to find out w hat they are going to dl- to remedy the problem since there have been complaints . There is local enforcement also which they could enforce the weight limit on that portion of Lower Creek Rd . Catherine Brown ,- Clm Evans made that a condition in the ✓ ariance that a sign be posted with no right t urn which you w ould expect to be posted near the road where a stop sign would be posted . They have posted their sign way back from the road and it is tilted so that you cannot read it . S upv. Schug - where they have the sign posted now would not control the road . It should be set on town property and there is a weight limit on that road up above that point . if the road is signed properly with a weight limit and stripe the road then the Town could contact the sheriffs department to patrol the road and they could get a ticket for not following the weight limit . 1 T26 - 12 - 90 page 7 Supv Schuq -- was told that their dispatcher would remind the truck drivers not to make a right turn out of the driveway _ Dan Eastman - was told that the dispatcher would not direct his drivers to make a left turn if there was a safety factor involved . They were also required as part of the variance to plant some pine trees along their property line and he did not t hink that has been done , Z . O . Slater - he has verified that the trees were planted as specified4 but some may have died since being planted . Clm Walbridge - it is up to them to maintain the trees . z . a . Slater - said that he would check on the trees - and if he needs to he will write 'them a letter . D ar, Eastman - wanted to know when Hi - Speed Check. Weigher was going to build their berm ? S upv Schng - did not know what their time schedule was , but was sure they would do it and he it properly . S ups Schug - asked Mr . Eastman when he had planned on finishing his house that the had started . He had applied for his building permit in 1996 . hen Eastman - he has been working on it right along . He has about 3 / 4 of the electric finished . The problem is he does not h ave enough financial resources to get a mortgage at this point . It wasn ' t supposed to take this longs but he had e broken wrist one year and kidney stones the next year . ATTORNEY kitty Perkins - request from William and Millie Reed to delay h ook up to the Monkey Run water district since there is now going to be a Turkey Hill waiter and sewer district . S upv Schug - the Rends were to hook up to the Monkey Run water district by Aug 1990 and they are requesting e delay so that they could hook up to the Turkey Hill district . They are presently hooked up to the Monkey Run sewer district . Millie Reel - she is requesting a 3 year extension to connect to the Monkey Run water district from Aug 19SO in case the Turkey H ill water district does not come about . She would not he any additional building and if the Turkey Hill did go through she would hook up to that district ee coon as mailable . Tie Walbridge - her understanding was that they would hook up to the Monkey Run water and sewer when it was available . TE6 - 1E - 90 page B Atty Perkins - read the contract that was adopted by the Town Board that the Reeds would construct at their^ own cost and expense including water lines including hydrants distribution mains , valves and other necessary appurtenances including those for interconnections t o the district water^ 1 i ryes ( Monkey Run w ater district ) . All such plans and specifications to the same should be prepared by the Reeds ' engineer and approved by the Town . The original improvements to be constructed by the Reeds shall be in accordance for the final plans , specifications and contract drawings approved by the Town . The original improvements prior to be constructed of this agreement shall be constructed and completed no later than August 314 1990 . The Reeds have on evens date herewith executed a sewer agreement and a purchase of water and sewer facilities agreement , The Reeds acknowledged that the inducement for the Town to enter into this sewer agreement and purchase of water and sewer facilities agreement is that the facility is best served by public water and sewer and that the construction of the project facility will n ot only benefit the Reeds but possible future water and sewer d istricts serving areas in the town presently not benefited by w ater and sewer service . The water agreement provides that the Reeds shall construct and complete the original improvements contemplated by that agreement not later than August 31 , 19909 It also states that if the Reeds have not done that the Town may sue them to enforce such connection for them in default . The Town can construct the lines and access the cost back to the Reeds . fil fltty Perkins -- the original inducement for the Town was the fact that there would be this hook up . it could be reasonable to allow an extension of this agreement until such time the Turkey H ill facilities are available and this should be the measure for the Reeds to hook up . Millie Reed -- the reason she is requesting the delay is because she has no need for public water; and sewer for the 4 units right now . Economically , financially , personally there are a lot of ✓ easons they are not planning on building more units at this t ime . ratty Perkins - suggested that if the Town Board agrees for an e xtension of time than wait and let the Turkey Hill water district be the measure of time as to when the connection should be made . If for some reason the Turkey Hill district does not go through them she can come back to the Board at that time and ✓ equest an extension , showing whatever reason she might have to continue to extend the obligation of hook up . He felt that putting a blanket extension now without any showing violates the intent of getting around the original agreement . If it is going to be easier and more available in the construction in the o riginal Turkey Hill water district improvement this would be a reasonable request provided that there are no existing problems . There is nothing to be gained by forcing the Reeds to hook up now if there i5 another way to be done i n the near future . LE blanket extension does not make any sense . , • TB9 - 12 - 9cD page 9 Clm Corrigan - rather than the blanket long extension she wanted to know how Mrs Reed felt about Atty Perkins suggestion . Millie Reed - thought that it would be fine , but she did not want to upset the Board at all and not get any extension at all , but she did not understand what it would mean to the Board to give her the year extension . Ciro Corrigan - felt that this extension would set a precedent fltty Perkins - last year the Board agreed to the postpone f requirement to hook up to the water . They allowed theta to hook u p to just the sewer and gave them another year to hook up to the water because of construction thee . There was an inducement to the Board to approve the project and the special permit for the project based on the fact that they would be served by public water and sewer . To allow them to hook up to just one was an inducement for booth of them . The Board could make the e xtension to the decision by the State Comptroller whether an n ot the district is allowed t o be formed . If the State Comptroller has a positive response and actually go to construction they would be required to honk up at the time of improvements . I f the state Comptroller turns down the formation o f the Turkey Will district you could say 9 months from the data n otice is received and rejection of such application . hie Corrigan - what happens if this district is formed and the Town receives another request from someone else that they need an extension of time to connect for personal hardship , business reasons , what 'then ? Millie Reed - she is only requesting a 9 year extension to hook u p to the present Monkey Run water district if the Turkey Hill w ater district i s not formed . • 0 •A RESOLUTION NO . 150 ( 1990 ) Councilman _ :amuridge _ . offered the following ✓ esolution and asked for its adoption : WHEREAS , the Town of Dryden has several water districts and sewer districts situate within the Town , and WHEREAS , there are potential customers situate outside such districts who could utilize the benefits of municipal w ater or municipal sewer but for the fact that they are situate outside such districts , and WHEREAS , it is often in the bests interests of .residents of the Town of Dryden ( including those situate w ithin water districts and sewer districts ) to permit out of district customers to connect to district services provided that the capacity of the same is not in jeopardy by such connection , and WHEREAS , such connections may tend to benefit district u sers because of additional payments by the out of district customers toward the debt service which is payable in the first instance by in district customers , and WHEREAS , the Town has heretofore permitted out of district connections by Wilcox Press , Inc . , Guthrie Clinic , T,td . and William Reed and Mildred Reed , and WHEREAS , all of the agreements permitting sent connections by out of district customers have made it clear that there is no precedent intended by any such agreement , and WHEREAS , it is in the bast interests of all residents o f the Town and district customers to net forth a policy of the Town Board in determining whether or not to permit connections to district services by out of district customers , NOW , THEREFORE , BE IT RR SOLVED BY THE TOWN BOARD AS FOLLOWS CONNECTION POLICY FOR OUT OF dfdddYCT WATER CUSTOMERS AND SEWER CUSTOMERS 1 , Connections may be made only after approval by the Town Board , 2 . If the State Comptroller approves the formation of the Turkey Hill Water District4 then the Reeds shall connect to the Turkey Hill Water District as soon as service is available . Atty Perkins -- at the request of the Town Doard he prepared a connection pol icy for out of district water and sewer customers . He wanted to point out to the Board members question 1I insofar as possible such connections shall be permitted only if the connection party agrees to connect to both water and sewer services . State E nvironmental Review Act and that they were not required to test all of the sites including the sites that they could not gain access to without using their powers under the eminent domain law . The assumption that he had one loot approximately 18 acres o n the south side of the road . He did have road frontage on the side that he has completed and received a certificate of o ccupancy . The next step is that he has been offering this property for sale with less than all 18 acres which would be in ✓ iolation of his building permit , like 1 . 8 . At the request of several beard members he contacted the relator and confirmed the fact that was what was offered . He wrote a letter to Mark S tevens reminding him of his obligation and the Town of Dryden subdivision ordinance and that he could not sell less than the 18 acres . Mark responded to him that he believed that he has more than 20 acres and that he was therefore going to sell the h ouse and 11 . 80 acres which would not be a subdivision and would n ot need any approval . He would then have 12 . 81 acres left and that also does not require subdivision approval . Conveyance of any _ether parcels would throw hire into subdivision requirements . H e has confirmed the numbers with Marks surveyor and he does h ave over 20 acres of property , which he has 24 . 61 acres remaining . Based on that he can build another house on the remaining acreage . He cannot sell off less than 10 acres and if he does he is in violation of the subdivision ordinance . S upv Schug - asked Z . O . Slater if Mark agreed that when he received the building permit he would build the house and sell 18 acres as one unit ? Z . O . Slater - he was well aware of the fact that he could not split up anything less then a 10 acre parcel . He made no agreement to make any sales of any kind and that he was going to build the house to live in himself . S upv Schug - wanted to know if he had road frontage to build the other house . Atty Perkins - he has the sufficient road frontage . How Mark arrived at the 18 acres is that in April 1989 he requested that his engineer combine lots 1 through 6 on the subdivision plat . It is possible for him if he wants to go to the expense of what h e has done there is to have just 2 lots . One of 11 . 80 acres w hich has the house on that he has built and what he says now he is offering for sale and the other parcel of 12 . 81 for which he could get a building permit and build another house . Clm Walbridge - felt that it was something that the Town should not legislate . If people want to fly the flag that is perfectly fine , but this has been a controversy certainly in Ithaca that h as been blown way out of proportion in ways . She knows a number of veterans from Vietnam that find this whole discussion fairly d istasteful and wouldn ' t be in favor of necessarily flying the flag . She thought that there were a lot of different viewpoints . Clm Robert s - wanted to know if this request had come from the citizens . He had no problem with the flying of the flag and thought that it was a good idea . Insurance - should we increase our insurance liability on the town highway equipments Pt the present time we have $ 205000 . 00 coverage which is the minimum and only on 7 vehicles . Clm Roberts and Clm Hatfield will have the information by next beard meeting . Recycling / reusing packing materials - Pass it on from Wayne S tokes -- he would like to have the feeling from the Town Board as to whether or not he should apply for a special permit . He presently picks up all of the fciarn and fibre for reuse and thought this would be a good idea to bring people and reusable material together so that it does not end up at the landfill . The Town Fit_lard felt that it would be a good idea and to apply for a special permit , ✓ illage / Town of Larising4 and fawn of Dryden joint sewer agreement - our share would he % 750 . 00 and have our engineer look at it to see if we should go further with the transmission line and own a bigger portion of it . We will tell them that we w ill share in the cost of negotiations and if it makes sense the Town might be able to get more transmission lines .
